MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Tuesday July 5, 2022
Effective July 18, 2022, Village Board meetings will begin at 7:30 p.m.
Village Clerk Pramod Shah stated that the Mayor will be absent tonight but will
be present thru Zoom.
Motion to appoint Trustee Ralph Klein as Mayor Pro Tempore.
Moved: Trustee Khoeun Seconded: Trustee Robinson

Mayor Pro Tempore Klein called the meeting to order.
The Clerk called the Roll. Those present were Trustees Sutker, Robinson, Khoeun, Johnson, Pure
Slovin , Mayor Pro Tempore Klein and Mayor Van Dusen
Mayor Van Dusen relayed a message reflecting on yesterday’s Fourth of July and expressing deep
condolences for the Highland Park community as we join them in grieving over the death and trauma.
He thanked the Skokie Fourth of July Parade Committee and Skokie Park District for the decision to
cancel the parade and fireworks.
Trustee Robinson also read a statement expressing sadness, thanked the emergency response
personnel for their help in the horrific circumstances in Highland Park.
Motion to approve the Consent Agenda with removal of Item A on the Corporation’s Report.

New Business.
Trustee Johnson recommended that there be a discussion on the New Business section of
the next meeting of the Skokie Village Board regarding six proposals for referendums on
the November Elections.
Public Comments.
These emails were received from Michelle Patt regarding drive-through restaurants, Lisa
Silverman regarding Fireworks and a suggestion for public safety. Margaret Clarke also
submitted a comment by email.
These citizens spoke at the Board Meeting.
Mr. Burton commented on recycling problems and the traffic at Lincoln, Howard and
Skokie Boulevard.
These residents commented on the tragedy on July fourth in Highland Park-gun violence,
firearms, assault weapons-state wide, gun reform, safe storage, red flag laws, hate
crimes, domestic terrorism, background checks, fingerprinting, mental health issues
Margaret Clarke, Laura Williams, Brian Clarke, Barnett Pitzele, Angela Sonagaston,
Denyse Wang Stoneback, Cecilia Ayala Bland.
Lauren Grodnicki commented on the Green Alley Program and the proposed ballot
referendum.
The July 18th Board of Trustees meeting will begin at 7:30 p.m.

Mayor Van Dusen called the meeting to order.
Pledge of Allegiance led by Village Clerk Pramod C. Shah.
The Clerk called the Roll. Those present were Trustees Sutker, Robinson, Khoeun, Johnson, Pure

Mayor Van Dusen made a unanimous request to make Juneteenth a holiday in the Village of
Skokie. This request !s consistent with ihe federal holiday. The Board agreed to the unanimous
consensus required.

A. CpmmerciaL Corridor Storefront Enhancement Program: Proposed
Modifications.
In 2016, the Village created the Commercial Corridor Storefront Enhancement
Program (SEP) which is funded by the Economic Development Fund. The SEP is
designed to spur redevelopment, fill vacant commercial spaces and enhance
properties along primary commercial corridors located outside of TIF Districts to
facilitate reinvestment in these important areas. I am pleased the Village has
assisted 25 small businesses with this program to date. To make this program a
more viable option for property and business owners faced with inflation, higher
construction costs and supply chain issues while seeking to improve key sites in
need of more significant reinvestment throughout the Village, Community and
Economic Development staff recommend the following nnodifications to the
current SEP guidelines:
1. Exterior and/or interior improvement assistance shall be increased from
$25,000 to $30,000 max. If the applicant chooses to apply for both
jnterior/exterior assistance, combined maximum amount shall be $50,000
(up from $40.000).
2. Architectural/design fees of up to $3,500, up from $3,000 for
reimbursement in excess of the interior and/or exterior grant totals.
3. if the applicant is the owner or tenant of a building with at least two
facades visible from the street, an additional $30,000 of exterior
assistance, therefore the combined maximum amount for the above-
described properties shall be $80,000.
4. Similar to the Downtown and West Dempster TIF District available
incentives, commercia! brokers involved in the sale, purchase or lease of
Downtown Skokie commercial properties only that have applied for and
received SEP funds shall be eligible to receive a $2,500 broker's bonus
commission.
I concur with staff's recommendation and respectfully request Mayor and Board
approval of the above modifications to the Village of Skokie Commercia! Corridor
Storefront Enhancement Program.

B. Village of Skokje Green Alley Program - Alliance Contractors, Woodstock,
IUinois - $750,909.55.
The Village plans to utilize grant funds from the Metropolitan Water Reclamation
District of Greater Chicago (MWRDGC) along with Village funds for construction
of identified penneable alleys. The three alleys to be constructed currently are
either paved with ongoing drainage issues or have an aggregate surface that
requires extensive maintenance from Public Works. The subject alleys to be
reconstructed are as follows: 9100 Forestview-Ewing, 8800 Lincolnwood-Central
Park and 8500 Christiana-McComnick.
There are sustainability benefits of these alleys. First, they capture and contain
stormwater and return it to the water table versus conveying it to the sewer
system or to overland runoff (backyard). Cumulatively, the stone base of all three
proposed alleys will provide almost 70,000 gallons of stormwater storage each
time it rains. Second, a green alley has a longer life span and requires less
annual maintenance than a gravel alley which reduces greenhouse gases.
Two bids were received, and it is recommended the Village utilize the services of
Alliance Contractors, a firm the Village has worked with in the past with
satisfactory results. I concur with staff's recommendation and respectfully request
Mayor and Board approva! to enter into a contract with Alliance Contactors in the
amount not to exceed $750,909.55.
C. Amendment to the Garage Sate Ordinance.
According to Skokie Village Code, garage sales are defined as being patio sales,
basement sales, backyard sales, or any similar type sale of three or more
household Items. The current ordinance states that every owner of a dwelling
may not have more than one garage sale in a given year and that the garage
sale may not exceed more than three consecutive days.
Staff is recommending the following changes to the Garage Sale Ordinance:
• Increase the number of garage sales allowed each year from one to three.
• Decrease the permit fee for each garage sale from $10 to $5.
• Allow a maximum of two (2) signs advising of the sale in the public right-of-
way.
• Permit the Village Manager to establish one weekend (Friday, Saturday &
Sunday) each year as a "Community Wide Garage Sale", an addition to the
three allotted garage sales.
These changes further the Village's sustainability efforts by increasing the
opportunities for unwanted items to be reused. I concur with staff's
recommendation and respectfully request Mayor and Board approval to authorize
Corporation Counsel to draft the necessary ordinance for final reading and
adoption.
* D. Adoption of New Fire Protection Codes with Local Amendments.
The Village enforces various building construction, fire protection and life safety
codes to protect the health and safety of the community. These are generally
state and national codes that are modified by the Village to address community

needs, construction methods and local conditions. The Fire and Community
Development Departments have been reviewing the 2021 edition of the
International Fire Code (IFC) in consideration for adoption. Included in this
recommendation is an amendment to Section 901.6.3 Records, which would
provide the Village the ability to implement reporting and records management
system to collect required system inspections, tests and maintenance
information. The new Code Compliance Program will provide the Fire Prevention
Bureau accurate, timely and essential information for managing required
inspections, tests and certifications for fire protection and life-safety systems.
Adoption of the 2021 IFC edition is recommended with modifications to local
code. I concur with staff's recommendation. The Mayor and Board are
respectfully requested to authorize Corporation Counsel to draft the necessary
changes.
E. 2022 Sewer Cleaning & Televisina Program - Chicago Trenchless
Rehabilitation Systems. Niles. lliinois - $175,540.
The Capital Improvement Program provides funding for Sanitary Sewer System
Maintenance in various areas throughout the Village. This project includes the
cleaning and televising of numerous locations. Two bid responses were received
for the above contract. It is recommended that a contract in the amount of
$175,540 be awarded to Chicago Trenchless Rehabilitation Systems, the lowest
responsive and responsible bidder. The contractor has done work for Skokie in
the past with favorable results. I concur with staff's recommendation and
respectfully request Mayor and Board approval.
F. 2022 Thermoplastic Pavement Marking Maintenance Contract - Superior
Road Striping. Melrose Park, Illinois - $10CLOOO.
The Village purchases themnoplastic pavement marking maintenance on an
annual basis. Pricing for thermoplastlc pavement marking services was obtained
through the Northwest Municipal Conference's Joint bid procedure. The
conference bids this contract once every three years and reserves the right to
extend the contract for up to three additional one-year terms upon mutual
agreement on a negotiated basis. The lowest responsive and responsible bidder
was Superior Road Striping. I concur with staff's recommendation and respectfully
request Mayor and Board approval of a contract in the amount not to exceed
$100,000 to be awarded to Superior Road Striping.
G. Council Chambers Video and Control Systems Uparades ~ Midwest
Computer Products Inc.. West Chicago, Illinois - $36,028.35.
The Capita) Improvement Program Equipment Replacement Budget provides for
the upgrade of the Council Chambers' video distribution system, replacement of
the lectern, upgrade of the AMX system and integration of the upgrades into the
existing audio and projector systems. The upgrade will modernize and streamline
the operation of meetings held in the Council Chambers. Two bid responses were
received, and it is recommended that a contract in the amount of $36,028.35 be
awarded to Midwest Computer Products (MCP). The Village has successfully
worked with MCP in the past. Midwest Computer Products will provide all the
necessary equipment, labor and services required to complete the project. I concur
with staff's recommendation and respectfully request Mayor and Board approval.

