MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 7:30
p.m. on Tuesday, February 18, 2025
Pledge of Allegiance led by Village Clerk Minal Desai.
Mayor Van Dusen called the meeting to order.
Trustee Sutker, Robinson, Khoeun, Johnson, Klein and Mayor Van Dusen.
Mayor Van Dusen asked for unanimous vote to move Item 10A from the Manager’s report-
Declaration of Emergency Affecting Public Health Resolution to after the Consent Agenda.

A. Declaration of Emergency Affecting Public Health Resolution.
Resolution 25-2-R-1591
Motion to request Mayor and Board approval of the Resolution declaring an emergency affecting the
public health due to the transmission water main break that occurred at East Prairie Road and Emerson
Street on Friday, February 14, 2025.
Max Slankard, Public Works Director presented a report on the Water Main break on Friday,
February 14, 2025. He spoke about the Incident, Timeline, Repair operations,
Emergency Communication to the public-Director of Communications Patrick Deignan, spoke
about Smart 911, The Scoop, Village Website and Social Media.
Emergency Services-Fire Chief Jeff Hoeflich-secured a Water Supply Task force from Lake
County Fire Agencies. Also the Fire Department utilized the tankers and pumps to replenish
the water tank at Endeavor Skokie Hospital every 4 hours during the time water service was
disrupted.
Resident support- The Village distributed bottled water, worked with Health and Human
Services reaching out door to door to check on individuals, contacted Red Cross, Unitarian
Church for shelters and suspend late fee on water bills.
Business support-Economic Vitality Division coordinated with Health and Human Service and
the Fire Department to work with businesses whether it was safe for them to open. There will
be campaigns to support Skokie businesses for their loss of income.
Report property damage- The Village is preparing a preliminary damage assessment report for
Cook County Emergency Management for qualification for potential disaster fund and public
assistance Next steps.
Mayor Van Dusen thanked the staff, volunteers, businesses that contributed water, Senator Ram
Villivalam who secured water from "Reyes Coca - Cola Bottling" and PepsiCo and Cook
County Board Commissioner Josina Morita secured pallets of water. President of the Cook
County Commissioner’s Preckwinkle pledged to help the Village in any way she can help with
our Declaration of Eemergency. Marianos, Walmart, City of Evanston, Sam’s Club and Lowe’s
also contributed water.
Trustees Klein, Sutker, Robinson and Khoeun also expressed appreciation and gratitude to Public
Works, Health Department, Fire Department, support volunteers, businesses, Village Staff, and
everyone in the community for quick and efficient way that they resolved the issues.
Max Slankard also answered questions from the Board and residents.

Michael Likhite 9300 Bennett spoke about his house encased in ice, the fear, being scared, no
control over the situation and lack of trust from the Village.
Mr. Cutler- never has seen this happen. Thanked the workers address the problem in the brutal
weather.
Kathleen Schmidt- Lyons St. spoke about the mental trauma of her family and loss of property.
She thanked all the volunteers, neighbors who came to her house.
Mayor Van Dusen spoke about having a company come in and give us their analysis and help
us plan.

Proclamations
Reaffirm our Commitment to Immigrant Ordinance of 2017
Trustee Khoeun read a Proclamation reaffirming the Village of Skokie’s commitment to the
Immigrant Ordinance of 2017.
Trustee Khoeun spoke about some recommendations that Fred Tsao, the senior policy council
from the Illinois Coalition of Immigrant Refugee rights provided to us. Mayor Van Dusen spoke
about Mr. Tsao’s suggestions to us. Most are in our Ordinance in the Chief of Police guidance to
the officers interpreting the trust act. In the Chief’s guidance state-under prohibited activities
assisting immigration enforcement- no compliance with immigration detainers administrative
warrant or custody transfers with out a criminal warrant no sharing of information about
individuals in custody. The Village does no share Village database information with 3rd party
brokers even FOIA request.
Trustee Khoeun made a motion to state explicitly that the Chief’s guidance of 2025 and
Immigration is supported by the Village’s ordinance and is part of the Ordinance itself which
would be Section 58-8 and also to continue to work with the Illinois Coalition.

