13654 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 7:30 p.m. on Monday, May 15, 2023 Pledge of Allegiance led by Village Clerk Pramod Shah. Mayor Van Dusen called the meeting to order. The Clerk call the Roll. Those present were Trustees Sutker, Robinson, Johnson, Pure Slovin, Klein and Mayor Van Dusen. Trustee Khoeun was not present. Recognition, Awards and Honorary Presentations. A. Award Presentation Jimmy Gonzalez, member of the Skokie Telecommunications and Technology Commission presented the Skokie Telecommunications and Technology Award to Natalie Ng, a 10th grade student at Niles North High School. She received her award on her Science Fair project of “Effects of Digital & Physical Textbook on Learning”. Trustee Khoeun arrived. Appointments, Reappointments and Resignations. * A. Report of the Village Manager. *A.Commercial All-Risk Property / Cyber Liability Coverage Renewals – Affiliated FM Insurance – $106,500 and BCS Insurance Company - $35,971. Motion to award a contract to Affiliated FM Insurance -$106,500 and BCS Insurance Co. in the amount of $35,971.0 for commercial all-risk property/cyber liability coverage renewals. Omnibus vote. *B. Police Department Drone – RMUS Unmanned Solutions – Centerville, Utah - $31,096.90. Motion to award a contract to RMUS Unmanned Solutions-Centerville, UT in the amount of $31,096.90 for Police department drone. Omnibus vote. *C. HP Infrastructure Maintenance Contract – CDW G, Vernon Hills, Illinois - $27,316.32. Motion to award a contract to CDW G, Vernon Hills, IL in the amount of $27,316.32 for HP Infrastructure maintenance contract. Omnibus vote. 611387 13655 Meeting of the Mayor and Board of Trustees Monday, May 15, 2023 Page Two Report of the Corporation Counsel. FIRST READING: A. An ordinance amending Chapters 46 and 58 of the Skokie Village Code pertaining to Affordable Housing. Item A is on the agenda for first reading and will be on the June 20, 2023 second reading and adoption. Trustees discussed where the Chapter will be placed in the Code, inclusionary requirement permanent, allowing affordability requirements to sunset for 40 years, discussion for 20 or 30 years, giving developers the option for payment-in Lieu fee and opt-out of the full requirement. Community Development Director Nyden answered questions from the Board. B. Resolution 23-5-R-1552 Motion to adopt a resolution establishing a housing Sub-Committee of the Plan Commission to make recommendations concerning the housing chapter of the Village of Skokie Comprehensive Plan. Item B is on the agenda for the first reading and adoption. Discussion included a permanent advisory Housing Committee, the roles and responsibilities of the Housing Commission. Kimberly Polka, Lauren Grodnicki, Judy Mendel, Gail Schechter on behalf of Skokie Neighbors for Housing justice thanked the Village. Judy Mendel spoke about the % of inclusionary housing and read a letter from Betty Lazar-Highland Park regarding affordable housing. Jason -resident from Skokie spoke about a letter signed by over 325 residents, homeowner, voters not in favor of the proposed affordable housing ordinance referencing that Skokie has the highest % of the North Shore. Resolution 23-5-R-1553 Motion to adopt a resolution approving a plat of subdivision for the property located at 9318 Lockwood Avenue, Skokie, Illinois in an R2 Single-Family district. Item C is on the agenda for first reading and adoption. Moved: Trustee Johnson Seconded: Trustee Pure Slovin Ayes: Sutker, Robinson, Khoeun, Johnson, Pure Slovin, Klein and Mayor Van Dusen Nays: None. Absent: None. MOTION CARRIED New Business. A. Appointment Process for Village Attorneys. Trustee Johnson advocated that the Village Board update and revise the appointment process for Village attorneys to mirror the current appointment process for the Village Manager. These included: An Inclusive Process That the process for Corporation Council be revised to include the entire Village Board, that the Village Trustees be allowed a more active role in the selection of Corporation Counsel, not the consent to the Mayor’s nomination. A Limited Process That the appointment process for Village attorneys be revised to limit the scope of the Mayor and Board’s appointment power to just the Corporation Counsel and allow the Corporation Counsel to appoint their own Assistant Corporation Counsels. A Nonpartisan Process That the appt. process for Corporation Counsel to revised to include language to the appt. process for Village Manager, requiring that the Corporation Counsel be appointed for their professional qualifications and remain nonpartisan in the performance of their official duties 611387 13656 Meeting of the Mayor and Board of Trustees Monday, May 15, 2023 Page Three Discussion included residency requirements, clarifying language with advise of Trustees, qualification-non partisan positions-hired without regard of affiliations, code of ethics, in house Legal Department . The current process outlined in Chapter2, Article III, Division 5 of the Village will be modified with clarifying language. These residents spoke concerning the New Business. Kimberly Polka spoke about political appointments, Steve Franklin spoke about honest, effective government, not in favor of outside counsel. Betty Dworkin-business owner complimented the Corporation Counsel’s office. Rich Evonitz read a letter from Elline Eliasoff about the Corporation Counsel’s office as a trusted advisor and their expertise, provide information, problem solve, and that the system is working. Brad Rosen an attorney spoke about revising the code in the legal department Brian Clarke spoke about the domination of the Caucus party and