Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Monday April 4, 2022

Mayor Van Dusen called the meeting to order.

Public Comment.
Ann Urbach on Harvard Terrace spoke about neighbors feeding squirrels, birds and other
animals that has presented problems. The Mayor stated that the Village will look into the
Ordinance about feedings in relation to animals etc.
Hugh Iglarsh commented about Touhy Avenue traffic by the Dunkin Donuts expansion at
5150 Touhy. He also suggested the possibility of a bridge/sidewalk allowing people to
safely cross the Edens cloverleaf on Touhy.
This Public Comment was sent by email to the Village Board. This and all Public
Comments can be viewed at the Clerk’s Office
Trustee Johnson made a request under New Business that at the next Board meeting to
discuss and clarify the process on which Trustees can get positive issues on the Agenda
for voice consideration.

A. Presentation
Presentation of the Workforce Training Initiative by Ann Tennes, Director of Marketing and
Communications.
The Village initiated a new partnership with Oakton Community College to provide Skokie
residents who are either unemployed or under-employed due to the impact of the COVID-19
pandemic with full scholarship support to enroll in short-term certificate training programs at
Oakton Community College. The program goal is to help residents secure employment to
provide for themselves and their families and reduce reliance on social services.

Skokie.

WHEREAS, April marks the 54th anniversary of the United States Federal Fair Housing
Act ~ a law whose spirit embraces equal housing, not only as a national policy', but a fundamental
human concept for everyone to embrace; and
WHEREAS^ the Village of Skokie was the first in the State to pass a Fair Housing
Ordinance that prohibits unlawful housing practices and discrimination to assure full and equal
opportunity to obtain fair and adequate housing for all residents and their families within the
Village and to secure to all persons an equal opportunity to view, purchase, leasef rent, or occupy
real estate in the Village without discrimination because of their race^ color, religion) sex, creed,
ancestry, disability^ age^ marital status, presence or age of children^ national origin, sexual
orientation, or source of income; and
WHEREAS, acts of housing discrimination and barriers to equal housing opportunity are
repugnant to a common sense of decency and fairness; and
WHEREAS, the Fair Housing Act affirms the right of every person to equal housing
opportunities prohibiting discrimination based on race^ color^ religion, age, sex (Including sexual
harassment and pregnancy)^ familial status, marital status, national origin/ancestry, disability,
sexual orientation, gender identity^ military status^ unfavorable military discharge^ and order of
protection status; and
WHEREAS^ economic stability, community health, and human relations in all
communities are improved by diversity and integration; and
WHEREAS, the talents of grassroots and nonprofit organizations ^ housing service
providers ^financial institutions, elected officials ', national, state^ and local agencies, and others must
be combined to promote and preserve fair housing and equal opportunity.
NOW, THEREFORE, J, GEORGE VAN DUSEN, Mayor of the Village ofSkokie,
do hereby proclaim the month of April 2022, as
"FAIR HOUSING IS NOT AN OPTION. IFS THE LA W MONTH"
in the Village ofSkokie and to affirm Skokie as an open and inclusive community committed to fair
housing and to promote appropriate activities by private and public entities intended to provide or

The Village of Skokie Beautification and Improvement Commission
The Commission assists the Mayor and Trustees in an advisory capacity
on matters of community beautification and improvement.
ACTIVITIES INCLUDE:
• Designing, supporting and funding landscaping for Village parkways
and public properties.
• Sponsoring the Annual Arbor Day observation, the Property Owner's
Beautification Awards Ceremony and Cfean-Up Week activities.
• Coordinating activities with the Skokie Garden Club and the Park District.
• Participating in the 4th of July Parade and Festival of Cultures.
• Selecting and displaying decorative banners along Village boulevards.
• Coordinating with the Skokie Department of Public Works and the
Village Forester monitoring & maintaining the health of the Village's trees.
The Commissioners are appointed by the Mayor and approved by the
Village Board of Trustees. Commissioners are unpaid volunteers who are

Skokie residents. Projects supported by the Commission have, in part,
been responsible for Skokie's designation as a Tree City by the National
Arbor Day Foundation for over 35 years.

