MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 7:30
p.m. on Tuesday, March 7, 2023
Pledge of Allegiance led by Village Clerk Pramod Shah.
Mayor Van Dusen called the meeting to order.
The Clerk call the Roll. Those present were Trustees Sutker, Robinson, Khoeun, Johnson, Klein
and Mayor Van Dusen. Trustee Pure Slovin was absent.
Motion to approve the Consent Agenda with the exception of Item A on Appointments and Item
A on the Corporation Counsel’s report.

Director of Health and Human Services Mike Charley and Deputy Chief Jesse Barnes answered
questions from the Board and residents.
Lauren Grodnicki, Emi Yamauchi and Kimberly Polka asked questions concerning dogs being
on leashes, limit of dogs for condos, and platform feedings.
Motion to concur with staff’s recommendations and request Mayor and Board approval for
Corporation Counsel to prepare the necessary ordinance amendments.

This item was taken off the Consent Agenda.
A member from GoGreen Skokie, Mathew Gliebe, Emi Yamauchi, Judy Mendel, Kimberly
Polka, and Trustee Johnson spoke about a Non partisan Corporation Counsel’s office, political
parties, public servants, conflict of interest, transparency, Electoral reform, Ethics Commission-
comments and issues on the Open Meetings Act.
Motion to adopt an ordinance establishing the salaries of the Village Manager, Deputy Village
Clerk, Corporation Counsel and Assistant Corporation Counsels of the Village of Skokie. This
item is on for second reading and adoption. The first reading was on February 21, 2023.

Motion to adopt an ordinance approving modifications to the previously approved site plan for

Boris Vemik spoke about 90 minute parking on 4100 Main St. People tend to park there
all day or move their vehicles slightly for another 90 mmutes,
Emi Yamauchi asked about any updates on Carvana, updates on the Electoral Reform,
Affordable Housing-outreach for the community and how can residents have input on new
projects in Skokie.
Judy Mendel also spoke about the process when potential developers bring requests to the
Village ofSkokie,

A. Proposed Ordinance Amendment for Feeding of Wildlife or Birds (Section 18"
11) and Number of Dogs (Section 18-39).
Attached is a memo from Health and Human Services Director, Michael Charley
and Police Chief, Brian Baker in regard to amending the Village's ordinances for
feeding of wildlife or birds and number of dogs. The Village regularly reviews
ordinances to evaluate the purpose and needs.
Staff is recommending that platform feeders be prohibited. Platform bird feeders
attract the widest variety of nuisance species as well as the greatest number of
birds. The Village has observed an increase in nuisance species in recent years
including rats, squirrels, raccoons, opossum and skunks. Bird feeding has been
identified as one of the top contributing factors and this recommendation is one of
several strategies to reduce this nuisance activity.
Staff is recommending increasing dog limitations by one to allow up to three dogs in
any singie-family residence and lot and up to two dogs in any apartment or
condominium. Staff feels that increasing dog limitations wil! not have any adverse
effect on the health and welfare of residents or dogs and is responsive to resident
feedback.
I concur with staff's recommendations and respectfully request Mayor and Board
approval for Corporation Counsel to prepare the necessary ordinance
amendments.

SUBJECT: Ordinance Amendment Recommendations: Chapter 18 – Animals
Section 18-11. Feeding of wildlife or birds.
Section 18-39. Maximum number of dogs.
Staff are recommending two ordinance amendments to “Chapter 18 – Animals” of the Village ordinance.
The first, is to increase dog limitations to allow or permit 3 dogs per single-family residence and lot and
to permit 2 dogs to remain in or about in any apartment or condominium. Periodically the Village
receives interest from residents for increasing dog limitations from two (2) to three (3) dogs in a single-
family home. As regular practice, the Village reviews ordinances periodically to evaluate the purpose
and needs as well as review how other communities handle such issues. A survey of sixteen (16) other
Chicago-area municipalities showed that all those municipalities allowed three (3) or more dogs. Staff
utilized this information, analyzed Skokie’s existing ordinance, policies and procedures, consulted with
internal staff with specialized knowledge on animal control and responsibility for enforcing the Village’s
Animal Control ordinance and it was determined that increasing dog limitations for single-family and
multi-family properties was appropriate at this time for the Village of Skokie. In general, it was
determined that the health and welfare of the community would not be compromised, but enhanced
with increasing limitations. Dogs are well known to be companion animals which provide our residents
with love and affection and even make us happier and healthier.
The second, is to prohibit platform feeding of birds/wildlife. In recent years, Skokie has observed an
increase in nuisance animals (rats specifically) and bird/wildlife feeding has been found to be a
significant contributing factor associated with the increase in rats. The prohibition of platform feeders is
just another step the Village of Skokie is recommending taking to reduce and eliminate our nuisance rat
and wildlife population.
If the ordinance sections are enacted, staff will monitor its implementation, evaluate the amendment
and identify any resulting process/policy improvements that need to be addressed.

