Mayor Van Dusen called the meeting to order.
The Clerk called the Roll. Those present were Trustees Sutker, Robinson, Khoemi, Johnson,
Pure Slovin, Klein and Mayor Van Dusen. Trustee Klein will be an'iving late.
Motion to approve the Consent Agenda with the exception of the Proclamation and approval of
the minutes. Trustee Johnson thanked Village Clerk Desai and Manager Lockerby for approving
the Budget Hearing Minutes.

Annual Comprehensive Financial Report (ACFR) Pt-esentation by Jasieen Kam- ofLauterbach & Amen,
LLP
Ms. Jasteen Kaur ofLauterbach & Amen made a brief presentation on the annual audit. The 2023 ACFR
includes the audit opinion from the auditors, who attest that the Viifage has properly reported its financial
position in accordance with accounting standards. Afso the Auditor's Management Letter report discusses
the results of the internal control review undertaken as part ofthe annual audit.

of permitted active licenses for pawnbrokers.
Trustees Robinson, Klein, Khoeun and Pure SIovin spoke on the subject. Also resident David lancu
commented on the subject.

A. Ordinance 24-5-C-4684
Motion to approve an ordinance amending Chapters 46 and 58 of the Skokie Viilage Code pertaining to
Affordabie Housing. Item A is on the agenda for second reading and adoption. The first reading was on
April 15,2024.
Corporation Lorge stated that this ordinance is a new version of several previous!y proposed ordinance
which encompassed the request and directions of the Trustees, concepts from public comments,
stakehol'der input and the Plan Commission's presentation to the Village Board.

Trustee KIein spoke about Skokie's housing at 22% affordable and over 287 emails from
residents to vote NO,
Trustee Pure Slovin stated that this Ordinance does not address needs of residents.
Trustee Johnson spoke about renters paying over 50% income for housing, parking issues,
affordable rates, 2 tier structure, fee in lieu, and does not create affordable units,
Trustee Robinson, Sutker, Khoeun stated that it is far from perfect, that it is a start and a
compromise, stepping stone, start and tract data, and having a Housing Commission,
Trustee Johnson made a motion to amend the original motion of58.43B4 that large
developments with 150 or more would not be eligible for fee-in-lieu.

Trustee Johnson made a motion to amend the Resolution preceding this Ordinance to establish an
Independent Housing Committee within 90 days.

Gail Schechter from Skokie Neighbors for Housing Justice spoke about the Inciusionary Ordinance.
Jan Beiadi spoke about the Ordinance and read a fetter from Emi Yamauchi concerning
Affordable housing.
Sue Lobach from Joining forces for AffordabJe Housing that is a program of Connection for the
Homeless spoke about the housing crisis.
Lauren Grodnicld spoke about the Ordinance far from being perfect but to have something in place is
good.
Trustee Johnson spoke abouthalfofSkokie or majority are rent challenged, paying over 30% of their
income for rent.
David lancu asked Trustee Johnson for clarification on his statement about Skokie renter's being cost
burden.
Jason Amrani spoke about surrounding suburbs of Skokie and how the housing numbers are lower with
the mandate in place. According to HUD, most of the numbers have decreased. Skokie is at 21.9%
affordability.
Mayor Van Dusen stated that the State of Illinois strives to achieve at ieast 1 0% minimum low &
moderate Income by the Illinois housing Development Authority,
George Hanus- commended the Board for the service of the Police and Fireman. He is opposed to the
Affordable Ordinance.
Kevin Foley-green energy, affordable housing and electric power is affecting his business.
Michelie Neuendorf spoke about the closure ofBessie Rhodes School, Mayor Van Dusen wrote the
Board President a letter concerned about the announcement of closing of the potential District 65 schoo!.
Lauren Grodnicki spoke about City of Chicago's bird strike ordinance. Skokie isa leader of Bird Strike
Mitigation, She also did a Power Point on Environmental Impact.

Village of Skokie Budget Hearing #3 - Meeting Minutes

The Village's FY25 Proposed Budget and Budget Message, a detailed summary of the budget/ are
available for review on the Village's website, www.skokie.org/budRet. Annually/ the Village Board
reviews the budget at three public budget hearings. These hearings are open to the public and also are
streamed live and archived on the Village's YouTube channel.
The Mayor called the meeting to order at 6:15 p.m.
Those present were Trustees Robinson, Johnson/ Pure Slovin, Klein and Mayor Van Dusen. Also present
was Clerk Minal Desal, Corporate Counsel/ Michael Large, Village Manager/ John Lockerby, Assistant
Village Manager, Nick Wyatt, Assistant to the Village Manager, Alex Franz/ and Executive Assistant to the
Mayor, Vicky Varga. Absent was Trustees Khoeun and Sutker.
Review of Budgets:
I. Boards and Commissions
a. Board of Health
Chair, Edward Linn, Vice Chair, Sibyl Yau/ and Health and Human Services Director,
Michael Charley, presented the FY25 Board of Health budget. Trustee Klein asked if the
CDC is recommending that people get additional Covid-19 boosters. Edward explained
that they are and that the frequency that one should get them is based on age and
health factors. Trustee Klein asked if the Covid-19 vaccination will be added to
childhood vaccination schedules. Trustee Robinson complimented the Board of Health
and asked about mental health services. Trustee Pure Slovin asked if the Village is doing
a good enough job at educating residents on health resources available to them. Trustee
Pure Slovin suggested meeting with clergy groups in Skokie to disseminate information.
b. Commission on Family Services
Chair, Harold Primack, and Social Worker, Melissa Versch/ presented the FY25
Commission on Family Services Budget.
c. Human Relations Commission
Commissioner, Sheila Crumrine, and Social Worker, Amanda Sabri, presented the FY25
Human Relations Commission budget. Trustee Johnson thanked the commission for
their fair housing event. Michael Large suggested that the Corporation Counsels office
conduct another fair housing seminar for the commission.
d. Plan Commission
Chair, Paul Luke/ and Community Development Director, Johanna Nyden/ presented the
FY25 Plan Commission budget. Mayor Van Dusen asked about the Housing Sub-
committee report. Johanna stated that they hope to have it completed some time in
June or July.
e. Zoning Board of Appeals

