MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 7:30
p.m. on Monday July 18, 2022
Pledge of Allegiance led by Village Clerk Pramod C. Shah.
Mayor Van Dusen called the meeting to order.
The Clerk called the Roll. Those present were Trustees Sutker, Khoeun, Johnson, Pure Slovin , Klein
and Mayor Van Dusen
Motion to permit Trustee Robinson to participate remotely for this meeting.

Trustee Sutker read a statement reflecting on the horrific mass shooting in Highland Park on
Independence Day. She stated the Village should be prepared to a community trauma by
proposing the Village institute a Mental Health Reserve Corps of volunteer licensed mental
health professionals to activate if necessary.

Block Party of the Year Awards presented by Maria Monastero Bueno, Chair, Human
Relations Commission. Awards were presented to: 8037 Lowell (From Keeney St. to Oakton St.),
4334 Madison St. (From Lowell Ave. to Alley before Kostner), and8107 Kostner (From Cleveland Ave.
to Keeney. St. ). Chairman of the Commission and the Mayor thanked the staff, Human Relations
Commission, Elected Officials and the Fire Department for their hard work.

A. Commercial Corridor Storefront Enhancement Program: 5041 Oakton Street.
Motion to approve a grant not to exceed $53,500 for CK Studio Salon located at 5041 Oakton
for work that includes electrical, plumbing, mechanical/HVAC, flooring, drywall, painting and
signage.

Property Maintenance Code and the 2020 National Electrical Code with Local amendments.
Motion to authorize Corporation Counsel to draft the necessary changes.

FIRST READING:
D. An ordinance granting relief from Chapter 10, Section 10-10 of the Skokie Village Code
in order to allow the temporary sale, possession and consumption of alcoholic liquor on the
public right of way and municipal property during specified hours of Skokie’s 15th Annual
Backlot Bash. This item is on the agenda for first reading and will be on the August 1, 2022
agenda for second reading and adoption.
New Business.
A. Discussion regarding referendums.
Trustee Johnson spoke about having deeper conversations about referendums, asking the
Board to use the power of referendum for long term and using it meaningfully. Mayor
Van Dusen responded and said that Corporation Counsel would produce a report for the
discussion. He also spoke about Binding and Advisory referendums. Mayor and Trustees
were open to future discussions for referendums depending on specific matters.
Public Comment.
Emi Yamauchi commented on binding referendums and updates on Carvana.
Patrick commented on Skokie Park District-Drag Queen story hour.
Carrie Bradean also comment on referendums, sustainable matters and the Skokie Park
District story hour.
Kimberly Polka also commented on Carvana’s problems.
Lauren Grodnicki spoke about fireworks, colors and wave lengths and sustainability.
Trustee Robinson stated that the Skokie Community has values-not perfect but strive for
inclusivity for all gender, races and ethnicities.
Public Comments by email.
Opposition to cities policies which approve of any new buildings that are not safe for birds
in flight. No name provided.
Ken Ditkowsky commented about Police going onto a private property to do a wellness
check and ended up seizing a private vehicle. Assistant Village Manager Wyatt gave a
summary of the situation and stated that the Police were legally on the property
conducting a well-being check and had the obligation to tow the vehicle when it was
identified as stolen

Village Clerk Pramod Shah stated that the Mayor will be absent tonight but will
be present thin Zoom.

Mayor Van Dusen relayed a message reflecling on yesterday's Fourth of July and expressing deep
condolences for the Highland Park community as we join them in grieving over the death and trauma,
He thanked the Skokie Fourth of July Parade Committee and Skokie Park District for the decision to
cancel the parade and fireworks.
Tmstee Robinson also read a statement expressing sadness, thanked the emergency response
personnel for their help in the horrific circumstances in Highland Park.

Trustee Johnson recommended that. there be a discussion on the New Business section of
the next meeting of the Skokie Village Board regarding six proposals for referendums on
the November Elections.
Public Comments.
These emails were received from Michelie Pan regarding drive-through restaurants; Lisa
Silverman regarding Fireworks and a suggestion for public safety. Margaret Clarke also
submitted a comment by email.
These citizens spoke at the Board Meeting.
Mr, Burton commented on recycling problems and the traffic at Lincoln, Howard and
Skokie Boulevard.
These residents commented on the tragedy on July fourth in Highland Park-gun violence,
firearms, assault weapons-state wide, gun reform, safe storage; red flag iaws. hate
crimes, domestic terrorism, background checks, fingerprinting, menta! health issues
Margaret Clarke, Laura Williams, Brian Clarke, Barnett Pitzele, Angela Sonagaston,
Denyse Wang Stoneback, Cecilia Ayaia Bland.
Lauren Grodnicki commented on the Green Alley Program and the proposed ballot
referendum.

SUBJECT: Block Party of the Year Award Announcements
The Human Relations Commission reviewed applications for the 2021 Block Party of the Year Awards, a
process which recognizes the efforts of community members to buitd relationships with their neighbors
and promotes quaiity of life for the whole community. Winners will have a sign installed on their blocks
that denote the recognition of this award,
Last year, 63 block parties were organized throughout our Skokie community. Within those 63, 16 block
parties applied for Block Party of the Year Award. Upon reviewing the applications for the Block Party of
the Year Award, we were impressed by the creativity and themes among our Skokie neighbors. The
foiiowing block parties are to be recognized for the 2021 Block Party of the Year Awards on July 18th
Village Board Meeting:
8037 Loweli Ave (From Keeney St. to Oakton St.)
This block party received the most votes with their LOWELLPALOOZA Block Party Parade Theme had
water balloon toss, side-walk chalk, neighbor pot-luck, and various activities for the adults and kids going
on al! day long. The neighbors came out in full force with a parade, theme, eating together as neighbors
and a full gathering. A true spirit of bringing a "palooza" to Skokle!
4334 Madison St. (From Loweli Ave. to Alley before KostnerAve,)
The theme of this block party each year is "BYOP" Bring Your Own Pumpkin! And this year, they out did
themselves with their Hatloween theme, huge pumpkin jump house for the kids, costume contest,
outstanding pumpkin carvings and a ton of pot-luck food, and of course, CANDY!
8107 KostnerAve. (From Cleveland Ave. to Keeney St.)
The best parties are the ones where other blocks come and join in on the fun, and 8107 welcomed other
blocks showing their true Skokie Spirt! They had a donut eating contest, face painting, a craft station,
bounce house and a bike parade during the day. But that is not all! Once the sun went down, the
projector went up and the popcorn came out! The aduits made a fire pit and they watched a movie
outdoors for the kids, while the aduits shared stories about the block from the older neighbors to the new
neighbors. Again, sharing the true spirit of what Block Parties are all about!

A. CQmmercial Corridor Storefront Enhancement Program: 5041 Oakton Street.
Cristina Hotca, longtime owner of CK Studio Salon at 8040 Lincoln Avenue, and
her husband Tarik Khribech, have applied for funding under the Commercial
Corridor Storefront Enhancement Program (SEP). Cristina and her husband
purchased the 2-unit, 5,700 s.f. building (previously leased by Subway and other
businesses at 5041-5043 Oakton Street) based in part on all the new
development and investment occurring in Downtown Skokie. This new location
will triple the size of the current CK Studio space to over 3,760 s.f. as weli as
increase the total number of employees from 8 to up to 26 during the first 18-24
months. The couple also has listed a smaller space (1,940 s.f.) on the eastern
side of the facility with the goal of leasing to a complimentary business to the
salon, such as a cafe, service/retaiier
The applicant has received several bids for the major components of the interior
and exterior work. The work includes electrical, plumbing, mechanical/HVAC,
flooring, drywall, painting and signage. The lowest estimate for the eligible
investments and improvements to be undertaken totals approximately $275,000
and, of that, approximately $59,802 is deemed eligible for reimbursement.
Therefore, the total Village SEP grant recommended is a maximum $50,000 plus
$3,500 in design/architecturat fees. The total SEP grant will not exceed $53,500,
which would be transferred to the owner following the completion of all the work,
fina! inspections and submitta! of all required documentation.
Mayor and Board approval for a grant not to exceed $53,500 is respectfully
requested for CK Studio Salon, located at 5041 Oakton Street.
B. Building Codes and Other Code Amendments.
The Community Development and Fire Departments are recommending updates
to various Building Codes including adoption of the 2021 International Buiiding
Code, the 2021 Internationa! Residential Code, the 2021 International Mechanical
Code, the 2021 International Fuel Gas Code, the 2021 International Property

