13712 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 7:30 p.m. on Monday, December 18, 2023 Pledge of Allegiance led by Village Clerk Pramod Shah. Mayor Van Dusen called the meeting to order. The Clerk called the Roll. Those present were Trustees Sutker, Robinson, Khoeun, Johnson, Pure Slovin, Klein and Mayor Van Dusen. Motion to approve the Consent Agenda with the exception of approval of the closed session meeting held Monday June 5, 2023. Trustee Johnson asked about how the Closed Session minutes will be approved in the future. Proclamations Niles Township Food Pantry Awareness Month – December 2023 Mayor Van Dusen read a Proclamation urging all residents to support the efforts of the Niles Township Food Pantry Foundation by making a monetary donation to the Food Pantry Holiday Gift Card Drive and by donating whenever possible toiletry items and non-perishable food goods. Niles Township Trustee Mark Collins accepted the award. Recognition, Awards and Honorary Presentations. A. Award EV (Electric Vehicle) Readiness Bronze Designation to Village of Skokie The Village of Skokie has been recognized by the Metropolitan Mayors Caucus and ComEd as one of the first Illinois municipalities to complete the EV Readiness Program, created to help local governments prepare for the growth of electric vehicles (EVs) and charging infrastructure across northern Illinois. Skokie and eleven other municipalities were recognized at an awards event on December 7 for achieving the designation of “EV Ready Community,” demonstrating that they have taken steps to develop clear guidelines for permitting EV charging infrastructure, conduct safety training for staff including first responders, and implement plans that engage the community and ensure a safe integration of zero-emissions vehicles. Resources and information for community members can be found on the Village’s new EV landing webpage. Mayor Van Dusen thanked the Staff for all their work and efforts on the project. Plan Commission. A. Plan Commission Case 2023-15P – Zoning Map Amendment: 4600 Main Street. Motion to concur with the Plan Commission that the petitioner’s request to amend the zoning map to change the zoning district for the northern approximately 165 feet of 4600 Main Street from R1 Single-Family to R4 Multifamily Housing be approved subject to all conditions. 616451 13713 Meeting of the Mayor and Board of Trustees Monday, December 18, 2023 Page Two Mark Gerson attorney for Petitioner gave a Power Point Presentation regarding the background of the project and addressed issues from the Board and residents. Mike DeRowin , Architect from Fitzgerald spoke in regards to the proposed project. Susan Phillips, Ken Marley, Anita Ross, Dave F. , Thomas Whitaker, Jeff Smith, Jack Goldberg, Rose Blustein,, Emi Yamauchi, Kimberly Polka, Rachel Vanhoose, Howard Sproul, Daniel Garden, Brian Levinson. All spoke-,some were in favor and some were against the proposed project. Mayor Van Dusen mentioned that according to the Illinois Hosing Authority the affordable housing percentage in Skokie rose from 19.7 to 21.2% . Plan Commission Case 2023-16P – Subdivision: 4600 Main Street. Motion to concur with the Plan Commission that the petitioner’s request to resubdivide 2 existing lots into 1 new lot at 4600 Main Street with a 33.00’ x 165.05’ right-of-way dedication along Kenton Avenue in an R4 Multifamily Housing district be approved subject to all conditions. Motion to concur with staff s recommendation to exclude the Village of Skokie as an employer from coverage under the Paid Leave for All Workers Act. Debra Stinson, Human Resources Director answered questions from the Board and residents on how this will impact the Village. Hilary Hunter had questions about this recommendation. Matt Jarvis questioned about a possibility of a "sunset clause". Steven Pauley spoke about potential issues with parking with the bus service. Shell! Residents spoke about "families- blendmg in", no problems with residents, good neighbors, location, they have transportation and the Fair Housing Act- housing for disabled people. Emi Yamauchi- the Inclusionary Ordinance-when it will be brought back up. Also any updates on Homewood Suite. Carrie Bradean-Skokie Alliance for Electoral Reform thanked the Village for the official passage of the Ordinance for Electoral Reform. She thanked the volunteers for their time, energy, talents, and material resources. She also thanked the many voters and the implementation team, Trustee Johnson asked what will be on the Agenda Dec. 18 concerning the AG binding determination. Mayor replied that the item will be on the Agenda. He made a motion that the Village Board fully comply with the Attorney General's December 1st binding detennination and include the June 5, 2023 closed session minutes on the Consent Agenda, Moved: Trustee Johuson Seconded: There was no second. FROM: J^^^{ Mfcrfa^I 1\^ Lorg^jCorporatiqfi'Counsel DATE: December 14, 2023 ^ SUBJECT: PAC of Opinion Regarding Approval of Closed Session On December 1, 2023, the Public Access Counselor (hereinafter "PAC") determined that section 120/2(c)(21)ofthe0pen Meetings Act does not allow municipal executive session minutes from a closed session to be approved in closed session. Prior to this opinion, the Village of Skokie, along with numerous municipalities throughout the State of Illinois, interpreted section 120/2(c)(21) as granting it authority to approve executive session minutes during a closed session. Specifically, section 