MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 7:30
p.m. on Tuesday, February 20, 2024
Pledge of Allegiance led by Assistant Village Manager Nicholas Wyatt.
Mayor Van Dusen called the meeting to order.
The Assistant Manager called the Roll. Those present were Trustees Sutker, Robinson, Khoeun,

JJ Avaska and Gail Schechter from Skokie Neighbors for Housing Justice spoke about shortage of
affordable housing, mixed developments, subsiding luxury developments and passing
inclusionary housing ordinance.
Lauren Grodnicki- power point presentation concerning Housing affordability and health
outcomes.
Rachel Vanhooes, thanked the Fine Arts Commission for the presentation. She spoke about
developing Oakton street-vacant store fronts and Main Street.
Emi Yamauchi spoke about the Skokie news and the Old Orchard development, blighted business
district and the sales tax increase.
James Johnson continued the history of the legal department and reforming the department.
Trustee Klein spoke about “Point of Order procedure” , disruption and repetition of Trustee
Johnson.
Trustee Sutker spoke about the accomplishments of the Village Board and Trustee Johnson
comments are distracting.

2024-2025 Community Development Block Grant Public Hearing #2.
Justin Malone, Neighborhood & Housing Coordinator/CDBG Administrator presented the Public
Hearing.
The Village's entitlement grants for Program Year 2024/Fiscal Year 2025 (PY24/FY25) is not yet known.
At this time, we are estimating between $500,000 to $600,000 in entitlement funds. Proposals from both
Viliage staff and outside agencies total $1,001,060, so reductions will be necessary. The program's 20%
cap for administrative funding and the 15% cap for public service funding (non'capital/non-construction
expenditures) is applied against the new entitlement, while there is no cap on capitaVconstruction
projects.

Planning Program.
Housing
VOS - Home Funding wi!! be used to continue the Village's 80,000

Infrastructure

VOS-Sidewalk Funding will be used to provide grants to 3,000
Replacement Program home owners meeting low/moderate-income
eligibility,

HODC - Housing Funding will be used to install security cameras at 45,000

Development Corporation
The Harbour Funding will be used to Instali low voltage wiring at 38,250
three of Harbour's transitional housing facilities.
AHS Family Health Center Funding will be used for facilities impfovements of 20,000
dinic parking lot at 8800 N Lockwood Avenue.
Turning Point Funding will be used for facility improvements at 13,408
the main and garage door entrances.
SHORE Funding will be used to replace a boiler at the Lois 67,442

Partners Employment Services Program.
Orchard Village Funding will be used to support staffing of direct 30,000
care staff.
PEER Services Fundine will be used to offset the costs with 15,000
employing an aduit and adolescent coordfflstor.
Children's Advocacy Funding will be used to support mental health 1.0,000
Center of North and counseling services.
Northwest Cook County
North Shore Senior Funding will be ysed for support fof case 12,000
Center(NSSC) management, supportive counseling, arid senfices
for older aduits living in Skokie.

All the 2024 Construction /rehabilitation projects gave a short presentation.
The 2024 Public services applicants except for Children's Advocacy center spoke.
Budget recommendations by staff will be presented at the next public hearing on Tuesday,
February 20, 2024. The Board will determine at that time the proposed funding award for each
project or activity.

Howard Sprout spoke about Natural Gas and the proposed Gas powered leafblower ban.
Emi Yamauchi inquired about the Hilton Hotel construction and whether there are any
updates.
Lauren Grodmcki have a presentation on what does "affordable housing" mean. She spoke
about the technical defmition, renting affordable housing and a family of 4 monthly
budget.
A resident at 5021 SufTield Ct. spoke about snow and ice in her alley.
Trustee Johnson addressed the Board continuing a series on reforming the Village of
Skokie Legal Department. He spoke about a Code of Ethics for municipal officers in the
Village Legal Department similar to the ICMA Code of Ethics,