Maintenance Code and the 2020 National Electrical Code with local amendments.
These proposed codes are the latest editions. The codes contain the latest
updates for use of materials, construction methods and safety as well as updates
for energy efficiency. I concur with staff's recommendation. The Mayor and Board
are respectfu!ly requested to authorize Corporation Counsel to draft the necessary
changes.
C. North Shore Center for the Performing Arts in Skokie (NSCPAS) Entry
Canopies Restoration Design Services - The HOH Group, Inc., Schaumburg,
Illinois-$32,000.
The North Shore Center for the Performing Arts in Skokie has secured a $250,000
grant from the Daniel F. and Ada L. Rice Foundation for the purpose of restoring
and improving the appearance of the exterior entry canopies at the NSCPAS
facility. The canopies at the north and west entrances are showing signs of wear
and fatigue and the lighting is in poor condition. Four bid responses were
received, and it is recommended that a contract for architectural services in the
amount of $32,000 be awarded to The HOH Group. I concur with staff's
recommendation and respectfully request Mayor and Board approval.
D. Proprietary Purchase of Fire Safety Gear - W. S. Darlev & Company, Itasca,
Illinois - $47.750.
Fire safety gear is an integral and necessary component of personal protective
equipment worn by all sworn members of the Fire Department Based upon
industry standards, manufacturer's recommendations and due to the routine
exposure to heat, smoke, and wear and tear, fire safety gear only has a useful life
of five years. The FY2023 Capital Improvement Program (CIP) Budget provides
funding for the replacement of 17 complete sets of firefighter safety gear that were
original!y purchased more than five years ago. It is recommended that a contract
for the purchase of 17 complete sets of fire safety gear in the amount of $47,750
be awarded to W. S. Darley & Company, Itasca, tliinois, an authorized dealer of
innotex gear to meet the needs of the Skokie Fire Department, i concur with
staff's recommendation and respectfully request Mayor and Board approval.

COMMERCIAL CORRIDOR STOREFRONT ENHANCEMENT
PROGRAM: 5041 OAKTON STREET
The Village of Skokie seeks to enhance the overall marketability and stability of primary
and neighborhood commercial areas within Skokie. To that end, the Village created the
Commercial Corridor Storefront Enhancement Program (SEP) in 2016 (recently amended
in 2022) and which is paid out of the Economic Development Fund. Similar to the
Village's successful Tax Increment Finance (TIF) funded interior renovation and exterior
facade grants, this program is designed to spur redevelopment and enhance properties
along the primary commercial corridors not currently included within the boundaries of
the Village's three existing TIF districts. This grant rebate program is offered on a
competitive (first come, first served) basis and limited to ground floor commercial space
within any areas zoned Bl, B2, B3, NX, TX or CX.
Eligible property owners or tenants may apply for exterior storefront improvement grant
rebates from the Village using a 60% (applicant) / 40% (Village) cost-sharing basis for
approved construction costs up to a maximum of $30,000. Priority is extended to retail
and/or restaurant uses. Interior renovation assistance is also available for retail or
restaurant uses only. Interior assistance applicants are eligible for grant rebates from the
Village of up to $30,000 on the same 60/40 cost-sharing basis or, if combined with an
exterior storefront improvement grant (as per above), the maximum level of combined
assistance is $50,000. Architectural/design fees of up to $3,500 are eligible (where
applicable) for reimbursement in excess of the interior and/or exterior grant totals.
Cristina Hotca, longtime owner ofCK Studio Salon at 8040 Lincoln Avenue, and her
husband Tank Khribech, have applied for funding under the SEP. This request would be
the 26 SEP project to be implemented since inception. For over 20 years in Romania
and in the U.S., Cristina has cultivated a strong customer base for CK Studio's
professional hair treatment services and has been named a top-rated (#1 Chicago Blonde
specialist) salon by clients and hair professionals in the area. Since 2012, Ms. Hotca has
employed several widely regarded hair stylists at her salon on Lincoln Avenue and
uses/sells high quality products for maximum results for their clients. Following a multi-
year, Village-wide search for property which would allow for a considerable expansion
of her Downtown Skokie business, Cristina and her husband purchased the 2-unit, 5,700

s.f. building (previously leased by Subway and several other businesses at 5041-5043
Oakton Street) based in part on all of the new development and investment occurring in
Downtown Skokie. This new location will triple the size of the current CK Studio space
to over 3,760 s.f. as well as increase the total number of workers from 8 employees to up
to 26 during the first 18-24 months. The couple also has listed a smaller space (1,940 s.f.)
on the eastern side of the facility with the goal of leasing to a complimentary business to
the salon, such as a cafe, service/retailer.
The proposed new interior site layout and design concepts for the salon is included in the
attached rendering. The interior work to be completed represents a substantial upgrade to
a current raw space that was re-built following a fire in the former restaurant. The
applicant has received several bids and/or invoices for the major components of the
interior and exterior work required to transform this space into a high-end salon. These
improvements include electrical, plumbing, mechanical/HVAC, flooring, drywall,
painting, and signage. The lowest estimate for the construction investment and eligible
improvements to be undertaken totals approximately $275,000 and, of that,
approximately $59,802 is deemed eligible for reimbursement. Therefore, the total Village
SEP grant recommended is a maximum $50,000 plus $3,500 in design/archkectural fees.
Funding will only be transferred to the owner following completion of all work, final
inspections, and submittal of all required documentation. The applicant is aware that
they will need to provide copies of all bids, contracts, contractor invoices, paid receipts,
cancelled checks and waiver-of-liens as proof of payment prior to reimbursement by the
Village.
I respectfully request Board approval of a Commercial Corridor SEP rehabilitation grant of a
maximum of $53,500 to be issued on behalf of CK Studio. Ms. Hotca and Mr. Khribech will
be present at the July 18th meeting to respond to any questions. Thank you.

CODE AMENDMENTS
The Community Development and Fire Departments have been reviewing the Village codes to
determine that they are up to date and to eliminate conflicts with other codes. As a result of this
analysis, staff recommends the following building related codes be adopted, with amendments,
which are further defined in the attached modified code sections.
The Village enforces numerous building construction codes to protect the health and safety of
residents and businesses in the Village. These codes are generally state and national codes that are
modified by the Village to address local conditions and special enforcement needs. These codes are
updated on a regular basis to address changes in building construction and materials. The
maintenance of current codes is also required to uphold the Village's ISO ratings. There are many
advantages in using this set of model codes. The consistency in public health, safety and welfare
requirements across the country helps moderate construction costs by allowing new materials,
products and methods of construction. Local amendments are also recommended to some of these
codes to reflect area construction methods and to increase safety.
At this time, staff is recommending the adoption of the following National and International
Building Codes with local amendments:

Although it was staffs intent to revise all construction codes at one time, the Illinois Energy
Consen/ation Code 2012 and State of Illinois Plumbing Code 2014 have not been revised by the
State of Illinois and are not being presented for adoption at this time. The Village must adopt these
codes by reference and enforce them without any local amendments when the State completes its
revisions.