Chair, Brian O'Donnell, Community Development Director, Johanna Nyden, and Building
and Zoning Manager, Brian Augustine/ presented the FY25 Zoning Board of Appeals
(ZBA) budget. Mayor Van Dusen inquired on building height requirements. Trustee
Robinson asked about increased interest in developing in Skokie. Brian 0'Donne!! noted
the differences between the ZBA and Plan Commission.
f. Appearance Commission
Chair, Michael lynk. Community Development Director, Johanna Nyden, and Building
and Zoning Manager, Brian Augustine, presented the FY25 budget for the Appearance
Commission.
g. Public Safety Commission
Chair/ Paul Pitalis, and Engineering Director, Russ Rietveld, presented the FY25 Public
Safety Commission budget. Trustee Robinson asked if the Commission has any events
this summer.
h. Fine Arts Commission
Chair, Pamela Garbarini/ and Communications Manager/ Meredith Gioia, presented the
FY25 Fine Arts Commission budget. Trustee Klein congratulated the Commission on their
accomplishments.
i. Beautification & improvement Commission
Chair/ Bob Quane, and Forester, Cathy Stevens, presented the FY25 Beautification &
Improvement Commission budget. Trustee Pure Slovin asked if residents are getting
interested in native landscaping. Trustee Johnson complimented the commission for all
their hard work.
j. Consumer Affairs Commission
Chair, Biju Krishnan/ and Community Development Director, Johanna Nyden/ presented
the FY25 budget for the Consumer Affairs Commission.
Trustee Johnson discussed consolidating the Plan Commission and Zoning Board of Appeals (ZBA).
Trustee Pure Slovin asked how many residents serve on each commission and noted that residents enjoy
the sense of civic pride. Trustee Klein asked what the purpose of eliminating the ZBA was. Trustee
Johnson noted that the ZBA has a small workload. Trustee Klein noted that members only get paid if
there is a meeting. Trustee Johnson asked the Mayor for his thoughts. Mayor Van Dusen said that it was
something to explore but that the ZBA chair explained that an increase of ZBA cases is forthcoming.
II. Performing Arts Center
Executive Director, Lynn Cannon, Corporate Internal Auditor of Venuworks, Pat Ahters, Performing
Arts Center Board Chair, Terry Guolee, and Assistant to the Village Manager/ Alex Franz/ presented
the FY25 Performing Arts Center budget.
ill. Corporation Counsel
Corporation Counsel/ Michael Large, and Assistant Corporation Counsels, Jim Mccarthy, Barb
Mangler, and Avi Funk, presented the FY25 Corporation Counsel budget. Trustee Johnson inquired
about video gaming and requested that a memo be drafted to the Village Board before an
ordinance appears on the agenda. Trustee Johnson asked how much the Corporation Counsel

Department has spent on outside counsel. Trustee Johnson asked how much staff time has been
spent on Attorney General violations. Mayor Van Dusen noted that they are alleged violations.
Trustee Johnson asked if the department has completed a comprehensive review of the Village's
open meeting act process. Trustee Johnson asked when the annual review of the Village Manager
and Corporation Counsel is going to be. Mayor Van Dusen noted that he would like the Executive
Session Procedure Policy in place.
IV. Board of Fire and Police Commission
Chair, Willard Evans, Jr., Human Resources Director/ Debra Stinson, and Police Chief, Jesse Barnes
presented the FY25 budget for the Board of Fire and Police Commission. Trustee Robinson asked
about the Commissions outreach and partnerships. Trustee Pure Slovin asked about lateral
transfers and if they area concern for the Police Department.
V. Police
Police Chief, Jesse Barnes, Deputy Chiefs, Denise Franklin and John Oakley/ Communications
Supervisor/ John Barkhoo, and Management Analyst, Enkhnasan Taylor, presented the FY25 Police
Department budget. Trustee Pure Slovin asked how many officers are out on extended leave and at

113. Trustee Kiein asked what it would take to get to 115 officers. John Lockerby and Chief Barnes
noted that they would conduct an analysis on the staffing needs of the department once 113
officers was reached. Trustee Pure Slovin agreed that it would be best to conduct an analysis after
all 113 officer positions are staffed. Trustee Pure Slovin requested that the analysis be completed in
six months. Trustee Johnson asked about the co-responder program and if a second co-responder
team is needed. Chief Barnes explained that an analysis will be completed in 6 months. Trustee
Johnson asked about body worn camera FOIA requests and if the Attorney General has investigated
any FOIA responses. John Lockerby explained that staff wiil research this.
VI. Grant Programming
Assistant to the Village Manager, Alex Franz, presented the FY25 Grant Programming budget.
Public Comments:
Trustee Johnson commented on alleged Open Meetings Act and Freedom of Information Act violations.
Trustee Johnson asked that the Village Board stop fighting Attorney Genera! investigations. Mayor Van
Dusen noted that an alleged violation does not mean that the Viiiage is at fault.

WHEREAS, emergency medical services are a vital public service; and
WHEREAS, members of emergency medical services teams are ready to
provide lifesavmg care to those in need 24 hours a day, seven days a week; and
WHEREAS, access to quality emergency care dramatically improves the
survival and recovery rate of those who experience sudden illness or injury; and
WHEREAS, emergency medical services demonstrate the teamwork of
emergency physicians, emergency nurses, emergency medical technicians,
paramedics, fireffghters, dispatchers, educators, administrators, and others; and
WHEREAS, the members of emergency medical services teams, whether
career or yo/unteer, engage in thousands of hours of specialized training and
continuing education, to enhance their lifesaving skills; and
WHEREAS, it is appropriate to recognize the value and accomplishments of
emergency medical services providers and particularly our Skokie Fire Department
First-Responders who provided professional, empathetic care for more than 8,000
patients this past year; and
WHEREAS, the United States of America is celebrating the 50th Anniversary
of EMS Week; and
WHEREAS, this year's theme "Honoring our Past, Forging the Future"
recognizes the tremendous contributions of EMS Providers for half a century, while
continuing to strive to improve services and patient outcomes.
NOW, THEREFORE, /, GEORGE VAN DUSEN, Mayor of the Village of

A. Commercial Corridor Storefront Enhancement Program approval for Slyce
Restaurant, 4849 Oakton Street. $35,220
Slyce Restaurant has applied for funding under the Commercial Corridor
Storefront Enhancement Program (SEP) for their newest location at 4849 Oakton
Street. Owner Daut Ibisi’s mission is to bring New York style food to Skokie. This
will be their second location. The food served will be Halal and include pizza,
chopped cheese and loaded fries, gyros and chicken over rice. The applicant will
be investing over $100,000 into the buildout and has received two bids for interior
work to include new equipment/venting components such as griddles and fryers,
pizza, sandwich and dessert preparation tables, tables for hot storage, a walk in
cooler and freezer, electrical and ventilation upgrades. Goldstone Construction
has been chosen to do the work and will include the design, materials and
construction. Therefore, the total Village SEP grant recommended is a maximum
of $35,220. Mayor and Board approval for a grant not to exceed $35,220 is
respectfully requested for Slyce Restaurant, located at 4849 Oakton Street.
B. Updated proposed, conditions, and concepts for regulating short term
rentals (STRs).
Staff recommends approval to codify regulations with operating Short-term rentals
(STR’s) in the Village as presented in the attached memorandum. The
recommendations for regulation include establishing definitions within the Village
Code, specifying eligibility and requirements to operate STRs, proposed operating
conditions and a fee structure for this use. Following the March 4, 2024 Village
Board meeting, staff incorporated feedback from the discussion and also reviewed
additional research for inclusion of STR’s in the community. I concur with staff’s
recommendations and respectfully request Mayor and Board authorize the
Corporation Counsel to draft the necessary ordinance.
*C. Lead Water Service Line Inventory Services, Engineering Enterprises Inc,
Itasca $50,000
The Village is in the process of developing a lead service line replacement plan
and has submitted an initial lead service line inventory to the Illinois
Environmental Protection Agency (IEPA). The Village secured a $50,000 IEPA

grant that provides funds to contract with a qualified, experienced engineering firm
to complete the final inventory process. The Village issued a Request for
Proposals (RFP) to select the inventory firm and received four responses. Staff
reviewed and evaluated the proposals and determined that Engineering
Enterprises Inc. (EEI) is the best qualified and prepared firm to take on the subject
project. EEI is currently under contract with the Village to develop the Act-
mandated !ead service line replacement plan and has worked with 23 areas
communities with lead service line management programs. I concur with staff's
recommendation and respectfully request Mayor and Board approval to enter into
a contract with Engineering Enterprises Inc. in the amount of $50,000.