revising the code in the Legal Department. Michael Smith, co-owner of Culver’s spoke about the Corporation Counsel’s office when their expertise was needed. Mark Collins, Niles Township Trustee read a letter from Marilyn Glazer, retired supervisor of Niles Township government commending the work of the Corporation Counsel staff. Judy Mendel commented on the ethics code and language. Plan Commission. A. Plan Commission Case 2023-07P – Zoning Map Amendment: 8000 East Prairie Road. Motion to concur with the Plan Commission to approve a map amendment to rezone the northern section of 8000 subject to all conditions. Jerry Brozek spoke about the ethics complaint from Trustee Johnson Judy Mendel spoke about whether the attorney has been hired regarding the referendum. Mr. Hirsch spoke about the once a week garbage pickup. Shelly Patt thanked the Board. Plan Commission and staff for the Affordable Housing ordinance. Bonnie Ognisanti, Niles Township supervisor-appreciate for the role of the Corporation Counsel in intergovernmental cooperation and collaboration between other governing bodies. Moved: Trustee Pure Slovin Seconded: Trustee Klein All the Trustees made comments and recommendations ,thanked the Staff, Plan Commission, Johanna Nyden, groups that worked on this Affordable Housing project. Discussion included inclusionary housing ordinance,- amendmg to 20%, prioritizing framework for stajETs proposals, set up temporary subcommittee for the Housing Commission, resident applications ^prioritize essential workers that work in Skokie, and encourage development. Director of Community Development Nyden answered questions from the Board. These residents spoke concerning the proposed ordinance. Elline EUasoff, Ethan Nagar-Reaitor from North Shore Bamngton Association of Realtors, Kimberly PoUca, Lauren Grodnicki, Jasmine Sabaggala, Gail Schechter-from Skokie Neighbor for Housing Justice, Jan Beladi, Rob Anthony-President form Community Partners for Affordable Housing, Shira Hammann, JJ Avoska, Shelly Patt, Carrie Bradean, Roxanna Salgado, Bob Quane, and Jason-Skokie resident. Rachel Gradstein read a statement from 325 residents stating that what has been happening naturally has been working as we have the highest rate almost 20% on the Northshore and not to impose standards unless the affordable housing level reaches 12% or below. The discussions include allocating money to older adults, inclusion for new construction, possibility for financing and encouraging developers, a Housing Commission, upgrading the Comprehensive Plan, immigrants, college grads, elderly people, single parents, increase affordable housing for families. Also an Inclusionary ordinance that is 15% instead of 5%, 38% of Skokie-house burden, diverse housing stock, homeowner' s vs renters, living where you work, land trust, upgrade and create more housing. Tmstee Sutker made an amendment to the motion to require 5% on 11-150 units and 10% on 151 units affordability levels would be split between 60 percent and 80 percent of Area Median Income and affordable units would need to be a mix of all unit types offered throughout the building. The trustees agreed that more information is needed before a vote. Trustee Sutker stated that May is Mental Health Awareness Month. Trustee Khoeun acknowledged all the people that helped with research, and worked to provide feedback in this complex issue. New Business, Trustee Johnson requested information regarding Attorney General's determination concerning the Village of Skokie's violation of the Open Meeting's Act. He wanted to know when it will be discussed. Public Comment Gail Schechter wanted to revisit the inclusionary ordinance to 15%, Kimberly Polka commented that a review of the Ordinance in 1 year is unacceptable. Public Comments by Email. The overall property insurance marketplace has become more favorable in 2023 although there are key drivers adversely impacting the commercial market. Inflation plays a large role given the rising costs of construction materials and labor, financial market uncertainty, as well as catastrophic losses ofwind/hail, fire and flood in the Midwest. Despite upward market trends, incumbent Affiliated FM Insurance Company quoted a flat renewal rate of .085361; however, the Village's insurable values increased eleven percent to $124,764,143, thus resulting in a 2024 premium for All-Risk property coverage of $106,500. The Village also purchases Cyber Liability coverage with aggregate limits of $1,000,000. Cyber Liability continues to be a difficult line of coverage for public sector entities. Last year, the marketplace had all but collapsed with nearly all insurers pulling out of the public sector marketplace for Cyber/Ransomware. Carriers exited the marketplace at a rapid pace and those that remain, require public sector buyers to demonstrate that they have best-in class mitigations in place, such as Multi-Factor Authentication for remote access, encrypted cloud-based backup, staff training to prevent clicking on phishing emails and other loss-prevention measures. Skokie demonstrated robust IT mitigation measures are in place and as such, the Village secured full unrestricted cyber coverage of $2,000,000 for fiscal year 2024 for a premium of $35,971. This is $4,374 or 13.8 percent increase over last year, but with increased coverage from $ 1,000,000 to $2,000,000. Given current market conditions, obtaining $2,000,000 in cyber liability coverage speaks highly of the IT mitigation measures that Skokie has demonstrated are in place. Recommendation: It is recommended that commercial all-risk property coverage be placed with Affiliated FM Insurance, for coverage period of June 1, 2023 to