Staff is recommending that the International Building Code 2021, International Mechanical Code
2021 and International Fuel Gas Code 2021 be adopted with only minor modifications such as the
deletion of unused sections, renumbering of paragraphs, and a few safety modifications. The 2021
International Building Code applies to all structures except for one" and two-family dwellings. The
code covers all aspects of new building construction and existing building renovation. The 2021
International Mechanical Code establishes regulations for the design and installation of mechanical
systems, appliances, duct and ventilation systems, combustion air provisions, hydronic systems and
solar systems. The code also protects the people who install and maintain the system. The 2020
National Electrical Code deals primarily with the installation and maintenance of electrical systems
in all building types and the connection of electrical equipment and appliances. Only minor
amendments are being proposed that deal with ground fault and voltage regulations. The 2021
international Fuel Gas Code regulates the design and installation of fuel gas distribution piping and
systems, appliances, appliance venting systems, combustion air provisions, gaseous hydrogen
systems and motor vehicle fuel dispensing stations. Fuel gas includes natural, Uquified petroleum
and manufactured gases and mixtures of gases. This code is important for the regulation of piping
in commercial and residential uses.
The 2021 International Residential Code addresses the design and construction of one- and two-
family dwellings and townhouses. As with the other construction related codes, this code has been
adopted on a regular basis with local amendments. The only significant local amendment that staff
is recommending at this time is related to the requirement for residential fire sprinkler systems in
Sec.22-63(58). The code currently requires that all new residences and building additions which
increase the floor area of a residence by more than 50 percent of the original square footage of the
building have sprinkler systems. The requirements have worked well for new residences; however^
property owners are avoiding the sprinkler system requirement for additions by reducing their size
below the 50 percent size threshold and then making extensive renovations to the existing
buildings. In many cases property owners are creating totally new and expanded homes without
sprinkler protection. Staff is recommending that this loophole be eliminated with the following
requirements:
An automatic fire sprinkler system is required for:
A. Any new construction of a residence.
B. Building additions that increase the floor area of such residence by 50 percent or more of the
original square footage of the building prior to construction.
C. Building additions less than 50% of the existing structure's square footage, plus alterations
to the existing structure that equals 80% or more of the existing square footage.
D. Alterations that affect 80% or more of the existing structure's square footage.
Each year there are 6 to 12 fires in one- and two-family dwellings and townhouses. Fortunately,
there have not been any residential deaths because of fire; however, property damage has been
extensive. The proposed amendments will reduce the potential injury, death and extensive property
damage from a fire. The estimated cost of a sprinkler system for a residence is between $13,900 and
$20,000. There may also be an additional cost of a new Village water service line to the residence
that could cost between $7,000 and $13,500 dollars. Currently 9 of 24 building projects submitted
between January 1, 2022 and June 30, 2022 required a sprinkler system. With the proposed
amendment an additional 4 projects would have required a sprinkler system during the same period.
Staff is also proposing the adoption of the 2021 International Property Maintenance Code with local
amendments. This code establishes operating and maintenance requirements for all structures and
properties in the Village.

Sec. 22-31. - International Building Code adopted.
Pursuant to authority granted by 65 ILCS 5/1 -3-2, the Village hereby adopts by reference the International
Building Code, 2012 2021 edition/ as published by the International Code Council, Inc., as the building
code/ excepting those provisions that are modified or deleted as provided in this article.

The provisions of the State of Illinois Plumbing Code, as amended/ shall apply to all plumbing systems

Section 111 Certificate of Compliance,
111.1 General. A certificate of compliance shall be required priortooccupancyoruseofany buHding or structure
for which a building permit has been issued.
111.2 Compliance with codes. No certificate of compliance shall be issued unless a building or structure has been
completed in accordance with the building permit and all applicable codes/ ordinances and rules and regulations
of the Village.
111.3 Inspections. Upon written application and payment of the fees required in Chapter 46 Article IV/ of the
Village Code by the owner/ building permit holder or their designated agent/ the Village Manager or designee
may issue a certificate of compliance. A certificate of compliance shall only be issued after inspection by the
Building, Fire/ Engineering, Plumbing/ Electrical/ and Health Inspectors of the Village to determine whether the
building or structure has been completed in accordance with the building permit/ plans and specifications and
compliance with all codes, ordinances and rules and regulations of the Village.
111.4 Partial approval. In the case of a multi-unit structure or building, or complex of buildings/ a certificate of
compliance may be applied for as provided above for any unit, section, floor/ or building in case of a complex of

buildings/ provided that all common areaways and facilities serving the unit, section, floor or building have been
completed in accordance with the permit/ plans and specifications and compliance with all codes/ ordinances
and rules and regulations of the Village.
111.5 Conditional approval. A conditional approval of a certificate of compliance may be issued as hereinafter
provided prior to completion of exterior parking requirements, sidewalks, driveways and landscaping, upon
determination by the Village Manager or designee that seasonal weather conditions are unfavorable for exterior
construction or other factors that prevent the completion of work in a timely manner. Conditional approval of a
certificate of compliance shall only be issued upon the Village s receipt from the owner or building permit holder
of a cash deposit in an amount equal to 110 percent of the exterior construction to be performed. The cost shall
be determined by the Village Manager or designee. The owner or building permit holder shall agree in writing to
complete the exterior construction in accordance with the plans and specifications on or before a date certain
as determined by the Village Manager or designee. Upon completion of all exterior construction in compliance
with the building permit plans and specifications and all codes, ordinances and rules and regulations of the
Village, as specified in this subsection, the Village Manager or designee shall refund the cash deposit. Further/
the written agreement shall provide that, upon failure of the owner or building permit holder to satisfactorily
complete the exterior improvements within the prescribed time, the cash deposit shall be forfeited and the
Village shall have the right, without further notice, to cause the work to be performed in accordance with
procedures established for public improvements. If the cash deposit is insufficient to cover the cost incurred by
the Village to complete the work, the owner or building permit holder shall be responsible for the insufficient
amount. If such amount is not paid/ the Village shall have the right to place a lien on the property that has
benefited from the work for the insufficient amount.

{44) (17) 115.4 Unlawful continuance. Insert the following after the word penalties as required under Section
1-6 of the Village Code.
{^S} (18) Add Section 117 Construction Hours. The erection/ demolition/ alteration/ or repair of any building or
site work requiring a permit is prohibited between the hours of 6:00 p.m. and 7:00 a.m. and Sundays and
holidays except in case of an emergency in the interest of public health
and safety, and then only with written permission from the Village Manager or designee. Such permission may
be granted for a period not to exceed 3 days while the emergency continues and may be extended for an
additional 3 days if the emergency continues.
{16)-(19) 310.1 Residential Group R. At the end of the fast sentence, add the following:
Allowable occupancy shall be defined by the Village Zoning Ordinance.

c. The area in the basement shall be signed as directed by the Fire Chief or designee with a 24-inch square
sign, or multiple signs if determined appropriate, with the following text in red 2-inch letters on white
background: Limited Access Basement Area for Employees Only No Production or Continuous Operation in this
Basement'';
D. Exiting from the basement is otherwise provided in compliance with the Building Code;
E. A sprinkler system is not required by other portions of the Building Code.

orchestra floor or platform lift without first having secured a permit. Applications for a permit shall be
accompanied by such drawings and specifications as shall be necessary to inform of alterations/ and the location
thereof. If the drawings and specifications show that the equipment to be installed or altered is in conformity
with the building provisions of this code, the Village Manager or designee shall cause a permit to be. issued,
provided that all permit fees have been paid.
{^(34) Add 3001.5.2 Inspections. Every elevator, movable stage, movable orchestra floor, movabfe platform/
dumbwaiteror escalator shall be inspected under the direction of the Village Manager or designee at least once
every 6 months, and no new equipment shall be placed in operation until an inspection of such equipment has
been made. When the required inspection shows that ail equipment and safety devices are in good working
condition and good repair/ it shall be the duty of the Village Manager or designee to cause to be issued a
certificate setting forth the result of such inspection and tests and containing the date of inspection, the weight
which such equipment will safely carry, and a statement that all equipment complies with the applicable
provisions of the code. It shall be the duty of the Village Manager or designee to order that all equipment found
to be in an unsafe condition be stopped and remain inoperative until equipment is found to be in compliance
with all provisions of this code.
{33)(35)Add 3001.5.3 Display of certificate of inspection. It shall be the joint duty of the owner, agent/ lessee/ or
occupant of the building in which such equipment is located and of each person in charge or control of such
equipment to frame the certificate and place the certificate in a conspicuous place in each elevator and near