*A. Ordinance. Special Use Permit, 8229 Christiana Avenue, 2024-03P
Item A is on the consent agenda for second reading and adoption. The first reading
was on April 15,2024.
This ordinance will grant a special use permit to allow an automotive repair facility at
8229 Christiana Avenue, located in an M3 Industry district. The interior of the Rafa's
Auto Repair will house two service bays with lifts, an office, a customer waiting area,
and bathrooms. The site includes six outdoor parking spaces in front of the building
and one accessible parking space will be located behind the building.
*B. Ordinance, Special Use Permit, 8014 Lincoln Avenue, 2024-04P
Item B is on the consent agenda for second reading and adoption. The first reading
was on April 15,2024.
This ordinance will grant a special use permit to allow a co-working office at 8014
Lincoln Avenue, located in a CX Core Mixed Use district. This will be another location
for Enclave, a co-working business. There are many current locations in the
Chicagoland area, with several more anticipated in the near future. These offices are
geared for the professionals who need office space close to home. This location of
Enclave will occupy a 3,309 square feet space that will contain 11 offices and a
conference room. Access to the office space will be allowed from 6:00 a.m. to 2:00
a.m.
*C. Ordinance, Speed Reduction, Kostner Avenue, Oakton Street to Main Street
Item C is on the consent agenda for second reading and adoption. The first reading
was on April 15,2024.
This ordinance will reduce the speed limit on a portion of Kostner Avenue, from Oakton
Street to Main Street, from 30 MPH to 25 MPH and authorize the Village Manager to
install signage reflecting that reduction.
In response to resident inquiries and concerns, the Village ofSkokie conducted a traffic
study for speed limit reduction along Kostner Avenue, between Oakton Street and Main
Street. The area is zoned R1 Single-Family with an unposted speed limit which would
default to 30 miles per hour in accordance with the Illinois Traffic Code. A traffic study

that collected speed data found median speed within the corridor averaged 21 MPH.
The 85th percentile speed within the corridor averaged 26 MPH. These speeds are
below 30 MPH and 5 MPH within 25 MPH. The 85th percentile speed is typically used
to determine the speed at which drivers fee! safe traveling based on the road
characteristics. Kostner Avenue, with parking on both sides, is wide enough to
accommodate one vehicle in each direction. Adjacent to the road, the area consists of
sidewalk, parkway, and residential homes. These roads are typically designed for
lower speeds. It was determined that a reduction in the speed limited from 30 MPH to
25 MPH would benefit the community and promote traffic safety.
(D. Ordinance, Installatipjiof a multi wav stop intersection, Kostner Avenue and
Keeney Street
Item D is on the consent agenda for second reading and adoption. The first reading
was on April 15,2024.
This ordinance will authorize the Village Manager to install traffic signage at Kostner
Avenue and Keeney Street to designate that as an all way stop intersection. From time to
time the Village will review various traffic patterns and intersections in order to improve
traffic safety. The traffic control at the intersection of Kostner Avenue and Keeney Street
was reviewed, due to the number of accidents at that intersection in the last two years. As
a result of a traffic study at the intersection, it has been determined that the installation of
a multi-way stop control should be established, in order to calm traffic and improve traffic
safety.
CE. Ordinance, Approving Amendments to Agreement with SWANCC
Item E is on the consent agenda for second reading and adoption. The first reading
was on May 6, 2024.
This ordinance will amend the membership agreement with and by-laws of the Solid Waste
Agency of Northern Cook County (SWANCC). This is the same agreement that other
municipalities have entered into in order to establish SWANCC, a cooperative municipal
joint action agency. These amendments are regarding the appointment of representatives
authorized to represent the Village at meetings of SWANCC.
T. Resolution, Appointing Mayor Van Dusen and John T, Lockerbv, as Director and
Alternate Director of SWANCC
item F is on the consent agenda for first reading and adoption.
This Resolution will reappoint Mayor George Van Dusen as Director and John T. Lockerby as
Alternate Director to SWANCC's Board of Directors. Pursuant to the Agency Agreement, the
Village is obligated to appoint a Director and an Alternate Director to the Agency's Board of
Directors for two-year terms expiring April 30, 2026.

This ordinance will create a new type of liquor license and iimit the availability to two
licenses. The Skokie Farmer's Market, seasonally he!d from June to October has grown in
popularity over the years. The Market continues to expand the number and types of vendors
each year. in addition to its roster of fresh fruits and vegetables, the Market seeks to offer a
wider variety of artisana! goods and products locally produced. This year in answer to a
request for local distilleries, vineyards and breweries to bring product to the Famer's Market,
the Liquor Commissioner has determined that a limited number of local distiileries, vineyards
or breweries would complement the vendors at the Market. To that end the Liquor Control
Commissioner is recommending the creation of a Class J license providing for package
sales and to allow tasting at the Skokie Farmer's Market. These licensees would also have
to secure a booth at the Farmer's Market as well.

This ordinance will approve and accept the dedication of a portion of 4400 Oakton Street,

7.00 feet by 105.86 feet rectangular piece of land includes part of the Oakton Street. The
dedication will be made to the Village of Skokie without financial compensation for the land
pursuant to condition number 6 in Village Ordinance Number 23-10-Z-4660.