* A. 2022 Non-Arterial Street Resurfacina Proaram - Schroeder and Schroeder
Inc., Skokie, Illinois - $5,500,436.08.
This project provides for the resurfacing of approximately 6.51 miles of residential
streets, which will include 29 streets within the Village. Motor Fuel Tax, Local Fuel
Tax, General Revenue and Rebuild Illinois Funds will be used to fund the cost of
the project. It is recommended that a contract be awarded to Schroeder and
Schroeder, Inc., the lowest responsive and responsible bidder, in the amount of
$5,500,436.08. This firm is pre-qualified by the Illinois Department of
Transportation and has worked with the Village on numerous resurfacing projects
with satisfactory results. I concur with staff's recommendation and respectfully
request Mayor and Board approval.
* B. Riding Lawn Mower - Halloran Power Equipment, Inc., Palatine, IL -
$27,392.82.
The FY22 CIP includes funding for the replacement of one riding lawn mower
which was initially purchased in 2016. During summer months, this mower is used
to maintain large Village owned turf locations. This zero-emissions electric mower
would help the Public Works Department achieve its goal of reducing its carbon
footprint with an estimated fuel savings of 250 gallons per year. The Village will

to help offset the cost. It is recommended that contract be awarded to Halloran
Power Equipment, Inc. in the amount of $27,392.82. The Village has been satisfied
with previous equipment purchases from Halloran Power Equipment. I concur with
staff's recommendation and respectfully request Mayor and Board approval.
* C. Request to Sell Surplus Vehicles and Equipment.
The Public Works Director has requested authorization to sell at auction certain
surplus vehicles. These vehicles will be auctioned through the Northwest Municipal
Conference (NWMC) Auction, which has proven to be successful in the past. The
Village currently has four police vehicles and two public works vehicles that are
being replaced or removed from the fleet. I concur with these recommendations and
respectfully request Mayor and Board approval for these vehicles to be sold at the
NWMC auction.

RECOMMENDATION
It is recommended that a contract in the amount of $5,500,436.08 be awarded to Schroeder and Schroeder
Inc. of Skokie, IL, the lowest responsive and responsible bidder. The attached MFT resolution also requires
approval by the board. The purpose of this contract is to provide for the bituminous re-surfacing of 29 streets
throughout the Village (total length of approximately 6.51 miles), and includes pavement milling and patching,
replacement of deteriorated sidewalk and curbs, drainage structure adjustments, sod replacement, paving alleys
and related work.
This project is funded by the Motor Fuel Tax, Local Fuel Tax, General Revenue and Rebuild Illinois funds.
This project was designed by Village staff. The Engineering Division will provide the construction phase
supervision and will closely monitor the project and take advantage of opportunities to minimize project costs.

Recommendation: It is recommended that a contract for the purchase of one (1) new Gravely
Pro-Turn EV60 Mower be awarded to Halloran Power Equipment Inc. in the total net amount of
$27,392.82.
Comments: The Capital Improvement Program budget provides funding for the replacement of
a mower which was purchased in 2016. During the summer months this mower is used to
maintain large Village owned turf locations. This zero-emission electric mower would help the
Public Works Department achieve its goal of reducing its carbon footprint. The purchase amount
is more than originally budgeted because of the department's decision to move towards more
environmentally friendly equipment. The increased cost of this piece of equipment will be
covered with funding balances from other Capital Improvement Program replacements. The
Village will also apply for a grant from ComEd and the Metropolitan Mayors Caucus. This grant
is a $10,000 match and is provided as a reimbursement after the purchase. The estimated fuel
savings will be 250 gallons per year. Due to the lack of fuel cost and reduced maintenance
required, return on investment calculators estimate the time to break even on the increased cost
to be 36 months.
The Village has purchased equipment from Halloran Power Equipment Inc. in the past and is
satisfied with their equipment.

Item A is on the consent agenda for second reading and adoption. The first reading was
on February 22, 2022.
This ordinance will approve an amendment to a previously approved site plan for a timited-
service restaurant with a drive-through in a B2 Commercial district. In 2019, approval for a
four-tot planned development at 3720 Touhy Avenue was granted pursuant to Village
Ordinance Number 19-5-Z-4459 which also granted relief from certain sections of Chapters
82 and 118 of the Skokie Village Code. Lots 1, 2 and 3 were utilized and Lot 4 was
undeveloped. Approval has been sought for construction of a Chick-Fil-A restaurant with a
dual lane drive-through on Lot 4. It is anticipated that the proposed 4,447 square-foot
restaurant will be open from 6:30 am to 10:00 pm, Monday through Saturday. There is not
a sufficient number of required parking spaces on Lot 4. However, Lot 2 can accommodate
shared parking among the other lots pursuant to a previously executed easement agreement
and will satisfy the parking required for Chick-fil-A. In the interest of legislative efficiency, the
previous site plan and Village Ordinance Number 19-5-Z-4459 will be repealed and a new
site plan will be granted incorporating the previous relief from certain sections of Chapters
82 and 118 of the Skokie Village Code and all of the relevant conditions will continue.
*B. Ordinance, 2022-02P, Soecial Use Permit, Establishment of a Limited-Service
Restaurant with Driye-Thrpuah, 3720 Touhv Avenue
Item B is on the consent agenda for second reading and adoption. The first reading was on
February 22, 2022.
This ordinance will grant the special use permit to establish and operate a limited-service
restaurant with a drive-through at 3720 Touhy Avenue in a B2 Commercial district. As
previously stated, the Chick-Fil-A restaurant will have hours from 6:30 am to 10:00 pm,
Monday through Saturday with a two-lane drive-through and ail parking requirements met
as outlined in Item A.