3009.3 Exemption, Elevators in buildings that are four to seven stories are exempt from Section 2.27.3 of the
ASMEAl7.1,if, priortojanuary I/2010, they are equipped with systems approved by the Skokie Fire Department
that provide for: (i) a fire alarm system with smoke detection; and (ii) an activation system that notifies the Skokie
Fire Department or other central station.
{36)(39) Add 3303. Demolition.
3303.7 Definition. Demolition is the dismantling or razing of all or part of a building or structure, including all
operations thereto.
3303.8 Demolition Permit. A permit for demolition of a building or structure shall be issued under either Section
3303.8.1 or Section 3303.8.2.
3303.8.1 Concurrent Demolition. Where a demolition permit and building permit are issued at the same time
and construction will begin immediately following demolition/ or
3303.8.2 Demolition Only. Where oniy a demolition permit is issued and a building permit has not been applied
for and/or construction will not begin in less than 30 days.
3303.9 Site condition. After the demolition of a building or structure as allowed by Section 3303.8.2 and the
removal of debris, the following requirements must be met:
3303.9.1 Purpose. A written statement, which shall include the intended purpose of leaving the site vacant, must
be submitted by the property owner to the Community Development Director or designee.
3303.9.2 Grading Plan. A grading plan, prepared by an Illinois Registered Civil Engineer/ must be submitted to the
Community Development Director or designee, The grading plan shall be submitted for approval by the Village
Engineer.
3303.9.3 Sodding or Seeding. Black topsoil shall be spread four (4) inches deep over the entire surface of the
property; and the soil shall be seeded for grass or sodded within thirty (30) days of demolition or the
commencement of seasonable weather/ i.e., April 1 5 through October 1 5 inclusive/ If seeded/ seeding shall be
established at a minimum of five (5) pounds per one thousand (1000) square feet and shall be an approved
commercial perennial blend. Once seeded or sodded/ the grass shall be maintained. If necessary, it shall be
replaced or reseeded or re-sodded until such time as the grass takes hold/ grows and survives. Grass shall be
mowed on a regular basis and shall not exceed 6 inches in height.
Exception: If the submitted grading plan indicated in 3303.9.2, includes paved areas and the property owner
requests that paved areas on the site remain/ the Community Development Director must approve such a plan
or request. In order for the Community Development Director to approve the request for paved areas to remain
on site/ the following minimum requirements must be met:
1. The area to remain paved must be properly paved/ curbed/ drained, striped, and landscaped pursuant to the
Village Code;
2. The property owner must indicate in writing that these parking areas are intended for reuse in the future;
3 . The parking spaces must be made available for general public parking use;
4. The parking tot and landscaping must be maintained to Village standards; and
5. The property owner shall indemnify the Village for any and all liability related to the public use of the lot.

3303.9.4 Signage. Any vacant property with a non-residential zoning/ or any property with a residential zoning
but with a non-residential use/ must be posted with a sign no smaller than two feet by two feet and no larger
than four feet by eight feet. Such a sign must provide the name, address, and telephone number of the
property owner or agent. The sign must be placed so that the wording shal! be legible from the public way. Any
and all obsolete signs shall be removed from the property.

(b) The Village Manager or his designee shall have the authority to issue a stop work order or revoke a

ineffective; or
(3) The necessary precautions as specified in the tree preservation plan were not undertaken before

(1) 210.8 (A) (5) Ground-Fault Circuit-lnterrupter Protection Basement receptacles Add exception no. 2 to
(5): Receptacles serving sump pumps, ejector pumps, lift stations and similar pumps shall not be
required to have GFCI protection provided there is only one receptacle outlet on a single yoke or
device. Such receptades shall be clearly marked with circuit number and disconnect location.
(2) 210.8 (F) Ground-Fault Circuit-lnterrupter Protection outdoor outlets Amend by adding exception no.
1: GFI protection shall not be required for A/C condensers or other HVAC equipment if a separate
equipment grounding conductor sized in accordance with 250.122 is installed throughout the raceway,
and bonded, as outlined in 250.96 from the branch circuit panelboard to the equipment. The use of
listed bonding bushings at all conduit penetrations of enclosures and disconnecting means is required.
(3) 210.12 (A) Arc-Fault Circuit-lnterrupter Protection Amend by adding exception no. 2: AFCI protection
shall not be required for branch circuits supplying kitchen counter outlets, kitchen appliances,
furnaces, motors, pumps, and other equipment or appliances that may arc during normal operation.

(10) 705.11 (D) Supply Side Source Connections Modified as follows: The connection of power source output
circuit conductors to the service conductors shall be made using listed connectors as described in 110.14 and
comply with all enclosure fill requirements. No such connection is permitted to be made in a meter socket
enclosure which does not meet modern wire bending requirements such as W base enclosures or to
conductors having cloth covered rubber insulation. Any modifications to existing equipment shall be made in
accordance with the manufacturer s instructions or the modification must be evaluated for the application
and have a field label applied. For meter socket enclosures or other equipment under the exclusive control of
the electric utility, only connections approved by the electric utility shall be permitted.
The following shall be added to the adopted electrical code as an addendum.
a. Copper wire shall be used for all ground conductors and water meter pumps.
b. All non-metallic raceway or cable types are prohibited and associated code articles and
requirements are effectively deleted. Electrical metallic tubing, rigid conduit or intermediate metal
conduit shall be used to enclose all branch circuit wiring. Flexible metal conduit (types FMC, MC, AC,
LFMC) may be used in accessible locations with its cumulative length limited to 6 feet and a
dedicated equipment grounding conductor. In other than accessible locations, special permission
may be granted for lengths in excess of 6 feet on a case by case basis.
c. Sub-panels will not be allowed to be added to single phase 100 Amp services.
d. Ground clamps and hubs used to form all portions of the grounding electrode conductor and
required jumpers shall be listed for direct burial or wet location.

equipped with a heavy-duty deadbolt to be readily openable from the side from which egress is to be made
without the need for keys/ special knowledge or effort and shall have a minimum lock throw of 1 inch. The
door shall also have a heavy-duty door knob-in-lock set with a dead latch mechanism. Such locks shall be
installed according to the manufacturer s specifications and maintained in good working order. The locks shall
be installed with a heavy-duty four-screw strike plate installed with 3-inch screws to penetrate into a door
frame. For the purpose of this section/ a sliding bolt shall not be considered an acceptable deadbolt lock. Each
access door- shall also be of solid wood or metal construction and be equipped with a wide angle 160°
peephole mounted no higher than 58 inches from the floor. Doors that do not meet these requirements or do
not have the required locks/ peephole or strike plate must be brought into compliance upon the replacement
of the door or the sale of the rental property/ whichever comes first.

sale of automotive products shall supply at least one approved covered container for litter at the main

removal of litter every four hours. Relief from this requirement may be granted if there is no place to locate
a container, the main entrance to the premises abuts a public sidewalk, or the business is located in a
shopping center where litter containers are provided by the center's management.

Entry Canopies Restoration Design Services
Background:
The NSCPA Foundation has secured a $250,000 grant from The Daniel F. and Ada L. Rice
Foundation for the purpose of restoring and improving the appearance of the exterior entry
canopies at the NSCPA facility. The canopies at the north and west entrances of the building are
showing signs for wear and fatigue. The finishes and facades are failing, and the lighting is In
poor condition.
As the first step of this endeavor, it is necessary to engage an architect to develop a design
program for restoration and follow through with oversight of the eventual
restorations/constmction. In anticipation of this work, the Village issued a Request for
Qualifications (RFQ) for Architectural Services and on April 14, 2022 a total of four responses
were received. An Evaluation Committee consisting of NSCPA's General Manager Michael
Pauken and Manager of Facility Chris Fitzgerald; Village Director of Marketing and
Communications Ann Tennes, Assistant Village Manager Nick Wyatt and Assistant Finance
Director Mike Aleksic was formed in order to review the proposals and to select the best
qualified firm. The submitting firms were as follows:
The HOH Group Inc., Schaumburg, IL.
Architectural Consulting Group Ltd., Bamngton, IL.
Joseph S. Bibat, Chicago, IL.
Sumac Inc., Chicago, IL.
After a thorough review of the qualifications, it was determined by the committee that The HOH
Group was best qualified to take on this project. HOH has extensive experience and a successful

track record with similar projects. The Village requested a proposal from HOH for the provision
of project services as specified in the RFQ.
Recommendation:
Staff recommends that a contract for Architectural Services be awarded to The HOH Group in
the amount of $32,000. Services include the inspection and review of the current condition of
the canopy structures, schematic design of the improvements/restoration, review of design
development with NSCPA and Village staff, production of drawings and construction
documents, and construction supervision and contract administration. It is anticipated that the
project could be designed and constructed by the end of calendar 2022, however this schedule is
contingent on weather and the ongoing roofing work at NSCPA.
Comments:
This project will provide a fresh new look for the NSCPA building. New lighting and facades
are the major components of this project and these upgrades will improve the building's
appearance and the overall experience for the customers.
Although the Village has not worked with The HOH Group previously, they have excellent
references from the Chicago Department of Aviation, Great Lakes Medical Investments LLC.
and Salvation Army.