June 1, 2024, at a premium of $106,500. Additionally, it is recommended that cyber liability coverage be placed with BCS Insurance Company for coverage period of June 1,2023-June 1, 2024, at a premium of $35,971. City of Des Plaines, 153 IIL2d 164 (1992), 7 including to regulate and to promulgate rules and regulations that pertain to its government 8 affairs; and 9 10 WHEREAS, Chapter 46, of the Skokie Village Code contains various fees for Village n services, programs, and policies and is the appropriate Chapter of the Skokie Village Code to 12 contain provisions concerning "fee in lieu" as part of Affordable Housing; and 13 WHEREAS, Chapter 58, of the Skokie Village Code focuses on and addresses Human 14 Relations including requirements and procedures for housing practices and, therefore, is the 15 appropriate Chapter of the Skokie Village Code to contain provisions concerning Affordable 16 Housing; and 17 WHEREAS, the Village has a long and admirable history concerning open and fair is housing including being the first municipality in the State of Illinois to pass a Fair Housing 19 Ordinance and empowering its Human Relations Commission decades ago to aggressively 20 enforce its Fair Housing Ordinance through mediation and public hearings; and 21 WHEREAS, the Village has achieved a level of 19% of the Village housing stock as 22 affordable housing, as defined and calculated by the Illinois Housing Development Authority 23 through organic housing trends, without affordable housing regulations or imposition of 24 requirements on new construction; and 25 26 WHEREAS, notwithstanding the aforementioned 19%, there is a continuing need to 27 provide affordable housing, for: those who have lived in the Village and contributed to its 28 success but are now on reduced or limited incomes as senior residents, for those who work 29 in the Village and for those who seek to come to live in the Village for its opportunities; and 30 Page 1 of 12 VOSDOCS-#610989v1 MML Return to Corp Rpt 1 WHEREAS, there is a continuing need to provide new or improved and updated 2 affordable housing to ensure that those who obtain affordable housing in the Village live in 3 property that is safe and habitable and provides dignity for its occupants; and 4 5 WHEREAS, without establishing standards and requirements for affordable housing 6 in the Village there is reasonable concern that the quantity of affordable housing may be 7 diluted by other new housing construction and the trend toward increased housing prices may 8 result in an inadequate quantity of affordable housing; and 9 10 WHEREAS, there is also the need and interest in the Village to encourage and attract n new housing development because sufficient and varied housing in our community 12 strengthens the economic vitality of the Village; and 13 14 WHEREAS, the Village recognizes that providing affordable housing in our community 15 increases housing opportunities to maintain a diverse population, including but not limited to ie family friendly housing, multi-generationat housing, senior housing and accessibility; and 17 is WHEREAS, the Village Plan Commission, as directed by the Village Board, undertook 19 to develop affordable housing recommendations and held a listening session on January 19, 20 2023 for recommendations from local and regional organizations, held two (2) Public 21 Hearings (February 2, 2023 and March 2, 2023) to discuss possible affordable housing 22 recommendations and held a meeting on March 16, 2023 to approve draft goals to present 23 to the Village Board to enable it to estabiish new affordable housing policies and Vi!!age Code 24 provisions; and 25 26 WHEREAS, on April 17, 2023 the Plan Commission Report entitled "Affordable 27 Housing Policy Discussion" was presented to the Village Board at its regular public meeting 28 by the Plan Commission Chair and thereafter, on May 15, 2023, the Village Board at its duly 29 held regular public meeting, further discussed the Village Plan Commission's Report; and 30 31 WHEREAS, the Mayor and Board of Trustees at the public meeting duly held on May 32 15, 2023, voted to concur in part with the aforesaid recommendation of the Skokie Plan 33 Commission; and 34 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the 35 Village of Skokie, Cook County, Illinois; 36 Section 1: That Chapter 56 of the Skokie Village Code be and the same is hereby 37 amended in the manner hereinafter indicated. The new material is highlighted in bold. 38 Chapter 58 - HUMAN RELATIONS AND AFFORDABLE HOUSING 39 ARTICLE 1. - IN GENERAL... 40 ARTICLE III. Intent and Purpose. 2 This Article shall promote the public health, safety and welfare of existing and future 3 residents of the Village by requiring certain residential developments or mixed-use 4 developments which contain a residential component to incorporate a specified 5 percentage of dwelling units to qualifying as Affordable Housing. 6 See. 58-40. DEFINITIONS 7 s A. Definitions. 9 10 - Affordable Housing. Housing that is affordable for targeted households n identified in this Article. "Affordable Housing" Is divided into tiers based on 12 availability to households at distinct income levels. 13 14 - Affordable Housing Compliance Plan. A plan submitted by a developer or 15 owner of a Governed Development describing how a development shall ie comply with the requirements of this Article. 17 18 - Affordable Housing Fund. A fund to be established by the Village, pursuant 19 to Section 58-53 of this Article. 20 21 - Affordable Housing Unit. A dwelling unit that meets the criteria for affordable 22 housing. 23 24 - Affordable Owner Occupied Units. Affordable housing units marketed and 25 offered for sale to eligible households subject to an affordable unit covenant. 