7 Trustees, it was determined by the Village staff that for legislative efficiency, a new site plan be
8 granted incorporating the previously granted relief from the Skokie Village Code and relevant
9 conditions and that any ordinances that may have been repealed by the foregoing ordinance,
10 shall remain repealed and are null and void; and
11 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
12 Village of Skokie, Cook County, Illinois:
13 Section 1: That the site plan amendment requested by the petitioner to construct
14 and establish a limited-service restaurant with a drive-through at the property legally described
15 above and commonly known as 3720 Touhy Avenue, Skokie, Illinois in a B2 Commercial
16 district, is hereby granted and approved subject to each of the conditions set forth below:
17 1. The petitioner shall develop the Subject Property in substantial conformance with
18 the final Village approved site plans dated May 7, 2019, landscape plans dated
19 May 15, 2019, ground sign dated March 8, 2019, sign criteria dated July 3, 2018,
20 and building elevations dated July 3, 2019 (Building A), February 11, 2019
21 (Building B), and March 8, 2019 (Building C) and as they may be amended by the
22 following site plans dated March 25, 2021, landscape plans dated March 25,
23 2021, ground sign dated March 25, 2021, sign criteria dated March 25, 2021, and
24 building elevations dated March 25, 2021.
25 2. The petitioner acknowledges that shortages in parking caused by choices in the
26 mix of tenants on the site are a self-imposed hardship and shall not constitute
27 justification for future parking relief or variation;
28 3. Prior to the issuance of building permits, the petitioner shall submit for approval a
29 lighting photometrics plan, fully developed civil engineering plans that comply with
30 the county WMO requirements and Village’s stormwater control provisions, and
31 redevelopment engineering plans to address all aspects of private and public
32 utility services. Any reconfigurations within state ROW will require an IDOT
33 highway/utility permit;
34 4. New parking lot and exterior lighting shall meet Illuminating Engineering Society of
35 North America (IES) standards, be full cut-off design, and be directed away from
36 adjacent properties, subject to the approval of the Engineering Division;
37 5. All existing damaged public sidewalks or public sidewalks damaged due to the
38 implementation of this plan shall be replaced;
39 6. No objects are allowed within a 10' sight distance triangle in R1, R2, R3, and R4
40 districts, or within a 15' sight distance triangle in all other districts, between 30"
41 and 84" in height from grade except traffic control devices listed in the Manual on
42 Uniform Traffic Control Devices;