The Village of Skokie continues to work toward enhancing the overall marketability and stability
of the primary and neighborhood commercial areas outside of the Village s three (3) existing Tax
Increment Fund (TIF) Districts. In 2016, the Village created the Commercial Corridor Storefront
Enhancement Program (SEP) which is paid out of the Economic Development Fund. Similar to
the Village's successful longtime Downtown and West Dempster TIF-funded interior renovation
and exterior facade grants, the SEP is designed to spur redevelopment, fill vacant spaces and
enhance properties along other primary commercial corridors to help spur reinvestment in these
important areas. Over the past 6 years, over 25 local business and property owners have been
awarded SEP grants via this successful investment rebate program, resulting in a total of over
$1.28 million of private investment into the Main, east Dempster, and Oakton Street and Lincoln
Avenue corridors, m particular. Thus far, the Village has reimbursed these applicants
approximately $321,772 for eligible interior and exterior improvements (a 4:1 private/public
ratio) which has also led to spin-off investment into these areas and created or retained over 100
total jobs at these locales. During and since COVID closures, interest in the Village's SEP has
increased significantly among parties looking to fill or enhance existing ground floor commercial
space within areas zoned Bl, B2, B3, NX, TX or CX.
In order to continue and enhance the success and impact of the SEP and to make it a more viable
option for property and business owners faced with inflation, higher construction costs and
supply chain issues while seeking to improve key sites in need of more redevelopment
throughout the Village, Community and Economic Development staff are recommending the
following modifications to be made to the current SEP guidelines:
1. Exterior and/or interior improvement assistance using the current 60% (applicant)/40%
(Village) cost-sharing basis for approved construction costs shall be increased from
$25,000 to a new maximum of $30,000 (adjusted for inflation since 2016). Interior
renovation assistance will continue to be available for retail or restaurant uses only. If
applicant chooses to apply for both exterior/interior assistance, combined maximum
amount shall be $50,000 (up from $40,000).

2. Architectural/design fees of up to $3,500 (up from $3,000) are eligible (where
applicable) for reimbursement in excess of the interior and/or exterior grant totals.
3. If applicant is the owner or tenant of a building with at least two f2) facades visible from
the street, an additional $30,000 of exterior assistance is available based on the same
60/40 split. Therefore, the combined maximum amount for the above-described
properties shall be $80,000.
4. Similar to the Downtown and West Dempster TIF District available incentives,
commercial brokers involved in the sale, purchase, or lease of Downtown Skokie
commercial properties only that have applied for and received SEP funds shall be
eligible to receive a $2,500 broker s bonus commission.

Village staff is currently working with a number of proposed and prospective investors within
the Downtown, along Main, Oakton and Dempster Streets, and on Touhy Avenue who are in the
process of purchasing or leasing longtime vacant properties. The above described proposed
changes would provide meaningful incentives to get these projects over the finish line. Several of
the proposed applicants are longtime Skokie business owners looking to take their business to the
next level and further solidify their investment here in Skokie! Other applicants are coming from
Chicago or elsewhere who are encouraged by the public and private investments occurring In the
Village (e.g., Highpoint at 8000 North, the Homewood Suites by Hilton hotel, and various other
mixed-use projects) to bring more residents, workers visitors and customers to a particular
commercial area, post-Covid. As such, staff is prepared to recommend several new potential
SEP grant recipients to help facilitate exciting new uses within Skokie over the next couple of
months.

VILLAGE OF SKOKIE STOREFRONT ENHANCEMENT PROGRAM (SEP)
FOR COMMERCIAL CORRIDOR PROPERTIES LOCATED OUTSIDE TIF DISTRICTS (2/2/2022)
The Village ofSkokle continues to promote enhancements which improve the overall marketabilityand stability of the
Village's commercial areas. Since 2016, the Village has made available financial incentives to encourage commercial
rehabilitation and structural improvements to buildings located outside of the Village's three existing Tax Increment
Financing (TtF) Districts. The purpose of the commercial corridor Storefront Enhancement Program ("SEP") is to
encourage and assist owners (and/or current or new tenants) of existing commercial properties to renovate, upgrade
and expand buildings, as well as to improve site conditions in these areas. Similar to the Village's Downtown and West
DempsterTIF Facade Improvement and Interior Renovation Programs/this grant rebate program is offered on a
competitive basis and limited to ground floor commercial space within any areas zoned Bl, 82, B3, MX, TX or CX.
Applicants with a permitted use are eligible to receive exterior storefront improvement grant rebates from the Village
using a 60% (applicant)/40% (Village) cost-sharing basis for approved construction costs up to a maximum of $30,000.
Priority wilt be extended to retail and restaurant uses. An additional $30/000 in exterior assistance may also be
considered for owner-occupied properties located within Downtown Skokie with two (2) visible facades.
Eligible exterior improvements may include: tuck pointing and masonry repair, new windows and doors, cornice repair
or replacement, rebuilding front walls and foundations, improving product display areas and lighting. Other
improvements may be eligible if undertaken along with some of the above stated items, such as: concrete replacement
for private walkways/ curbs and gutters, landscaping, resurfadng/re-striping asphalt parking lots, signage and awnings.
Ground-floor facades must meet required design standards for appropriate windows, building materials and
preservation of any existing historical elements.
Interior renovation assistance is also available for retail or restaurant uses only. Interior assistance applicants are
eligible for grant rebates from the Village of up to $30,000 on the aforementioned 60%/40% cost-sharing basis or/ if
combined with an exterior storefront improvement grant (as per above), the Maximum Level of Combined
Rehabilitation Assistance is $50,000 (or $80,000 for stand alone, owner-occupied dual facades within the Downtown
Skokie Sector A area) in 2022 dollars.

Typical interior build-out projects may include: building systems such as plumbing, HVAC/ electrical and structural
improvements, sprinkler and security systems, flooring, ceilings and walls, as well as kitchen, bathroom/ show room or
office renovations and equipment. Architectural/design fees of up to $3,500 are eligible for reimbursement in excess
of the interior/exterior grant total. If a SEP grant award is approved, commercial brokers involved in the sale or
purchase of Downtown Skokie properties only are eligible for a broker's bonus commission of $2,500.
Total budgeted program funds are subject to change and, therefore, applicants are advised to submit their proposals in
a timely manner to increase the likelihood of a grant award. Each applicant must affirm that "but for" the Village grant,
the proposed improvement project likely would not be undertaken.
Village staff will work with applicants to complete their applications and will determine whether the project warrants
funding in accordance with program parameters and Village standards. Projects will need to be completed within 12
months from the time of award or the applicant will forfeit the grant. The Village reserves the right to approve grants on
behalf of applicants based upon prior program parameters, community goals, acceptable Village standards and
anticipated benefits to be gained for the commercial corridor from the proposed development project.
Note: Grants will be transferred to applicants on a rebate basis only upon the completion of the approved work and any

RECOMMENDATION
It is recommended that a contract in the amount of $750,909.55 be awarded to Alliance Contractors,
Woodstock. IL, the lowest responsive and responsible bidder. The project pertains to the construction of three
permeable pavcr alleys. 'I^he three alleys are shown on the attached map, The total length of this construction is
0.30 miles. Two of the alleys to be constructed are currently concrete and do not drain as vveil <is they used too,
The other alley is an aggregate surface ihat requires extensive maintenance from Public Works. The proposed
alleys combine penneable pavers with concrete ribbons along the edge. These alleys arc constructed above a
deep stone base. This base provides storage for the storm water as it infiltrates into the adjacent soil.
Cumulatively, the stone base of all three proposed alleys vvil! provide almost 70,000 gallons of stormvvater
storage each time it rains.
This project is funded by both the use of a Metropolitan Water Reclamation District(MWRD) Green
Infrastructure Grant and Village funds for construction, The project grant amount is $190.000.00. The Village
programmed $610,000,00 to supplement the grant. This project was designed by a consultant that specializes in
storm water projects and will be supervised by both the consultant and Village staff.