120/2(c)(21) of the Open Meetings Act states, "A public body may hold closed meetings to consider the discussion of minutes of meetings lawfully closed under this Act ... for purposes of approval by the body of the minutes..." (emphasis added). As one prominent municipal law firm queried, "[t]his issue has been an open question under the OMA for many years with many governmental entities, on advice of counsel, taking the position that approval of executive session minutes in open session could subject those minutes to production under Section 7(1)(f) of the Freedom of Information Act ("FOIA")." Accordingly, "in order to avoid the application of Section 7(1 )(f) of FOIA...executive minutes have been approved by many governmental bodies in closed session. Until this opinion, the PAC has not spoken on this issue." Klein, Thorpe, Jenkins, Ltd. Bulletin (Dec. 6, 2023). Pursuant to this reasoning and the inherent statutory conflict, municipalities split in the methodology to approve executive session minutes and opted to approve minutes in the same manner as the Village of Skokie has done, for decades. The property owner Arie Crown Hebrew Day School, an Illinois Not-for-Profit Corporation as sole beneficiary with power of direction for Chicago Title Land Trust Company Trust Number 25-10254, submitted an application on behalf of the petitioner to amend the zoning map to change the zoning district for the northern approximately 165 feet of 4600 Main Street from R1 Single-Family to R4 Multifamily Housing. The petitioner is rezoning the subject site in conjunction with requests for a subdivision (case 2023-16P) and site plan approval (case 2023-17P) in order to place the entire Arie Crown Hebrew Day School property within the R4 zone, which presently comprises the southern 125 feet of the site, and construct a new development containing 68 townhouse residences. The Plan Commission concurred with Staff’s recommendation to grant the zoning map amendment. INTERESTED PARTIES Legal notice was properly posted, advertised, and delivered to all property owners in the area of the subject site as prescribed by the Zoning Chapter. Several interested parties either spoke or submitted petitions against the approval of this case. Their primary concern was that the rezoning of the R1 district portion of the property would enable taller, higher-density buildings next to existing single-family residences and would also create a negative impact within the neighborhood due to the appearance of the new buildings and the assumed traffic and parking impacts that would be generated as a result of the development. Mr. Gershon gave a detailed presentation of this high-end residential development that will improve the Main Street frontage. It has been in the making for 1½ years. This development will support the commercial, retail, and residential needs of the area. It is a huge change from the school use that impacted traffic and it will return the property to the tax rolls. The project consists of re-zoning the northern portion of the site to R4 which would allow the townhome development, a re-subdivision of the two parcels into a single new lot, and site plan approval for the creation of 68 new townhomes, surface parking, and storm water detention. The powerpoint presentation was entered into the record as document # 613507. The project has gone through many revisions after receiving input from staff, the Appearance Commission, as well as area neighbors. The current version removed the multifamily housing component from the development to reduce density. Mr. Sidel spoke of following protocols for Green Globe certification and adhering to sustainability guidelines even before the Village provided a draft of the Environmental Sustainability Plan. This is an all-rental development with the owners maintaining the open green space as well as a snow removal plan. The units will be 2 & 3- bedroom single-family residential townhomes with work from home areas, a clubhouse for socializing, a wine cooler area, exercise/work-out space, and 2 parks at the northeast and northwest sides of the site for mingling. The architects added that the development will have a 25-ft setback along Main Street, 2-car garages, electric vehicle charging stations, 22 guest parking spaces around the clubhouse, and 6-ft landscape buffers on Kenton and Kilpatrick with a single curb cut on each street. Mr. Aboona reminded all that the school use caused traffic surges due to school activities and redeveloping the site will eliminate the detrimental impact. He has concluded that access from Kenton and Kilpatrick is adequate. Village Code dictated the parking requirement of 158 parking spaces which has been met. Skokie’s standards are stricter than the national standards. There is on-street public parking on Main Street. In conclusion, Mr. Gershon stated that the project focused on sustainability even before the sustainability proposal was approved. There is a 57% density reduction from the original submission. He also mentioned that they are not requesting any relief and will commit to providing some affordable housing even though they are not obligated to do so as they submitted the proposal before any affordable housing decisions were made. A commissioner questioned the location of the 2 trash enclosures. According to the site plan, they are located on either side of the clubhouse. The petitioner confirmed that renters are required to bring their trash to the receptacles. He