Background:
The Skokie Fire Department's annual review and evaluation of protective safety gear has
again identified Innotex brand fire safety gear to provide the best combination of thermal
protection, breathability, weight, flexibility, bloodborne pathogen protection, and
durability. Innotex fire safety gear has met the needs of the Skokie Fire Department and
has become the standardized brand issued to all sworn members of the Department.
The Skokie Fire Department's cancer reduction initiative includes the issuance of a
second set of fire safety gear to each member. When a firefighter's primary set of fire
safety gear becomes contaminated with cancer causing carcinogens, commonly found in
products of combustion (smoke), the firefighter temporarily utilizes their secondary set of
fire safety gear while the primary set goes through an extensive in-house decontamination
process. The consideration of a secondary set of fire safety gear not only reduces the
member's continuous exposure to fire safety gear that is saturated with carbon and other
cancer-causing chemicals but reduces the Village of Skokie's liability cost for a member
that is stricken with cancer or other debilitating effects from such chemicals. It also
ensures personnel are able to respond to the next emergency with essential personal
protective equipment.
Based on industry standards, manufacturer's recommendations, and the routine exposure
to heat, smoke, and wear and tear; a primary set of fire safety gear has a useful life of five
years of front-line service before being downgraded to a secondary (backup) set for an
additional five years. The FY 2023 CIP budget provides funding for a structured fire

safety gear replacement program, which replaces obsolete or non-compliant gear and the
purchase of secondary sets of fire safety gear to meet our cancer reduction initiative. This
annual program allows for a more fiscally responsible approach toward timely
replacement as well as protecting our most valuable asset, our fireflghter/paramedics.
Recommendation:
It is recommended that the purchase of seventeen (17) complete sets of fire safety turnout
gear be awarded to W. S. Darley & Company, Itasca, Illinois, an authorized dealer of
Innotex gear, in the amount of $47,750.00. The Skokie Fire Department has successfully
partnered with W. S. Darley & Company on numerous safety equipment purchases in the
past.
Comments:
Fire safety gear is an integral and necessary component of personal protective equipment
worn by all sworn members of the Department. Fire safety gear provides personal
firefighter protection from the environment encountered while operating at structural
firefighting incidents, auto extrication, hazardous material spills, and other associated
emergency responses. Manufactured out of the latest fire-resistive materials, each set of
fire safety gear consists of protective inner and outer coat and pant shells, suspenders,
uniquely designed outer and inner pockets, knee protection pads, and reflective outer
safety markings.

*A. Ordinance, 2022-14P, Special Use^ Outdoor Storage, 5363 Lincoln Avenue
Item A is on the consent agenda for second reading and adoption. The first reading was
on June 7, 2022.
This ordinance wi!l grant a special use permit to allow outdoor storage at an existing
convenience store for the purposes of storing and exchanging propane tanks. The total
storage area will be 40" x 72" x 27". Tanks will not be filled on site.
*B. Ordinance, Code Amendment, Chapters 38 and 50 Fire Code Amendments
Item B is on the consent agenda for second reading and adoption. The first reading was
on July 5, 2022.
This ordinance will amend Chapters 38 and 50 of the Skokie Village Code, in part by
adopting the 2021 editions of the International Fire Code (hereinafter "!FC") and the Fire
Prevention Code, NFPA Life Safety Code (hereinafter "Life Safety Code"). The Village
currently utilized the 2012 editions. The Fire Chief and Interim Community Development
Director have reviewed 2021 editions of IFC and the Life Safety Code and based upon their
analysis, they have recommended the 2021 editions of these codes be adopted along with
specified amendments, which are in the attached modified sections of the Village Code,
as stated in their Memorandum, dated July 5, 2022. By adopting the 2021 Editions of the
IFC and Life Safety Code, and the proposed amendments, it will provide contemporary
codes to promote life-safety and property protection, while supporting community
development with new construction, renovation, and repurposing of existing structures.
*C. Ordinance, Code Amendment, Chapters 26 and 46, Garage Sales
item C is on the consent agenda for second reading and adoption. The first reading was
on July 5, 2022.
This ordinance wil! amend the Chapters 26 and 46 of Village Code pertaining to garage
sales. From time to time, Village staff will review various sections of the Village Code for
efficiency and feasibility. Village staff, which works to address various code issues,
reviewed the Village Code pertaining to garage sales. Included in that review were the
ordinances of surrounding communities, with the goal of furthering the Village's
sustainability efforts by increasing the number of opportunities for residents to sell
unwanted items instead of disposing them in the landfill. The changes are as follows:

• Increase the number of garage sales allowed each year from one to three.
• Decrease the permit fee for each garage sale from $10 to $5.
• Allow a maximum of two (2) signs advising of the sale in the public right-of-way.
Signs cannot be placed on any trees, lights standards, telephone poles or other
support structures.
• Permit the Village Manager to establish one weekend (Friday, Saturday &
Sunday) each year as a "Community Wide Garage Saie", in addition to the three
allotted garage sales.
D. Ordinance. Temporary Sale and Consumption of Alcoholic Liquor on Public Right
of Wav and Municipal Property - Backlot Bash 2022
Item D is on the agenda for first reading and will be on the August 1, 2021 agenda for
second reading and adoption.
This routine Backlot Bash ordinance will grant temporary relief from Chapter 10, Section
10-10, of the Skokie Village Code pertaining to the possession and consumption of
alcoholic liquor on Village owned property. On August 26, 27 and 28, 2022, the Skokie
Park District is sponsoring Skokie's 15th annual Backlot Bash. The festival and carnival
will utilize Village owned parking lots and portions of the public ways. The Skokie Park
District has applied for and received a temporary liquor license for the T/i day event. As
in previous years, the Park District will restrict the consumption of alcoholic liquor to a
defined and fenced-in area which wiii include portions of the public right of way of Oakton
Street, the Village Hall parking lot and the Village Green.

WHEREAS, the Skokie Plan Commission, at a public hearing duly held on May 5, 2022,
for which proper legal notice had been achieved and no interested parties appeared, (a) made
the appropriate findings of fact as required under Section 118-6(f) of the Skokie Village Code
and (b) voted to recommend to the Mayor and Board of Trustees that the requested special use
permit be granted subject to the conditions contained in the Plan Commission Report dated June
7, 2022; and
WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on June 7,
2022, concurred in the aforesaid recommendations and findings of fact of the Skokie Plan
Commission;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Skokie, Cook County, Illinois:
Section 1: That the special use permit requested by the petitioner for outdoor storage
to support propane tank sales at 5363 Lincoln Avenue, described above, in a B1 Service
Commercial district, be and the same is hereby granted and approved subject to each of the
conditions set forth below:
1. The petitioner shall develop the Subject Property in substantial conformance with the final
Village approved site and landscape plan dated June 16, 2022;
2. New parking lot and exterior lighting shall meet Illuminating Engineering Society of North
America (IES) standards, be full cut-off design, and be directed away from adjacent
properties, subject to the approval of the Engineering Division;
3. Any outdoor sound systems shall at all times maintain audio levels that are compliant with
the Skokie Village Code;
4. All existing damaged public sidewalks or public sidewalks damaged due to the
implementation of this plan shall be replaced;
5. No objects are allowed within a 10' sight distance triangle in R1, R2, R3, and R4 districts,
or within a 15' sight distance triangle in all other districts, between 30" and 84" in height
from grade except traffic control devices listed in the Manual on Uniform Traffic Control
Devices;
6. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
landscaping, structures, and any other facilities or infrastructure on the Subject Property
shall be maintained in a good state of repair, and when needed, be repaired or replaced
in a timely manner;
7. All private and public sidewalks shall be maintained free of snow, ice, sleet, or other
objects that may impede travel;
8. Trash shall only be allowed within a designated trash enclosure and shall be screened
from public view in an enclosure approved by the Appearance Commission or Community
Development Director. All trash shall be contained in such a way as to remain out of sight
at all times, except for waste receptacles referenced in Condition Number 26 below;
9. Waste receptacles shall be placed on the Subject Property for the use of customers, and
that the Health and Human Services Department shall determine the size, type, and
location of these units;
10. All off-street parking spaces shall be legibly striped and maintained;