4 more commonly described as 8014 Lincoln Avenue, Skokie, Nlinois (hereinafter "Subject
5 Property"), petitioned the Village of Skokie on behalf of Thomas H. Griseta, for a special use
6 permit to allow a co-working office in a CX Core Mixed Use district; and
7 WHEREAS, Mr. Griseta will create a Skokie location for Enclave, a co-working
8 business. There are many current locations in the Chicagoland area, with several more
9 anticipated in the near future. These offices are geared for the professionals who need office
to space close to home. Enclave will occupy a 3,309 square feet space that will contain 11
n offices and a conference room. Access to the office space will be allowed from 6:00 a.m. to
12 2:00 a.m. There wili be shared bathroom facilities located off of a common hallway; and
13 WHEREAS, at a public hearing of the Skokie Plan Commission duly held on Apri! 4,
14 2024, for which proper legal notice had been achieved and after hearing all testimony, the Skokie
15 Plan Commission (a) made the appropriate findings of fact as required under Section 118-6(f)
16 of the Skokie Village Code and (b) voted to recommend to the Mayor and Board of Trustees that
17 the requested speciai use permit be granted subject to the conditions contained in the Plan
18 Commission Report dated Apri! 15,2024;and
19 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on Apri! 15,
20 2024, concurred in the aforesaid recommendations and findings of fact of the Skokie P!an
21 Commission;
22 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
23 Village of Skokie, Cook County. Illinois:
24 Section 1: That the special use permit requested by the Petitioner, on behalf of Mr.
25 Griseta, to allow a co-working office at the Subject Property described above and commonly
26 known as 8014 Lincoln Avenue, Skokie, liiinois, in a CX Core Mixed Use district and the same
27 is hereby granted and approved subject to each of the conditions set forth below:
28 1. Prior to the issuance of building permits, the petitioner shal! revise the partition plan to
29 include the following:
so a. Fire rated separation between occupancies.
31 b. Common path and egress travel distance for the 8014 Lincoln Avenue space.
32 c. The labeling of the locations of ail bathrooms within 8014 Lincoln Avenue.
33 2. The Petitioner shall develop the Subject Property in substantial conformance with the
34 final Village approved partition plan dated November 27, 2023, and Floor Plan - Roor 1
35 dated September 21, 2018.
36 3. The use shall be open to the public for a minimum of 40 hours a week.
37 4. The surface of the windows and doors shall not be covered or obstructed by products,
38 window coverings (blinds, drapes, shades, or the like), signs in excess of the
39 requirements in the Signs chapter, or other opaque materials placed behind the
40 window.
41 5. Ail fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,

1 landscaping, structures, and any other facilities or infrastructure on the Subject Property
2 shall be maintained in a good state of repair and, when needed, be repaired or replaced
3 in a timely manner.
4 6. AH new construction, alterations, and remodeling shall meet current International
5 Building and NFPA Life Safety Codes as amended.
6 7. All private and public sidewalks shal! be maintained free of snow, ice, sleet, or other
7 objects that may impede travel.
8 8. All off-street parking spaces shall be legibly striped and maintained.
9 9. Any plan to modify parking lot striping must be approved by the Director of Engineering.
io 10. Vehicles shall not be allowed to be parked in or otherwise block common driveways,
n sidewalks, aisles, or other points of access at any time, shall only be parked in
12 designated parking spaces, and shall not overlap the striped lines of designated parking
13 spaces.
14 11. The owner of the Subject Property shall ensure that employees park on the Subject
15 Property.
16 12. The petitioner shall obtain ail required permits and approvals for improvements to
17 County, State, or Federal rights-of-way from the governing jurisdiction.
18 13. All signage shall conform to the Skokie Village Code. Any sign on the Subject Property
19 that is in violation of that Code must be removed or modified to conform with the Village
20 Code prior to the issuance of an occupancy permit.
21 14. All modifications to building elevations, signage, and landscaping shall be subject to the
22 review and approval of the Skokie Appearance Commission.
23 15. The petitioner shall submit to the Planning Division electronic files of the plat of survey,
24 site plan, and landscape plan in their approved and finalized form. The files sha!! be
25 scaled 2-dimensionaf drawing files on non-compressed, non-read only CD-ROM *.dwg
26 AutoCAD format.
27 16. Prior to the issuance of building permits, the petitioner shall submit to the Planning
28 Division of the Community Development Department the name, address, and telephone
29 number of the company and contact person responsible for site maintenance in
30 compiiance with the special use permit.
31 17. If work is to be performed on public property or if public property is utilized or impacted
32 during construction and/or development, the owner shall provide, or shall cause the
33 developer and/or contractor to provide, the Village of Skokie with a certificate of
34 insurance naming the Village of Skokie as additionally insured for any and all claims
35 related to any and ai! work. The owner shall hold, and shall cause the developer and/or
36 contractor to hold, the Village of Skokie harmless and indemnify the Village for any and
37 all claims for property damage or personal injury related to work on or use of public
38 property.
39 18. The petitioner shall comply with all Federa! and State statutes, laws, rules and
40 regulations and att Village codes, ordinances, rules, and regulations.
41 19. Failure to abide by any and all terms of this Ordinance shall be cause for the Village to
42 initiate hearings to determine whether the subject Ordinance, as well as any applicable

1 business licenses, should be revised or revoked. The petitioner shall pay ail costs
2 related to any hearings conducted as a result of non-compliance with any of the
3 provisions of the enabling ordinance. The costs shall indude but not be limited to court
4 reporter fees, attorney fees, and staff time required researching and conducting said
5 hearing.
6 Section 2: That a notice of the approva! of this Ordinance incorporating the
7 conditions contained herein shall be executed by the owner of the property in writing and duly

STREET, IN SKOKIE, ILLINOIS, IN AN R1 SINGLE'FAMILY DISTRICT
1 WHEREAS, in response to resident inquiries and concerns, the Village of Skokie conducted
2 a traffic study for speed limit reduction along Kostner Avenue, between Oakton Street and Main
3 Street; and
4 WHEREAS, Kostner Avenue between Oakton Street and Main Street, is a local residential
5 street that follows an alternating stop pattern along this stretch with the end of the section being
6 under stop control at Oakton Street and at Main Street. The area is zoned R1 Single-Family with
7 an unposted speed limit which would default to 30 miles per hour in accordance with the Illinois
8 Traffic Code; and
9 WHEREAS, collected speed data found median speed within the corridor averaged 21
to MPH. The 85th percentiie speed within the corridor averaged 26 MPH. These speeds are below
n 30 MPH and 5 MPH within 25 MPH. The 85th percentile speed is typically used to determine the
12 speed at which drivers feel safe traveling based on the road characteristics. Kostner Avenue,
13 with parking on both sides, is wide enough to accommodate one vehicle in each direction.
14 Adjacent to the road, the area consists of sidewalk, parkway, and residential homes. These roads
15 are typically designed for lower speeds; and
16
17 WHEREAS, it was determined that a reduction in the speed limited from 30 MPH to 25 MPH
18 would benefit the community and promote traffic safety; and
19
20 WHEREAS, the Village Manager concurred in the recommendation of the Senior Engineer
21 to the Mayor and Board of Trustees that the aforementioned reduction in the speed limit be granted;
22 and
23 WHEREAS, the Mayor and Board of Trustees, after public meeting duly held on Aprii 15,
24 2024, concurred in the aforesaid recommendation of the Village Manager and Senior Engineer;
25 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village
26 ofSkokie, Cook County, UlinoJs;
27 Section 1: That the speed limit on Kostner Avenue, between Oakton Street and Main