Staff justification for recommendation:
1. Section 18-11. Feeding of wildlife or birds be amended to prohibit platform feeding of
birds/wildlife.
Staff are recommending that platform feeders be prohibited. Platform feeders means feeders
designed for the open placement of feed generally intended for consumption by ground-feeding
species. Due to their design and placement near the ground, platform feeders are accessible to
nuisance species (rats, squirrels, raccoons, opossums and skunks) and create an undue nuisance
to the community. Platform bird feeders are the most non-selective type of bird feeders
because they allow easy access by all birds, however they also allow access to the other
nuisance species. The bird seed is simply poured into an open platform or tray that any
nuisance animal can easily access. Platform bird feeders attract the widest variety of nuisance
species as well as the most numbers of birds. The Village has observed an increase in nuisance
species in recent years including rats and other nuisance wildlife such as squirrels, raccoons,
opossum and skunks. For example, the number of rat cases received by the Village has
increased since FY20, and this is one of the strategies to reduce the number of rat cases. Bird
feeding has been identified one of the top contributing factors with rats in each of the last three
years.
2. Section 18-39. Maximum number of dogs be amended to increase dog limitations to allow or
permit 3 dogs to remain in or about any single-family residence, building or lot and to allow or
permit 2 dogs to remain in or about in any single-family apartment or condominium, within
such person’s control, at any one time.
Staff feel that increasing dog limitations will not have an adverse and/or negative affect on the
health and/or welfare of residents or dogs within the Village of Skokie. The Village
conducted a municipal dog limitation ordinances survey. The survey found that 16 of the 16
municipalities surveyed allowed for 3 or more dogs per residential unit.
If limitations are increased, apartment and condominium property owners have the discretion
to modify their leases, bylaws or rules to limit dogs. This ensures that even if the Village
increased limitations, that individual property owners would have the authority to govern their
properties independent of the Village ordinance.
Finally, the Village has the resources and tools (ordinance, policies, procedures) to monitor and
respond to dog limitation issues. The Village can and will respond to all nuisance issues on a
case by case basis to ensure that dog owners are responsible pet owners.

tB. Ordinance, Repeal pLVarious Sp_ecial Use Permit Ordinances, Multiple Locations
Item B is on the consent agenda for second reading and adoption. The first reading was on
February 21, 2023.
This ordinance will repeal special use permit and site plan ordinances that are no longer being
utilized. The Community Development Department has conducted detailed review of all
active and inactive special use permits and site plan approvals, and has found 18 of them
are no longer needed because the respective property is not currently being used in a manner
consistent with the ordinance. Notice was mailed to all property owners affected by the repeal
and no property owner objected. This reduction in the number of active permits will result in
improved enforcement.
*C. Ordinance, Modifications to Previously Approved Sjte Plan, 8057 Niles Center Road
Item C is on the consent agenda for second reading and adoption. The first reading was on
February 21, 2023.
This ordinance will modify a previously approved site plan approval ordinance, for a planned
development at 8057 Niles Center Road, by allowing for the construction of a one story
addition to a building at the property. This modification is in substantial compliance with
the intent of the original site plan approval, will still leave the original site plan approval
ordinance.

1 WHEREAS, the Skokie Village Code, Chapter 2, Article III, Division 4, Sections 2-132 and
2 2-134, provides that the Village Manager shall be appointed by a majority vote of the Mayor and
3 Board of Trustees and receive such compensation as the Mayor and Board of Trustees shall fix
4 from time to time; and
5 WHEREAS, the Skokie Village Code, Chapter 2, Article IN, Division 3, Section 2-117,
6 provides that the Deputy Village Clerk may be appointed by the Village Clerk with the consent of
7 the Mayor and Board of Trustees and at such compensation as provided for in the annual budget;
8 and
9 WHEREAS, the Skokie Village Code, Chapter 2, Article 111, Division 5, Section 2-168,
10 provides that the Corporation Counsel and Assistant Corporation Counsels shall be appointed by
n the Mayor with the consent of the Board of Trustees and shall receive such compensation as the
12 Mayor and Board of Trustees shall fix from time to time; and
13 WHEREAS, the Mayor and Board of Trustees have considered the FY2023 compensation
14 for the aforementioned positions and have approved cost-of-living adjustments ("COLA") and other
15 adjusted salaries effective May 1, 2022, for ail appointed officials;
16 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village
17 of Skokie, Cook County, Illinois that:
is Section 1: The compensation for the Village Manager of the Village of Skokie, Cook
19 County, Illinois, for FY2023, shall be paid (i) directly to John T. Lockerby, in the annualized sum of
20 $234,084.00, effective May 1, 2022 through April 30, 2023; and (ii) into a deferred compensation
21 plan or annuity for the benefit of John T. Lockerby in the annualized sum of $20,808.00 effective
22 May 1, 2022 through April 30, 2023.
23 Further, the Village Manager shall receive the same benefits as fulf-time Village employees
24 as provided in the Village's annual budget and personnel manual.
25 Section 2: The compensation for the Deputy Village C!erk of the Village of Skokie, Cook
26 County, Illinois for FY2023, shall be paid directly to Sylvia Luke in the annualized sum of $83,649.74,

28 Further, the Deputy Clerk shall receive the same benefits as full-time Village employees as

13 Abraham W. Funk shall receive the same benefits as full-time Village employees as provided in the

15 Section 5: The compensation for the part-time Assistant Corporation Counsels of the
16 Village of Skokie, Cook County, Illinois, for FY2023, is as follows: (i) Tyler Kobylski, shall be paid
17 directly in the annualized sum of $14,145.00 effective May 1, 2022 through April 30, 2023, and
18 (ii) an Assistant Corporation Counsel, to be hired, shall be paid directly in an annualized sum of
19 $37,600.00.
20 Further, the part-time Assistant Corporation Counsel, Tyler Kobylski, and the individual to
21 be hired, shali not receive benefits provided to full-time employees.
22 Section 6: That this Ordinance shall be in full force and effect from and after its passage,
23 approval and pubiication in pamphlet form as provided by law.