mentioned that trash removal will not be handled by the Village; a private company will haul it away. The commissioner also asked about pavement material. Another commissioner commented that a townhouse rental development would be a good option for those that can’t afford to own. Staff requested the reports be accepted into the record as written. They are in support of the project. For the subdivision case (2023-16P), a dedication at the northeast corner of the site is included in order to create a consistent 66-foot wide right-of-way along Kenton Avenue. Staff noted a correction for the report for site plan approval, (2023-17P.) The developer offered, in the spirit of affordability, a $450,000 payment in-lieu reflecting the value of 5 units rather than the $600,000 stated in the report. The affordable housing ordinance is not yet in effect. As noted in a recent case before the Plan Commission, a school district was concerned with the potential numbers of additional children to the school when a large development at Touhy & Linder was approved. In this case, the additional children in schools is minimal. There were several community members voicing their comments and concerns. A letter of objection was signed by 95 signatures and read into the record along with a few comments emailed to staff and the Plan Commission. -Most talked about too much density not fitting in with the small area. It is inconsiderate of the R1 neighbors. -A few spoke to Arie Crown’s commitment to put the property back on the tax rolls and how important it is to support the businesses within walking distance. It would be an opportunity to bring in more potential workers to the area. -Following LEED certification is better than Green Globe. Use green roofs and covered parking. Mr. Gershon gave a detailed presentation of this high-end residential development that will improve the Main Street frontage. It has been in the making for 1½ years. This development will support the commercial, retail, and residential needs of the area. It is a huge change from the school use that impacted traffic and it will return the property to the tax rolls. The project consists of re-zoning the northern portion of the site to R4 which would allow the townhome development, a re-subdivision of the two parcels into a single new lot, and site plan approval for the creation of 68 new townhomes, surface parking, and storm water detention. The powerpoint presentation was entered into the record as document # 613507. The project has gone through many revisions after receiving input from staff, the Appearance Commission, as well as area neighbors. The current version removed the multifamily housing component from the development to reduce density. Mr. Sidel spoke of following protocols for Green Globe certification and adhering to sustainability guidelines even before the Village provided a draft of the Environmental Sustainability Plan. This is an all-rental development with the owners maintaining the open green space as well as a snow removal plan. The units will be 2 & 3- bedroom single-family residential townhomes with work from home areas, a clubhouse for socializing, a wine cooler area, exercise/work-out space, and 2 parks at the northeast and northwest sides of the site for mingling. The architects added that the development will have a 25-ft setback along Main Street, 2-car garages, electric vehicle charging stations, 22 guest parking spaces around the clubhouse, and 6-ft landscape buffers on Kenton and Kilpatrick with a single curb cut on each street. Mr. Aboona reminded all that the school use caused traffic surges due to school activities and redeveloping the site will eliminate the detrimental impact. He has concluded that access from Kenton and Kilpatrick is adequate. Village Code dictated the parking requirement of 158 parking spaces which has been met. Skokie’s standards are stricter than the national standards. There is on-street public parking on Main Street. In conclusion, Mr. Gershon stated that the project focused on sustainability even before the sustainability proposal was approved. There is a 57% density reduction from the original submission. He also mentioned that they are not requesting any relief and will commit to providing some affordable housing even though they are not obligated to do so as they submitted the proposal before any affordable housing decisions were made. A commissioner questioned the location of the 2 trash enclosures. According to the site plan, they are located on either side of the clubhouse. The petitioner confirmed that renters are required to bring their trash to the receptacles. He mentioned that trash removal will not be handled by the Village; a private company will haul it away. The commissioner also asked about pavement material. Another commissioner commented that a townhouse rental development would be a good option for those that can’t afford to own. Staff requested the reports be accepted into the record as written. They are in support of the project. For the subdivision case (2023-16P), a dedication at the northeast corner of the site is included in order to create a consistent 66-foot wide right-of-way along Kenton Avenue. Staff noted a correction for the report for site plan approval, (2023-17P.) The developer offered, in the spirit of affordability, a $450,000 payment in-lieu reflecting the value of 5 units rather than the $600,000 stated in the report. The affordable housing ordinance is not yet in effect. As noted