11. Any plan to modify parking lot striping must be approved by the Director of Engineering;
12. The proposed development shall have a minimum of 8 off-street vehicle parking spaces
including 1 handicapped parking space, and a minimum of 1 bicycle parking space, as
indicated on the Subject Property plan dated June 16, 2022;
13. The handicapped parking spaces shall be installed and maintained in compliance with State
of Illinois Accessibility Standards and the Skokie Village Code, including required signage;
14. Vehicles shall not be allowed to be parked in or otherwise block common driveways,
sidewalks, aisles, or other points of access at any time, shall only be parked in designated
parking spaces, and shall not overlap the striped lines of designated parking spaces;
15. The owner of the Subject Property [and its tenant] shall ensure that employees park on
the Subject Property;
16. No required parking space on the site may be for the exclusive use of any tenant;
17. The petitioner shall sign an "Agreement for Installation and Maintenance of Landscaping"
to assure that the Subject Property and parkway landscaping is completed and
maintained, including trimming, watering, and replacing of dead plant materials in a timely
manner in accordance with the final approved landscape plan. A copy of said Agreement
is attached hereto, marked Exhibit “A” and hereby made part of this Ordinance. This
“Agreement for Installation and Maintenance of Landscaping" shall be recorded at the
petitioner’s expense;
18. All new construction, alterations, and remodeling shall meet current International Building
and NFPA Life Safety Codes as amended;
19. The petitioner shall obtain all required permits and approvals for improvements to County,
State, or Federal rights-of-way from the governing jurisdiction;
20. All signage shall conform to the Skokie Village Code. Any sign on the Subject Property
that is in violation of that Code must be removed or modified to conform with the Village
Code prior to the issuance of an occupancy permit;
21. All modifications to building elevations, signage, and landscaping shall be subject to the
review and approval of the Skokie Appearance Commission;
22. The petitioner shall submit to the Planning Division electronic files of the site plan and
landscape plan in their approved and finalized form;
23. Prior to the issuance of building permits, the petitioner shall submit to the Planning
Division of the Community Development Department the name, property address, email
address, and telephone number of the company and contact person responsible for site
maintenance in compliance with this special use permit;
24. The petitioner shall comply with all Federal and State statutes, laws, rules and regulations
and all Village codes, ordinances, rules, and regulations;
25. Failure to abide by any and all terms of this Ordinance shall be cause for the Village to
initiate hearings to determine whether the subject Ordinance, as well as any applicable
business licenses, should be revised or revoked. The petitioner shall pay all costs related
to any hearings conducted as a result of non-compliance with any of the provisions of the
enabling ordinance. The costs shall include but not be limited to court reporter fees,
attorney fees, and staff time required researching and conducting said hearing; and

26. The owner of every occupied commercial premises used for the sale of packaged or

covered container for litter at the main entrance to the premises for use by customers.
The owner of the premises shall be responsible for the removal of litter every four hours.

conditions contained herein shall be executed by the owner of the property in writing and duly
recorded with the Cook County Clerk’s Office at the owner’s expense.

1. At or near the time of execution of this Agreement, the VILLAGE granted an
Occupancy Permit, Business License, Site Plan Approval or Special Use Permit
hereinafter collectively referred to as “permit” pursuant to state statutes and local
ordinances.
2. By the terms of the aforesaid permit, the PROPERTY OWNER is required to install
and maintain landscaping in accordance with the plan dated June 16, 2022, or as it
may be subsequently revised with the approval of the Village Manager, or designee,
and the Corporation Counsel.

3. The parties to this Agreement recognize that the installation and maintenance of
landscaping is an integral part of the PROPERTY OWNER's plan for development
and/or use of the property and is necessary to carry out the purpose and intent of the
VILLAGE's land use objectives, and that the permit would not have been approved by
the VILLAGE without the assurance that this Agreement would be executed by the
PROPERTY OWNER.
4. The purpose of this Agreement is to assure:
(a) installation of the landscaping in accordance with the landscaping plan
approved by the VILLAGE, and
(b) continued maintenance and care of the landscaping, including any
landscaping indicated in the parkway area.
5. The property, which is the subject matter of this Agreement, is legally described above.
The portions of the Subject Property which are to be landscaped and maintained
pursuant to the terms and conditions of this Agreement are indicated on the Landscape
Plan attached hereto, marked Exhibit “1” and are hereby made a part of this
Agreement.
6. PROPERTY OWNER agrees that the installation and maintenance of the landscaping
which is required in accordance with the permit issued by the VILLAGE and this
Agreement will materially benefit the Subject Property. Such landscaping is necessary
in order for the PROPERTY OWNER to comply with the conditions of the permit issued
or granted by the VILLAGE for the PROPERTY OWNER’s requested development or
use of the property.
7. PROPERTY OWNER shall diligently maintain and care for the landscaping which is
installed and required by the permit and this Agreement, using generally accepted
methods of cultivation and watering. The PROPERTY OWNER shall maintain a
standard of care necessary to prevent the landscaping from deteriorating to the extent
that its value as landscaping is destroyed. If Exhibit “1”, attached hereto or permit
specifies maintenance standards or procedures, such procedures are hereby adopted
as part of this Agreement, and by such adoption, become enforcement conditions of
this Agreement.
8. Failure to maintain the landscaping as required by this Agreement shall be a nuisance.
In the event the PROPERTY OWNER fails to meet the standard of maintenance
necessary to keep the landscaping in a healthy condition as required by this
Agreement, the VILLAGE shall give written notice of the deficiency to the PROPERTY
OWNER who shall have 20 days to make the necessary correction or replacement. If
such correction or replacement is not made within the aforesaid 20-day period, the
VILLAGE may elect to abate the nuisance and take necessary action to assure that
the landscaping is replaced and/or maintained. In the event, the VILLAGE so elects;
the VILLAGE shall serve notice of its intent to enter the premises for this purpose.
The VILLAGE shall either personally serve the notice upon the PROPERTY OWNER
or mail a copy of it by certified mail to the PROPERTY OWNER's last known address,
or as shown on the tax rolls, at least 15 days in advance of the date when the VILLAGE
or its agent intends to enter the premises.
9. For this purpose, the VILLAGE or its agent may enter upon the property and perform
such work as it considers reasonably necessary and proper to restore, maintain, or

replace the landscaping required by this Agreement. The VILLAGE may act either
through its own employees or through an independent contractor.
10. The VILLAGE shall be entitled to reimbursement for abating the nuisance in restoring,
maintaining or replacing the landscaping, provided that the VILLAGE follows the
procedures set forth in this Agreement. Costs shall include but shall not be limited to
actual costs incurred by the VILLAGE and administrative costs. The VILLAGE shall
make demand upon the PROPERTY OWNER for payment. If the PROPERTY
OWNER fails to pay the costs within 30 days of the date on which demand is made,
the VILLAGE may cause a lien to be placed on the Subject Property. The VILLAGE
may record a notice with the Recorder of Deeds for Cook County stating that it has
incurred expenses under the terms this Landscape Agreement. The VILLAGE shall
be entitled to collect interest at the statutory rate on the amount owed.
11. In addition to having a lien placed on the Subject Property, the VILLAGE may institute
a legal action to collect the amount owed. The PROPERTY OWNER agrees to pay
the VILLAGE a reasonable sum for attorney's fees and court costs.
12. If either party upon the execution of this Agreement or during the course of
performance considers that it is necessary to have the PROPERTY OWNER post
additional security to guarantee the performance of his obligations hereunder, the
VILLAGE may require the PROPERTY OWNER to post additional security. The
VILLAGE may require either a cash deposit or a surety bond guaranteeing
performance in a form signed by sureties satisfactory to the VILLAGE. The condition
of the security shall be that if the PROPERTY OWNER fails to perform any obligation
under this Agreement, the VILLAGE may, act on behalf of the PROPERTY OWNER
and use the proceeds of the cash bond, or in the case of a surety bond, require the
securities to perform the obligations of this Agreement.
13. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the
VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions
or causes of action for personal injury, property damage or otherwise, including
reasonable attorney’s fees, which may arise from the VILLAGE exercising any of its
rights or obligations and performance under this Agreement.
14. All notices required or to be given pursuant hereto shall be in writing and either
delivered personally or by a nationally recognized "over-night" courier service or
mailed by United States certified or registered mail, postage prepaid, addressed to the
VILLAGE and the PROPERTY OWNER as follows:

AN ORDINANCE AMENDING CHAPTERS 38 AND 50 OF THE
SKOKIE VILLAGE CODE PERTAINING TO EMERGENCY SERVICES
AND FIRE PREVENTION AND PROTECTION