A. Commercial Corridor Storefront Enhancement Prparam: 7909 Lincoln
Avenue.
Owners Brenda Phung and her daughter Donna Nguyen plan to bring a new
contemporary hot pot restaurant in Downtown Skokie called The Spot. Hot pot is a
traditional Asian dish that involves various ingredients being cooked in a pot of
simmering broth. This new restaurant will be located at 7909 Lincoln and is
expecting to employ 15-20 full and part-time employees. This is the former
Robert's Office Supply store location.
The owner has applied for funding under the Commercial Corridor Storefront
Enhancement Program (SEP) for exterior and interior work. The SEP Program
encourages enhancing the commercial corridors in town. The reimbursement
grant is a 60/40 cost-share with the applicant paying 60%. The exterior work
includes new darker bricks, replacing the doors with new double doors, replacing
the windows and adding windows on the wail facing the parking lot to add extra
sunlight. Interior improvements include demolition and new plumbing, HVAC,
kitchen, epoxy flooring, electrical, washrooms and carpentry.
The total cost to revitalize the building is estimated at $650,000. The total Village
SEP grant recommended is a maximum $50,000. The work must be completed
within one year. Mayor and Board approval for a grant not to exceed $50,000 is
respectfully requested for The Spot, located at 7909 Lincoln Avenue.

STOREFRONT ENHANCEMENT PROGRAM APPROVAL FOR THE SPOT
RESTAURANT, 7909 LINCOLN AVENUE
Commercial Corridor Storefront Enhancement Program: 4845 Oakton Street. The Village's Commercial
Corridor Storefront Enhancement Program (SEP) encourages enhancing the commercial corridors in
town. The program recognizes the need and cost of reinvesting in these properties and thus offers
storefront grant reimbursements for exterior and interior renovations. The reimbursement grant is a 60/40
cost-share with the applicant paying 60%. Owners Brenda Phung and her daughter Donna Nguyen will be
in attendance.
Staff recommends Village Board approval of the Storefront Enhancement Program for a maximum of
$50,000 based on The Spot's $650,000 investment in revitalizing the building where the restaurant will be
opening. Work must be completed within one (1) year of the date of this approval and all paid receipts
must be provided. Total reimbursement will be 40% of the lessor amount between actual and estimated
costs and shall not exceed $50,000.
Background: The Spot will be a new contemporary and vibrant hot pot restaurant that will cater to the
discerning palates of Skokie residents and visitors. Hot pot is a traditional Asian dish, which can come in
many variations that involve cooking various ingredients, including seafood, vegetables, and meats, in a
pot of simmering broth. This restaurant will provide customers with a unique and interactive dining
experience, allowing them to customize their meals by selecting from a wide range of high-quality
ingredients. Introducing an all-you- can-eat concept restaurant with a unique conveyor belt concept wiU
attract a wide range of customers. They are expecting to hire 15-20 full and part-time employees.
Exterior improvements would include changing the bricks in the front of the building to a more modern
and appealing, darker brick. The existing doors are going to be changed into new double doors and the
windows replaced. The wall on the side of the parking lot will have windows added to let in extra
sunlight.
Interior improvements will include the demolition of everything (removing tiles, ceiling, dry wails, and
bathroom fixtures). There will be new plumbing, HVAC, kitchen, epoxy flooring, electrical, washrooms,
and carpentry. The space will be divided into the dining area, private dining rooms, kitchen, bathrooms,
and office ensuring our upscale and modem vision comes to life.
The owner has submitted a Storefront Enhancement Application for exterior work, interior work and
signage. Two (2) estimates were submitted for exterior and interior work. Included in the original
estimates is design, materials, and construction.