Aliiance Contractors is pre-quailfied by the Iliinois Department of Transportation for this type of work. This
firm also has worked with the Village on a number of projects with satisfactory results. Most recently Alliance

During the May 4, 2022 Code Committee meeting, the interdisciplinary group which works to address
various code issues, reviewed the Village's Garage Sale Ordinance and the ordinances of comparable
communities with the goal of furthering the Village's sustainability efforts by increasing the number of
opportunities for residents to sell unwanted items instead of disposing them in the landfill.
For background, the Village currently permits residents to have one garage sale per year, for a maximum
duration of three consecutive days. To have a garage sale, residents must obtain a permit in-person at the
Skokie Police Department for a fee of $10. Garage sale signs are permitted; however, they can only be
placed on private property and are not allowed on trees, poles, the parkway or other public spaces.
Attached to this memorandum is an analysis which compares Skokie's Garage Sale Ordinance to those of
its sixteen comparable communities with a focus on whether a garage sale permit is required, if there is a
fee associated with the permit, the number of garage sales allowed per year, the maximum allowable
duration of each garage sale and if garage sale signs are permitted in the right-of-way (ROW). Notable
results include:
• Seven communities require a garage sale permit.
• The average number of garage sales allowed per year is three (3).
• The average maximum duration allowed is three (3) days.
• Twelve communities do not charge a fee. Of those that do, the average fee is $6.
• Eleven communities prohibit posting signs on public property.
Based on the analysis and results above, the Code Committee recommends that the Village ofSkokie
ordinance pertaining to garage sales be updated to include the below changes:
• Increase the number of garage sales allowed each year from one to three.
• Decrease the permit fee for each garage sale from $ 10 to $5.
• Allow a maximum of two (2) signs advising of the sale m the public right-of-way. Signs cannot
be placed on any trees, lights standards, telephone poles or other supporting structures. Persons
that do not remove signs within the parameters of Section 26-714 of the Skokie Village Code of
Ordinances will be subject to a local ordinance citation(s).
• Permit the Village Manager to establish one weekend (Friday, Saturday & Sunday) each year as a
"Community Wide Garage Sale," an addition to the three allotted garage sales.
Should the Village Board concur with stajff recommendations, Corporation Counsel will draft an amended
ordinance.

Recommendation for Adoption of Fire Protection Codes and Amendments
The Fire and Community Development Departments have been reviewing the 2021 editions of
the International Fire Code (IFC), and NFPA Life Safety Code in consideration for adoption.
Based upon this analysis, staff recommends these codes be adopted along with specified
amendments, which are in the attached modified sections of the Village Code. The Village is
currently following the 2012 editions of these codes, which were adopted by the Board in 2015.
The Village enforces building construction, fire protection, and life safety codes as part of our
community risk reduction strategies that enhance fire prevention and public safety. These codes
are generally national and state codes with municipal amendments to address community needs,
construction methods, and local conditions. Adopting the 2021 Editions of the IFC and Life
Safety Code, and the proposed amendments will provide contemporary codes to promote life-
safety and property protection, while supporting community development with new construction,
renovation, and repurposing of existing structures. The updated codes also address expanding
technologies such as solar arrays, energy storage, and charging stations.
Included in this recommendation is an amendment to Section 901.6.3 Records, which would
provide the Village the ability to implement a reporting and records management system to
collect required system inspections, tests and maintenance information. Although current codes
require annual systems tests and certification, there is no mechanism in place for collecting this
important data from the vendors who perform them. This proposed amendment would require
vendors to submit reports electronically along with a submittal fee for all the systems they
inspect, test, and maintain. This new Code Compliance Program will provide the Fire Prevention
Bureau accurate, timely and essential information for managing required inspections, tests, and
certifications for fire protection and life-safety systems. It will also generate a modest source of
revenue that will support the program.

Adopting Section 901.6.3 would authorize the Fire Department to implement this new Code
Compliance Program, which will offer numerous benefits to the community, Village and Fire
Department:
1. Fire alarm and sprinkler system vendors are responsible for reporting inspections, tests
and certifications. This program would provide the framework for collecting and
managing these reports, which will improve compliance and record keeping.
2. Most of these vendors include the cost of reporting in their service fees whether they pay
a submittal fee to the local jurisdiction or not. Consequently, the Code Compliance
Program will have a minimal direct cost to Village of Skokie property and business
owners.
3. There will be some cost associated with inspections and report submittals for fire
protections systems that have been neglected by the property or business owners. In these
cases, the owners would be prompted to have their systems inspected and brought into
compliance. The submittal fee (anticipated to be $30.00 per system) would be minimal in
relation to the inspection service fee applied by the vendor. The value of having fire
protections inspected and certified to be operational is priceless.
4. The Fire Prevention Bureau currently accepts and maintains records of alarm and
sprinkler system inspections that are submitted. However, there is no database that tracks
if/when these systems are due for certification, or resources available to ensure
compliance. This program creates a system that reduces community risk and promotes
efficiency and accountability.
5. The Code Compliance Program would generate a small amount of revenue that could be
utilized to manage the program and enhance current fire inspection services.
Recommendation:
Having conducted a comprehensive review of the 2021 Editions of the IFC and Life Safety Code
and careful consideration of the proposed amendments, Fire and Community Development Staff
recommend adoption of the Code with the modifications as presented in the attachment.

DMSiON 1. GENERALLY
Sec. 38-36. Automatic telephone alarms.
Any automatic telephone aiann or device installed and operated that
dials the Village emergency telephone lines to the Communications Center of
the Police and Fire Departments is prohibited. No person shall install, or cause
to be installed, or maintain or cause to be maintained, any automatic telephone
alarm that dials the Village emergency teiephono lines to the CommunicationG
Center, the only exception being elevator communication deviee&r dialing
devices used to transmit an emergency alarm to the fire department, police
department, or the 9-1-1 dispatch center are expressly prohibited, except
for devices in elevators or passenger hoists.
Chapter 50 FIRE PREVENTION AND PROTECTION
ARTICLE II. FIRE PREVENTION CODE
Sec. 50-31. international Fire Code and National Fire Protection Association
Life Safety Code adopted.
(a) A fire prevention code is hereby established to provide the
Village with rules and regulations to improve public safety by promoting the
control of fire hazards, to regulate the installation, use, and maintenance of
equipment, to regulate the use of structures, premises, and open areas, to
provide for the abatement of fire hazards, to establish the responsibilities and
procedures for code enforcement, and to set the standards for compliance and
achievement of these objectives.
(b) Pursuant to authority granted by 65 !LCS 5/1-3-2, the Village
hereby adopts by reference the International Fire Code, 204^21 edition,
inclusive of Appendices B, C, D, E, F, H, I, K, and L , hereinafter referred to
as the "IFC" published and modified by the international Code Counci! (!CC), as
the fire prevention code, excepting those provisions that are modified or deleted
as provided in this Article.
(c) Pursuant to authority granted by 65 ILCS 5/1-3-2, the Village
hereby adopts by reference the Life Safety Code, 204^21 edition, inclusive of
all Appendices, hereinafter referred to as the "LSC" published and modified by
the National Fire Protection Association (NFPA).
Sec. 50-38. Standards for fire extinguishers.

(a) Definitions. The following words, terms and phrases, when
used in this section, shall have the meanings ascribed to them in this
subsection, except where the context clearly indicates a different meaning;
Service, where used in reference to fire extinguishers, means the inspection,
repair, recharging or testing of fire extinguishers.
Serviceperson means a person licensed by the Viliage to inspect, repair,
recharge or test fire extingulshers.
Standard fire extinguisher means a portable fire extinguisher which bears the
label of approval of a national testing laboratory acceptable to the Fire Chief.
(b) Tags. Every standard fire extinguisher shall have attached
thereto a tag or other label approved by the Fire Chief which cieariy indicates
the dates of inspection and recharging. The tag or label shall have clearly
imprinted thereon in numerais no less than Vz inch in height the year for which it
is issued.
(c) Servicing. Fire extingulshers more than 1 year past the
service date are in violation of this section. Pressured extinguishers must be
hydrostratically hydrostatically tested as prescribed in current NFPA
standards.
Sec. 50-47. Lock box system.
(a) Definitions. The following words, terms and phrases, when used
in this section, shall have the meanings ascribed to them in this subsection,
except where the context clearly indicates a different meaning:
Hazardous substance means a substance for which an occupational safety and
health standard has been adopted under the Occupational Safety and Health
Act of 1970, 84Stat. 1590, 29 U.S.C.A. §651, as amended, and the rules
adopted pursuant thereto; or a mixture of substances that contains any
substance listed in such Act in a quantity that constitutes more than 1 percent
of the composition or volume of the mixture.
Lock box means heavy steel box fitted with a Level 3 locking device that
requires a key that cannot be duplicated by a locksmith. A lock box shall be a
type that is approved and requested by the Skokie Fire Department and
keyed as such that the Skokie Fire Department is the only entity that can
open it.
(b) Lock box system required for certain buildings. All premises
required by the Village Code to provide fire detection or fire extinguishing
systems, with the exception of residential property, or premises in which
hazardous substances are used or stored, shall be required to have a lock box
installed on the premises. A lock box shall be installed as requested by the
authority having jurisdiction (hereinafter referred to "AHJ"), near a door
that has unlocking hardware.