Citizen Comments
Jerry Brozek spoke about the Ordinance and whether Skokie can legally shut out criminals from
ICE and the Federal Government.
Maggie Vandermeer-thanked the Village for bringing up community concerns .Also the need to
update the Ordinance and Mr. Tsao’s contributions to the 2017 Ordinance and his willingness to
contribute again and more important updates to be made.
Roxanne Salgado- thanked the Village for response to the water main brake and expressed
sympathy to the residents impacted by the flood. Skokie s a sense of community and also
strengthen the welcoming ordinance.
Lauren Grodnicki questioned Administrative vs criminal warrant. Assistant Corporation Counsel
McCarthy stated that the Skokie Police Department will not help Federal Ice agents unless
presented with a criminal warrant.
Emi Yamauchi-support updating the Ordinance. Spoke about “Know your rights gathering or
seminar for Immigrant refugee rights” Possibly thru “The Scoop” Toll free number for Immigrant
Refugee rights center, links ACLU video, Village newsletter. The Village had a seminar stronger
together event at Sketchbook which a number of municipalities from the North Shore attended.
Black History Month – February 2025
Trustee Robinson read a Proclamation recognizing Black History Month as an opportunity to share
the historical and present contributions of African American and celebrate the countless
achievements and contributions made by African American to the Village of Skokie’s cultural,
economic, political and social development.

Howard Meyer Recognition Day – February 18, 2025
Mayor Van Dusen read a Proclamation congratulating Howard Meyer on a well-earned career at
the Skokie Chamber of Commerce. On behalf of the Village of Skokie , elected officials, residents
and Skokie business community, expressing sincerest gratitude for his commitment and service.
Veton, Senator Ram Villivalam, chief of staff read a proclamation on behalf of Senator Villivalam
and Illinois State representative Kevin Olickal honoring Howard Meyer for his years of service,
and all of his achievements.
Jared Davis, Cook County Deputy Director representing Cook County Commissioner Josina
Morita read a Resolution honoring Howard Meyer for his dedication, service and deep compassion
for Skokie.
Howard Meyer thanked the everyone for the honor to serve and grow business.

B. Implementation of a Municipally-Supported Community Land Trust. This is a mechanism that
promotes affordable home ownership and funding housing rehabilitation programs. Johanna Nyden
Community Development Director provided an overview of the concept.
The Village Board expressed interest in creating a land trust.

Questions of how does a land trust would work, how you find houses to purchase, challenges that occur.
Decision making process and how does parcel of land gets incorporate as part of a Trust. Counseling and
Possibility of a time line. Tax on land, tax sales, tax exempt status , and vacant properties. This item is
only for discussion and no action is required at this time.
Gail Schechter- in favor of the Land Trust. Jerry Brozek not in favor of affordable housing. Lauren
Grodnicki spoke about multi family housing in the land trust.
Emi Yamauchi in favor of affordable housing, in favor of the Comprehensive Housing study.
How much would a person be able to buy the house if the land is in the land trust. The Village would
work with a professional appraiser to separate the value of the land vs value of the home.
C. Drive-Through via Special Use Process.
There has been a thorough review of drive-throughs and many discussions including with the Economic
Development Commission. The Village’s existing Special use process within the zoning code will
continue to apply to proposed drive-throughs. As a result of the recent review, the Special Use policy
guidelines are augmented with a framework that provides specificity to drive-throughs. The policy
guidelines remain constant and the framework will evolve as drive-throughs evolve and market place
conditions change.
Trustee Johnson commented that the Village will not be pursing the Zoning Chapter to make code
changes.

Building Code modifications. Item A is on the consent agenda for second reading and adoption. The first

B. An ordinance amending the Skokie Village Code pertaining to term limits for Village Mayor,
Village Clerk and Village Trustees. Item B is on the agenda for first reading. The second reading will be
on March 3, 2025.
Trustee Johnson commented that he was supporting this Ordinance.

Jerry Brozek congratulated Mayor Van Dusen on his years of service and spoke about the
Corporation Counsel’s role.
Emi Yamauchi spoke about the water main break and that the condo she lives in didn’t
know the severity of the problem and would have liked regular updates on the progress.
Dave Dalka spoke about a number of items in the Village that he needs help with-
infrastructure, paving issues, ATT fiber, staffing at the Police Department with animal
control etc. He gave a list to the Trustees.
Gordan Kalabic spoke about the many problems with short-term rentals, Airbnb-with
noise, garbage, parking, every week-different people.
Trustee Johnson spoke about the protest pf political hiring in the Legal Department.
Trustee Robinson 1 3 100 1 , 1 Incident, 3 days of service and dedication and over 100
volunteers and 1 day of gratitude for those who helped.