This ordinance will reclassify the zoning of a portion of 4600 Main Street from an R1
Singfe-Family district to an R4 Multifamily Housing district. The portion to be
reclassified is approximately the northern 165 feet of 4600 Main Street. This action
will place the entirety of the site, on which currently exists the Arie Crown Hebrew Day
School, in one zoning classification, R4 Multifamity Housing district.
*B. Ordinance, Plat of Subdivision, 2023-16P. 4600 Main Street
Item B is on the consent agenda for second reading and adoption. The first reading
was on December 18, 2023.
This ordinance will approve and accept the Greenspace Development Project p!at
of subdivision, dated July 25, 2023, making 4600 Main Street into one lot. The
subdivision plat includes the dedication of a strip of land, 33 feet in width and 165.05
feet in length, which abuts Kenton Avenue to the east. This dedication is needed in order
to create a consistent 66 foot wide right of way along Kenton Avenue. There shall be no
compensation from the Village for this dedication.
*C. Ordinance, Site Plan Approval, 2023-17P, 4600 Main Street
Item C is on the consent agenda for second reading and adoption. The first reading
was on December 18, 2023.
This ordinance wilt grant site plan approval to construct and establish a townhouse
development in an R4 Multlfamily Housing district at 4600 Main Street. This 68
townhome development has undergone many revisions by the Developer in response
to input received from area neighbors and Village staff. The developer and its
representatives have met with concerned neighbors on three separate occasions at
open community meetings. The plan presented removed the both the multifamily
housing component and the clubhouse, in order to reduce density, height and use,
and to improve permeability.

25 assisted-living services, skilled nursing facilities, and multi-family housing; and
26 WHEREAS, while Village has not adopted affordable housing requirements which
27 would direct this project/ Petitioner has agreed to a payment of a fee-in-lieu of 5% of the
28 units at $150,000 each. The development project at 68 units, will generate 3.4 units in
29 potential fee-in-lieu for a total of $450,000 to be placed in a fee-in-lieu fund; and

1 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on August 3,

21 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
22 Village ofSkokie, Cook County, Illinois:
23 Section 1: That the Site Plan approval requested by the petitioner to construct and
24 establish a townhouse development at the property legally described above and commonly
25 known as 4600 Main Street, Skokie in an R4 Multifamily Housing district is hereby granted and
26 approved subject to each of the conditions set forth below:
27 1. Prior to obtaining building permits, the petitioner must submit language of the
28 deed restriction on the allowed uses that will be prohibited from being built:
29 stand-alone parking as a principle use, asslsted-living services, skilled nursing
30 facilities, and multi-family housing.
31 2. Upon conversion to individual for-sale units, an association must be created
32 that is responsible for the maintenance of common elements including but not
33 limited to garbage.
34 3. Prior to the issuance of a building permit, the petitioner must obtain an MWRD
35 determination letter to determine if an MWRD permit is required for the
36 proposal.
37 4. The petitioners shall develop the Subject Property in substantial conformance
38 with the fina! Village approved site plan, dated October 16, 2023, landscape
39 plan, dated October 1 1, 2023, and elevations, dated October 23, 2023.
40 5. Parking !ot and exterior lighting shall meet illuminating Engineering Society of
41 North America (IES) standards, be full cut-off design, and be directed away

1 from adjacent properties, subject to the approval of the Engineering Division.
2 6. All existing damaged public sidewalks or public sidewalks damaged due to the
3 implementation of this pian shall be replaced.
4 7. All fencing, wails, sidewalks, driveways, curbs, wheel stops, parking areas,
5 signage, landscaping, structures, and any other facifities or infrastructure on
6 the Subject Property shall be maintained in a good state of repair, and when
7 needed, be repaired or replaced in a time!y manner.
s 8. All private and public sidewalks shall be maintained free of snow, ice, s!eet, or
9 other objects that may impede travel.
to 9. Trash shall only be allowed within a designated trash enclosure as depicted
n on site plan dated October 16, 2023 and shall be screened from public view in
12 an enclosure approved by the Appearance Commission. All trash shall be
13 contained in such a way as to remain out of sight at a!l times.
14 10. All off-street parking spaces shall be legibly striped and maintained.
15 11. Any plan to modify parking lot striping must be approved by the Director of
16 Engineering.
17 12. The proposed development shall have a minimum of 158 on-site off-street
18 vehicle parking spaces.
19 13. The handicapped parking spaces shall be installed and maintained in
20 compliance with State of Illinois Accessibility Standards and the Skokie Village
21 Code, including required signage.
22 14. Vehicles shall not be allowed to be parked In or otherwise block common
23 driveways, sidewalks, aisles, or other points of access at any time, shall only
24 be parked in designated parking spaces, and shall not overlap the striped lines
25 of designated parking spaces.
26 15. All overhead new utilities on the Subject Property shall be placed or relocated
27 underground. The petitioner shall bear the full cost of any utility relocation
28 and/or conflicts.
29 16. The petitioner shall sign an "Agreement for installation and Maintenance of
30 Landscaping" to assure that the Subject Property and parkway landscaping is
31 completed and maintained, including trimming, watering, and replacing of
32 dead plant materials in a timely manner in accordance with the final approved
33 landscape plan. A copy of said Agreement is attached hereto, marked Exhibit
34 "A" and hereby made part of this Ordinance. This "Agreement for Installation
35 and Maintenance of Landscaping" shall be recorded at the petitioner's
36 expense.
37 17. All new construction, alterations, and remodeling shall meet current
38 International Building and NFPA Life Safety Codes as amended.
39 18. The petitioner shall obtain ati required permits and approvals for
40 improvements to County, State, or Federal rights-of-way from the governing
41 jurisdiction.
42 19. The Subject Property must conform to the Village's storm water control