AN ORDINANCE PROVIDING FOR THE INSTALLATION AND
ESTABLISHMENT OF A MULTI-WA Y STOP INTERSECTION A T
KOSTNER AVENUE AND KEENEY STREET, SKOKIE, ILLINOIS
1 WHEREAS, from time to time the Village will review various traffic patterns and
2 intersections in order to improve traffic safety. The traffic control at the intersection of Kostner
3 Avenue and Keeney Street was reviewed, due to the number of accidents at that intersection in
4 the last two years; and
5 WHEREAS, a traffic study was conducted at the intersection, which included accident
6 data from 2019 through 2024, field observations made at the intersection, a review of the street
7 network system, and sight distance evaluation. The main factor that required attention is the crash
s experience. There have been five reported accidents within a twelve month period. The data trend
9 leans on an increase of accidents occurring; and
10 WHEREAS, as a result of the traffic study, it has been determined that the installation of
n a muiti-way stop control should be established at the intersection of Kostner Avenue and Keeney
12 Street, in order to calm traffic and improve traffic safety; and
13 WHEREAS, the Village Manager concurred in the recommendation of the Senior Engineer
14 for the Village of Skokie, to the Mayor and Board of Trustees that the intersection be upgraded and
15 a multi-way stop sign control at the intersection of Kostner Avenue and Keeney Street be installed
16 and established, as indicated on the diagram attached hereto marked Exhibit "A" and hereby made
17 a part of this Ordinance; and
18 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on April 15,
19 2024, concurred in the aforesaid recommendation;
20 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village
21 ofSkokie, Cook County, Illinois:

OF NORTHERN COOK COUNTY
1 WHEREAS, the Village of Skokie (hereinafter "Village") is a home rule, special charter,
2 municipal corporation existing in accordance with the Illinois Constitution of 1970;and
3 WHEREAS, Section 6(a) of Article VII of the Illinois Constitution of 1970 authorizes home
4 rule units, such as the Village to "exercise any power and perform any function pertaining to its
5 government and affairs"; and
6 WHEREAS, Section 10 of Article Vli of the illinois Constitution of 1970 authorizes units of
7 local government, such as the Village, to contract or otherwise associate amongst themselves in
8 any manner not otherwise prohibited by law or ordinance; and
9 WHEREAS, Section 3 of the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/3,
10 permits any powers, privileges, functions or authority exercised or which may be exercised by a
n unit of local government, such as the Village, to be combined and exercised jointly with any other
12 unit of local government; and
13 WHEREAS, pursuant to such authorization, the Village of Skokie (hereinafter "Village")
14 has entered into an agreement (hereinafter "Agreement") with other municipalities establishing
15 the Solid Waste Agency of Northern Cook County (hereinafter "SWANCC") as a municipal joint
16 action agency; and
17 WHEREAS, as a member of SWANCC, the Village has approved SWANCC's by-laws
18 (hereinafter "By-Laws") that, together with the Agreement, govern the function and operation of
19 SWANCC; and
20 WHEREAS, the Village now desires, and finds it in the best interest of the health, safety,
21 morals and welfare of the Village, to amend the Agreement and the By-Laws of SWANCC
22 concerning the appointment of representatives authorized to represent the Village at meetings of
23 SWANCC.
24 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village
25 ofSkokie, Cook County, Illinois:
26 Section 1: The foregoing recitals are hereby adopted by this reference as findings of the

2 Section 8. Governance.

4 8.1 The Agency shall be governed and administered as provided in
5 this Section and in the By-Laws, adopted pursuant to, and subject to the
6 limitations of, this Agreement.

8 8.2 The governing body of the Agency shall be the Board of
9 Directors. There shalf be one Director for each Member, who shall be
to appointed by vote of the corporate authorities of the Member and who at the
n time of appointment shall be the (i) Mayor or President of a Member (if such
12 Member is a municipality) or the President or Chairman of a Member (if such
13 Member is a County), (ii) another elected member of the corporate
14 authorities of the Member or, (iii) the chief administrative officer of the
15 Member. The term of each initial Director shall begin when he or she is
16 appointed and shall continue until April 30, 1991 and until his or her
17 successor is appointed. Thereafter, all Directors shall be appointed for two-
18 year terms expiring on April 30 of odd numbered years. Except as provided
19 in paragraph 8.4, a person serving as a Director shall serve until his or her
20 term expires, and thereafter until his or her respective successor is
21 appointed. Each Director shall have one vote on the Board of Directors.
22 8.3 Any Member may appoint one or more persons to serve as the
23 Alternate Director. Any such appointee shall meet the qualifications for office
24 as a Director established in paragraph 8.2 or shall be a staff person of the
25 Member appointed by its corporate authority and granted the authority
26 to act on theMember's behalf. The Alternate Director may attend any
27 meeting of the Board of Directors and may vote as the Director in the
28 absence of the Director from that Member or if there is a vacancy in the
29 position of Director from that Member. The term of an Alternate Director shall
30 be the same as the term of the Director from the appointing Member. Except
31 as provided in paragraph 8.4, a person serving as Alternate Director shall
32 serve until his or her term expires and thereafter until the successor is
33 appointed.
34 8.4 All appointments of Directors and Alternate Directors shall be by
35 ordinance or resolution of the corporate authorities of the appointing
36 Member, a certified copy of which shall be filed with the Secretary of the
37 Agency. Should any Director or Alternate Director cease to serve as the
38 President, Mayor, Chairman, elected member of the corporate authorities^
39 chief administrative officer of the appointing Member or staff person of the
40 Member granted authority to act p^^^ that person
41 shall simultaneously cease to serve as Director or Alternate Director of the
42 Agency and the position shall be vacant. Any vacancy in the office of Director
43 or Alternate Director shall be filled by appointment by the Member with

4 (a) The Village of Skokie (hereinafter "Village") is a member of the Solid Waste Agency of

6 establishing the Solid Waste Agency of Northern Cook County as a Municipal Joint
7 Action Agency (hereinafter "Agency Agreement");
8 (b) The Mayor and Board of Trustees had previously appointed a resolution in accordance

1 WHEREAS, Chapter 10 of the Skokie Village Code (hereinafter "Code") provides for rules
2 and regulations pertaining to the sate of alcoholic liquor in the Village of Skokie (hereinafter
3 "Skokie"), and
4 WHEREAS, Chapter 46, Section 46-80 of the Code provides for fees for businesses and
5 occupations in Skokie; and
6 WHEREAS, in accordance with the Illinois Liquor Control Act and the Code, the Mayor is
7 charged with the duties of Local Liquor Control Commissioner and is generally responsible for the
8 regulation of the retai! sale of alcoholic liquor; and
9 WHEREAS, the Skokie Farmer's Market (hereinafter "Market"), seasonally held from June
io to October has grown in popularity over the years. The Market continues to expand the number
n and types of vendors each year; and
12 WHEREAS, in addition to its roster of fresh fruits and vegetables, the Market seeks to
13 offer a wider variety of artisanal goods and products locally produced. This year in answer to a
14 request for local distilleries, vineyards and breweries to bring product to the Market, the Liquor
15 Commissioner has determined that a limited number of local distilleries, vineyards or breweries
16 would complement the vendors at the Market; and
17 WHEREAS, the Liquor Control Commissioner is recommending the creation of a Class J
is license providing for package sales and tasting at the Skokie Farmer's Market; and
19 WHEREAS, the Liquor Control Commissioner recommends to the Board of Trustees that
20 Chapters 10 and 46 of the Code be amended accordingly;
21 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the

2 Sec. 10-64. Classification.
3 Liquor licenses are divided into 4516 classes as described in paragraphs (a) through (pe).