Music Theatre Works, Kyle Dougan, Producing Artistic Director
Each year, the Skokie Fine Arts Commission invites individual and group nominations for the
Skokie Award for Artistic Excellence, and presenting the award to one individual and one group
who have made significant contributions to the arts in Skokie, including visual, musical,
performing or literary arts. Award judging criteria include visibility in the community, scope of
artistic talents, other awards received by the artist or group and breadth of impact or number of
people reached in Skokie and the entire region.

FIRST READING
B. An ordinance amending Chapter 10, Article I, Section 10-10, and Article II, Section 10-63
of the Skokte Village Code pertaining to alcoholic liquor at 4051 Main Street, recently acquired
by the Village for various functions and events.. Item B is on the agenda for first reading, The
second reading will be on February 18, 2025.
New Business.
Trustee Robinson commented on honoring Black History Month, celebrating the
achievements, resilience and contributions of Black American's throughout this nation s
history and in Skokie.
Trustee Khoeun spoke about citizen comments regarding the Village ofSkokie s
Welcoming Ordinance of 2017. Wondering about reviewing and to see if there are
potential changes to be updated.
Mayor Van Dusen summarized that our 2017 Ordinance is strong. The Village does not share
citizenship and immigration status with 3rd party vendors, does not detain anyone based
only on immigration status, and does not enforce administrative warrants issued by ICE or
other agencies.
Would the Village be informed or have access to information if one of our residents is
detained by ICE? Police would have information if a crime occurred in town and the
Police would try to help.
Tmstee Johnson asked if there was a possibility to repeat or renew the Ordinance that was
passed in 2017 to reaffirm the spirit and policy of the Sanctuary Ordinance. Mayor
responded that we will look at it. Corporation Counsel stated that the possibility of
redrafting for the next meeting.
Gail Schechter-appreciate reviewing and upholding the Ordinance, reinforce support for
all groups that make up our diversity in Skokie-free of discrimination and harassment.
Ted Smukler-appreciate 'a lot of citizen involvement in the 2017 Ordinance.

WHEREAS, Chapter 58, of the Skokie Village Code provides for Human Relations as
a matter of right in the Village; and
WHEREAS, the United States of America is a nation founded by immigrants seeking
refuge from oppression, discrimination and religious persecution, and the Village of Skokie
has a long and proud history of being a place that welcomes immigrants into its community
and prohibiting any and all kinds of bigotry, hate crimes, intolerance and discrimination; and
WHEREAS, the Village of Skokie recognizes the value and contribution that
immigrants make to the community, be it those who immigrated decades ago and have
remained a valuable part of the community ever since, or those who have Joined the Village of
Skokie mere weeks ago and strive to enrich it; and
WHEREAS, the Village of Skokie is and has always been a community of immigrants,
making up nearly 40% of the population of the Village of Skokie and hailing from over 90
countries; and
WHEREAS, there is now significant fear amongst immigrants throughout the country,
as turmoil has created a level of uncertainty with regards to universal access to local
municipal services and police and fire protection; and
WHEREAS, the Village of Skokie is cognizant of effects of having any portion of our
community living in constant fear, not knowing whether it is safe to make contact with
emergency and other Village services, and seeks to aliay recent fears in their already difficult
lives; and
WHEREAS, the Village of Skokie considers immigrant rights to be unequivocally a
matter of human rights, and that fundamentally everyone deserves to live with an expectation
of basic safety and security; and
WHEREAS, the Village of Skokie has always maintained, and wi!! continue to
maintain, a policy to offer services regardless of immigration status, and to not inquire about
such status for any reason; and
WHEREAS, the Mayor and Board of Trustees reiterate their support for Chapter 58,
Article I, of the Skokie Village Code.
NOW, THEREFORE, I GEORGE VAN DUSEN. Mayor of the Village of Skokie, in
conjunction with the Board of Trustees, do hereby reaffirm our commitment to our immigrant
neighbors and friends as we did in 2017.

countless achievements and contributions made by African Americans to the Village
ofSkokie 's cultural, economic, political and social development; and

scholar. Dr. Carter G. Woodson in 1926 and seeks to rightfully restore the struggles
and triumphs ofAfrican-Americans into the national narrative; and

spotlight support for Black businesses and highlights the accomplishments and
contributions made to our economy and history; and