(c) Lock box authorized for residentia! units. Lock boxes are
authorized, but not required for any legal residential unit in the Village. Property
management companies and property owners of muitifamily properties shall not
prohibit or deter the use of Lock boxes. Condominium Associations shall allow
the use and installation of Lock boxes if so desired by the individual unit owner
or tenant.
(1) Residential Lock boxes are to be installed on the front door of
an individual residential unit to provide access during an emergency response
by the Skokie Fire Department.
(2) The Liock box shall contain a key to the door upon which it is
mounted. Key(s) contained inside a lock box shall be for all interior and
exterior doors with lockable hardware. Any keycard(s) for any
electronically locked doors shall be provided to the AHJ.
(3) The lock box size shall be determined by the AHJ. A
determination of lock box size will be based on the number of keys to be
contained within and/or the documentation required for the hazards on
premises.
(4) The AHJ may require multiple lock boxes if deemed
necessary for occupancy.
(d) Authorization of installation; waiver and indemnification
agreement.
(1) Prior to the installation of any lock box, approval for the iocation
and utilization must be obtained from the Village Manager or designee. The
owner or occupant of the premises must provide the Village Manager or
designee with a completed application including authorization form for the
Village's utilization of the lock box.
(2) An executed waiver and indemnification agreement, on a form
provided by the Village shaft be submitted with the authorization form by the
owner or occupant.
(e) Contents of lock boxes referred to in Section 50-47(b) shall
include the following as appropriate:
(1) Keys to locked points of ingress, whether on the interior or
exterior of such buildings.
(2) Keys to locked fire protection and other mechanical equipment
rooms.
(3) Keys to locked electrical rooms.
(4) Keys to elevator controls.
(5) Keys to other areas as directed by the Fire Official.
(6) A list of all hazardous substances and information sheets on
these substances.
(7) Any other valuable information such as floor plans, protection
systems, HVAC drawings, utilities access, etc., which could be requested by
the Fire Department for its overall approach to a fire emergency.
(f) Access to lock box. !t shall be the responsibility of the owner or
occupant of the premises to keep the contents of the lock box required in
subsection (e) of this section up to date. If it is necessary for the owner or

occupant of the premises to access the lock box for the purpose of updating its
contents, the owner or occupant shall contact the Village Manager or designee.
The Village Manager or designee shal! have the only key to access the lock box
and shall be present when the lock box is accessed.
(g) Authority to establish additional regulations. The Village Manager
is authorized to establish rules, regulations and procedures for the
implementation of this section.
Sec. 50-49. Privately owned fire hycfrants.
(g)—Village inspections. The Village Manager or designee shall
inspect and flow privately owned hydrants. Private Hydrant Inspections. The
owner of the private water mains and associated hydrants shall have the
water mains and hydrants flow tested and inspected. The records of these
tests shall be submitted to the Skokie Fire Prevention Bureau through the
reporting system designated by the AHJ. Additionally, documentation of
the tests shall be available upon request of fire official.
(h) Notification of repairs. The Village shal! forward any repair or
maintenance discrepancies to the designated contact person for correction.
Notification of completion of any repair shall be made to the Village Manager or
designee for the purpose of inspection and acceptance. Repairs are to be
completed in a timely manner.
(i) Time limit for completing repairs. Property owners have 10 days
from notification to effect repairs or to request a time extension from the Village
Manager or designee.--Fa4hti:e--te-fflake-Fteees&aFy~F:epati:s or to request an
extension shall result in water to the property being shut off after 20 days-ef
noncompiiance. Notification of initiation and completion of any repati^
regardless of whether it is in response to a Village initiated notification, shall be
made to the Village Manager or designee for the purpose of notification,
tp&pection and aeeeptaneer Failure to make the required repairs or to
request an extension of time may result in the Village making the required
repairs at the cost to the owner.
Sec. 50-52. Amendments to International Fire Code.
The International Fire Code adopted by reference in this article shall be
modified as foilows:
(1) 109.4 Violation Penalties. Replace existing text with the
following;
Penalty for failure to correct fire hazard. Any owner, or agent,
employee or officer thereof, or person in possession or control of building or
place mentioned in Section 50-36, who shall refuse or neglect to make such
changes, alterations or repairs within a period of five (5) days after the date of
such notice, shall be subject to the penalties provided in Section 1-6 in addition

to any other penalty specifically provided for; Skokie Village Ordinance Sec. 50-

(2) Sec. 404.5 Availability. Add the following subsection:
404.5.1.2 Pre-Plan Drawings. To assist the fire department to deveiop pre-
plans for fire emergencies, all new and altered buildings (except single-famiiy
detached dwellings) are required to present as-build drawings prior to certificate
of occupancy. Drawings shall indicate a full site plan and a complete interior
floor pian (building foot print). Where practical the drawings shall be in an
electronic media format, but In all cases in a format approved by the AHJ.
(3) Sec. 503.2.3 Surface. Add as follows: Must allow ail weather
access and be maintained as such.
(4) Sec. 507.5 Fire Hydrant systems. Add as follows: Where
required. Where any portion of the facility or building hereafter constructed
or moved to within the jurisdiction is more than 300 feet from a hydrant on
a fire apparatus access road, as measured by an approved route around
the exterior of the building or facility, additional on-site fire hydrants and
looped mains shall be provided where required by the fire official.
Sec. 507.5.1.2 Fire Hydrant for FDC. Add as follows: A
minimum of one fire hydrant shall be readily accessible within no more
than 150 feet of the fire department connection. The distance shall be
permitted to exceed 150 feet where approved by the AH J.
(^5) Sec. 510 Radio Ampttfication system. Delete text and replace
with:
(46) Sec. 511 Village Public Safety Communications Network. Add
as follows:
If the erection or construction of a structure interferes with the
existing telecommunications system for public safety purposes, the developer
and/or owner shall provide for appropriate easement, facilities and equipment to
ensure the continued satisfactory operation of the public safety
telecommunications system at no cost to the Village. Facilities and equipment
needed to alleviate the concern shall become part of the Village of Skokie's
communications network and shall be operated and maintained by the Village.
In the event that the faciiities and equipment cannot be located on the proposed
structure, or their location on the structure will not provide satisfactory operation
of the public safely telecommunications system, the development shall pay the
cost of equipment, Instailation and easement to locate the equipment at an
alternative location determined by the Village to provide proper
communications.
(7) Sec. 901.6.3 Records. Add as follows: Records of all system
inspections, tests, and maintenance required by the referenced standards
shall be maintained on the premises for a minimum of three years.
Contractors performing system inspections, testing, and maintenance shall
submit all records electronically to the reporting system determined by the
Village of Skokie.

Each contractor performing system testing, inspection, and maintenance,
and reporting through the online system, will be required to pay a filing fee.
The filing fee shall be in such amount as determined by the Village of
Skokie. The filing fee shall be paid at the time the reports are submitted.
Reports that are not submitted through the reporting system established
by the Village of Skokie will not be accepted.
(8) Sec. Section 901.6.3.2: Required test certificate submission.
Add as follows: Records of the following tests shall be submitted to the
reporting system that has been determined by the Village of Skokie, as
required in Section 901.6.3. The following tests shall be completed and
submitted to the designated reporting system by a qualified person:

(§9) Sec. 903.1.2 Equipment-Fire Alarm Control Panels. Add as
follows:
New fire alarm controi panels shall be addressable. The equipment
shall be capable of having the audio signal silenced without using a pass code,
key or resetting the fire alarm control panel. Ati new fire alarm control panels
shatl be connected via radio to Skokie Communication Center or to an AHJ
approved onsite proprietary supervising station that is in accordance with
NFPA 72. All fire alarm control panels or full function annunciator panels shall
be installed within ten (10) feet of the main entrance or in a location approved
by the AH J.
(€10) Sec. 903.2.11.1.3 Basements. Delete Text and replace with
language as follows:
A complete automatic fire alarm system may be installed throughout
the building in lieu of automatic sprinkler system in the basement where the
following exits:
1. Use Groups B or M;

2. Building is a singie story having basement compartments with
one (1) hour fire protective rating no larger than 2,500 square feet, with
basement use limited to storage of dry goods, merchandise and food products,
not needing specialized fire protection, ventilation or handling, with access to
basements limited to employees or employee agents only and not for public use
with no production work or continuous operations;
3. The area in the basement shall be signed as directed by the
Fire Chief or designee with a twenty-four (24) inch square sign, or multiple
signs if determined appropriate, with the following text in red two (2) inch letters
on white background: "Limited Access Basement Area for Employees Only - No
Production or Continuous Operation in this Basement";
4. Exiting from the basement is otherwise provided in compliance
with the Building Code;
5. A sprinkler system is not required by other portions of the
Building Code.
(711) Sec. 903.2.13 Nonresidentiat zoning districts. An automatic
sprinkler system shall be provided for al! occupancies that are in nonresidential
zoning districts that are not covered under site plan or special use provisions
when the buiiding area, without regard to fire walls, is equal to or exceeds 5,000
square feet.
(^) Sec. 903.,1.2 Alarms. Adcf-as first sontence to paragraph:

