Absent: None MOTION CARJRIED 2022-2023 Community Development Block Grant Public Hearing #1. Community Director Nyden presented an overview of the items at the Board meeting. Public hearings for the Community Development Block Grant (CDBG) program will be conducted at the Village Board meetings on Tuesday, January 17, 2023, and Tuesday, February 21, 2023. Public hearings are mandated by the US. Department of Housing and Urban Development (HUD) regulations to receive public input and determine the Village of Skokie's funding request and to approve the one-year Action Plan that serves as our formal application for funding. The upcoming fiscal year will be the 49 consecutive year of CDBG funding, durmg which the Village has benefited from over $24.0 million in total grant allocations' The Village's current five-year Consolidated Plan will focus on the CDBG national objectives of principally benefitting low/moderate-income persons (as defined by HUD) and preventmg areas of blight. Proposed changes for the 2023 Action Plan are to 1.) cap the minimum grant allocation to $5,000 with a goal of increasing that minimum to $10,000 over the next few years; and 2.) contract the administration of the Housing Rehab grants to sn outside organization. 601792 Return to Agenda 13618 Meeting of the Mayor and Board of Trustees Monday, December 19, 2022 Page Five Both of these recommendations are an attempt to better use limited resources and staff time to provide for the greatest needs in the community. At this pomt we do not know the exact amount of our entitlement grant for 2023-24; however, we will likely estimate $600,000, which is slightly more than the current year's grant amount of $563,422. Ideally, we would know the exact amount prior to the February hearing when project awards are determined; however, the timing will likely be later. In addition, we plan to reprogram a portion ofunobligated funds from last year. The program caps of 20% for administrative funding and 15% for public services will be applied to the new entitlement the Village receives, Public Comment, Judy Mendel, Gail Schechter, and Catherine White spoke about Affordable Housing. Lam'en Grodnicki spoke about Idling vs. moving vehicles. Public CQiTmientssend^ Judy Mendel, Catharine White, Denise Haberkorn, Maggie Vandermeer commented on Affordable Housing, and request for a Town Hal! Meeting on Housing in Skokie. Gail Schechter sent a thank You in support of the action for affordable housing. Mayor Van Dusen mentioned about the possibility of a snow storm later this week and reminded residents of alternate side parking. Mayor Van Dusen acknowledged the passmg of Dorothy LUwin. She was a pioneer in many fields, starting with working at the first TV station in Chicago in 1945, starting Centre East in Skokie, helping create the North Shore Center for the Performing Arts in Skolde and founding Huntley Community Radio. Staff recommended disallowing standalone businesses and requiring them to be part of a primary use. Vape shops and massage parlors have proliferated in commercial areas over the last few years. The Village regularly receives complaints about their presence in the community, and they create enforcement challenges. Staff is also proposing to better align the business licensing chapter of the Skokie Village Code with zoning requirements. Staff proposed to change the land use designation from “tobacco or tobacconist establishments” to “cigarette and tobacco sales” and redefine the use by limiting sales to grocery, pharmacy, or convenience stores. Tobacco sales would be limited to no more than 20% or 100 linear feet of shelf space or display area in the store, whichever is less. For massage parlors, staff proposed to change the land use designation to “massage services” and redefine the use by limiting services to licensed physicians, chiropractors, and physical therapists and health/fitness centers. As noted in their respective definitions, the changes will prohibit standalone establishments as a primary use. The uses will be deleted from the Appendix A land use table. Existing vape shops, tobacco stores, and massage parlors can continue to operate and will be deemed legal non-confirming uses. New establishments or an expansion of the use will not be permitted. In accordance with licensing requirements, licenses are not transferable to a new owner or operator. If an establishment closes, they will need to adhere to all Village code requirements and would no longer be permitted. Case Description: 2021-30P – Zoning Chapter Amendment: Restrict Vape Shops and Massage Parlors The Village of Skokie is requesting an amendment to Section 118 of the Skokie Village Code to restrict vape shops and massage parlors to be subordinate to primary uses. The chairman verified that there was a quorum. Discussion and Interested Parties Legal notice was advertised as prescribed by the Zoning Chapter. Personal notice was not required for this case. Staff requested the report be entered into the record as written. They propose to change the land designations and definitions from “tobacco or tobacconist establishment” to “cigarette and tobacco sales” and “massage therapy” to “massage services”. This text amendment request will prohibit “cigarette or tobacco sales” and “massage service uses” from operating as primary stand-alone businesses; restricting them rather to operate as secondary uses within limited primary business uses. This change will also better align business licensing with the zoning requirements of the Village Code. Cigarette and tobacco products for sale will be limited to no greater than 20% or 100 linear feet of shelf space within a grocery, pharmacy, liquor, or convenient store. Massage services or massage therapy will be restricted to a physician, podiatrist, chiropractor, physical therapist licensed in the State of Illinois or a health and fitness center. The chairman inquired about existing establishments and public comments. The director stated that existing establishments can continue to operate and will be considered legal non- conforming uses. Expansion of the use or new establishments will not be permitted, and licenses will not be transferrable to new owners or operators. There were no public comments received.