BOARD MEETING OF TUESDAY, FEBRUARY 18, 2025
A. Declaration of Emergency Affecting Public Health Resolution
At approximately 5:15 a.m. on Friday, February 14, 2025 a significant
transmission water main break occurred at East Prairie Road and Emerson Street
that resulted in a total loss of water supply to all Skokie water customers and
significant flooding and property damage to the residencies and businesses
nearest the break. At 7:30 a.m., the Village activated its Emergency Operations
Center (EOC), an interdisciplinary team consisting of staff from each department,
to coordinate its emergency response activities. At approximately 8:00 a.m., after
the system water pressure dropped below 20 pounds per square inch (PSI), the
Village issued a Boil Water Order in accordance to Illinois Environmental
Protection Agency guidelines. As a result of the water outage and Boil Water
Order, tap water was deemed unsafe for consumption without boiling it for at least
five minutes. This resulted in the temporary closure of over 400 Skokie food
establishments, all schools and many Skokie businesses, including the entire
Westfield Old Orchard shopping center, for the duration of the Boil Water Order
and lead to a significant loss of business. I respectfully request Mayor and Board
approval of the Resolution declaring an emergency affecting the public health due
to the transmission water main break that occurred at East Prairie Road and
Emerson Street on Friday, February 14, 2025.
B. Implementation of a Municipally-Supported Community Land Trust.
The Village Board expressed interest in creating a land trust. This is a mechanism
that promotes affordable home ownership and funding housing rehabilitation
programs. Funding is primarily through any fee-in-lieu activities as defined in the
Village’s Inclusionary Housing Ordinance. Johanna Nyden, Community
Development Director will provide an overview of the concept. This item is for
discussion and no action is required at this time.
C. Drive-Through via Special Use Process.
There has been a thorough review of drive-throughs and many discussions
including most recently with the Economic Development Commission. The
Village’s existing Special Use process within the zoning code will continue to
apply to proposed drive-throughs. And as a result of the recent review, the Special
Use policy guidelines are augmented with a framework that provides specificity to

drive-throughs. The policy guidelines remain constant and the framework will
evolve as drive-throughs evolve, market place conditions change and through
periodic reviews. This is informational and no action is required.
* D. Financial Auditing Services – Lauterbach and Amen, LLP, Naperville, Illinois
- $92,780.
The Village of Skokie engages the services of a licensed firm of certified public
accountants to audit its financial statements. The purpose of the audit is to assure
the public and regulatory agencies that the Village is appropriately accounting for
financial transactions including all necessary disclosures required by the
Government Accounting Standards Board (GASB) and Single Audit of our grant
programs. Lauterbach and Amen, LLP offered the Village the best combination of
relevant experience, qualified staff, company resources and exceptional value.
They provide accounting services for over one hundred municipalities including
the Villages of Morton Grove, Wilmette and Elk Grove. It is staff’s recommendation
that a $92,780 contract be awarded to Lauterbach and Amen, LLP for auditing
financial statements for fiscal years 2025 and 2026. I concur with staff’s
recommendation and respectfully request Mayor and Board approval.

A RESOLUTION DECLARING AN EMERGENCY AFFECTING
THE PUBLIC HEALTH DUE TO A TRANSMISSION WATER
MAIN BREAK NEAR THE INTERSECTION OF EAST PRAIRIE ROAD
AND EMERSON STREET ON FEBRUARY 14, 2025.
1 WHEREAS, at approximately 5:15 a.m. on Friday, February 14, 2025 a water main
2 break occurred near the intersection of East Prairie Road and Emerson Street (“Transmission
3 Water Main Break”). This water main is one of the transmission mains that provides water to
4 the Village of Skokie (“Skokie”) directly from the water provider. This break resulted in a total
5 loss of water supply to all Skokie water customers including residents and businesses; and
6
7 WHEREAS, at 7:30 a.m. on Friday, February 14, 2025, Skokie activated its Emergency
8 Operations Center (EOC), an interdisciplinary team consisting of appointed Village staff, to
9 coordinate its emergency response activities. The Fire Chief was appointed by the Village
10 Manager as lead Coordinator; and

12 WHEREAS, due to the Transmission Water Main Break, Skokie’s water system
13 pressure dropped below 20 pounds per square inch (PSI) resulting in a “Boil Water Order” to
14 be issued at approximately 8:00 a.m. on Friday, February 14, 2025, for the entire Village, in
15 accordance to Illinois Environmental Protection Agency (EPA) guidelines; and
16
17 WHEREAS, homes and businesses nearest the break experienced significant flooding
18 and property damage and all properties in Skokie that rely on water for heating were unable to
19 heat their properties for over 24 hours in temperatures that dropped below ten degrees; and
20
21 WHEREAS, for over two days all Skokie residents and businesses were unable to
22 safely ingest tap water without boiling it for at least five minutes and instead had to use bottled
23 water; and
24 WHEREAS, all Skokie food establishments, schools, and many Skokie businesses,
25 including the Westfield Old Orchard shopping center, were unable to safely operate during the
26 water outage and Boil Water Order and had to close for over two days resulting in a significant
27 loss of business; and