26 27 - Affordable Rental Units. Affordable housing units marketed and offered for 28 rent to eligible households subject to standard lease terms. 29 30 - Area Median Income (AMI). The median income level for the Chicago- 31 Naperville-Elgin, IL-IN-WI Metropolitan Statistical Area, as established and 32 defined in the annual schedule published by the Secretary of Housing and 33 Urban Development, and adjusted for household size. 34 35 - Certificate of Qualification. A certificate establishing a qualified household's 36 eligibility to purchase or lease an affordable dwelling unit based on income 37 eligibility using income and asset limits, In accordance with the Village's 38 policies and procedures. 39 40 - Consumer Price Index (CPI). Consumer price index for the Chicago- 41 NaperviUe-Elgin area as published annually by the U.S. Department of Labor, 42 Bureau of Labor Statistics. 43 44 - Conversion. A change in a residential or mixed-use rental development, 45 including Office condominiums, to individual-owner residential 46 condominium units. The party responsible for obtaining approvals from the Village, 3 including zoning, subdivision, and building permit approvals, for a Governed 4 Development. 5 6 - Eligible Household. For purposes of this Article, a household with an annual 7 income less than 60% and 80%, respectively, of the Area Median Income 8 (AMI). 9 to - Governed Development. Any residential or mixed-use development with a n residential component that is required to provide affordable housing units 12 under provisions of this Article. Projects at one location undertaken in 13 phases, stages or otherwise developed in distinct parts shall be considered 14 a single Governed Development. 15 is - Housing Expenses. 17 a) For affordable rental units - rent and utilities; and is b) For Affordable Owner Occupied Units - principal and interest of any 19 mortgages placed on the unit, property taxes, condominium or homeowner's 20 association fees, if applicable, and insurance. 21 22 - Maximum Resale Price. The maximum price, at which an owner-occupied 23 affordable unit may be sold to another eligible household, based on a 24 valuation formula incorporating appraisal data, a maximum appreciation 25 factor, and allowances for capital improvements, all as set forth in a 26 schedule to be published by the Village on an annual basis. 27 28 - Market Rate Housing Units. All owner-occupied or rental dwelling units in a 29 Governed Development that are not classified as affordable housing units. 30 31 - Nursing Facilities. This means either a Skilled nursing facility or an Assisted-iiving 32 facility as defined in Section 118- 32 of the Code. 33 34 35 See. 58-41. Administration. 36 37 The provisions of this Article shall be administered by the Village Manager, or 38 designee. 39 40 See. 58-42. Applicability. 41 42 A. General. The provisions of this Article shall apply to all developments that 43 result in the addition of or contain 11 or more residential dwelling units. 44 Developments subject to the provisions of this Article shall be deemed 45 Governed Developments and shall include, but are not limited to, the following: 46 47 1. A development that is new residential construction or new mixed-use Page 4 of 12 VOSDOCS-#610989 v1 Return to Corp Rpt 1 construction with a residential component. 2 3 2. A development that is the renovation or reconstruction of an existing 4 multiple family residential building that increases the number of 5 residential dwelling units from the number of dwelling units in the original 6 structure. 7 8 3. A development that shall change the use of an existing building from 9 non-residential to residential or that will change the class of residential 10 use from single family to multi-family. 11 12 4. A development that includes the conversion of rental property to 13 private ownership of individual dwelling units, 14 15 5. An existing Governed Development that engages in a substantial 16 renovation or remodel where the scope of the work requires the 17 relocation of tenants or permanent end of tenancy for the tenants or when is more than 30% of the units in the development are undergoing the 19 renovation or remodel at one time. 20 21 B. Development on Multiple Parcels. For purposes of this Article, a development 22 that is constructed across multiple adjacent parcels under common ownership 23 shall be considered a single development. 24 25 C. Excluded Developments. The requirements of this Article shall not apply to 26 the following housing types: 27 28 1. The reconstruction of an individual dwelling unit that is rebuilt; 29 30 2. A non-residential development; 31 32 3. Assisted living facilities; and 33 34 4. Nursing facilities. 35 36 See. 58-43. Affordable Housing Requirement for Governed Developments 37 38 A. Calculation of Required Affordable Units. The developer of a Governed 39 Development must satisfy the requirements of this Article by providing 40 affordable housing units within the physical envelope of the development, in the 41 amounts to be calculated is as follows, unless an exception or alternative is 42 approved by the Mayor and Board of Trustees: 43 44 1. Tiered Requirement 45 a. For projects with 11 to 150 total dwelling units in a Governed 46 Development, 5% shall be marketed, offered, and maintained as 47 affordable housing units. Page 5 of 12 VOSDOCS-#610989v1 Return to Corp Rpt 1 b. For projects with more than 150 total dwelling units in a Governed 2 Development, 10% shall be marketed, offered, and maintained as 3 affordable housing units. 