1 requirements as contained in the Skokie Village Code, including the
2 disconnection ofanydownspouts.
3 20. All signage shall conform to the Skokie Village Code, except as provided in
4 this ordinance.
5 21. The petitioner shall submit to the Planning Division electronic files of the plat
6 of survey, site p!an, and landscape plan in their approved and finalized form.
7 The files shall be scaled 2-dimensional drawing files on non-compressed, non-
s read only CD-ROM *.dwg AutoCAD format.
9 22. Prior to the issuance of building permits, the petitioner shall submit to the
to Planning Division of the Community Development Department the name,
n property address, email address, and telephone number of the company and
12 contact person responsible for site maintenance in compliance with this site
13 plan approval.
14 23. If work is to be performed on public property or if public property is utilized or
15 impacted during construction and/or deveiopment, the owner shall provide, or
16 shall cause the developer and/or contractor to provide, the Village of Skokie
17 with a certificate of insurance naming the Village of Skokie as additionally
is insured for any and all claims related to any and all work. The owner sha!
19 hold, and shall cause the Developer and/or contractor to hold, the Village of
20 Skokie harmless and indemnify the Village for any and all daims for property
21 damage or personal injury related to work on or use of public property.
22 24. The petitioner shall comply with all Federal and State statutes, laws, rules and
23 regulations and a!l Village codes, ordinances, rules, and reguiations.
24 25. Failure to abide by any and all terms of this Ordinance shall be cause for the
25 Village to initiate hearings to determine whether the subject Ordinance, as well
26 as any applicable business licenses, should be revised or revoked. The
27 petitioner shall pay all costs related to any hearings conducted as a result of
28 non-compliance with any of the provisions of the enabling ordinance. The
29 costs shall indude but not be limited to court reporter fees, attorney fees, and
30 staff time required researching and conducting said hearing.
31 Section 2: That a notice of the approval of this Ordinance incorporating the
32 conditions contained herein shall be executed by the owner of the property in writing and
33 duly recorded with the Cook County Clerk's Office at the owner's expense.
34 Section 3: That this Ordinance shall be in full force and effect from and after its
35 passage, approval, and recordation as provided by law.