5 (j) Class J license which shall authorize the retail sale off premises, of packaged
6 alcoholic liquor at the Village of Skokie Farmer's Market during its seasonal hours of
7 operation. Sales shall be limited to locally produced spirits, beer, and wine in sealed
8 containers. Licensee must also obtain a booth at the Skokie Farmer's Market and follow all
9 rules and regulations of the Skokie Farmer's Market Sampling shall be conducted
10 pursuant to 235 ILCS 5/6-31, except that the samples shall only be consumed directly in
11 front of the seller's booth.
12 (}k) Class M license which shall authorize the retail sale of alcoholic liquor for consumption
13 off-premises in establishments in which the sale of alcohoHc liquor is a secondary function of the
14 establishments and that encompass more than 10.000 square feet but less than 40,000 square
15 feet of total retail space in the following areas of the Village: (i) the North Commercial Liquor
16 District,(ii) the Central Commercial District, (iii) the South Commercial Liquor District, (iv) the
17 East Midtown Commercial Liquor District, (v) the West Midtown Commerda! District, and (vi) the
18 Southeast Commercial Liquor District. A maximum of 300 linear feet of shelf space, including
19 viewing coolers and al! displays, may be designated for the retail sate of alcohoiic liquor;
20 notwithstanding the area restrictions stated in this paragraph. For purposes of this section,
21 linear sheif space shall mean any single shelf, which may or may not be included in a shelving
22 unit that is utilized for the promotion, display or retail sale of alcoholic liquor. An existing Class A
23 license may be converted to a Class M license as provided in subparagraph 10-64(a)(5).
24 (^1) Class 0 license which shall authorize the retail sale of alcoholic liquor for consumption
25 off of the premises of the licensee. No alcoholic liquor shall be consumed on the premises of a
26 Class 0 licensee unless such alcoholic liquor is being offered as a promotional event or taste
27 testing without the payment of anything of value by the consuming patron.

29 Qm) Class P license which authorizes the retail sale of alcoholic liquor at a limited service or
30 full service restaurant at a specific location. Any person or entity holding a Class A license and
31 owning the real property on which a limited or full service restaurant, serving alcoholic liquor, is
32 or will be operated, may convert the Class A license to a P-Right, having such rights as defined
33 in subparagraph (2) below.

35 (mn) Class Q license which shall authorize the service and retail sale of alcoholic liquor for
36 consumption on the premises designated therein in establishments containing banquet hall
37 facilities and authorized for banquets as a principal use, provided that alcoholic liquor under this
38 license may be served and sold only to previously invited guests.

(no) Class T license which shall authorize the retai! sale of alcoholic liquor as part of the
operation of live theaters and movie theaters, subject to an Operation Plan approved by the
Local Liquor Control Commissioner.
(ep) Class W license which shall authorize the retail sale of wine for consumption off of the
premises. No wine shall be consumed on the premises of a Class W licensee unless it is being
offered as part of a sampling or taste testing without the payment of anything of value by the
consuming patron.

During our two regular meetings in April, the Board discussed the possibility of adding two binding
referendums" for term limits and ranked choice voting (RCV)-to the November 2024 ballot in Skokie, in
response to voter-initiated petitions being circulated in the Skokie community forthese electoral changes.
Although the Board has discussed whether or not to engage the law firm Klein, Thorpe & Jenkins (KTJ) to
help craft referendum resolutions, it remains unclear whether a majority of the Board actually supports
either/both of these electoral changes. For this reason, I would greatly appreciate an opportunity to hear
more from each member of the Board before proceeding any further.

A FairVote Guide
I RANKED CHOICE VOTING IS SIMPLE
Ranked choice voting (RCV) is a way to ensure elections are fair for all voters. Voters
pick a first-choice candidate and have the option to rank backup candidates in order of
preference: second, third, and so on.
If a candidate receives more than half of the first 1st 2nd 3rd 4th

RANKED CHOICE VOTING SOLVES PROBLEMS
RCV promotes majority rule without the need for a delayed runoff election. Voters
can honestly rank the candidate they like most, without fear that doing so will help
the candidate they like least. With more choices, voters have more power. Candidates
have an incentive to engage with all voters to earn both first choices and later
choices, meaning voters will have a greater chance of being heard and campaigns
will reduce personal attacks. Because RCV only requires one election, it can save
taxpayers' dollars by eliminating the cost of a runoff election.

I RANKED CHOICE VOTING IS POPULAR IN PRACTICE
50 American jurisdictions have adopted ranked choice voting for their public
elections. 10 more use RCV ballots for certain contests, such as party-run primaries or
for overseas voters to participate in runoffs.
RCV has been passed by city councils, by state legislatures, and by voters through
ballot measures. Voters have said yes to RCV in 27 city ballot measures in a row.
Voters who use RCV overwhelmingly like it, find it simple, and want to keep using it.
Ranked choice voting is used statewide in Maine and Alaska, including in their
presidential general elections. It is used in the largest cities in seven states
including New York City, home to over 8 million people. Six states use RCV ballots
for military and overseas voters, so that they can participate in congressional runoff
elections without the need to receive and return a second ballot.
RCV is widely used in party primaries and conventions. It has been used for
Democratic presidential primaries in six states, and for Republican presidential
primaries in Maine and the U.S. Virgin Islands. Virginia Republicans used it to
nominate their winning slate of candidates for statewide office in 2021. It has also
been used for party nominations from Pennsylvania to Indiana and Utah.
Ranked choice voting is widely used overseas, including to elect Australia's House
and Senate, the president of Ireland, and the leaders of all four Canadian national
parties that are represented in Parliament. Recommended by Robert's Rules of Order,
it is used by some of the world's largest private associations along with student
government elections in approximately 100 American colleges and universities.

Voters use the opportunity to rank candidates
When given the opportunity, most voters rank multiple candidates rather than choose
just one. 68% ofRCV ballots rank at least two candidates. In highly competitive
elections, even more voters (74%) rank multiple candidates.
Winners enjoy strong consensus from voters
Winners of RCV races tend to be ranked highly on many ballots, even beyond the
majority needed to be elected. For RCV races in the U.S., 75% of ballots ranked the
winning candidate in their top three choices, demonstrating broad support for
winners selected with this method.