4 c. For all projects, half the required affordable housing units shall be 5 for applicants with no more than 60% of AMI and half shall be for 6 applicants with no more than 80 % of AMI. 7 s 2. Fractional Units. When the application of the percentages specified 9 above results in a number of required affordable housing units that 10 includes a fraction, the fraction shall be rounded up to the next whole n number if the fraction is greater than 0.5. If the result includes a fraction 12 equal to or less than 0.5, or if the result Is an odd number of units, the 13 developer shall have the option of founding up to the next whole number 14 and providing the affordable housing units on-site, or providing the 15 Village with a payment-in-lieu of providing an additional affordable ie housing unit. 17 18 19 B. Payment-in-Lieu of Providing Affordable Units. 20 21 1. A developer may make a cash payment-in-lieu of constructing some or 22 all of the required affordable housing units otherwise required to be 23 constructed pursuant to this Article, but only if the Mayor and Board of 24 Trustees approves such payment as part of a Site Plan Approval or 25 Planned Unit Development. 26 27 2. Required Payment"! n-Lieu fee. For Governed Developments permitted 28 to satisfy their affordable housing requirement through a payment-in- 29 lieu, the amount due to the Village shall be pursuant to Section 46-140 of 30 the Code. 31 32 3. Timing of Payment. A developer shall be required to submit the 33 permitted payment-in-lieu for a Governed Development prior to the 34 issuance of any building permits for the Governed Development In the 35 event that a Governed Development is being constructed in phases, the 36 developer shall only be required to submit a portion of the payment-in- 37 lieu corresponding to the proportion of that phase. 38 39 4. Governed Developments with 100 residential units or more, shall not 40 be eligible to pay the Payment-in-Lieu alterative. 41 42 43 Sec.58-44. Location and Design Attributes of Affordable Housing Units. 44 45 Affordable housing units in a Governed Development must comply with the following 46 standards, unless granted an exception by the Village Board as part of the affordable 47 housing compliance plan. Page 6 of 12 VOSDOCS-#610989v1 Return to Corp Rpt 1 2 A. Location of Affordable Housing Units. Affordable housing units must 3 be dispersed among the market rate housing units throughout the 4 Governed Development and not clustered together or segregated from 5 market rate housing. 6 7 B. Size of Units. Affordable housing unit size must be generally 8 representative of and correspond to the size of the market rate housing 9 units within the Governed Development. 10 n C. Phasing of Construction. In a Governed Development to be 12 constructed in multiple phases, each phase of the development must 13 include a number of affordable housing units proportional to the fraction 14 that the phase consists of the entire Governed Development. 15 Construction of affordable housing units may not be delayed or grouped 16 into later phases of a Governed Development 17 is D. Exterior Appearance. The exterior appearance of affordable housing 19 units in any Governed Development must be visually compatible with the 20 market rate housing units In the Governed Development. External 21 building materials and finishes must be substantially the same in type 22 and quality for affordable housing units as for market rate housing units. 23 Affordable housing units shall be indiscernible from market rate housing 24 units from when viewed from interior corridors and other common areas. 25 26 E. Mix of Bedroom Types of Affordable Housing Units. The bedroom mix 27 of affordable housing units must be in equal proportion to the bedroom 28 mix of the market rate housing units within the Governed Development. 29 30 F. Amenities. Affordable housing units must have similar access to 31 common areas, facilities, and services as that enjoyed by comparable 32 market rate housing units in a Governed Development including but not 33 limited to outdoor spaces, amenity spaces, storage, parking, bicycle 34 parking facilities, and resident services. 35 36 G. Mixed Occupancy Developments. If a Governed Development includes 37 both rental housing units and owner occupied units, the ratio of 38 affordable rental to affordable owner occupied units marketed and 39 offered must be equal to the ratio of rental to owner occupied market rate 40 housing units marketed and offered in the Governed Development. 41 42 See. 58-45. Period ofAffordability. 43 44 For both Affordable Owner Occupied Units and Lease of Affordable Rental Units 45 the period of affordability shall be 40 years, to commence at the time of six (6) months 46 subsequent to the Certificate of Occupancy is issued by the Village. The developer or 47 owner shall execute and record any agreements, covenants, or instruments required Page 7 of 12 VOSDOCS"#610989v1 Return to Corp Rpt 1 by this Part to ensure compliance with this section. 2 3 Sec. 58-46. Affordability Controls for Affordable Owner Occupied Units. 4 5 A. Initial Sale Prices for Affordable Owner Occupied Units. Permitted initial sales 6 prices for Affordable Owner Occupied Units shall be set according to a schedule 7 published by the Village annually and calculated on the basis of: 8 9 1. Housing expenses at or below thirty one percent (31%) of the 10 designated eligible income tiers with a household size corresponding to 11 the size of the unit. 12 13 2. The following relationship between unit size and household size shall 14 be used to determine the appropriate income level at which affordable 15 housing expenses are calculated: 16 Income Level Unit Size for Household Size Efficiency 1 Person 1 Bedroom 2 Persons 2 Bedrooms 3 Persons 3 Bedrooms 4 Persons 4 Bedrooms 5 Persons 17 18 3. An available fixed rate thirty (30) year mortgage, consistent with the 19 average rate published from time to time by Freddie Mac; 20 21 4. A down payment of no more than five percent (5%) of the purchase 22 price; 23 24 5. A calculation of property taxes; 25 26 6. A calculation of homeowner's insurance; 27 28 7. A calculation of condominium or homeowner association fees; and 29 30 8. A calculation of private mortgage insurance, if applicable. 