29 WHEREAS, the public health of the residents, employees, employers and visitors, in
30 Skokie, including first responders, utility personnel and other public employees, is of
31 paramount concern and a primary responsibility of Skokie; and
32
33 WHEREAS, the Village of Skokie Director of Public Health and Human Services has
34 issued advisory notices and specific directives concerning the emergency condition of the
35 public water supply which required certain action by Village of Skokie staff and community
36 members and businesses; and

1 WHEREAS, Section 8-10-5 of the Illinois Municipal Code, 65 ILCS 5/8-10-5, provides
2 that the corporate authorities of a municipality may declare an emergency when the public
3 health or safety is affected pursuant to a majority vote of its members and such a declaration
4 will allow for contracts to be approved by the Village without formal bidding; and
5
6 WHEREAS, Section 2-969 of the Skokie Village Code (“Code”) allows that the Mayor
7 and Board of Trustees may, on recommendation of the Agency Coordinator with the
8 concurrence of the Village Manager, authorize and adjust Skokie’s financial processes and
9 governmental operations to place the Village in a position to effectively combat any risk to
10 public health and safety, to protect property and to provide emergency assistance to residents
11 and businesses; and
12 WHEREAS, Section 2-37 of the Skokie Village Code (“Code”) permits notice of
13 meetings, which would include the public notice of meeting agendas, at least 48 hours before
14 such meeting and pursuant to the Illinois Open Meetings Act, 5 ILCS 120/2.01(a) agenda for
15 public meetings may be posted at least 48 hours before a meeting to vote on an agenda
16 matter and therefore, with the next Village Board meeting scheduled for Tuesday, February
17 18, 2025 proper notice of this Resolution may be by publication by end of the day February 16,
18 2025; and

20 WHEREAS, for these reasons it is necessary and prudent for the Village Board to
21 declare a public health emergency in the Village pursuant to Section 8-10-5 of the Illinois
22 Municipal Code.

24 NOW THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
25 Village of Skokie, Cook County, Illinois, in the exercise of its home rule powers, as follows:

27 Section 1. Recitals Incorporated. The recitals are incorporated herein as
28 though fully set forth below.

30 Section 2. Declaration of Emergency Affecting the Public Health. The Mayor
31 and Board of Trustees declares a public health emergency due to the Transmission Water
32 Main Break that occurred on February 14, 2025 pursuant to Section 8-10-5 of the Illinois
33 Municipal Code.

35 Section 3. Duration of Emergency Declaration. This Emergency Declaration
36 shall be in effect until April 7, 2025 which may be extended in increments of seven (7) days
37 each by the Village Manager, or such time as the Mayor and Board of Trustees shall
38 conduct its next meeting where a quorum is physically present pursuant to Section 2.01 of
39 the Illinois Open Meetings Act, 5 ILCS 120/2.01.

41 Section 4. Village Finances. The Village Manager is authorized to establish
42 administrative rules and procedures for the continuation of Skokie finances and operations
43 as a result of and related to the Transmission Water Main Break on February 14, 2025,
44 including any and all payments and financial actions to ensure the continued and
45 uninterrupted day to day Skokie operations.

47 Section 5. Severability and Repeal of Inconsistent Ordinances and
48 Resolutions. If any section, paragraph, clause or provision of this Resolution shall be held

1 invalid, the invalidity thereof shall not affect any of the other provisions of this Resolution. All
2 ordinances, resolutions or adopted motions in conflict herewith are hereby repealed to the