1 7. Prior to the issuance of building permits, the petitioner shall submit a temporary
2 pedestrian, bicycle, and transit circulation plan, including routing, signage, and
3 barriers, to be in place prior to the commencement of construction, subject to the
4 approval of the Engineering Division;
5 8. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas,
6 signage, landscaping, structures, and any other facilities or infrastructure on the
7 Subject Property shall be maintained in a good state of repair, and when needed,
8 be repaired or replaced in a timely manner;
9 9. All private and public sidewalks shall be maintained free of snow, ice, sleet, or
10 other objects that may impede travel;
11 10. Trash shall only be allowed within a designated trash enclosure and shall be
12 screened from public view in an enclosure approved by the Appearance
13 Commission. All trash shall be contained in such a way as to remain out of sight
14 at all times, except for waste receptacles referenced in Condition Number 11
15 below;
16 11. Waste receptacles shall be placed on the Subject Property for the use of
17 customers, and that the Health Department shall determine the size, type, and
18 location of these units. In addition to where trash receptacles have already been
19 agreed to be placed, specific to the site plan, petitioner shall also put trash
20 receptacles on Lot 2. These the amount and placement of these additional trash
21 receptacles shall be determined by the Health Department;
22 12. All off-street parking spaces shall be legibly striped and maintained;
23 13. Any plan to modify parking lot striping must be approved by the Director of
24 Engineering;
25 14. The handicapped parking spaces shall be installed and maintained in compliance
26 with State of Illinois Accessibility Standards and the Skokie Village Code, including
27 required signage;
28 15. Vehicles shall not be allowed to be parked in or otherwise block common
29 driveways, sidewalks, aisles, or other points of access at any time, shall only be
30 parked in designated parking spaces, and shall not overlap the striped lines of
31 designated parking spaces;
32 16. The owner of the Subject Property and its tenants shall ensure that employees
33 park on the Subject Property;
34 17. No required parking space on the site may be for the exclusive use of any tenant;
35 18. Prior to issuance of building permits, the petitioner shall submit evidence of
36 issuance of permits for the construction and operation of the water main and
37 associated equipment by the Illinois Environmental Protection Agency (IEPA) or
38 provide a determination by IEPA that such permits are not required. Water mains
39 that feed multiple building structures and/or create a "looped" system that require
40 an IEPA permit will also require an easement and custodial agreement with the
41 Village;
42 19. All overhead utilities on the Subject Property or in adjacent right-of-way shall be
43 placed or relocated underground. The petitioner shall bear the full cost of any

1 utility relocation and/or conflicts;
2 20. The petitioner has previously signed an "Agreement for Installation and
3 Maintenance of Landscaping" to assure that the Subject Property and parkway
4 landscaping is completed and maintained, including trimming, watering, and
5 replacing of dead plant materials in a timely manner in accordance with the final
6 approved landscape plan;
7 21. All new construction, alterations, and remodeling shall meet current International
8 Building and NFPA Life Safety Codes as amended;
9 22. The petitioner shall obtain all required permits and approvals for improvements to
10 County, State, or Federal rights-of-way from the governing jurisdiction;
11 23. The Subject Property must conform to the Village's storm water control
12 requirements as contained in the Skokie Village Code, including the disconnection
13 of any downspouts;
14 24. All signage shall conform to the Skokie Village Code, except as provided in this
15 ordinance. Any sign on the Subject Property that is in violation of that Code must
16 be removed or modified to conform with the Village Code prior to the issuance of
17 an occupancy permit;
18 25. All modifications to building elevations, signage, and landscaping shall be subject
19 to the review and approval of the Skokie Appearance Commission;
20 26. The petitioner shall submit to the Planning Division electronic files of the site plan
21 and landscape plan in their approved and finalized form;
22 27. Prior to the issuance of building permits, the petitioner shall submit to the Planning
23 Division of the Community Development Department the name, property address,
24 email address, and telephone number of the company and contact person
25 responsible for site maintenance in compliance with this site plan approval;
26 28. If work is to be performed on public property or if public property is utilized or
27 impacted during construction and/or development, the owner shall provide, or
28 shall cause the developer and/or contractor to provide, the Village of Skokie with a
29 certificate of insurance naming the Village of Skokie as additionally insured for
30 any and all claims related to any and all work. The owner shall hold, and shall
31 cause the developer and/or contractor to hold, the Village of Skokie harmless and
32 indemnify the Village for any and all claims for property damage or personal injury
33 related to work on or use of public property;
34 29. The petitioner shall comply with all Federal and State statutes, laws, rules and
35 regulations and all Village codes, ordinances, rules, and regulations; and
36 30. Failure to abide by any and all terms of this Ordinance shall be cause for the
37 Village to initiate hearings to determine whether the subject Ordinance, as well as
38 any applicable business licenses, should be revised or revoked. The petitioner
39 shall pay all costs related to any hearings conducted as a result of non-
40 compliance with any of the provisions of the enabling ordinance. The costs shall
41 include but not be limited to court reporter fees, attorney fees, and staff time
42 required researching and conducting said hearing.