31 32 B. Procedure for Initial Sale of an Affordable Owner-Occupied Unit to an Eligible 33 Household. 34 35 1. Sixty (60) days prior to offering any owner-occupied affordable unit for sale 36 to the public, a developer must notify the Village In writing of such offering. The 37 notice shall set forth the number, size, price, and location of affordable housing 38 units to be offered, and must provide a description of each housing unit's 39 finishes and availability. The notice must also include a copy of the approved 40 affordable housing compliance plan for the development, and any such Page 8 of 12 VOSDOCS-#610989v1 Return to Corp Rpt 1 additional Information the Village Manager may reasonably require in order to 2 establish compliance with this Part. 3 4 2. The prospective purchaser must make application for a Certificate of 5 Qualification on a form provided by the Village. If the Developer determines a 6 purchaser is an eligible household pursuant to the requirements of this Part to 7 purchase an affordable housing unit, it shall issue a Certificate of Qualification 8 to that purchaser. A purchaser must provide documents to verify that their 9 household satisfies these requirements, including an affidavit that the 10 affordable housing unit shall be their primary residence. The Village shall have n the authority to audit the Certificate of Qualifications and all related 12 documentation. 13 14 3. The developer may not sell or lease any affordable housing units without a 15 valid certificate of qualification from the Village for the prospective purchaser. 16 17 C. Maximum Resale Price and ftflaximum Appreciation. 18 19 I. The maximum resale price at which an affordable owner-occupied unit 20 may be sold to an eligible household for shall be established in an affordable 21 unit covenant executed by the purchaser. This price shall take into account the 22 maximum permitted appreciation allowed by this 58-46 C. as well as changes 23 in the area median income. 24 25 a) The maximum resale price is an upper limit, but should not be 26 construed as a guarantee that the unit will be resold at that price. 27 28 b) Market conditions, and characteristics of the affordable housing 29 unit, may result in the sale of an owner occupied housing unit at a 30 price lower than the maximum resale price. 31 32 2. The maximum permitted appreciation that may be claimed by the owner 33 of an affordable owner-occupied unit may not exceed fifteen percent (15%) of 34 the increase In the unit's value, as determined by the difference between fair 35 market appraisal at the time of purchase of the unit by the current owner and a 36 fair market appraisal at the time of resale, with such adjustments for 37 improvements made by the current owner and necessary costs of sale which 38 shall be accounted for in the price schedule published by the Village. 39 40 D. Village First Option to Purchase. The Village shall have the first option and right, 41 but not an obligation, to purchase any affordable owner-occupied unit prior to the unit 42 being marketed or offered to the public. If the Village exercises the option and 43 purchases the affordable owner-occupied unit, the Village shall have the right to 44 subject the unit to such agreements, covenants, or instruments, to ensure the 45 continued affordabiiity of the unit in accordance with this Article. Such documentation 46 shall Incorporate the provisions of this Article and shall provide, at a minimum, each 47 of the following: Page 9 of 12 VOSDOCS-#610989v1 Return to Corp Rpt 1 2 1. The maximum resale price is an upper limit, but shall not be construed as a 3 guarantee that the unit shall be resold at that price. 4 5 2. Market conditions, and characteristics of the affordable housing unit, may 6 result in the sale of an affordable housing unit at a price lower than the 7 calculated maximum resale price. The Village shall also reserve the right to 8 assign and transfer its interest in any Affordable Owner Occupied Units that it 9 purchases pursuant to this Subsection to a not-for-profit partner organization. 10 n E. Purchases by Eligible Households, in all other sales of Affordable Owner Occupied 12 Units between private eligible households, the parties to the transaction shall be 13 required to execute and record such documentation as required by Section 58-45 of 14 this Code to ensure the provision and continuous maintenance of the affordable 15 housing units. Such 16 documentation shall include the provisions of this Code and shall provide, at a 17 minimum, each of the following: 18 19 1. That the purchaser acknowledges the Village's first option to purchase the 20 owner-occupied unit set forth in Section 58-46 (D) of this Article. 21 22 2. In the event that the Village does not exercise its first option to purchase, the 23 affordable housing unit only be sold to and occupied by an eligible household. 24 25 3. The affordable housing unit may only be conveyed subject to restrictions that 26 shall permanently maintain the affordability of such affordable housing units for 27 eligible households, including a prohibition on sales above the maximum resale 28 price. 