RCV outperforms delayed runoffs to determine majority winners
Ranked choice voting includes the benefits of runoff elections, but without the
precipitous decline in turnout. In federal primary runoff elections since 1994, there
has been a median turnout decline of 40% between the first and second rounds. In
addition, more than half of runoff winners during this period received fewer votes
in the runoff than they did in the first election. RCV only needs voters to show up to
vote one time, while still promoting majority rule.
Ballot error rate is comparable to or lower than in non-RGV races
Ballot errors occur under any voting method. Research has shown that errors do not
increase under RCV. RCV has a lower overvote rate than other methods, such as top-
two voting in California. With modern ballot design, 99.7% of voters regularly cast
valid RCV ballots, as in recent municipal elections and 2020 presidential primaries.
Voters enjoy using RCV in elections
Thirty years ago, fewer than 100,000 Americans lived in cities that used RCV. In 2024,
20 million Americans live in communities that have embraced RCV. Exit polls show
that:
85% of Alaska voters reported that RCV is "simple" in their first RCV
election in 2022.
In 2022, 56% of Virginia Republicans who used RCV in congressional
primaries preferred RCV to single-choice elections.
77% of New York City voters said they wanted to keep using RCV after their
first use in 2021.
In 2021, 86% of Utah voters who used RCV were
satisfied with their voting experience.
61% of Maine voters said they wanted to see RCV
maintained or expanded after their first use in
2018. Maine's legislature then expanded RCV to
presidential elections, and its largest city passed
RCV for all offices with 81% of the vote.
94% of Santa Fe, NM voters were satisfied with
their first RCV experience in 2018.
In 2023, Minnetonka, MN voted to keep using RCV
by an even wider margin than when they voted to
adopt it two years earlier - showing that once voters
use RCV, they like it even more.

High Voter Turnout in RGV Races
RCV elections in the last several years have had higher-than-expected turnout.
Turnout in New York City in 2021 increased by 36% over the previous open-
seat mayoral race, and a higher share of voters who participated in the mayoral
election also voted in down-ballot races.
In San Francisco's 2018 mayoral election, more voters participated in the
RCV contest for mayor than in the non-RCV races at the top of the ballot for
governor and U.S. senator.
Santa Fe's first use of RCV in 2018 set a record for turnout in mayoral
elections.
ACADEMIC ENDORSEMENTS FOR RCV
Ranked choice voting has drawn widespread support as a sensible solution to
problems with our elections, including support from major newspapers, political
leaders, electoral reform commissions, and organizations. In 2020, more than 50
leading scholars signed onto this statement: "I support greater use of ranked choice
voting for federal, state, and local elections in the United States." Those in support
include ten Nobel Prize laureates and nine winners of the Johan Skytte Prize ("the
Nobel for political science"}. A 2021 survey of political science experts showed 78%
support for RCV.
I RESEARCH ON THE EFFECTIVENESS OF RANKED CHOICE VOTING
Research suggests that RCV promotes civil campaigning and improves representation,
and that voters of all backgrounds use the ranked ballot effectively. Examples of
scholarly research on RCV include:
CAMPAIGN CIVILITY UNDER PREFERENTIAL AND PLURALITY VOTING, Todd Donovan
(Western Washington University), Caroline Tolbert (University of Iowa), and Kellen
Gracey (University of Iowa)
This study finds that voters in RCV cities were more satisfied with the conduct of
local campaigns, more likely to have in-person contact with candidates for office, and
less likely to view campaigns as negative compared to voters in non-RCV cities.

This report examines the causes behind the well-documented increase in
representation for candidates of color under RCV. Findings include that candidates

elections, and that RCV has improved the civility of debates.
VOTING ERROR ACROSS MULTIPLE BALLOT TYPES: RESULTS FROIU SUPER TUESDAY (2020)

This 2020 paper finds ranked ballots produce fewer void votes (more valid votes)
than traditional single-choice ballots. Additionally, ranked ballots were associated
with smaller racial and gender discrepancies in error rates than single-choice ballots.

AVENUE FOR AN AMENDMENT TO SPECIAL USE PERMIT ORDINANCE
09-8-Z-3699 THROUGH THE MODIFIED REVIEW PROCEDURE
The Village received a request from 8106 Lincoln, LLC, at the above listed address, to amend
special use permit ordinance 09-8-Z-3699 through the modified review procedure. The petitioner
intends to modify the site plan at 8106 Lincoln Avenue in order to remove the existing driveway to
the south of the building and remove the former parking lot pavement to the west of the building in
order to construct a new playground area for Swift Child Care. The removal of the driveway will
restore a parking space along Lincoln Avenue and make the street safer.
The playground, which will contain several activity areas and have a synthetic turf surface. New
landscaping will be planted within the playground and the space will be enclosed by the existing
building walls and new fencing along the north, east, and west sides. No other modifications are
being made to the interior of the building or the exterior of the property at this time.
The petitioner is also requesting that the ordinance be amended to remove condition #2, which states
that “the pickup and drop-off of the children is to take place on the petitioner’s property. No part of
Lincoln Avenue shall be reserved for this use.” Since the drafting of the original ordinance, a new
public alley was constructed to the west of the subject site, and 6 perpendicular parking spaces were
striped, replacing the 5 spaces that were located within the former parking lot. While parking off the
alley is the most convenient option, the petitioner would like to provide caregivers with the
flexibility of being allowed to park on Lincoln Avenue and walk their children through the
playground in order to access the day care’s entrance on the west side of the building.
Staff has reviewed the special use permit ordinance amendment request. Staff has no objections to
the request and that the Petitioner’s request be approved to amend special use permit ordinance 09-8-
Z-3699 to modify the site plan at 8106 Lincoln Avenue according to the attached Early Childhood
Playground Design plan, dated April 30, 2024.
Appearance Commission review and approval was not required.
The Corporation Counsel, Plan Commission Chairman, and Community Development Director
reviewed the request. It was their opinion that the modification to the site is in substantial
compliance with the intent of the original special use permit ordinance.
It is respectfully recommended that the Petitioner’s request be approved to amend special use permit
ordinance 09-8-Z-3699 to modify the site plan at 8106 Lincoln Avenue according to the attached
Early Childhood Playground Design plan, dated April 30, 2024.