PLAN COMMISSION ANALYSIS
During its March 17, 2022 meeting/ the Plan Commission heard requests for a zoning
map amendment/ alley vacation, site plan approval, and two special use permits for a
3,973 square foot limited service restaurant with a drive-through and outdoor seating at
the existing Dunkin'-Baskin store at 5150 Touhy with the addition of three residential
properties on Jarlath.
The applicant proposes to combine the properties and rebuild the store with the
addition of a double drive-through, outdoor dining, and other site features.
The applicant requested a reduction of parking spaces from 34 space to 29 spaces
based upon a consultant traffic engineer's report and staff's review. Relief was also
requested for additional signs as presented on the elevations.
Upon review/ the Plan Commission recommended changes to the landscape plan that
will provide better screening for the residents on Jarlath. The Commission also
recommended conditions that Laramie Avenue be included in required litter pick-up and
trash pick-up at least 3 times a week. The applicant provided a revised landscape plan
that includes the installation of 15 arborvitae trees between the parking lot and the
fence. The revised landscape plan replaces the previous version of the plan.
INTERESTED PARTIES
Legal notice was advertised/ posted/ and delivered to property owners in the area as
prescribed by the Zoning chapter of the Village Code.
Five neighboring residential property owners spoke at the hearing. Their concerns
included hours for outdoor dining, change to the residential street and the view from
their homes/ the potential increase in trash and vermin/ noise from the drive-through,
and traffic.
APPEARANCE COMMISSION
The proposed building elevations and landscape plan were reviewed and approved at
the March 9/ 2022, Appearance Commission meeting with additional signs as presented.
PLAN COMMISSION RECOMMENDATIONS AND VOTING
The Plan Commission recommended, by votes of 5 ayes and 0 nays, that the
petitioner's request for the zoning map amendment/ alley vacation/ site plan/ and

The Panjwani family has been involved with Dunkin' Donuts since 1986; becoming owners of
this location in 1991. They now own all the Dunkin' restaurants in Skokie.
Ideas were discussed with Village staff back in 2015 on ways to improve this small/ challenging
site. They purchased the 3 residences directly behind them on Jariath, which are slated for
demolition, and are now proposing a new Dunkin'- Baskin-Robbins with a drive-through to
replace the existing congested restaurant.
There has been a change in consumer trends and an increase in competition with the offering
of coffee beverages to patrons via drive-through windows. In 2020 & 2021, this was amplified
by the pandemlc when restaurants relied heavily on their drive-through facilities. They
estimated a loss of 70% of sales during that time because of the lack of the drive-through
component. They are motivated to move forward with this project.
Mr. Kolber stated that Jarlath dead-ends at Laramie and there are no plans to change it. The
residential front lawns and sidewalk will remain as weil. Trees will be planted along the Laramie
frontage. A board-on-board fence will be installed at the property line for screening. The
planned location of the menu board and speaker will be closer to Touhy and farther away from
the residents. There will be a restricted entry into the site from Touhy and full access on
Laramie; exit is oniy from Laramie. The main entrance will be located on the north side of the
site with a covered canopied area for the outdoor patio. The south side (facing Touhy) shows a
display window instead of the typical back side of the building. The drive-through lane will wrap
around the building at the Touhy frontage.
A small portion of the commercial alley behind the restaurant is proposed to be vacated
allowing alley admittance to remain from LeClaire (on the east) so that access to garages
behind homes on Jarlath is intact. There is no entry into the alley from Laramie. Trash
containment will be upgraded from a fenced enclosure to a hardened masonry structure on the
east side and removal wilt increase to 4-6 times per week.
The parking requirement for this restaurant is 34 spaces based on square footage of floor
space. Relief for a reduction in the number of spaces has been requested as 23 on-sifce parking
spaces are provided with 6 additional spaces on Laramie. The rationale is that more customers
will use the double drive-through lanes than wil! park and go inside the building. It was also
noted that more of the floor space will be devoted to "back of the house operations" with fresh
baking done on-site. There will only be 18 seats in the inside dining area.
A commissioner asked about the staffing numbers. Ms. Panjwani stated that staffing will
increase during the peak AM hours of 7-9 to 8 people rather than the 5 currently. In the
evenings, after 8 PM/ 3 people can easily handle requests.
Another commissioner asked about the drive-through windows. Ms. Panjwani answered that
they will utilize 3 separate windows; one for paying during peak hours/ one for pick-up and the
last one for large orders and deliveries.
A commissioner asked about truck deliveries. Ms. Panjwani stated that deliveries are made 1-2
times per week during the off-peak hours of 2-5 PM and before the evening Baskin rush
bringing the dry goods into the back of the building so not to have any effect on the drive-
through.