29 30 See. 58-47. Affordability Controls For Affordable Rental Units. 31 32 A. Rental Rates for Affordable Rental Units. Permitted housing expenses for affordable 33 rental units shall be set according to a schedule published by the Village annually and 34 calculated on the basis of: 35 36 1. Housing expenses at or below thirty one percent (31%) of the designated 37 eligible income tiers set forth in Section 58-43, with a household size 38 corresponding to the size of the unit. 39 40 2. If the most recent edition of HUD's reporting indicates a lower area median 41 income than the previous edition, the maximum housing expenses shall be 42 adjusted accordingly. 43 44 3. Lease Term. No affordable rental unit may be initially leased for a period of less than 4 12 months. All leases must be written and in a form approved by the Village. Renewal 5 leases may be less than 12 months based on mutual agreement between the developer 6 and tenant. Final lease agreements are the responsibility of the developer and the 7 prospective tenant. Tenants are responsible for application fees, security deposits and 8 the full amount of the rent as stated on the lease. All lease provisions shall comply 9 with applicable laws and regulations. The developer shall maintain copies of all leases 10 entered into with a certified household (including an income certification) and 11 distribute a copy to the Village or its designated not-for-profit partner organization. 12 13 C. Rental Compliance. The developer, or its designee, shall submit an annual 14 compliance report describing each affordable unit in detail including but not limited to 15 changes in tenancy, turnovers, and income certifications for all new tenants upon 16 request of the Village Manager. 17 18 Sec. 58-48. Affordable Housing Compliance Plans - Review And Approval Process. 19 20 A. Application. For all Governed Development projects, the developer shall file an 21 application for approval of the project's plan to comply with this Article on a form 22 provided and required by the Village Manager or designee. 23 24 25 Section 2: That Chapter 46 of the Skokie Village Code be and the same is hereby 26 amended in the manner hereinafter indicated. Johnson, Village Trustee Date: May 9/2023 Subject: Agenda Item - May 15, 2023 Village of Skokie Board Meeting Appointment Process for Village Attorneys At our May 15 public meeting, the Village Board will be considering potential revisions to Chapter 2, Article Ill, Division 5 of Village Code, concerning the appointment process for Village attorneys in the Corporation Counsel's Office (aka Legal Department). This section of Village Code has not been modified at all since 1979, and has not been substantially updated since the formal establishment of our Legal Department in 1957. Attached to this memo Is a table prepared by the Village Manager's Office, comparing Skokie's process for appointing Village attorneys with other municipalities in the area. The current appointment process for Village attorneys is outlined in Chapter 2, Article III/ Division 5 of our Village Code: • Sec. 2-162. - Appointment of attorneys and other personnel. (a) The Corporation Counsel and Assistant Corporation Counsels shall be appointed by the Mayor with the consent of the Board of Trustees, and they shall hold office until their respective successors shall be duly appointed and qualified. (b) Additional employees other than attorneys, required from time to time by the Corporation Counsel, shall be hired by the Village Manager, • Sec. 2-163. - Qualifications of attorneys. The Corporation Counsel and Assistant Corporation Counsels shall be duly licensed by the Supreme Court of the State/ shall be members of the bar in good standing, and shall otherwise be qualified by law to serve as the attorneys for the Village. For comparison/ the current appointment process for Village Manager is outlined in Chapter 2, Article 111, Division 4 of our Village Code: • Sec. 2-132. - Appointment; qualifications. The Village Manager shall be appointed by majority vote of the Mayor and Board of Trustees. The Manager shall be chosen solely on the basis of such person's executive and administrative Return to Agenda qualifications without regard to such person's political beliefs. At the time of the Manager's appointment/ the Manager need not be a resident of the Village or of the State, but during the Manager's tenure of office the Manager shall reside within the Village. I am advocating that the Village Board update and revise the appointment process for Village attorneys to more closely mirror the current appointment process for Village Manager, in order to make the process for appointing Village attorneys more intentionally inclusive, limited, and nonpartisan. An Inclusive Process. Although the Village Manager is "appointed by the majority vote of the Mayor and Board of Trustees/' Village attorneys are "appointed by the Mayor." Village Trustees are mostly excluded from the appointment process for Village attorneys, aside from voting on whether to consent to the Mayor's nominations. Since the Corporation Counsel serves as the legal advisor for the entire Village Board, I am advocating that the appointment process for Corporation Counsel be revised to include the entire Village Board. Moving forward, Village Trustees should be allowed a more active roie in the vetting and selection of the Corporation Counsel, beyond simply voting on whether to consent to the Mayor's nomination. A Limited Process. Although the Village Manager is charged with appointing an Assistant Village Manager (and other immediate subordinates in the Manager's Office), the Corporation Counsel