in a recent case before the Plan Commission, a school district was concerned with the potential numbers of additional children to the school when a large development at Touhy & Linder was approved. In this case, the additional children in schools is minimal. There were several community members voicing their comments and concerns. A letter of objection was signed by 95 signatures and read into the record along with a few comments emailed to staff and the Plan Commission. -Most talked about too much density not fitting in with the small area. It is inconsiderate of the R1 neighbors. -A few spoke to Arie Crown’s commitment to put the property back on the tax rolls and how important it is to support the businesses within walking distance. It would be an opportunity to bring in more potential workers to the area. -Following LEED certification is better than Green Globe. Use green roofs and covered parking. The project has gone through many revisions after receiving input from staff, the Appearance Commission, as well as area neighbors. The petitioners met with the neighbors at three separate community meetings. The final version removed the multifamily housing component as originally proposed to reduce density and height, and the clubhouse to improve permeability. It also increased the rear setback from the required 30 feet to 40 feet, and the front setback from the required 20 feet to 25 feet. Window placement and building materials were also modified to incorporate feedback. The petitioner offered to put in place deed restrictions on the parcel to further restrict the allowed uses after rezoning from R1 to R4. Specifically, the uses that will be prohibited from being built are: stand-alone parking as a principle use, assisted-living services, skilled nursing facilities, and multi-family housing. While the Village does not have an affordable housing ordinance, the petitioners have agreed to a payment of a fee-in-lieu at 5% of the units at $150,000 each. The project at 68 units, generates 3.4 units in potential fee-in-lieu. The developer has agreed to pay for 3 units at the proposed $150,000/unit rate, which is a total of $450,000. The Plan Commission voted to approve relief for exceeding the 65% permeability by 2%. Subsequent modifications of the site plan mentioned above have brought the permeability percentage down to the allowed 65%. This relief is no longer required. PETITIONER’S SUBMITTAL The petitioner is requesting site plan approval to construct 68 townhouse residences, surface parking, and storm water detention at 4600 Main Street. Site plan approval is required in this instance because modifications are being made to buildings on a site 1 acre or larger in size. Significant attention was paid to the scope of the development, namely drastic reductions in overall height and density from the prior proposal, to ensure the Project will be harmonious with adjacent property and will not adversely affect adjacent properties. This will be a high-quality medium intensity Project which, typical of the area, will be comprised entirely of two- and three-bedroom single family residential townhomes. This is a reduction in density from the 3 and 4 story multi-family developments that can be found on properties across Main Street from the Project and in the R4 zoning for many blocks to the south. The existing private school on the project site has generated significant, but typical, school traffic, particularly during applicable school start and end times. Redeveloping this site will eliminate the real and perceived impact of educational facilities, including traffic, and add to an already strong residential, retail, restaurant, office and service building area. Established site control protocols or covenants will ensure that maintenance of this facility is ongoing to protect and preserve this significant asset. Sustainability and care for the environment are an important tenant of this project. Long before the Village provided the public with a draft of its Environmental Sustainability Plan (the “Sustainability Plan”), The Developer and its architect, committed to designing the Project to meet the Green Building Initiatives (“GBI”) requirements and protocols for a Green Globe certification. In addition to the construction of the new townhomes, the petitioner will also be making several improvements to the site, including: x The project’s applicants started consideration and study of this project in 2Q2022. Application for Site Plan Approval preceded the introduction of the ordinance (at this time no ordinance has been adopted). The project’s applicants have agreed to meet the spirit of the Village’s ordinance that is currently under consideration by the Village Board, which is payment of the fee-in-lieu at 5% of the units at $150,000. The project at 68 units, generates 3.4 units in potential fee-in-lieu. The developer has agreed to pay for 3 units at the proposed $150,000/unit rate, which is a total of $450,000 to the Village to meet the spirit of the ordinance. x Increasing rear setback from the required 30 feet to 40 feet, and the front setback from the required 20 feet to 25 feet. x Including open space setbacks at the northeast and northwest corners of the site. The petitioners are also requesting a map amendment to rezone the northern 165 feet of 4600 Main St property from R1 Single-Family to R4 Multifamily (2023-15P) and a subdivision of the subject site into a single lot (2023-16P). Engineering Division A total of 158 parking