The chairman wanted confirmation that a board-on-board fence will be installed on the east
side of the site as wel! and that restaurant staff park on-site. He also commented that Laramie
needs to be included in policing the site every 4 hours for trash control with the restaurant
being near the park and so close to residents. Ms. Panjwani confirmed that they have a "travel
pass for trash" every 30 minutes.
Staff requested that the reports be entered into the record as written. He also stated that the
applicant will be compensating the Village for the vacated alley. Two items of relief have been
requested; a reduction of required parking spaces on site and increase of signage per the
elevations but with the restrictions added by the Appearance Commission.
The chairman wanted to have Laramie included as part of the trash policing and an increased
trash pick-up schedule to be added as additiona! conditions.
Mary Jo & Don Rosso/ 5156 Jarlath/ spoke of their concerns with fencing not being adequate
with their line of sight. They suggested a higher fence or preferably more foliage and taller
landscaping, so they don't have a view of the parking lot from their front window. They bought
the house 7 years ago and are certain their property value will decrease if the B2 zoning is
expanded to the property across the street from them.
Juan Paz/ 5145 Jarlath, purchased his house 25 years ago liking the quiet neighborhood and the
dead-end street. The feel of the street will not be the same. He is concerned about the increase
in garbage and the rat problem getting worse. He will have limited use of his property with the
lack of privacy and noise from the menu board speakers, lighting at night/ pollution from the
cars at the drive-through and in the parking lot. He also stated that a fence with a maximum
height of 6 feet is not enough.
Vinh Nguyen, 5120 Jarlath/ owner since 2017, said that the expansion onto Jarlath wil! take
away the neighborhood feel. He doesn'fc understand how they can acquire 3 beautiful homes to
destroy them for the expansion of a restaurant when there are so many people homeless and in
poverty. Dunkin's targeted age group is 18-25 who can be rowdy and want to hang-out until
late into the night. He is in the restaurant business and knows that litter will be unavoidable no
matter what and employees don't care as much as owners do. Dunkin' has been at this location
for 30 years and they are stil! trying to control their staff. He doesn't like a fence at all no
matter what height - it is not neighborhood friendly.
Andy Lewczuk, 5124 Jarlath, stated that he'd rather look at 3 houses than a fence. They should
grow their business at a different location.
Another written comment came from a resident across Touhy opposing the request as it will
add to air pollution due to vehide emissions. Commercial vehicles making deliveries will use
Laramie which will cause traffic congestion.
Ms. Panjwani/ in her rebuttal, stated that the owners are ver/ involved with the daily operations
and are at the store ever/ day. It is important to them that the community enjoys their
establishment.
Addressing the concerns of the neighbors, Ms. Panjwani responded by saying that at the
location on Golf/ a fence separates the drive-through restaurant from a single-family home and

records show that the home value increased. She urged residents to check with their real estate
broker.
She is willing to install an 8-ft fence for screening. Staff interjected that a higher fence is not
following the requirements of the Village Code.
They have submitted a photometric plan which has been reviewed by staff showing that ali
lighting will stay on site. The hours of operation for the outdoor patio will be scheduled to follow
village guidelines^ currently to 11PM/ but can be restricted further.
There is an established contract for pest control at the restaurant/ but it was found that there
were pest burrows coming to the restaurant from one of the residential properties on Jarlath
because of vegetation overgrowth.
Dunkin" has nothing to do with the existing alley closure behind them from Laramie. It has been
barricaded for a long time, before their involvement.

STAFF REVIEW
Staff reviewed the request and found that the current depth of the commercial
properties along this segment ofTouhy Avenue are 106 feet while other commercial
developments are much deeper. This Is the only segment of Touhy in the Village with
this condition. For comparison/ the adjacent commercial site, which includes the multi"
tenant center and the Holiday Inn/ is over 440 feet deep. Due to this restriction/ the
petitioner has found it difficult to update the site by adding a drive-th rough. As a
result/ the petitioner purchased the 3 subject residential properties and is now
requesting a rezoning and an alley vacation In order to assemble the properties and
buifd a new store.
Staff supports the request provided the rear of the property is adequately screened, no
commercial operations are present on Jarlath Avenue/ and there is no further
commercial encroachment north into the residential neighborhood. Please note that if
approved/ there Is a likelihood the adjacent commercial properties east to the
expressway would purchase residential lots and request rezoning in the future.
STAFF RECOMMENDATIONS
Staff recommends that the petitioners' request to amend the zoning map be
GRANTED, subject to the attached Proposed Positive Findings of Fact.