(12) Sec. 903.3.8.5 Calculations. Add as follows: Hydraulic
calculations in accordance with NFPA 13 shall be provided to demonstrate
that the available water flow and pressure are adequate to supply all
sprinklers installed in any single fire area with discharge densities
corresponding to the hazard classification.
a. 903.3.8.5.'? - A minimum 5 psi (34.5 kPs) safety factor incorporated
into all hydraulic calculations associated with any new and/or
substantially modified fire sprinkler system. This safety factor shall
be added into the final calculations after all other hydraulic
calculations have been completed, at the point where the
underground service line directly connects to the public water main
system. All hydraulic calculations shall be based upon an on-site
flow test completed no more than 180 days prior to the design
submittal.
b. 903.3.8.5.2 - A minimum of residual of 20 psi shall be maintained on
the suction side of the fire pump.
(913) Sec. 903.4.2 Alarms. Add as follows:
Sec. 903.4.2.1 Alarm Notification for One and Two Family Dwellings. A weather
proof audio visual device shall be installed on the exterior of the structure as

part of the fire suppression system so that the operation of the fire sprinkler
suppression system will cause audio visual device to be seen from the fronting
street. A minimum six (6) inch beil shall be installed in the interior of the
structure, and shaft be mounted, if possible on the HVAC return air system, to
reverberate the sound of bet! throughout the entire structure to signal that there
is an activation of water fiow to the sprinkler system. The bell, AA/, and water
flow switch shall be wired into a shared basement electrical circuit (such as
sump pump, basement lights, etc.) this to prevent accidental disruption of the
alarm notification system.
(4^14) Sec. 903.4.3 Floor control valves. Add as follows:
Sec. 903.4.3.1 Multi-tenant occupancy. When an automatic fire suppression
system is installed in a new/existing multi-tenant building, each tenant shall
have its own sprinkler supply line off the sprinkler main or riser with its own
water flow switch and control valve. A weather proof horn/strobe shall be
mounted on the exterior front of that tenant space and as indicated in Section
903.4.2. The horn/strobe device shall activate upon water flow and/or fire alarm
activation within that individual unit.
(4415) Sec.904.3,5 Monitoring. Delete text and replace with:
Automatic fire-extinguishing systems shall be monitored by a building fire alarm
system which is maintained and operated in accordance with NFPA 72.
(4216) Sec. 905.4.3 Warehouse. Add as follows:
In all warehouse storage areas exceeding 50,000 square feet, and
where storage heights exceed twelve (12) feet, provide inside 2-1/2 inch fire
hose valves. Locate the valves at each exterior access/egress door to the
warehouse and/or storage area. Provide addttionai 2-1/2 inch fire hose valves
so that no portion of the warehouse and/or storage area is 200 feet maximum
travel distance to a fire hose valve. The fire hose valve system piping shall be:
a. The 2-1/2 inch valve shall be supplied by a minimum of four (4)
inch pipe with 2-1/2 inch drops to each valve.
(4-317) Sec. 907.1.34 Equipment Fire Alarm Control Panels
(FACP). Add as follows:
The fke aiarm system chal! be addressable as required by the Fire
Prevention Bureau by floor and/or area. All required Fire Alarm Systems,
excluding one and two family residential buildings shalt be provided with a full
function afwunciator panel at the entrance of the building, unless the control
panel is located at the main eptoftee-of the building. Fire Alarm Control
Panels: New fire alarm control panels shall be addressable. The
equipment shall be capable of having the audio signal silenced without
using a pass code, key or resetting the fire alarm control panel. Fire alarm
panels that require a code shall have a code provided by and programmed
for the AHJ, to be used only by the AHJ. All new fire alarm control panels
shall be connected via radio to Skokie Communication Center. All fire
alarm control panels or full function annunciator panels shall be installed
within ten (10) feet of the main entrance or in a location approved by the
AHJ.

(18) Sec. 907.1.5 Equipment Location. Add as follows: The
FACP or a Remote Annunciator (RA) shall be mounted in the room with
the sprinkler control valves. The door to this room shall be marked "FACP
Room" and "Sprinkler Room".
(19) Sec. 907.1.5.1 Device Map. Add as follows: A map of all
devices with labels as they annunciate shall be posted at the FACP
location.
(20) Sec. 907.1.5.2 Sprinkler System Map. Add as follows: A
map of the sprinkler system control devices, drains, and isolation zones
shall be posted near the sprinkler system controls. This map or drawing
shall be legible, inside a protective covering and mounted to a wall.
(21) Sec. 907.2.13.2 Fire department communication system. Add
as follows: Wired communications systems are not permitted, the wireless
service shall be recommended by the AHJ.
(22) Sec. 907.3.1.1 Smoke Detection. Add as follows: All new
and existing HVAC equipment containing smoke detection devices shall be
labeled to correspond to the fire alarm annunciation displayed on the fire
alarm panel.
a. 907.3.1.1.1 -The labels shall be clearly visible from the floor level on
the reset switches
b. 907.3.1.1.2- Corresponding two (2) inch number shall also be
permanently provided on each rooftop unit.
(23) Sec. 907.3.1.2 Duct Detection Resets. Add as follows: All
required duct detectors shall be provided with a remote testing and reset
device, located no more than six (6) feet above the finished floor.
(24) Sec. 907.3.1.3 Test Switch Location. Add as follows: The duct
detector remote test switch shall be located directly below the duct
detector.
(25) Sec. 1205.2.1.2 Setbacks at Ridge. Amend as follows: For
photovoltaic arrays occupying 33% or less of the plan view total roof area,
a setback of not less than 36 inches (918mm) wide is required on both
sides of a horizontal ridge. (rest remains the same, the change is from 18"
to 36")
(26) Sec. 1205.2.1.3 Alternative setbacks at ridge. Amend as
follows: Remove the 1 and 2 and replace with the following - For
photovoltaic arrays on a roof setback will be a minimum of 36 inches (918
mm) wide is required on both sides of a horizontal ridge.
(27) Sec. 1205.2 ~ Access and pathways - Amend as follows:
Roof access, pathways, and spacing requirements shall be provided in
accordance with sections 1205.2.1 through 1205.3.3. Pathways shall be
over areas capable of supporting fire fighters accessing the roof. These
pathways will be a minimum of 48 inches (1219 mm) from the edge of the
roof." The remainder will remain the same.

(28) Sec. 5601.1 Scope. Add as follows: Additional requirements
are found in the Village of Skokie Municipal Code. NOTE: Exceptions
remain the same
(4429) Sec. 907.6.5 Monitoring. Delete text and replace with:
All fire alarm subscribers, all required new or significantly modified
Fire Alarm Systems, excluding systems in one-and two-famiiy residential
buildings and those existing systems that do not require modification but have
experienced an increase in risk or life safety, shall have a direct connection to
the Combined Communications Center (CCC). This connection shall be made
and operational before occupancy of the building will be approved by the Fire
Prevention Bureau. The Fire Chief, or designee, shati make the determination
of whether a system has been significantly modified or potential for a higher
!oss of life or hazard classification has increased. Any waiver or modification of
this connection requirement may only be authorized by the Village Manager or
designee. Any significantly modified fire alarm system that is under contract to
transmit its emergency signal to a remote monitoring station rather than to the
CCC prior to submittal of alarm system improvement plans shall be allowed to
remain under such contract until the end of the current term of the contract or
until the contract is terminated, whichever occurs first. Upon expiration or
termination of said contract, the aiamn shall be converted to an alarm that
transmits its emergency signal via a Village-owned radio transmitter directly to
the CCC.
(4^30) Section 907.8.2 Add as follows:
A service agreement with an Alarm Contractor must be maintained. A
current copy of a sen/ice agreement for each alarm system shaff be provided to
the Fire Prevention Bureau. A copy of annual testing and inspection reports for
each fire alarm system, excluding systems in one-and two-family residential
buildings, shall be provided to the Fire Prevention Bureau.
(4^31) Section 907.8.5 Add as follows:
Section 907.8.5.1 Alarm Out of Service
If at any time coverage or protection provided by a fire alarm system,
excluding systems in one-and two-family residential buildings, decreases or
ceases, the following shal! occur:
1. The alarm user shall notify the CCC anytime a system is
removed from service due to maintenance, mechanical problems, or any other
condition in which the system will not transmit an activated alarm to the CCC.
2. The alarm user shall provide notice to all tenants/occupants in
the building that the fire alarm system is out of service, and that it will be
necessary to notify the fire department by calling 9-1-1 of any fires or similar
hazardous conditions.
3. If, at the discretion of the fire chief or designee, a system is
anticipated to remain out of service for more than four (4) hours, a fire watch at
the property owner's expense, may be required.
4. Upon restoration of the fire alarm system to normal operating
conditions, the property owner shal! notify the CCC and any affected tenant or
occupant.

5. Any and all corrective actions necessary to restore the system to
a normal operating condition shall be taken by the alarm user or their agent to
place the alarm back in full service within seventy-two (72) hours after the initial
out of service report to the CCC.
(4732) Section 912.1. Add as follows:
Section 912.1.1 Exterior fire department connection visual indicator. When a
fire sprinkler system is required to have a fire department connection in
accordance with Section 912.1, a visual indicator shall be installed directly
above the fire department connection in a location approved by the AHJ. In
those cases where architectural design visuaily obscures the visual indicator
from being seen from the primary roadway in front of the building and/or
structure that is protected by the fire sprinkler system, the AHJ shall determine
and alternate location of placement of the visual indicator on the front of the
buiiding/or structure. The visual indicator shall be weather proof and activate on
water flow alarms only.
(33) Section 912.2.3 Add as follows:
Exterior fire department connection visual indicator. When a fire sprinkler
system is required to have a fire department connection in accordance with
Section 912.1, a visual indicator and ten (10) inch bell shall be installed
directly above the fire department connection in a location approved by the
fire code official. The visual indicator device shall have a red housing with
the word "FIRE" in white lettering and a clear lens on the visual indicator
portion. Where architectural design visually obscures the visual indicator
from being seen from the primary roadway in front of the building and/or
structure that is protected by the fire sprinkler system, the fire code official
shall determine an alternate location for placement of the visual indicator
on the front of the building and/or structure. The visual indicator shall be
activated because of water flowing through the fire sprinkler system and
activation of the fire sprinkler system monitoring system.
(34) Sec. 912.3 Hose threads. Add as follows: Fire hose threads
and fittings used in connection with standpipe systems shall be equipped
with National Standard Thread (NST), American National Fire Hose
Connection (NH).
(4^35) Add Sec. 1106 Fire Protection Requirements: Additions,
Alterations, and Hazard Ciassification Changes to Existing Structures.
Additions -Any existing structure that is adding an addition will have
fire protection as indicated based on the following:
1. Fire Protection Sprinkler System will be provided as the fire
protection- if the resultant size of the structure, existing or new, is equal to
or greater than 5,000 square feet or the hazard classification has changed
based on evaluation by the AHJ.
If the resultant size of the structure is equal to or-^eater than 5,000
square foot and the Hazard Classification is increased baced on evaluation by