ORDINANCES GRANTING SPECIAL USE PERMITS AND SITE PLAN

1 WHEREAS, from time to time, the Mayor and Board of Trustees of the Vi!!age of
2 Skokie have adopted various ordinances granting special use permits (hereinafter "SUP") and
3 site plan approvals (hereinafter "SPA") at different locations within the Village of Skokie; and
4 WHEREAS, many of these uses for which the aforementioned SUPs and SPAs were
5 granted no longer exist, were never utilized or are no longer necessary and therefore should
6 be repealed; and
7 WHEREAS, the Community Development Department staff has conducted a detailed
8 review of SUPs and SPAs. It has been determined that there are currently eighteen (18)
9 SUPs and SPAs that are no longer applicable because the properties are not being used in a
10 manner consistent with the approving ordinance or are no longer necessary. A brief
n description of the SUP and SPA Ordinances to be repealed, and the reason for the repeal, is
12 attached hereto as Exhibit "1"; and
13 WHEREAS, notices were sent to the property taxpayers of record for the properties
14 affected by the eighteen (18) SUP and SPA Ordinances, notifying them: (i) the ordinance
15 granting their respective SUP or SPA was going to be repealed due to inactivity or it is no
16 longer necessary; and (it) they should contact the Community Development Department if they
17 objected to the repea!. The Village did not receive any objections; and
is WHEREAS, the Director of Community Development and the Corporation Counsel
19 recommended to the Mayor and Board of Trustees that the eighteen (18) ordinances specified
20 in Exhibit "1", granting the SUPs and SPAs for uses which no longer exist, were never utilized
21 or are no longer necessary, be repealed; and
22 WHEREAS, the repeal of these ordinances will reduce the number of active
23 ordinances, thereby resulting in improved enforcement; and
24 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on
25 February 21, 2023, concurred in the aforesaid recommendation;
26 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the

AN ORDINANCE APPROVING MODIFICATIONS TO THE
PREVIOUSLY APPROVED SITE PLAN FOR THE PLANNED
DEVELOPMENT AT 8057 NILES CENTER ROAD, SKOK/E, ILLINOIS
IN A CX CORE MIXED-USE DISTRICT
1 WHEREAS, on August 16, 2010, the Mayor and Board of Trustees of the Viiiage
2 of Skokie adopted Viiiage Ordinance Number 10-8-Z-3786 to grant site plan approval for
3 a four (4) building planned development, located at the property legally described as
4 fo!!ows:
5 LOTS 1 AND 2 IN THE HABEN SUBDIVISION IN THE WEST HALF OF THE
6 SOUTHEAST QUARTER OF SECTION 21, TOWNSHIP 41 NORTH, RANGE 13, EAST
7 OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS.

9 03-0000, 10-21 "410-004-0000, 1 0-21 -410-005- 0000, 10-
10 21-410-026-0000, 10-21-410-027-0000

12 and commonly known as 8057 Miles Center Road, Skokie, Illinois (hereinafter collectively
13 "Subject Property") in a CX Core Mixed-Use district; and
14 WHEREAS, the owner of the Subject Property requested to modify the previously
15 approved site plan in order to allow the construction of a one-story addition pursuant to the
16 Site Plan, dated August 8, 2022, attached hereto as Exhibit "A"; and
17 WHEREAS, pursuant to Section 118-8(c) of the Skokie Village Code, the

19 reviewed the request and found that the requested modifications are in substantial
20 compliance with the site plan approval granted on August 16,2010;and
21 WHEREAS, it was recommended to the Mayor and Board of Trustees that the
22 requested modifications be granted; and
23 WHEREAS, at a public meeting duly held February 21 , 2023, the Mayor and Board
24 of Trustees concurred in the aforesaid recommendations and findings of fact of the
25 Corporation Counsel, Plan Commission Chairman and Community Development Director;
26 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
27 Village of Skokie, Cook County, fiiinois:

Section 1: That the existing site plan approval, Village Ordinance Number 10-8-Z-
3786, be modified to allow the construction of a one-story addition according to attached
Site Plan, dated August 8, 2022.
Section 2: That a notice of the approval of this Ordinance incorporating the
modifications contained herein shall be executed by the Developer of the property in
writing and duty recorded with the Office of the Cook County C!erk at the Owner's
expense.
Section 3: That this Ordinance shall be in full force and effect from and after
its passage, approval and recordation as provided by law.