This Agreement is entered into this_day of_2024 by and
behveen Arie Crov/n Hebrew Day School, hereinafter referred to as "PROPERTY OWNER", and
the VILLAGE OF SKOKIE, an Illinois municipal corporation, hereinafter referred to as
"VILLAGE". The parties to this Agreement hereby agree as follows:
PROPERTY OWNER is the owner of real property located in the Village of Skokie,
LOT 1 IN GREENSPACE DEVELOPMENT PROJECT. BEING A RESUBDIVISION
OF THAT PART OF THE NORTHWEST QUARTER OF SECTION 22. TOWNSHIP
41 NORTH. RANGE 13 EAST OF THE THIRD PRINCIPAL MERIDIAN. ALL IN COOK
COUNTY. ILUNOIS.
PINS: 10-22-102-017-0000, 10-22-104-024-0000
1. At or near the time of execution of this Agreement. the VILLAGE granted an
Occupancy Permit, Business License, Site Plan Approval or Special Use Permit
hereinafter collectively referred to as "permit pursuant to state statutes and local
ordinances.
2. By the terms of the aforesaid permit, the PROPERTV OWNER is required to install
and maintain landscaping in accordance with the plan dated October 25,
or as it may be subsequently revised v/ilh the approval of the Village Manager, or
designee, and the Corporation Counsel.
3. The parties to this Agreement recognize that the installation and maintenance of
landscaping is an integral part of the PROPERTY OWNER'S plan for development
and/or use of the property and is necessary to carry out the purpose and intent of the
VILLAGE'S land use objectives, and that the permit would not have been approved
by the VILLAGE without the assurance that this Agreement would be executed by
the PROPERTY OWNER.
4. The purpose of this Agreement is to assure:
(a) installation of the landscaping in accordance with the landscaping plan
approved by the VILLAGE, and
(b) continued maintenance and care of the landscaping, including any
landscaping indicated in the parkway area.
5. The property, which is the subject matter of this Agreement, is legally described
above. The portions of the Subject Property which are to be landscaped and
maintained pursuant to the terms and conditions of thi[s Agreement are indicated on

the Landscape Plan attached hereto, marked Exhibit "1" and are hereby made a part
of this Agreement.
6. PROPERTY OWNER agrees that the installation and maintenance of the
landscaping which is required in accordance with the permit issued by the VILLAGE
and this Agreement wit! materially benefit the Subject Property. Such landscaping is
necessary in order for the PROPERTY OWNER to comply with the conditions of the
permit issued or granted by the VILLAGE for the PROPERTYF OWNER'S requested
development or use of the property.
7. PROPERTY OWNER shall diligently maintain and care for the landscaping which is
installed and required by the permit and this Agreement, using generally accepted
methods of cultivation and watering. The PROPERTY OWNER shall maintain a
standard of care necessary to prevent the landscaping from deteriorating to the
extent that its value as landscaping is destroyed. If Exhibit "1". attached hereto or
permit specifies maintenance standards or procedures, such procedures are hereby
adopted as part of this Agreement, and by such adoption, become enforcement
conditions of this Agreement.
8. Failure to maintain the landscaping as required by this Agreement shaft be a
nuisance. !n the event the PROPERTY OWNER fails to meet the standard of
maintenance necessary to keep the landscaping in a healthy condition as required
by this Agreement, the VILLAGE shall give written notice of the deficiency to the
PROPERTY OWNER who shaft have 20 days to make the necessary correction or
replacement. If such correction or replacement is not made within the aforesaid 20-
day period, the VILLAGE may elect to abate the nuisance and take necessary action
to assure that the landscaping is replaced and/or maintained. In the event, the
VILLAGE so elects; the VILLAGE shall serve notice of its intent to enter the
premises for this purpose. The VILLAGE shall either personally serve the notice
upon the PROPERTY OWNER or mail a copy of it by certified mail to Ihe
PROPERTY OWNER'S last known address, or as shown on the tax rolls, at least 15
days in advance of the date when the VILLAGE or its agent intends to enter the
premises.
9. For this purpose, the VILLAGE or its agent may enter upon the property and perform
such work as it considers reasonably necessary and proper to restore, maintain, or
replace the landscaping required by this Agreement. The VILLAGE may act either
through its own employees or through an independent contractor.
10. The VILLAGE shall be entitled to reimbursement for abating the nuisance in
restoring, maintaining or replacing the landscaping, provided that the VILLAGE
follows the procedures set forth in this Agreement. Costs shall include but shall not
be limited to actual costs incurred by the VILLAGE and administrative costs. The
VILLAGE shall make demand upon the PROPERTY OWNER for payment. If the
PROPERT/ OWNER fails to pay the costs within 30 days of the date on which
demand is made, the VILLAGE may cause a lien to be placed on the Subject
Property. The VILLAGE may record a notice with the Recorder of Deeds for Cook
County stating that it has incurred expenses under the terms this Landscape
Agreement. The VILLAGE shall be entitled to collect interest at the statutory rate on
the amount owed.