work area for the alteration of fifty percent (50%) of the aggregate area of the
building or fifty percent (50%) of the assessed value of the building will
have fire protection as indicated based on the following:
1. Fire Protection Sprinkler System will be provided as the fire
protectionT + if the resultant size of the structure is equal to or greater than
5,000 square feet an4 or the Hazard C!assification4s has increased based on
evaluation by the AHJ.
2. Fire Detection System will be provided: as the fire protection.
a. if the resultant size of the structure is equal to or greater than
2,500 square feet^; or
b. if the resultant size of the structure is less than 2,500 square

advertised and publicly opened on June 9, 2022. As a result of the solicitation, two (2)
bids were received.

COMMENTS
The purpose of this project is to clean and inspect, via video, sections of combined
sewer pipe within the Village. These areas are selected based first on upcoming
construction projects and then the overall condition. Sewer sections will be evaluated
for appropriate repairs following the cleaning and inspection.
Also included in this project is a pay item for spot liners. These are used in pipes that
need only a small area of repair. This work can be done within the existing pipe and
therefore does not require excavation or street restoration.
The contractor has successfully done work for the Village in the past.

2022 Thermoplastic Pavement Marking Maintenance Contract
The Village provides Thermoplastic Pavement Marking Maintenance on an annual basis. Pricing
for Thermoplastic Pavement Marking has been obtained through the Northwest Municipal
Conference's joint purchasing contract for thermoplastic pavement marking. The conference bids
this contract once every three years and reserves the right to extend the contract for up to (3)
three additional one-year terms upon mutual agreement on a negotiated basis. The lowest
responsive and responsible bidder was Superior Road Striping ofMeh'ose Park, Illinois. It has
been extended from April 12, 2022 through April 11, 2023 with no price increases.
Budget & Account: $100,000 #OQ20002 020-6000-407.07-32
Recommendation
It is recommended that a contract be awarded to Superior Road Striping for Thermoplastic
Pavement Marking Maintenance in the amount not to exceed $100,000. The exact amount will
be calculated per the established unit prices for the final field measured quantities of the
determined work performed.
Comments
The Village can take advantage of a more competitive bid participating in the joint contract than
by bidding on this type of work, alone. The Village however, must use non-MFT money to
participate in this contract.
In addition, the Village of Skokie has had a positive experience working with Superior Road
Striping in the past on other projects in the Village.

A Request for Proposals (RFP) for Council Chamber Video and Control System Upgrades was
advertised and as a result, proposals from two firms were received on May 24, 2022:

The CIP Equipment Replacement Budget provides for the upgrade of the Council Chambers'
video distribution system, replacement of the lectern, upgrade of the AMX system and
integration of the upgrades into the existing audio and projector systems.
Recommendation
It is reconunended that a contract for Council Chambers Video and Control System Upgrades be
awarded to Midwest Computer Products in the amount of $36,028.35. Midwest Computer
Products' proposal provides for the most comprehensive equipment upgrades at the best overall

value. The Village has successfully worked with Midwest Computer Products in the past.
Comments
The purpose of the subject project is to have the video distribution and control systems upgraded to
modernize and streamline the operation of meetings in the Council Chambers. The scope of work
includes upgrading the current system from analog to digital, provision of a new document camera,
a new video distribution system, two new control panels (7" touch panel at the lectem and an 11"
touch panel at the Village Manager position), microphone system upgrades and a new lectem which
will house the new equipment.
Midwest Computer Products will provide all the necessary equipment, labor and services required
to complete the project. They have successfully completed similar projects for the Village of
Northbrook, East Prairie School District #73 and Kane County.

1 WHEREAS, the lot at 5150 Touhy is approximately 160 feet deep, much more
2 narrow than other commercial developments, and without the Zoning Map amendment for
3 the Subject Property, a drive-through facility would not be possible; and
4 WHEREAS, the Skokie Plan Commission, after a public hearing duly held on March
5 17, 2022, at which several interested parties testified, and after hearing all testimony (i)
6 determined that proper notice had been given; (ii) made the appropriate findings of fact in
7 the affirmative as required under Section 118-6(h) of the Skokie Village Code and (iii) voted
8 to recommend to the Mayor and Board of Trustees that the requested zoning
9 reclassification be granted and the Official Zoning Map of the Village of Skokie be amended
10 to reflect this reclassification; and
11 WHEREAS, the Mayor and Board of Trustees, after public meeting duly held on April
12 4, 2022, concurred in the aforesaid recommendation of the Plan Commission;
13 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
14 Village of Skokie, Cook County, Illinois:
15 Section 1: That the Subject Property legally described above and commonly
16 known as 5149, 5153 and 5157 Jarlath Avenue, Skokie, Illinois, be and the same is hereby
17 reclassified from an R2 Single-Family district to a B2 Commercial district.
18 Section 2: That the Official Zoning Map of the Village of Skokie be and the same

1 WHEREAS, Skokie Property, LLC, the owner of 5150 Touhy Avenue and 5149-
2 5157 Jarlath Avenue (hereinafter “Petitioner”) has petitioned the Village of Skokie to vacate
3 the alley behind 5150 Touhy Avenue between Laramie Avenue and the intersecting alley
4 from Jarlath Avenue (hereinafter “Subject Property”); and
5 WHEREAS, the Subject Property, which measures 16 feet by 125 feet, is depicted
6 on the Plat of Vacation of Public Alley in the Village of Skokie, dated April 26, 2022, a copy
7 of which is attached hereto as Exhibit “A”; and
8 WHEREAS, the Subject Property is located in an B2 Commercial district within an
9 area bounded by 5150 Touhy Avenue to the south, Laramie Avenue to the west, 5149-5157
10 Jarlath Avenue to the north and the intersecting alley from Jarlath Avenue to the east and is
11 described in Exhibit “B” attached hereto; and
12 WHEREAS, the property directly to the north and the south is owned by the owner of
13 Dunkin’ Baskin Robbins. The plan is to combine the properties and rebuild the existing
14 store with the addition of double drive-thru lanes, along with outdoor dining; and
15 WHEREAS, the nature and extent of the public use or public interest to be
16 subserved in the Subject Property shall warrant the vacation of the same; and
17 WHEREAS, the title and ownership of the portion of the Subject Property to be
18 vacated shall, pursuant to 65 ILCS 5/11-91-1, to the abutting property owner as identified by
19 the Permanent Index Numbers (hereinafter “PIN”) and are listed by PIN block numbers in
20 Exhibit “B” attached hereto; and
21 WHEREAS, the Village will remove any existing alley aprons and restore parkways,
22 sidewalks and any curbs, if necessary; and
23 WHEREAS, easements for Village and Village-franchised public utilities will remain
24 over the entire area to be vacated until such utilities are relocated; and
25 WHEREAS, compensation shall be paid by the petitioner for the value of the real
26 estate which may accrue to them by reason of the enactment of this Ordinance; and
27 WHEREAS, the abutting property owners of the Subject Property were duly notified
28 of the Skokie Plan Commission proceedings and presented no objection to the proposed

6 Subject Property be vacated, subject to the conditions set forth in the Plan Commission
7 Report dated April 4, 2022; and
8 WHEREAS, the Mayor and Board of Trustees of the Village of Skokie, at a public
9 meeting duly held April 4, 2022, concurred in the recommendation of the Skokie Plan

23 2. Upon the passage of the ordinance by the Board of Trustees, the Mylar of the Plat of
24 Vacation shall be submitted to the Village with all signatures other than Village staff or
25 elected officials;
26 3. Easements shall be reserved for all Village and Village franchised public utilities over
27 the entire area to be vacated until such utilities are relocated;
28 4. Property owners shall not alter the grade or change the drainage pattern in the
29 easement area without a permit from the Engineering Division; and
30 5. The vacation shall be effective upon the recording of a Plat of Vacation by the Village in
31 the Office of the Recorder of Deeds of Cook County, Illinois.
32 Section 3: The Village, on its own behalf and on behalf of Village-franchised
33 public utilities, shall retain the right of entry upon the Subject Property in order to install,
34 repair, replace or remove, or engage in the maintenance of, any equipment or facility of any
35 such utility or the drainage conditions in the Subject Property. In the course of repair,
36 replacement or removal, or maintenance of equipment or facilities of a Village-franchised
37 public utility, or drainage conditions in, on or over the Subject Property, the Village or the
38 Village-franchised public utility shall not be held liable by any owner of the Subject Property
39 for any damage to structures, landscaping, or fences in, on or over the Subject Property.
40 Any and all structures, including a fence, built or maintained on the Subject Property are
41 done so at the owner of the Subject Property’s own risk.