2 WHEREAS, Chapter 38, Article II, of the Skokie Village Code provides for alarm
3 systems; and
4 WHEREAS, Chapter 50, Article II, of the Skokie Village Code provides for rules and
5 regulations pertaining to the Fire Prevention Code; and
6 WHEREAS, presently the Skokie Village Code incorporates by reference the 2012
7 editions of the International Fire Code (hereinafter “IFC”) and the Fire Prevention Code, NFPA Life
8 Safety Code (hereinafter “Life Safety Code”). The Fire Chief and Interim Community
9 Development Director have reviewed 2021 editions of IFC and the Life Safety Code and based
10 upon their analysis, they have recommended the 2021 editions of these codes be adopted
11 along with specified amendments, which are in the attached modified sections of the Village
12 Code, as stated in their Memorandum, dated July 5, 2022; and
13 WHEREAS, the Village enforces building construction, fire protection, and life safety
14 codes as part of our community risk reduction strategies that enhance fire prevention and
15 public safety. These codes are national and state codes with local amendments to address
16 community needs, construction methods, and local condition; and
17
18 WHEREAS, by adopting the 2021 Editions of the IFC and Life Safety Code, and the
19 proposed amendments, this will provide contemporary codes to promote life safety and
20 property protection, while supporting community development with new construction,
21 renovation, and repurposing of existing structures. These later editions also address
22 expanding technologies such as solar arrays, energy storage, and charging stations; and
23
24 WHEREAS, the Village Manager recommended that the Village Code be amended in
25 accordance with the Fire Chief’s and Interim Community Development Director’s
26 recommendations; and
27 WHEREAS, the Mayor and Board of Trustees at a public meeting duly held on July 5,
28 2022, concurred in the aforesaid recommendation of the Village Manager; and

31 (a) A fire prevention code is hereby established to provide the Village with rules and
32 regulations to improve public safety by promoting the control of fire hazards, to
33 regulate the installation, use, and maintenance of equipment, to regulate the use of
34 structures, premises, and open areas, to provide for the abatement of fire hazards, to
35 establish the responsibilities and procedures for code enforcement, and to set the
36 standards for compliance and achievement of these objectives.
37 (b) Pursuant to authority granted by 65 ILCS 5/1-3-2, the Village hereby adopts by
38 reference the International Fire Code, 201221 edition, inclusive of Appendices B, C,
39 D, E, F, H, I, K and L, hereinafter referred to as the "IFC" published and modified by
40 the International Code Council (ICC), as the fire prevention code, excepting those
41 provisions that are modified or deleted as provided in this Article.

4 Sec. 50-38. - Standards for fire extinguishers.

6 (a) Definitions. The following words, terms and phrases, when used in this section, shall
7 have the meanings ascribed to them in this subsection, except where the context
8 clearly indicates a different meaning:

10 Service, where used in reference to fire extinguishers, means the inspection, repair,
11 recharging or testing of fire extinguishers.
12 Serviceperson means a person licensed by the Village to inspect, repair, recharge or
13 test fire extinguishers.
14 Standard fire extinguisher means a portable fire extinguisher which bears the label of
15 approval of a national testing laboratory acceptable to the Fire Chief.
16
17 (b) Tags. Every standard fire extinguisher shall have attached thereto a tag or other label
18 approved by the Fire Chief which clearly indicates the dates of inspection and
19 recharging. The tag or label shall have clearly imprinted thereon in numerals no less
20 than ½ inch in height, the year for which it is issued.

22 (c) Servicing. Fire extinguishers more than 1 year past the service date are in violation of
23 this section. Pressured extinguishers must be hydrostratically hydrostatically tested
24 as prescribed in current NFPA standards.

27 Sec. 50-47. – Lock box system.
28
29 (a) Definitions. The following words, terms and phrases, when used in this section, shall
30 have the meanings ascribed to them in this subsection, except where the context
31 clearly indicates a different meaning:

33 Hazardous substance means a substance for which an occupational safety and health
34 standard has been adopted under the Occupational Safety and Health Act of 10070,
35 84 Stat. 1590, 29 U.S.C.A. § 651, as amended, and the rules adopted pursuant
36 thereto; or a mixture of substances that contain any substance listed in such Act in a
37 quantity that constitutes more than 1 percent of the composition or volume of the
38 mixture.

40 Lock box means heavy steel box fitted with a Level 3 locking device that requires a key
41 that cannot be duplicated by a locksmith. A lock box shall be a type that is
42 approved and requested by the Skokie Fire Department and keyed as such that
43 the Skokie Fire Department is the only entity that can open it.
44
45 (b) Lock box system required for certain buildings. All premises required by the Village
46 Code to provide fire detection or fire extinguishing systems, with the exception of
47 residential property, or premises in which hazardous substances are used or stored,
48 shall be required to have a lock box installed on the premises. A lock box shall be

1 installed as requested by the authority having jurisdiction (hereinafter referred to
2 “AHJ”), near a door that has unlocking hardware.

4 (c) Lock box authorized for residential units. Lock boxes are authorized, but not required
5 for any legal residential unit in the Village. Property management companies and
6 property owners of multifamily properties shall not prohibit or deter the use of Lock
7 boxes. Condominium Association shall allow the use and installation of Lock boxes if
8 so desired by the individual unit owner or tenant.

10 (1) Residential Lock boxes are to be installed on the front door of an individual
11 residential unit to provide access during an emergency response by the Skokie
12 Fire Department.
13 (2) The Llock box shall contain a key to the door upon which it is mounted. Key(s)
14 contained inside a lock box shall be for all interior and exterior doors with
15 lockable hardware. Any keycard(s) for any electronically locked doors
16 shall be provided to the AHJ.
17 (3) The lock box size shall be determined by the AHJ. A determination of
18 lock box size will be based on the number of keys to be contained within
19 and/or the documentation required for the hazards on premises.
20 (4) The AHJ may require multiple lock boxes if deemed necessary for
21 occupancy

24 (e) Contents of lock boxes referred to in Section 50-47(b) shall include the following as
25 appropriate:

27 (1) Keys to locked points of ingress, whether on the interior or exterior of such
28 buildings.

36 (g) Village inspections. The Village Manager or designee shall inspect and flow privately
37 owned hydrants. Private Hydrant Inspections. The owner of the private water
38 mains and associated hydrants shall have the water mains and hydrants flow
39 tested and inspected. The records of these tests shall be submitted to the
40 Skokie Fire Prevention Bureau through the reporting system designated by the
41 AHJ. Additionally, documentation of the tests shall be available upon request of
42 fire official.

44 (h) Notification of repairs. The Village shall forward any repair or maintenance
45 discrepancies to the designated contact person for correction. Notification of
46 completion of any repair shall be made to the Village Manager or designee for the
47 purpose of inspection and acceptance. Repairs are to be completed in a timely
48 manner.

1 (i) Time limit for completing repairs. Property owners have 10 days from notification to
2 effect repairs or to request a time extension from the Village Manager or designee.
3 Failure to make necessary repairs or to request an extension shall result in water to
4 the property being shut off after 20 days of noncompliance. Notification of initiation
5 and completion of any repair, regardless of whether it is in response to a Village
6 Initiated notification, shall be made to the Village Manager or designee for the purpose
7 of notification, inspection and acceptance. Failure to make the required repairs or to
8 request an extension of time may result in the Village making the required
9 repairs at the cost to the owner.

17 Penalty for failure to correct fire hazard. Any owner, or agent, employee or
18 officer thereof, or person in possession or control of building or place
19 mentioned in Section 50-36, who shall refuse or neglect to make such
20 changes, alterations or repairs within a period of five (5) days after the date of
21 such notice, shall be subject to the penalties provide in Section 1-6 in addition

36 fire hydrant shall be readily accessible within no more than 150 feet of
37 the fire department connection. The distance shall be permitted to
38 exceed 150 feet where approved by the AHJ.

40 (35) Sec. 510 Radio Amplification system. Delete text and replace with:
41 510.1 General. This Section covers radio amplification systems, which are bi-
42 directional amplifier systems, or similar systems needed to meet the threshold
43 radio communication standards for the Village of Skokie's public safety
44 communications network. For the purpose of this section all such systems shall
45 be referred to as a radio amplification system.

1 510.12 Permit required. A building permit shall be required for the installation of
2 any radio amplification system. The fee for the permit shall be the minimum
3 permit fee as established by the building permit fee schedule set forth
4 in Chapter 46 of the Skokie Village Code.
5 (46) Sec. 511 Village Public Safety Communications Network. Add as follows:
6 If the erection or construction of a structure interferes with the existing
7 telecommunications system for public safety purposes, the developer and/or
8 owner shall provide for appropriate easement, facilities and equipment to
9 ensure the continued satisfactory operation of the public safety
10 telecommunications system at no cost to the Village. Facilities and equipment
11 needed to alleviate the concern shall become part of the Village of Skokie’s
12 communications network and shall be operated and maintained by the Village.
13 In the event that facilities and equipment cannot be located on the proposed
14 structure, or their location on the structure will not provide satisfactory operation
15 of the public safety telecommunications system, the development shall pay the
16 cost of equipment, installation and easement to locate the equipment at an
17 alternative location determined by the Village to provide proper
18 communications.