14 WHEREAS, the petitioner currently operates the Swift Child Care at 8064 Lincoln and 8260
15 Eimwood. The Subject Property would be an additiona! location to the current Swift Child Care's
16 operation, focusing on infants and toddlers; and
17 WHEREAS, petitioner is making building renovations to the Subject Property which wili
18 result in an enlarged first floor and a second story residence. The proposed 1,791 ft2 child day care
19 will be on the first floor; and
20 WHEREAS, the 1,868 ft2 upper level wiii be used as a residence and is permitted by right.
21 The residentia! entrance wii! be iocated to the rear of the building and wii! be assigned an address
22 of 8104 Lincoln Avenue; and
23 WHEREAS, there -are seven parking spaces located at the rear of the building for
24 employees, customers, and the upper leve! residence. The main entrance to the day care wil! also
25 be in the rear. The entrance on Lincoln Avenue will be used as an emergency exit, but the
2G proposed floor plan can accommodate conversion of this entrance to a main entrance for a user in
27 the future; and
WHEREAS, the pickup and drop-off of the children Is to take place on the Subject
29 Property at the rear of the building, where the main entrance wiit be; and

1RE4S, the Community Development staff determined the need for the relief from
2 Section 118-184(c)(6). Due to the height of the ground floor, petitioner has provided the maximum
3 amount of glass feasible In an effort to meet the intent of the Code; and
4 WHIEREAS, the Skokie P!an Commission, at a public hearing duly held on July 2, 2009, for
5 which proper legal notice had been achieved and no interested parties appeared, (a) made the
6 appropriate findings of fact as required under Section 1 18-32 of the Skokie Viilage Code and (b)
7 voted to recommend to the Mayor and Board of Trustees that the requested special use permit be
8 granted subject to the conditions contained in the Plan Commission Report dated August 3, 2009
3 and that relief from Section 118-184(c)(6) be granted; and
lo WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on August 3,
n 2009, concurred in the aforesaid recommendations and findings of fact of the Skokie Plan
; 2 Commission;
is NOW, THEREFORE, BE IT ORDASNED by the Mayor and Board of Trustees of the Village
;4 of Skokie, Cook County, Illinois:
15 Section 1: That the special use permit requested by the petitioner to establish and
',3 operate a child care center at the Subject Property, legally described above and commoniy known
17 as 8106 Lincoln Avenue, SRokie, Illinois, in a CX Core Mixed-use district be and the same is
-is hereby granted and approved subject to each of the conditions set forth below:
19 1. The petitioner shall develop the Subject Property in substantial conformance with the final
20 Viiiage approved Site Plan, First and Second Floor Plans, Reflected Ceiling Pian, and
21 Electrical Plans, ai! dated June 26, 2009, and Exterior Elevations, dated June 15, 2009;
22 2. The pickup and drop-off of the children is to take place on the petitioner's property. No part
23 of Lincoln Avenue shali be reserved for this use;
24 3. Prior to a certificate of occupancy being issued, the following must be compieted;
25 a. The existing parking tot must be patched, resurfaced, and re-striped,
26 b. A copy of the child day care facility's license from the Illinois Department of Children
27 and Family Services shall be submitted to the Planning Division,
2s c. Approval of the facility shali be obtained from the Office of the State Fire Marshal;
29 d. The Fire Department shall inspect and certify the sprinkler system;
30 4. Required handicapped signage (R7-8) shall be instalied and maintained by the property
31 owner;
32 5. The Subject Property must conform to the Village's storm water control requirements
33 contained in the Skokie Viitage Code, induding the disconnection of any downspouts;
34 6. information shall be submitted to the Health Department regarding the name, address and
35 most current inspection (not to exceed six months past-dated) of any catering ser/ice to be
36 used at the subject nursery;
37 7. All light fixtures must be properly shieided and all electricai outiets shall be protected;
38 8. A Knox Box shall be mounted on the exterior of the buiiding adjacent to the main entrance;
39 9. Ail fencing, waiis, sidewalks, driveways, curbs, wheei stops, parking areas, signage,
40 structures, and any other facilities or infrastructure on the Subject Property shall be

1 maintained in a good state of repair, and when needed, be repaired or replaced in a timely
2 manner;
3 10. Parking !ot and exterior lighting shal! meet IES standards, be fuli cut-off design, directed
away from adjacent properties, and subject to the approval of the Engineering Division;
5 11. Ali off-street parking spaces shali be legibly striped and maintained;
6 12. Reguiatory signage or pavement markings shali be provided to help assure proper vehicular
7 traffic movement;
s 13. AI! modifications to building elevations, signage, and shall be subject to the review and
9 approval of the Skokie Appearance Commission;
o 14. All signage shall conform to the Skokie Viiiage Code. Any sign on the Subject Property that
1 is in violation of that Code must be removed or modified to conform therewith prior to the
2 issuance of an occupancy permit;
,3 15. Al! existing damaged public sidewalks or sidewalks damaged due to the implementation of
14 this plan shall be rep!aced;
:s 16. Handicapped ramps are to be provided as necessary and meet State of Stiinois Accessibility
is requirements and the Skokie Village Code;
i7 17. All private and public sidewalks sha!l be maintained free of snow, ice, s!eet, or other objects
i8 that may impede travel;
-i9 18. All.overhead utilities on the Subject Property shall be placed or relocated underground. Any
?o unnecessary service shall be removed. The petitioner shall bear the full cost of any utiiity
?i relocation and/or conflicts;
Z2 19. Ail buiidings shail meet current tnternational Building and NFPA Life Safety Codes as
23 amended;
?4 20. Cable access shall not be denied to any residents in the buitdsng. All cable providers shall
25 be given access to provide service. All cable and other fixtures necessary to provide service
26 . to the building shall be placed underground and conduit shall be provided inside the building
27 for wiring;
28 21. The petitioner shall submit to the Planning Division electronic files of the piat of survey, site
29 plan, and iandscape plan in their approved and finalized form. The files shaii be scaled
30 CADD 2D drawing flies on non-compressed, non-read oniy CD-ROM .dwg AutoCad format
31 (version 2004 or later preferred);
32 22. Prior to the issuance of building permits, the petitioner shal! submit to the Planning Division
33 of the Community Development Department the name. address, and telephone number of
34 the company and contact person responsible for site maintenance in compHance with the
35 special use permit;
36 23. if work is to be performed on public property or if public property is utilized or impacted
37 during construction and/or development, the owner shali provide, or shall cause the
38 developer and/or contractor to provide, the Village of SRokie with a certificate of insurance
39 naming the Viiiage of Skokie as additionally insured for any and all claims related to any and
40 ail work. The owner shail hold, and shall cause the deveioper and/or contractor to hold, the
41 Viiiage of Skokie harmless and indemnify the VHlage for any and ail daims for property
42 damage or personal injury reSated to work on or use of public property;
43 24. The petitioner sha!i comply with ati Federal and State statutes, iaws, rules and regulations
44 and all Village codes, ordinances, rules, and regulations;

1 25. Failure to abide by any and ail terms of this Ordinance shat! be cause for the Viiiage to
2 initiate hearings to determine whether the subject Ordinance, as well as any appiicable
3 business licenses, should be revised or revoked; and
4 26. The petitioner shaEI pay all costs related to any hearings conducted as a result of non-
5 compHance with any of the provisions of the enabling ordinance. The costs shai! include but
6 not be limited to court reporter fees, attorney fees, and staff time required researching and
7 conducting said hearing.
s Section 2: That relief from Chapter 118, Section 118-184(c)(6) of the Skokie Village
9 Code, in order to aiiow 39% of the ground floor wall area to be covered in transparent glass, is
o hereby granted.
1 Section 3: That a notice of the approval of this Ordinance incorporating the
2 conditions contained herein shal! be executed by the owner of the property in writing and duly
13 recorded with the Cook County Recorder of Deeds Office at the owner's expense.