11. In addition to having a lien placed on the Subject Property, the VILLAGE may
institute a legal action to collect the amount owed. The PROPERTY OWNER agrees
to pay the VILLAGE a reasonable sum for attorney's fees and court costs.
12. If either party upon the execution of this Agreement or during the course of
performance considers that it is necessary to have the PROPERTV OWNER post
additional security to guarantee the performance of his obligations hereunder, the
VILLAGE may require the PROPERTY OWNER to post additional security. The
VILLAGE may require either a cash deposit or a surety bond guaranteeing
performance in a form signed by sureties satisfactory to the VILLAGE. The
condition of the security shall be that if the PROPERTY OWNER fails to perform any
obligation under this Agreement, the VILLAGE may, act on behalf of the
PROPERTY OWNER and use the proceeds of the cash bond, or in the case of a
surety bond, require the securities to perform the obligations of this Agreement.
13. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the
VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions
or causes of action for personal injury, property damage or otherwise, including
reasonable attorney's fees, which may arise from the VILLAGE exercising any of its
rights or obligations and performance under this Agreement.
14. All notices required or to be given pursuant hereto shall be in writing and either
delivered personally or by a nationally recognized "over-nighf courier service or
mailed by United States certified or registered mail, postage prepaid, addressed to
the VILLAGE and the PROPERn OWNER as follows:

16. This Agreement pertains to, runs with the Subject Property, and shall be binding on
the successors, assigns, and heirs in interest.
17. This Agreement shall be recorded at the PROPERTY OWNER'S expense in the
Cook County Clerk's Office.

RESOLUTION REGARDING THE APPROVAL AND THE RELEASE
OF EXECUTIVE SESSION MINUTES AND VERBATIM RECORDING OF
THE MAYOR AND BOARD OF TRUSTEES
1 WHEREAS, the Village of Skokie (hereinafter "Village") is a home rule municipal
2 corporation in accordance with Article VH, Section 6(a) of the Constitution of the State of
3 Illinois of 1970. Pursuant to the Illinois Open Meetings Act, 5 !LCS 120/1 et seq. (hereinafter
4 "Act"); and
5 WHEREAS, the Mayor and Board of Trustees of the Village have met from time to
6 time in meetings that were closed to the public for purposes authorized by the Act
7 (collectively "Executive Sessions"); and
8 WHEREAS, as required by the Act, the Village has kept written minutes and verbatim
9 recordings of all such Executive Sessions; and
10 WHEREAS, pursuant to a request by the Public Access Counselor ("hereinafter
n PAC") in a letter, dated January 18, 2024. referencing the release of the "February 21, 2023,
12 closed session verbatim recording and minutes pertaining to the hotel development project",
13 the Mayor and Board of Trustees, in a duly noticed open meeting on February 5, 2024, voted
14 to direct the Corporation Counsel to prepare a Resolution for the release of minutes and
15 verbatim recording and make them available for public inspection. The PAC letter referenced
16 only the minutes and verbatim recording pertaining to the hotel development project to be
17 released and stated that the "Board may redact the portion of the verbatim recording and
is minutes pertaining to other matters";
19 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
20 Village of Skokie, Cook County, Illinois, as follows:
21 Section 1: The Mayor and Board of Trustees do hereby approve the written
22 minutes of the Executive Session on February 21, 2023 pertaining to the hotel development
23 at 8009 Niles Avenue.
24 Section 2: The Mayor and Board of Trustees do hereby authorize the public
25 inspection of the written minutes of the Executive Session on February 21, 2023 pertaining
26 to the hotel development at 8009 Niles Avenue and as such, shall be made available for
27 public inspection, pursuant to the Act and the Illinois Freedom of Information Act, 5 !LCS
28 140/1,etseq.
29 Section 3: The Mayor and Board of Trustees do hereby authorize the release and
30 public inspection of the verbatim recording of the Executive Session on February 21, 2023
31 pertaining to the hotei development at 8009 Nifes Avenue.
32 Section 4: That the Village Clerk is hereby authorized and directed to make the
33 minutes and verbatim recording, in accordance with this Resolution, available for public
34 inspection.