5 owner of the abutting properties for the value of the real estate which may accrue to them
6 by reason of the enactment of this ordinance and that the public interest and benefit will be
7 subserved by the vacation of the properties referenced herein.
8 Section 6: It is the intention of the Village that ownership and title to the vacated
9 alleys shall pass to and vest in the adjacent property owner to the north of the Subject
10 Property, as listed by the Permanent Index Numbers in Exhibit “B”, in equal proportions of
11 the vacated alley.

28 approved subject to each of the conditions set forth below:
29 1. The petitioner shall develop the Subject Property in substantial conformance
30 with the final Village approved site and landscaping plan dated March 23,
31 2022, floor plans dated March 17, 2022, and building elevations dated
32 February 16, 2022;
33 2. Prior to the issuance of building permits, the petitioner shall submit a
34 temporary pedestrian and bicycle circulation plan, including routing, signage,
35 and barriers, to be in place prior to the commencement of construction,
36 subject to the approval of the Engineering Division;
37 3. No restriction of use may be placed on the commercial space that is more
38 restrictive than is allowed in the Skokie Village Code;
39 4. Prior to the issuance of building permits, the petitioner shall submit for
40 approval a lighting photometrics plan, fully developed civil engineering plans
41 that comply with the county WMO requirements and Village’s stormwater
42 control provisions, and redevelopment engineering plans to address all

5 6. The applicant shall increase the width of the public sidewalk along Touhy to
6 meet the 8-foot wide multiuse path specifications or contribute to the sidewalk
7 fund to cover the cost of sidewalk improvements, as directed by the
8 Engineering Division;
9 7. No objects are allowed within a 15’ sight distance triangle between 30” and
10 84” from grade except traffic control devices listed in the Manual on Uniform
11 Traffic Control Devices;
12 8. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas,
13 signage, landscaping, structures, and any other facilities or infrastructure on
14 the Subject Property shall be maintained in a good state of repair, and when
15 needed, be repaired or replaced in a timely manner;
16 9. All private and public sidewalks shall be maintained free of snow, ice, sleet, or
17 other objects that may impede travel;
18 10. All off-street parking spaces shall be legibly striped and maintained;
19 11. Any plan to modify parking lot striping must be approved by the Director of
20 Engineering;
21 12. Vehicles shall not be allowed to be parked in or otherwise block common
22 driveways, sidewalks, aisles, or other points of access at any time, shall only
23 be parked in designated parking spaces, and shall not overlap the striped lines
24 of designated parking spaces;
25 13. All utilities on the Subject Property shall be placed underground or relocated
26 underground and the petitioner shall bear the full cost of any utility relocation
27 and/or conflicts;
28 14. The petitioner shall sign an “Agreement for Installation and Maintenance of
29 Landscaping” to assure that the Subject Property is completed and
30 maintained, including trimming, watering and replacing of dead plant materials
31 in a timely manner in accordance with the final approved landscape plan. A
32 copy of said Agreement is attached hereto, marked Exhibit “A” and hereby
33 made part of this Ordinance. This “Agreement for Installation and
34 Maintenance of Landscaping” shall be recorded at the petitioner’s expense;
35 15. All new construction, alterations, and remodeling shall meet current
36 International Building and NFPA Life Safety Codes as amended;
37 16. The petitioner shall obtain all required permits and approvals for
38 improvements to County, State, or Federal rights-of-way from the governing
39 jurisdiction;
40 17. The Subject Property must conform to the Village's storm water control
41 requirements as contained in the Skokie Village Code, including the
42 disconnection of any downspouts;
43 18. All signage shall conform to the Skokie Village Code, except as provided for in
44 this ordinance. Any sign on the Subject Property that is in violation of the
45 conditions set forth in this ordinance, must be removed or modified prior to the
46 issuance of an occupancy permit;
47 19. All modifications to building elevations, signage, and landscaping shall be
48 subject to the review and approval of the Skokie Appearance Commission.

1 20. The petitioner shall submit to the Planning Division electronic files of the plat
2 of survey, site plan, and landscape plan in their approved and finalized form.
3 The files shall be scaled 2-dimensional drawing files on non-compressed, non-
4 read only digital file *.dwg AutoCAD format;
5 21. Prior to the issuance of building permits, the petitioner shall submit to the
6 Planning Division of the Community Development Department the name,
7 property address, email address, and telephone number of the company and
8 contact person responsible for site maintenance in compliance with this site
9 plan approval;
10 22. If work is to be performed on public property or if public property is utilized or
11 impacted during construction and/or development, the owner shall provide, or
12 shall cause the developer and/or contractor to provide, the Village of Skokie
13 with a certificate of insurance naming the Village of Skokie as additionally
14 insured for any and all claims related to any and all work. The owner shall hold
15 and shall cause the developer and/or contractor to hold, the Village of Skokie
16 harmless and indemnify the Village for any and all claims for property damage
17 or personal injury related to work on or use of public property;
18 23. The petitioner shall comply with all Federal and State statutes, laws, rules and
19 regulations and all Village codes, ordinances, rules, and regulations;
20 24. Failure to abide by any and all terms of this Ordinance shall be cause for the
21 Village to initiate hearings to determine whether the subject Ordinance, as well
22 as any applicable business licenses, should be revised or revoked. The
23 petitioner shall pay all costs related to any hearings conducted as a result of
24 non-compliance with any of the provisions of the enabling ordinance. The
25 costs shall include but not be limited to court reporter fees, attorney fees, and
26 staff time required researching and conducting said hearing;
27 25. At least once during every 4 hours of operation and before opening and
28 closing of the business, employees shall patrol the Subject Property and
29 Laramie Avenue and clear it of debris; and
30 26. The petitioner shall have the trash picked-up at least 3 times a week.
31 Section 2: That relief from Section 118-218(b)(4) to allow a reduction in parking
32 spaces from 36 to 29 spaces and Section 82-27(c)(2) to allow more than one wall sign per
33 signable area as outlined in the Elevation plan dated February 16, 2022, is hereby granted.
34 Section 3: That a notice of the approval of this Ordinance incorporating the
35 conditions contained herein shall be executed by the owner of the property in writing and
36 duly recorded with the Cook County Clerk’s Office at the owner’s expense.

7 1. At or near the time of execution of this Agreement, the VILLAGE granted an
8 Occupancy Permit, Business License, Site Plan Approval or Special Use Permit
9 hereinafter collectively referred to as “permit” pursuant to state statutes and local
10 ordinances.
11 2. By the terms of the aforesaid permit, the PROPERTY OWNER is required to install
12 and maintain landscaping in accordance with the plan dated March 23, 2022,

1 or as it may be subsequently revised with the approval of the Village Manager, or
2 designee, and the Corporation Counsel.
3 3. The parties to this Agreement recognize that the installation and maintenance of
4 landscaping is an integral part of the PROPERTY OWNER's plan for development
5 and/or use of the property and is necessary to carry out the purpose and intent of the
6 VILLAGE's land use objectives, and that the permit would not have been approved
7 by the VILLAGE without the assurance that this Agreement would be executed by
8 the PROPERTY OWNER.
9 4. The purpose of this Agreement is to assure:
10 (a) installation of the landscaping in accordance with the landscaping plan
11 approved by the VILLAGE, and
12 (b) continued maintenance and care of the landscaping, including any
13 landscaping indicated in the parkway area.
14 5. The property, which is the subject matter of this Agreement, is legally described
15 above. The portions of the Subject Property which are to be landscaped and
16 maintained pursuant to the terms and conditions of this Agreement are indicated on
17 the Landscape Plan attached hereto, marked Exhibit “1” and are hereby made a part
18 of this Agreement.
19 6. PROPERTY OWNER agrees that the installation and maintenance of the
20 landscaping which is required in accordance with the permit issued by the VILLAGE
21 and this Agreement will materially benefit the Subject Property. Such landscaping is
22 necessary in order for the PROPERTY OWNER to comply with the conditions of the
23 permit issued or granted by the VILLAGE for the PROPERTY OWNER’s requested
24 development or use of the property.
25 7. PROPERTY OWNER shall diligently maintain and care for the landscaping which is
26 installed and required by the permit and this Agreement, using generally accepted
27 methods of cultivation and watering. The PROPERTY OWNER shall maintain a
28 standard of care necessary to prevent the landscaping from deteriorating to the
29 extent that its value as landscaping is destroyed. If Exhibit “1”, attached hereto or
30 permit specifies maintenance standards or procedures, such procedures are hereby
31 adopted as part of this Agreement, and by such adoption, become enforcement
32 conditions of this Agreement.
33 8. Failure to maintain the landscaping as required by this Agreement shall be a
34 nuisance. In the event the PROPERTY OWNER fails to meet the standard of
35 maintenance necessary to keep the landscaping in a healthy condition as required
36 by this Agreement, the VILLAGE shall give written notice of the deficiency to the
37 PROPERTY OWNER who shall have 20 days to make the necessary correction or
38 replacement. If such correction or replacement is not made within the aforesaid 20-
39 day period, the VILLAGE may elect to abate the nuisance and take necessary action
40 to assure that the landscaping is replaced and/or maintained. In the event, the
41 VILLAGE so elects; the VILLAGE shall serve notice of its intent to enter the
42 premises for this purpose. The VILLAGE shall either personally serve the notice
43 upon the PROPERTY OWNER or mail a copy of it by certified mail to the