RECOMMENDED VACATION CONDITIONS
1. Prior to the hearing of this case before the Board of Trustees, the petitioner shall
submit to the Village a Mylar copy Plat of Vacation for the alley.
2. The property shall be vacated pursuant to the Plat of Vacation <insert date of final
approved plat>/ and as may be further revised with the approval of the Village
Manager/ or designee/ and Corporation Counsel.
3. Prior to the passage of the ordinance by the Board of Trustees/ the applicant will
remit to the Village the value of the vacation.
4. Upon the passage of the ordinance by the Board of Trustees/ the Mylar of the Plat of
Vacation shall be submitted to the Village with ati signatures other than Village staff
or elected officials.

PROPOSAL SUMMARY
The petitioner is requesting site plan approval for a 3/973 square foot limited-service restaurant
with a drive-through and outdoor dining at 5150 Touhy Avenue in the B2 Commercial zoning
district/ 3 properties on Jarlath Avenue in the R2 ResidenSia! zoning district (with rezoning
pending), and a portion of the public alley.

STAFF REVIEW
All pertinent departments and divisions were offered an opportunity to comment on this case.
The following is a summary of principal aspects of the proposed development:
Comprehensive Plan
The Comprehensive Plan identifies this area as Retait/Sen/ice Employment and Single Family
Residential. Although the proposed use is not consistent with the single-family land use
designation in the Comprehensive Plan/ it is consistent with changes to commercial
developments along Touhy Avenue.
Land Use
The proposed land use is a limited service restaurant, which is a permitted use in the B2
Commercial zoning district. A rezoning and the special use permits for the drive-through and
outdoor dining are required to achieve the proposed improvements on the site plan.
Zoning Requirements
The proposed building and improvements adhere to minimum B2 Commercial zoning district
requirements. Bu!k requirements include the following:
The proposed building height is 25 ft. 3 in. The maximum building height for buildings
in the B2 district is 30 ft.
The minimum side yard setback is 6 ft/ which are met. There are no other setback
requirements applicable to this request.
Building & Site Elements
The proposed building is a single-story 3/973 square foot building with 29 parking spaces. The
building will be built on the site of the existing Dunkin'/Baskin store/ the 3 residential properties
on Jarlath/ and a portion of the public alley. Restricted entrance-only access on Touhy through
an existing curb cufc and fuli access is provided on Laramie.
BuilcSma Design
The Appearance Commission approved the building design at its March 9? meeting with relief
provided for signage but with the condition that the tota! number of signs is reduced.
Parking, Access, & Circulation
The parking required for the restaurant is 10 spaces for every 1/000 st of floor area. The total
number of spaces required is 34 spaces. The applicant is providing 23 spaces on-site and is

expanding Laramie to add another 6 spaces for a total of 29 spaces. The applicant is
requesting relief from the parking requirements. Please find the attached traffic study from
Kimley-Hom/ which discusses parking demand. The traffic engineer suggests more customers
will go through the double drive-through lanes than will park and enter the building, which has
increased since the COVID pandemic, It's also noted that 75% of the floor space is dedicated
to back of the house operations and only 18 seats are provided in the dining room,
In its review/ staff also considered parking requirements for restaurants from other
municipalities that require spaces based on the number of seats and the number of employees
on the busiest shift. If 1 space is provided for every 2 seats and 1 space is provided for each of
the 8 employees at the busiest shift/ 17 spaces would be required,
It's also worth noting the circulation on the site, which was discussed at length with the
petitioner. The Touhy curb cut will be restricted to an entrance-only. Customer traffic within
the site can enter either Laramie and Touhy go to the double-lane drive-through, go around the
building/ and exit onto Laramie. Customers not using the drive-through can enter from Touhy
and park alongside the building or enter from Laramie and park in the back.
Complete Streets
The following table provides information regarding walkability and transit opportunities:
• A public sidewalk is available along Touhy Avenue. ADA ramps with contrasting color tactile
warning indicators are located at the nearest intersections to the subject site. Similar to
new development on the north side ofTouhy near McCormick, the sidewalk will be widened
to 8 feet to be used as a multiuse path to be shared by pedestrians and bicyclists.
• Niles Center is designated as a bike route. The applicant is provided bicycle parking on-site.
• The subject site is served by Pace Bus Routes 290 and 226, which in front of the subject
site.
• Subject site is within walking distance of services/ shopping/ and residential neighborhoods.
• Emergency and business delivery access is available through Touhy and Laramie Avenues.
Stormwater Management
The applicant will be required to store surface runoff onsite as part of the Village's and the
Metropolitan Water Reclamation District (MWRD) requirements for the site permit.
Water Conservation
The building is required to adhere to the Illinois Plumbing code. This includes the incorporation
of lower flow fixtures - faucets and toilets. This item will be reviewed at the time of permit.
Electrical Conservation
The building is required to adhere to the Energy Consen/ation Code. This includes meeting
minimum standards for R-values for windows and insulation. The code requires a minimum
requirement for materials and wall thickness (in relation to insulation) that meets energy
efficiency standards. In addition/ the HVAC systems are required to meet minimum efficiency