spaces are required for the subject site and 158 parking spaces are provided, meeting the parking requirement. South side of proposed development will be within zoned permit parking. Residents and guests will not be eligible for zone permit parking. If during construction any lane closures or sidewalk closures are intended, owner/contractor must apply for Public Way Obstruction or Use permit with Engineering. Application may be obtained with engineering or on Village website. Traffic control plan and fees will apply. The petitioner must obtain an MWRD determination letter to determine if an MWRD permit is required for the proposal. Any existing or proposed overhead telecommunication, fiber optic, electric, etc. services to the buildings and grounds office shall be buried or installed underground. Forestry Division Forestry staff requires tree protection fencing for site trees in a construction project. Please install per plan for site trees. For north boundary trees please extend out as far as possible. The fencing must remain in place for the duration of the construction project. A tree removal permit is required prior to demolition. The tree removal bond cost for this project is $18,000 which may be reimbursed at the end of the project depending on number of trees planted back. There is also a parkway tree removal permit required of $1,200 which is non-refundable. Mix in State Street maples with the Autumn Flame maples. No Colorado spruce; could substitute Bald cypress, Concolor fir or Norway spruce. Recommend Triumph elm instead of Accolade & mix in some Swamp white oaks with the Red oaks. Recommend American Sentry linden instead of Redmond but not required. Use native species where ever possible for all plantings. Fire Prevention Division Identify the property use and construction type of the clubhouse. Identify the codes used for the plans submitted. Private fire hydrants will be required on the south side of the clubhouse and on the north end of the property, due to the possible lengths of supply hose for fire suppression activities. These hydrants will be maintained in accordance with NFPA standards and the Adopted Municipal Codes of the Village of Skokie. The petitioner will install permeable paving in lower-use area of the site. The North fire lane and guest parking, and the parking immediately adjacent to the clubhouse. These changes will put the impermeable percentage at 67% and will require relief for the 2% over the max of 65%. Staff is supportive of this request for relief especially given that the project will contain all it’s stormwater on site and will not have a negative effect on the Village infrastructure or the neighboring properties. The Planning Division supports the proposed site plan approval request. The proposal will increase the housing supply in the Main Street corridor with 68 new townhouses. Estimating 0.33 children per unit for attached housing estimates 22 additional children from grade school to high school. The construction will seek to meet sustainability objectives and obtain Green Globes certification. Environmental objectives pursued through Green Globes lead to lower energy and water bills, reduced emissions, optimized health and wellness benefits, and minimized waste. The pedestrian experience will also be improved by the new development. The entire Main Street frontage will better meet the sidewalk with human scale buildings and improved landscaping. Also, the increased purchasing power of the new residents will only help the struggling Main St businesses to the east and west. All townhouses on the perimeter will have addresses using Main Street, Kenton Avenue, and Kilpatrick Avenue as the base street. The interior townhouses will use Bobolink Terrace as the street name in their address. Planning staff will determine the exact addressing for each of the townhouse units. APPEARANCE COMMISSION Appearance Commission review will occur after the Plan Commission has completed its deliberations. STAFF RECOMMENDATIONS Staff recommends that the petitioner’s request for site plan approval to develop 68 townhouse residences, surface parking, and stormwater detention at 4600 Main Street in an R4 Multifamily Housing zoning district be APPROVED based upon the Proposed Positive Findings of Fact for the site plan approval and subject to the recommended site plan approval conditions listed below. Mr. Gershon gave a detailed presentation of this high-end residential development that will improve the Main Street frontage. It has been in the making for 1½ years. This development will support the commercial, retail, and residential needs of the area. It is a huge change from the school use that impacted traffic and it will return the property to the tax rolls. The project consists of re-zoning the northern portion of the site to R4 which would allow the townhome development, a re-subdivision of the two parcels into a single new lot, and site plan approval for the creation of 68 new townhomes, surface parking, and storm water detention. The powerpoint presentation was entered into the record as document # 613507. The project has gone through many revisions after receiving input from staff, the Appearance Commission, as well as area neighbors. The current version removed the multifamily housing component from the development to reduce density. Mr. Sidel spoke of following protocols for Green Globe certification and adhering to sustainability guidelines even before the Village provided a draft of