20 (7) Sec. 901.6.3 Records. Add as follows: Records of all system inspections,
21 tests and maintenance required by the referenced standards shall be
22 maintained on the premises for a minimum of three years. Contractors
23 performing system inspections, testing and maintenance shall submit all
24 records electronically to the reporting system determined by the Village of
25 Skokie. Each contractor performing system testing, inspection and
26 maintenance and reporting through the online system, will be required to
27 pay a filing fee. The filing fee shall be paid at the time the reports are
28 submitted. Reports that are not submitted through the reporting system
29 established by the Village of Skokie will not be accepted.

1 (33) Sec. 912.2.3 Add as follows: Exterior fire department connection visual
2 indicator. When a fire sprinkler system is required to have a fire department
3 connection in accordance with Section 912.1, a visual indicator and ten (10) inch
4 bell shall be installed directly above the fire department connection in a location
5 approved by the fire code official. The visual indicator device shall have a red
6 housing with the word “FIRE” in white lettering and a clear lens on the visual
7 indicator portion. Where architectural design visually obscures the visual
8 indicator from being seen from the primary roadway in front of the building and/or
9 structure that is protected by the fire sprinkler system, the fire code official shall
10 determine an alternate location for placement of the visual indicator on the front
11 of the building and/or structure. The visual indicator shall be activated because of

AN ORDINANCE AMENDING CHAPTERS 26 AND 46, OF THE
SKOKIE VILLAGE CODE PERTAINING TO GARAGE SALES
1 WHEREAS, Chapter 26, Article XV, of the Skokie Village Code provides for the
2 regulations pertaining to garage sales and Chapter 46, Article II, pertains to miscellaneous fees;
3 and
4 WHEREAS, from time to time, an interdisciplinary group of Village staff reviews various
5 sections of the Village Code for efficiency and feasibility. The group works to address various
6 code issues, and in this case, reviewed the Village Code pertaining to “garage sales”. Included
7 in that review were the ordinances of surrounding communities, with the goal of furthering the
8 Village’s sustainability efforts by increasing the number of opportunities for residents to sell
9 unwanted items instead of disposing them in the landfill; and
10 WHEREAS, based on their analysis, they recommended to the Village Manager that the
11 Village Code be updated to include the changes below:
12 • Increase the number of garage sales allowed each year from one to three.
13 • Allow a maximum of two (2) signs advising of the sale in the public right-of-way. Signs
14 cannot be placed on any trees, lights standards, telephone poles or other supporting
15 structures. Persons that do not remove signs within the parameters of Section 26-714 of
16 the Skokie Village Code will be subject to a local ordinance citation(s).
17 • Permit the Village Manager to establish one weekend (Friday, Saturday & Sunday) each
18 year as a “Community Wide Garage Sale,” an addition to the three allotted garage sales.
19 • Decrease the permit fee for each garage sale from $10 to $5.
20 WHEREAS, the Village Manager concurred in the recommendation of Village staff to the
21 Mayor and Board of Trustees at a public meeting duly held on July 5, 2022 that Chapter 26, and
22 Chapter 46 of the Skokie Village Code be amended accordingly; and
23 WHEREAS, the Mayor and Board of Trustees at a public meeting duly held on July 5,
24 2022 concurred in the aforesaid revised recommendation of the Village Manager;
25 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and board of Trustees of the
26 Village of Skokie, Cook County, Illinois;
27 Section 1: That Chapter 26, Article XV, Sections 26-713 and 26-714 of the Skokie
28 Village Code be and the same are hereby amended in the manner hereinafter indicated. The new
29 material is highlighted in bold and the material to be deleted is struck through and highlighted.
30 Sec. 26-713. Number and duration; permitted goods.
31 No more than one three garage sale permit permits may be issued to a dwelling unit in

5 (Friday, Saturday & Sunday) each year as a Community Wide Garage Sale. Participation
6 will not count towards the three allotted sales.
7 Section 2: That Chapter 26, Article XV, Section 26-714 (a) of the Skokie Village Code

AN ORDINANCE GRANTING RELIEF FROM CHAPTER 10,
SECTION 10-10, OF THE SKOKIE VILLAGE CODE TO ALLOW
THE TEMPORARY SALE, POSSESSION AND CONSUMPTION OF
ALCOHOLIC LIQUOR ON THE PUBLIC RIGHT OF WAY AND
MUNICIPAL PROPERTY DURING SPECIFIED HOURS OF
SKOKIE’S 15TH ANNUAL BACKLOT BASH
1 WHEREAS, this routine ordinance for the Backlot Bash concerns Chapter 10, Section
2 10-10 of the Skokie Village Code which prohibits the possession and consumption of
3 alcoholic liquor on Village of Skokie (hereinafter “Village”) owned property; and
4 WHEREAS, the Skokie Park District, in conjunction with various organizations, will be
5 presenting the 15th Annual Backlot Bash (hereinafter “Bash”), which will take place on August
6 26, 27 and 28, 2022; and
7 WHEREAS, the Bash is comprised of concerts, games, food and a carnival which will
8 utilize Village owned parking lots and a portion of the public ways at and around the
9 intersection of Floral Avenue and Oakton Street and a portion of Lincoln Avenue; and
10 WHEREAS, the Skokie Park District has or will acquire a temporary permit pursuant to
11 Section 10-40 of the Code, authorizing the sale of liquor for the 2 and ½ day event; and
12 WHEREAS, the Skokie Park District intends to restrict and limit the consumption of
13 alcoholic liquor to a defined and fenced-in area located on a portion of the public right of way
14 of Oakton Street, the Village Green and a portion of the Village Hall parking lot (hereinafter
15 “Beer Area”), as depicted on the 2022 Event Layout, attached hereto as Exhibit “1”; and
16 WHEREAS, the Mayor, as Liquor Commissioner, and the Corporation Counsel
17 recommend to the Board of Trustees that relief from Section 10-10 of the Code be granted to
18 the Skokie Park District; and
19 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the
20 Village of Skokie, Cook County, Illinois;
21 Section 1: That the Skokie Park District, or its specified agents, are authorized and
22 permitted to sell alcoholic liquor and to allow its consumption within the Beer Area. To the
23 extent necessary, relief from Section 10-10 of the Code is granted as part of this permission.
24 This permission to sell alcoholic liquor in the Beer Area is subject to the following conditions:

1 1) The Skokie Part District shall have a Temporary Permit to sell alcoholic liquor
2 from the Local Liquor Commissioner;
3 2) The Skokie Park District shall have obtained any license, permit or other
4 necessary approvals from the State of Illinois to sell alcoholic liquor;
5 3) The area in which the sale of alcoholic liquor takes place shall be enclosed with
6 a fence, access shall be restricted and consumption shall be limited to the self-
7 contained designated area. No consumption or sale of alcoholic liquor shall be
8 allowed on any other publicly owned property or any public right of way.
9 4) That any and all necessary authorization is granted from local, county or state
10 agencies, for the closure of certain public rights of way including but not limited
11 to Oakton Street.
12 5) The sale of alcoholic liquors shall only take place during the following times:
13 6:00 p.m. to 10:00 p.m. on August 26, 2022; 11:00 a.m. to 10:00 p.m. on
14 August 27, 2022; and 8:00 a.m. to 8:00 p.m. on August 28, 2022;
15 6) Only alcoholic liquor sold by the Skokie Park District or its approved vendor,
16 may be sold, consumed or possessed in the designated area of the Beer Area.
17 No alcoholic liquor may be brought in from outside of the designated area;
18 7) The Skokie Park District, the Youth Foundation of Skokie and the Village shall
19 enter into an Intergovernmental Agreement upon terms negotiated by the
20 Village Manager, or designee, and the Corporation Counsel, subject to final
21 approval by the Mayor and the Board of Trustees; and
22 8) The Skokie Park District, and its vendor(s), shall comply with the Village Code,
23 and all ordinances, rules and regulations of the Village.
24 Section 2: That this Ordinance shall be in full force and effect from and after its
25 passage, approval and publication in pamphlet form as provided by law.