1 PROPERTY OWNER's last known address, or as shown on the tax rolls, at least 15
2 days in advance of the date when the VILLAGE or its agent intends to enter the
3 premises.
4 9. For this purpose, the VILLAGE or its agent may enter upon the property and perform
5 such work as it considers reasonably necessary and proper to restore, maintain, or
6 replace the landscaping required by this Agreement. The VILLAGE may act either
7 through its own employees or through an independent contractor.
8 10. The VILLAGE shall be entitled to reimbursement for abating the nuisance in
9 restoring, maintaining or replacing the landscaping, provided that the VILLAGE
10 follows the procedures set forth in this Agreement. Costs shall include but shall not
11 be limited to actual costs incurred by the VILLAGE and administrative costs. The
12 VILLAGE shall make demand upon the PROPERTY OWNER for payment. If the
13 PROPERTY OWNER fails to pay the costs within 30 days of the date on which
14 demand is made, the VILLAGE may cause a lien to be placed on the Subject
15 Property. The VILLAGE may record a notice with the Recorder of Deeds for Cook
16 County stating that it has incurred expenses under the terms this Landscape
17 Agreement. The VILLAGE shall be entitled to collect interest at the statutory rate on
18 the amount owed.
19 11. In addition to having a lien placed on the Subject Property, the VILLAGE may
20 institute a legal action to collect the amount owed. The PROPERTY OWNER agrees
21 to pay the VILLAGE a reasonable sum for attorney's fees and court costs.
22 12. If either party upon the execution of this Agreement or during the course of
23 performance considers that it is necessary to have the PROPERTY OWNER post
24 additional security to guarantee the performance of his obligations hereunder, the
25 VILLAGE may require the PROPERTY OWNER to post additional security. The
26 VILLAGE may require either a cash deposit or a surety bond guaranteeing
27 performance in a form signed by sureties satisfactory to the VILLAGE. The
28 condition of the security shall be that if the PROPERTY OWNER fails to perform any
29 obligation under this Agreement, the VILLAGE may, act on behalf of the
30 PROPERTY OWNER and use the proceeds of the cash bond, or in the case of a
31 surety bond, require the securities to perform the obligations of this Agreement.
32 13. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the
33 VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions
34 or causes of action for personal injury, property damage or otherwise, including
35 reasonable attorney’s fees, which may arise from the VILLAGE exercising any of its
36 rights or obligations and performance under this Agreement.
37 14. All notices required or to be given pursuant hereto shall be in writing and either
38 delivered personally or by a nationally recognized "over-night" courier service or
39 mailed by United States certified or registered mail, postage prepaid, addressed to
40 the VILLAGE and the PROPERTY OWNER as follows:

1 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on March 17,
2 2022, for which proper legal notice had been achieved and no interested parties appeared, (a)
3 made the appropriate findings of fact as required under Section 118-6(f) of the Skokie Village
4 Code and (b) voted to recommend to the Mayor and Board of Trustees that the requested
5 special use permit be granted subject to the conditions contained in the Plan Commission
6 Report dated April 4, 2022; and
7 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on April 4,
8 2022, concurred in the aforesaid recommendations and findings of fact of the Skokie Plan
9 Commission;
10 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
11 Village of Skokie, Cook County, Illinois:
12 Section 1: That the special use permit requested by the petitioner to establish and
13 operate a limited-service restaurant with a drive-through at the Subject Property, described
14 above and commonly known as 5150 Touhy Avenue, Skokie, Illinois, in B2 Commercial district
15 be and the same is hereby granted and approved subject to each of the conditions set forth
16 below:
17 1. The petitioner shall develop the Subject Property in substantial conformance
18 with the final Village approved site plan dated March 23, 2022, landscape plan
19 dated March 23, 2022, and sign plans and building elevations dated February
20 16, 2022;
21 2. The petitioner shall develop and use the Subject Property in accordance with
22 the site plan approval for this site;
23 3. Any outdoor sound systems shall at all times maintain audio levels that are
24 compliant with the Skokie Village Code;
25 4. No objects are allowed within a 15' sight distance triangle between 30" and
26 84" in height from grade except traffic control devices listed in the Manual on
27 Uniform Traffic Control Devices;
28 5. Trash shall only be allowed within a designated trash enclosure and shall be
29 screened from public view in an enclosure approved by the Appearance
30 Commission. All trash shall be contained in such a way as to remain out of
31 sight at all times, except for waste receptacles referenced below;
32 6. Waste receptacles shall be placed on the Subject Property for the use of
33 customers, and that the Health Department shall determine the size, type, and
34 location of these units, including 1 waste receptacle near the drive-through exit
35 and 1 waste receptacle at the restaurant entrance;
36 7. At least once during every 4 hours of operation and before opening and
37 closing of the business, employees shall patrol the Subject Property and clear
38 it of debris;
39 8. All signage shall conform to the Skokie Village Code, except as provided in
40 this ordinance. Any sign on the Subject Property that is in violation of that
41 Code must be removed or modified to conform with the Village Code prior to
42 the issuance of an occupancy permit;

1 9. The petitioner shall implement any necessary operational improvements to
2 ensure that stacking of vehicles within the drive-through lane will be contained
3 on-site and not impede or obstruct pedestrian or vehicular movements;
4 10. All modifications to building elevations, signage, and landscaping shall be
5 subject to the review and approval of the Skokie Appearance Commission;
6 11. The petitioner shall comply with all Federal and State statutes, laws, rules and
7 regulations and all Village codes, ordinances, rules, and regulations; and
8 12. Failure to abide by any and all terms of this Ordinance shall be cause for the
9 Village to initiate hearings to determine whether the subject Ordinance, as well
10 as any applicable business licenses, should be revised or revoked. The
11 petitioner shall pay all costs related to any hearings conducted as a result of
12 non-compliance with any of the provisions of the enabling ordinance. The
13 costs shall include but not be limited to court reporter fees, attorney fees, and
14 staff time required researching and conducting said hearing.
15 Section 2: That a notice of the approval of this Ordinance incorporating the
16 conditions contained herein shall be executed by the owner of the property in writing and
17 duly recorded with the Cook County Clerk’s Office at the owner’s expense.
18 Section 3: That this Ordinance shall be in full force and effect from and after its
19 passage, approval and recordation as provided by law.

2 more commonly described as 5150 Touhy Avenue, Skokie, Illinois (hereinafter “Subject
3 Property”), petitioned the Village of Skokie for a special use permit to allow outdoor dining at
4 a limited-service restaurant in a B2 Commercial district; and
5 WHEREAS, the Owner is seeking to reconstruct the existing Dunkin’ Baskin Robbins
6 store with the addition of outdoor dining; and

1 WHEREAS, this is a companion case with Plan Commission cases 2022-08P, 2022-
2 09P, 2022-10P and 2022-11P; and
3 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on March 17,
4 2022, for which proper legal notice had been achieved and having heard testimony from
5 interested parties, (a) made the appropriate findings of fact as required under Section 118-6(f)
6 of the Skokie Village Code and (b) voted to recommend to the Mayor and Board of Trustees
7 that the requested special use permit be granted subject to the conditions contained in the
8 Plan Commission Report dated April 4, 2022; and
9 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on April 4,
10 2022, concurred in the aforesaid recommendations and findings of fact of the Skokie Plan
11 Commission;
12 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
13 Village of Skokie, Cook County, Illinois:
14 Section 1: That the special use permit requested by the petitioner to allow outdoor
15 dining at a limited-service restaurant at the Subject Property, described above and commonly
16 known as 5150 Touhy Avenue, Skokie, Illinois, in a B2 Commercial district be and the same is
17 hereby granted and approved subject to each of the conditions set forth below:
18 1. The petitioner shall operate and maintain the Subject Property in substantial
19 conformance with the approved outdoor dining plan;
20 2. Any outdoor sound systems shall at all times maintain audio levels that are
21 compliant with the Skokie Village Code;
22 3. Waste receptacles shall be placed on the Subject Property for the use of
23 customers, and that the Health and Human Services Department shall
24 determine the size, type, and location of these units, including 1 waste
25 receptacle in the outdoor dining area and 1 waste receptacle at the restaurant
26 entrance;
27 4. The use will comply with all standard conditions in Section 118-93(e) of the
28 Skokie Village Code for outdoor dining; and
29 5. At least once during every 4 hours of operation and before opening and
30 closing of the business, employees shall patrol the Subject Property and clear
31 it of debris.
32 Section 2: That a notice of the approval of this Ordinance incorporating the
33 conditions contained herein shall be executed by the owner of the property in writing and
34 duly recorded with the Cook County Clerk’s Office at the owner’s expense.
35 Section 3: That this Ordinance shall be in full force and effect from and after its
36 passage, approval and recordation as provided by law.