4 Section 6. Effective Date. This Resolution shall be in full force and effect upon
5 its passage and approval.

Implementation of a MunicipalIy-Supported Community Land Trust
As a result of the Village Board s prioritization to establish a Community Land Tmst (CLT) in
Skokie, staff has prepared this memorandum that summarizes additional information on CLT
implementation and updated Village Code language for Section 58-50 to establish the Skokie
Community Land Trust (SCLT).
Background
The creation ofaCLT in the Village will support the range of affordable and attainable housing
offerings that will build on the work underway to implement the Village's housing policy goals.
A CLT Is a mechanism for creating affordable homeownership units while maintaining them as
affordable over the long-term. CLTs achieve and sustain affordability by retaining ownership of
the land itself, requiring the homeowner to purchase only the home that is situated on the land,
while the ownership of the land is maintained by the land trust.
Through the CLT model, homeowners build wealth in two ways: (1) through the savings gained
by paying down the principal balance of their mortgage and (2) through the share of home price
appreciation allocated to them under a resale formula. The high costs of land are often an
obstacle to securing housing for moderate-income families and one way to address this issue is to
create a legal pathway to allow families to purchase a house without the land. Residents would
need to be income eligible when purchasing the property (typically households eligible for
purchasing homes in the land trust would need to fall between 80 and 120 percent of area median
income) and when they would like to sell the home in the future, the restriction to sell the home
to another income eligible household at a price that is considered affordable (price is typically
determined through a resale formula for housing affordability) would be required. The land
would continue to remain in the tmst in perpetuity to ensure the property remains affordable to
households in the future.
Skokie Community Land Trust (Section 58-50)
SCLT includes the following:
• Definition of a Land Tmst ~- A Land Trust is a form of shared equity ownership in which
the Land Tmst owns the land of a property and a different owner (an individual that is
low- or moderate income) owns the structure or improvement. A land tmst ownership

arrangement allows households to purchase a home at a more affordable amount since the
most significant driver of a home price is the location where the structure is situated.
• Purpose of the SCLT- To support acquisition, rehabilitation, or development of
residential properties with the purpose of providing housing for low- and moderate-
income households.
• Define households eligible for participation in the SCLT — Eligible households would be
households at 80 percent of the area median income and that do not exceed 120 percent
of the area median income for the Chicago area, as established and defined by the annual
schedule published by the Secretary of Housing and Urban Development (HUD).
• Creation of a Housing Fund:
o The funding source for the Housing Fund shall be funds received through fee-in-
lieu activities as defined by the adopted inclusionary housing ordinance, the sale
or rental of real property associated with housing activities, funds from other non-
Village governmental units in support of housing activities, and any other funds
identified or received to support the activities.
o Permissible uses for the Housing Fund include Village administered housing
rehab programs, acquisition activities associated with residential properties and
the SCLT, administrative costs associated with these activities, and other housing
elements and programs as developed by the Village to support investment in
homes for low- and moderate-income individuals.
o Distribution of funds shall be in the form of grants or loans for such activities as
well as acquisition of property and homes.
The focus of the CLT is to assist families that fall within the income limits between 80 and 120
percent of the area median income (AMI) as set by HUD amiually.

DRIVE-THROUGHS IN THE VILLAGE OF SKOKIE
Staff recommends continued application of the Village's existing special use process within the
zoning code to manage the review and consideration of proposed drive-throughs in the Village.
Staff further recommends utilization of the attached policy guidelines to apply the existing
zoning standards and conditions to future proposed drive-throughs. Based on this policy
measure, no further zoning changes or adoption of code changes related to the drive-throughs are
recommended.
At its December 18, 2024 the Economic Development Commission discussed the consideration
of the regulation ofdrive-throughs in the Village ofSkokie and concurred with staffs
recommendation to continue to utilize the Village's special use process to manage drive-
throughs. The administration of the special use requirements within a policy framework that
includes the Village's adopted Environmental Sustainability Plan will be both business-friendly
and seek to further the goal to bring a reduction in greenhouse gas emissions below 2020 levels
by 2030 and the achievement of carbon neutrality by 2050.
Background:
The establishment of new drive-throughs are regulated through the Village's special use process.
New drive-throughs are reviewed by staff and the Plan Commission. A recommendation is
established by these entities that is then presented to the Village Board; the Village Board is the
final determining body as to whether or not to allow a new drive-through. Within this special
use process, conditions are often placed on the proposed drive-through that could include hours
of use, location of the drive-through, and direction on site-specific characteristics such as
landscaping, loudspeakers, lighting, etc. The conditions are established to help a project meet
the zoning code's standards for a special use.
Presently the following standards are applied to all special uses:
1. The request is consistent with the intent of the Comprehensive Plan.
2. The request will not adversely affect adjacent properties.
3. The request is compatible with the existing or allowable uses of adjacent properties.
4. The request demonstrates that adequate public facilities, including roads, drainage,
utilities, and police and fire protection exist or will exist to serve the requested use at the
time such facilities are needed.