standards, and systems are required to be affixed with UL tags. The applicant will be required
to submit a "corn check" at the time of permit application to show adherence to the energy
conservation code.
Tree Preservation & Landscaping
The applicant is proposing to remove 9 trees/ relocate 1 tree, and install 11 trees along
frontage on Laramie and within landscaped islands. The landscape plan also features planting
areas along the front of the building and within the parking lot.
STAFF RECOMMENDATIONS
Staff recommends that the petitioner's request for site plan approval be APPROVED based
upon the Proposed Findings of Fact and subject to the recommended site plan approva!
conditions listed below.
Staff recommends providing relief for the following items:
1. A reduction in required parking spaces from 34 to 29, which includes 23 on-site and
6 along Laramie,
2. An increase in signage as per the elevations but with restrictions added by the
Appearance Commission.
RECOMMENDED SITE PLAN APPROVAL CONDITIONS
1. The petitioner shall develop the Subject Property in substantial conformance with the
final Village approved site and landscaping p!an dated <insert date of final approved
plan>/ floor plans dated <insert date of final approved plan>, and building elevations
dated <insert date of final approved pfan>. (Standard)
2. Prior to the issuance of building permits/ the petitioner shall submit a temporary
pedestrian and bicycle circulation plan/ including routing/ signage/ and barriers/ to be in
place prior to the commencement of construction/ subject to the approval of the
Engineering Division. (Standard)
3. No restriction of use may be placed on the commercial space that is more restrictive
than is allowed in the Skokie Village Code. (Standard)
4. Prior to the issuance of building permits/ the petitioner shall submit for approval a
Hghting photometrics plan, fully developed civil engineering plans that comply with the
county WMO requirements and Village's sfcormwater control provisions/ and
redevelopment engineering plans to address all aspects of private and public utility
services. Any reconfigurations within state ROW wili require an IDOT highway/utility
permit. (Standard)
5. All existing damaged public sidewalks or public sidewalks damaged due to the
implementation of this plan shall be replaced. (Standard)
6. The applicant shall increase the width of the public sidewalk along Touhy to meet the 8-
foot wide muitiuse path specifications or contribute to She sidewalk fund to cover the
cost of sidewalk improvements, as directed by the Engineering Division.
7. No objects are allowed within a 15/ sight distance triangle between 30" and 84" from
grade except traffic control devices listed in the Manual on Uniform Traffic Control
Devices. (Standard)
8. Prior to the issuance of building permits/ the petitioner shall submit a temporary

that stacking of vehicles within the drive-through lane will be contained on-site and
not impede or obstruct pedestrian or vehicular movements. (Standard)

the review and approva! of the Skokie Appearance Commission. (Standard)

12. Failure to abide by any and a!l terms of this Ordinance shall be cause for the Village

applicable business licenses/ should be revised or revoked. The petitioner shall pay
all costs related to any hearings conducted as a result of non-compliance with any of

STAFF RECOMMENDATIONS
Staff recommends that the petitioner's request for a special use permit for a limited-
service restaurant with outdoor dining at 5150 Touhy Avenue in a B2 Commercial
district be APPROVED/ based upon the Proposed Positive Findings of Fact and subject
to the recommended conditions below.
RECOMMENDED SPECIAL USE PERMIT CONDITIONS
1. The petitioner shall operate and maintain the Subject Property in substantial
conformance with the outdoor dining plan in this report. (Standard)
2. The petitioner shall comply with all applicable conditions in the specia! use permit
and site plan approval ordinances for this site.
3. Any outdoor sound systems shall at all times maintain audio levels that are
compliant with the Skokie Village Code. (Standard)
4. Waste receptacies shall be placed on the Subject Property for the use of customers/
and that the Health and Human Services Department shall determine the size/ type/
and location of these units^ induding 1 waste receptacle in She outdoor dining area
and 1 waste receptacle at the restaurant entrance, (standard)
5. The use will comply with all standard conditions in Section 118-93(e) of the Skokie
Village Code for outdoor dining.