the Environmental Sustainability Plan. This is an all-rental development with the owners maintaining the open green space as well as a snow removal plan. The units will be 2 & 3- bedroom single-family residential townhomes with work from home areas, a clubhouse for socializing, a wine cooler area, exercise/work-out space, and 2 parks at the northeast and northwest sides of the site for mingling. The architects added that the development will have a 25-ft setback along Main Street, 2-car garages, electric vehicle charging stations, 22 guest parking spaces around the clubhouse, and 6-ft landscape buffers on Kenton and Kilpatrick with a single curb cut on each street. Mr. Aboona reminded all that the school use caused traffic surges due to school activities and redeveloping the site will eliminate the detrimental impact. He has concluded that access from Kenton and Kilpatrick is adequate. Village Code dictated the parking requirement of 158 parking spaces which has been met. Skokie’s standards are stricter than the national standards. There is on-street public parking on Main Street. In conclusion, Mr. Gershon stated that the project focused on sustainability even before the sustainability proposal was approved. There is a 57% density reduction from the original submission. He also mentioned that they are not requesting any relief and will commit to providing some affordable housing even though they are not obligated to do so as they submitted the proposal before any affordable housing decisions were made. A commissioner questioned the location of the 2 trash enclosures. According to the site plan, they are located on either side of the clubhouse. The petitioner confirmed that renters are required to bring their trash to the receptacles. He mentioned that trash removal will not be handled by the Village; a private company will haul it away. The commissioner also asked about pavement material. Mr. Sidel stated that they will be working out of the clubhouse seven days a week from 10A to 6P. Another commissioner inquired about rental rates. A 2-bedroom unit would be $3,700 monthly and a 3-bedroom would rent for $3,900 monthly. Another commissioner commented that a townhouse rental development would be a good option for those that can’t afford to own. Staff requested the reports be accepted into the record as written. They are in support of the project. For the subdivision case (2023-16P), a dedication at the northeast corner of the site is included in order to create a consistent 66-foot wide right-of-way along Kenton Avenue. Staff noted a correction for the report for site plan approval, (2023-17P.) The developer offered, in the spirit of affordability, a $450,000 payment in-lieu reflecting the value of 5 units rather than the $600,000 stated in the report. The affordable housing ordinance is not yet in effect. As noted in a recent case before the Plan Commission, a school district was concerned with the potential numbers of additional children to the school when a large development at Touhy & Linder was approved. In this case, the additional children in schools is minimal. There were several community members voicing their comments and concerns. A letter of objection was signed by 95 signatures and read into the record along with a few comments emailed to staff and the Plan Commission. -Most talked about too much density not fitting in with the small area. It is inconsiderate of the R1 neighbors. -A few spoke to Arie Crown’s commitment to put the property back on the tax rolls and how important it is to support the businesses within walking distance. It would be an opportunity to bring in more potential workers to the area. -Following LEED certification is better than Green Globe. Use green roofs and covered parking. Ordinance, Paid Leave for All Workers, Opt-out Item A is on the consent agenda for second reading and adoption. The first reading was on December 4,2023. This ordinance will exercise the Village's Home Rule Authority to affirmatively opt out of the Paid Leave for All Workers Act, which is set to take effect on January 1,2024. This law mandates that employees are entitled to a minimum of 40 hours of leave per year. As applied to the Village, theoretically, under the Act, an entire shift of police officers, firefighters, public works crews or Village Hall administrative staff could all request to be off work the same week or during an emergency response such as snow storms. This law exempts Park Districts and School Districts statewide. It is unclear if municipalities will also be exempted. The Paid Leave for All Workers Act does not include any express limitation on the Village's home rule authority and expressly authorizes local ordinances, providing any paid leave, to be the controlling regulation within the appropriate jurisdiction. It is in the best interest of the Village to clearly define the paid leave benefits that Village employees shall receive and thereby, as such, this ordinance will codify the current paid leave poiicy for all Village employees as set forth in the 2024 Village of Skokie Human Resources Policy Manual and any collective bargaining agreements or any other policies implemented by the Village Manager. It is worth noting that in addition to the municipalities that have already opted out of the legislation, including Hoffman Estates, Lake Forest, Palatine, Schaumburg, Oak Park, Wilmette and Winnetka, several others are considering opting out as well, including Buffalo Grove and Park Ridge.