5. The request demonstrates adequate provision for maintenance and use of the associated
structures.
6. The request has considered and, to the degree possible, addressed the adverse effects on
the natural environment.
7. The request will not create undue traffic congestion.
8. The request will not adversely affect public health, safety, and welfare.
9. The request conforms to all applicable provisions of this code, except where relief is
granted with the request.
Staff and the Plan Commission review these standards and indicate if they have been met
through the drafting of a Findings of Fact that is enclosed in the staff report to the Plan
Commission and to the Village Board. The attached document provides a framework for how
the standards serve to accomplish the approval ofdrive-throughs that align with Village policies.
Background:
The Village Board directed the Plan Commission to study drive-throughs in 2023 and consider
potential changes to support mitigating their impact in commercial areas. Additionally, drive-
throughs were studied within the context of emissions production through idling activities while
cars wait for order pick-ups. At its September 18, 2023 and November 6, 2023 meetings, the
Village Board reviewed Case 2023-19P: Zoning Chapter Amendment to address drive-through
facilities in the Village. The amendment to Chapter 11 8 proposed to:
• Adopt specific language that defines a drive-through facility;
• Require drive-throughs to be screened from the street and placed behind buildings;
• Remove food-related drive-throughs as an allowed use from the mixed-use districts;
• Reduce the parking requirement at drive-through establishments from 1 parking space for
each 100 square feet of net floor area to 1 spot per 150 square feet of net floor area; and
• Require that no mature trees can be removed to accommodate a drive-through; and for
every trip generated by a drive-through, one new tree must be planted on-site or a fee-in-
lieu shall be paid to the Village to off-set emissions from drive through activities.
The discussion by the Village Board focused on whether to officially codify the suggested
amendments in the Village's Zoning Code or to direct staff to utilize these proposed amendments
as policy guidance to inform conditions for new development that include drive-throughs on a
case-by-case basis. Following the tabling on the November 6, 2023 meeting, the staff worked to
address outstanding concerns and answer questions as well as conduct additional due diligence
on the matter. Concurrent to the Village's review ofdrive-throughs, the market conditions
associated with drive-throughs are changing. Following the CO VID" 19 pandemic, drive-
throughs continue to be a popular manner to purchase food from fast casual restaurants ~ as such
new restaurants are being designed or retrofitted with this in mind. Examples of this include:
• Drive-throughs are oriented to better support movement of cars through a site. This is
accomplished through new restaurants with smaller dining areas and larger areas devoted
to parking pick-up areas for drive-through customers as well as interior areas designed
for pick-up orders; and
• Apps on phones are designed to facilitate ordering in advance, thereby supplanting
traditional menu boards and converting drive-throughs to predominantly pick-up
windows.

The offerings by restaurants and customer demand continue to evolve and this remains a subject
of interest and review by professional planning and economic development organizations and
practitioners.

Background
The Village ofSkokie engages the services of a licensed firm of certified public
accountants to audit its financial statements. The purpose of the audit is to assure the
public and regulatory agencies that the Village is appropriately accounting for financial
transactions including all necessary disclosures required by the Government Accounting
Standards Board (GASB). In addition to the financial audit, because the Village receives
significant funding from the Federal government (Community Development Block Grant
and Flood Remediation), the Village also undergoes an audit of its grant programs which
is typically referred to as the Single Audit.
To comply with our policies, staff seeks requests for proposals for auditing services every
five years. To that end, a request for proposals (RFP) was issued for the services of a
qualified auditing firm to perform the audit of the Village's financial statements for the
fiscal years 2025 and 2026. The RFP was advertised and on January 21, 2025 the
following three firms responded:
Sikich LLP, Naperville, IL
Lauterbach and Amen LLP, Naperville, IL.
Crowe LLP, Oak Brook, IL.
The firms were evaluated based on a combination of factors including satisfactory prior
engagements with the Village, significant familiarity with audits of governmental
agencies. Single Audit experience, proposed fees for services, and the ability of the firm
to continue to obtain the Government Finance Association's (GFOA) "Certificate of
Achievement for Excellence in Financial Reporting" award.

Recommendation
Upon completion of the review process, it was determined that Lauterbach and Amen
LLP offered the Village ofSkokie the best combination of relevant experience, qualified
staff, company resources and exceptional value. It is recommended that a contract for the
audit of Village financial statements for fiscal years 2025 and 2026 be awarded to
Lauterbach and Amen LLP, in the amount of $92,780 ($45,480 for FY25 and $47,300 for
FY26). The proposed fees from Lauterbach and Amen LLP were substantially lower
than the other two firms.
Comments
Lauterbach and Amen has provided auditing services for the Village from FY20 through
FY24, and staff has had an excellent working relationship with the firm. In order to
provide utmost assurance to the public as well as the various agencies and entities with an
interest in our financial statements, the proposed engagement will be fulfilled by a
completely new team of staff and partners from Lauterbach and Amen. Lauterbach and
Amen specializes in governmental accounting and auditing, and they provide
professional auditing services for over one hundred municipalities. Those clients include
the Villages ofMorton Grove, Wilmette, and Elk Grove.