is not charged with appointing Assistant Corporation Counsels. Currently, the Mayor is charged with appointing all Corporation Counsels, Including full-time and part-time Assistant Corporation Counsels. I am advocating that the appointment process for Vitlage attorneys be revised to limit the scope of the Mayor and Board's appointment power to Just the Corporation Counsel, and allow the Corporation Counsel to appoint their own Assistant Corporation Counsels. A Nonpartisan Process. Although our Village Manager is required to be appointed "without regard to such person's political beliefs/' there is no requirement for nonpartisanship in the appointment process for Village attorneys. Since the late 1950's, this has continuously allowed Skokie Mayors to appoint their own political party and political campaign leaders to positions in the Corporation Counsel's Office, which has resulted in complaints about political conflicts of interest. I am advocating that the appointment process for Corporation Counsel be revised to include language similar to the appointment process for Village Manager, explicitly requiring that the Corporation Counsel be appointed solely for their professional qualifications and "without regard to such person's political beliefs." This would help ensure that all Corporation Counsels remain fundamentally nonpartisan in the performance of their officia! duties. I thank the Mayor and Trustees for the opportunity to discuss and consider potential revisions to the current appointment process for Village attorneys. Beyond the recommendations that I have included in this memo, I welcome any additional or alternative recommendations from other members of the Village Board. This will enhance the character of the neighborhood. Well maintained and desirable schools are a significant contributor to property values. Improving the functionality and appearance of an existing school will positively impact surrounding property values. There are no anticipated changes to traffic patterns or volumes due to the construction of the building. Only a limited number of staff vehicles currently access and will continue to access the lot and use the buildings and grounds office and storage facility. No additional parking is proposed. All utilities will be buried and will meet the requirements of the Village and authorities having jurisdiction. School buildings and their accessory structures are a vital part of the social fabric of a community. Schools educate our children. School facilities provide locations for community events. Schools assist in identifying and addressing students and community members that are experiencing financial and social hardships. Support buildings that assist in keeping a district’s equipment, facilities, and maintenance personnel secure and organized lay the foundation for all the benefits a school brings to a community to be realized. In addition to the construction of the new building, the petitioner will also be making several improvements to the site, including: • Adding a second handicapped parking space to the parking lot on the north side of the building to bring the site into compliance with the State of Illinois Administrative Code. The petitioners are also requesting a map amendment to rezone the property from R2 Single-Family to B2 Commercial (2023-07P) and a subdivision of the subject site into a single lot (2023-08P). STAFF ANALYSIS All pertinent departments and divisions were offered an opportunity to comment on this case. The Engineering, Forestry, Fire Prevention, and Planning Divisions provided comments on the subject case. Engineering Division A total of 35 parking spaces are required for the subject site and 48 parking spaces are provided, meeting the parking requirement for the school. Oakton Street is owned and maintained by the Cook County Highway Department. Any work within the Oakton Street right-of-way will require a permit from Cook County. The petitioner must obtain an MWRD determination letter to determine if an MWRD permit is required for the proposal. Any existing or proposed overhead telecommunication, fiber optic, electric, etc. services to the buildings and grounds office shall be buried or installed underground. Forestry Division Forestry staff requires that the petitioner install protection fencing around the 4 parkway trees on Oakton Street. The fencing must remain in place for the duration of the construction project. Additionally, grass must not be planted any closer than 3 feet from the base of the trunk of the existing tree that is located between the school building and the proposed building. The area around the tree shall not be graded after removal of the tree protection fencing. The proposed swale area to the east of the proposed building must be maintained to keep out invasive species. Fire Prevention Division A set of fire alarm plans for the proposed building must be submitted to the Building Department for review. The floor plan must be revised to indicate the locations of all emergency and exit lighting and fire extinguishers. The site plan must be revised to convert the striped loading area to the north of the northern handicapped parking space to a regular parking space. Both handicapped parking spaces are permitted to share a common loading area. Planning staff requests that curbing be installed around the south, east, and west sides of the sodded area to the north of the parking lot in order to prevent vehicles from parking within that area. APPEARANCE COMMISSION Appearance Commission review is not required for the proposal as public school facilities are not subject to appearance review unless relief is needed from the Village Code.