This ordinance will amend the various sections of Chapters 22,46 and 86oftheSkokie
Village Code. Many of these code changes clarify and strengthen the building code. They
include, but are not limited to the following:
Requiring proof of insurance, in place of bonds for contractor work;
Allowance for a Temporary Certificate of Occupancy (TCO) in certain
circumstances;
Requiring new muiti-family buildings to include a fireproof storage room for
electronic mobility devices, ensuring protection of property in the event of a fire
caused by improperly stored or charged batteries.

B. Ordinance, Code Amendment Pertaining to Term Limits
Item B is on the agenda for first reading. The second reading will be on March 3,2025.
This ordinance will amend Chapter 2 of the Skokie Village Code by establishing term
limits for the Mayor, Village Clerk and Village Trustees, both at-large and district
Trustees. Pursuant to Village Resolution Number 24-7-R-1573, beginning with the 2025
Consolidated Election; one may not hold the offices of Village Mayor, Village Clerk
and at-large Village Trustee for more than three (3) terms total. Beginning with the
2027 Consolidated Election, one may not hold the office of a District Trustee for more
than three (3) terms total.

SECOND READING
C. Ordinance, Code Amendment Pertaining to Alcoholic Liquor
Item C is on the agenda for second reading and adoption. The first reading was on
February 3, 2025.
This ordinance will amend Chapter 10, Sections 10-10 and 10-63 of the Skokie Village
Code, by allowing the sale and consumption of alcohol at 4051 Main Street, recently
acquired by the Village for various functions and events. This is a site-specific
exemption which will allow the sale and consumption of alcoho! on Village owned
property. Any liquor sold or served at 4051 Main Street shall be provided only within the
building inferior and as part of a Village sponsored event or activity. The vendor must be
an existing Skokie Liquor Licensee, who would be required to obtain a Temporary Liquor
License for each event, pursuant to Section 10-40.
Additionally, in response to the inquiries and requests by the Liquor Commissioner from
existing and potential restaurants and other establishments for liquor licenses in the
Village, this ordinance will increase the number of Class E, Class M, and Class "P-
right/P" license structures.

Proposed Village Code Amendments Related to Building Code
Improvements
Staff recommends the Village Board direct Corporation Counsel to draft an ordinance to update
portions of the Skokie Village Code to ensure the community is In line with best practices and
continues to support a business-friendly approach to permitting and inspection work.
In reviewing the Village ofSkokie's adopted Building Codes (and amendments) staff
recommends changes that will make the Village consistent with other communities and leaders
in service to our customers:
• Requiring proof of insurance, in place of bonds, for contractors to obtain a building
permit. Presently the requirement of a bond may give the impression to property
owner/tenant/contractor that the Village is responsible for making those repairs, should
the work not be completed. In no circumstance would the Village complete outstanding
work on a project occurring on private property.
• Addition of language to allow for a Temporary Certificate of Occupancy (TCO).
This would allow for a business to open prior to completing all inspections required for a
full certificate of occupancy. Often businesses have created habitable space that meets
the Village's life safety requirements but have minor or weather dependent work (e.g.
landscaping, etc.) while they continue addressing any remaining permit requirements.
Requiring a fee to obtain a Temporary Certificate of Occupancy (TCO) helps ensure that
the business follows through with completing the necessary repairs to eventually receive
their Final Certificate of Occupancy (FCO).
• Changing the term "Certificate of Compliance" to "Occupancy Certificate"
throughout our code aligns with standard terminology used by other codes and
municipalities, while also simplifying the language. These "certificates" give the rights
for a business to occupy space.
• Add a code section requiring new multi-family buildings to include a fireproof
storage room for electronic mobility devices, ensuring protection of property in the
event of a fire caused by improperly stored or charged batteries. The exemption for
mobility devices ensures individuals with mobility challenges can still use their devices
to navigate the building.
• Addition of a code requiring multi-family dwellings, with assigned parking, to label
the parking spaces to correspond to the associated unit. Since multi-family properties

In 2022, the Village of Skokie adopted the most current International Code Council (ICC) codes
and amendments. The codes assure safe building construction practices and help to keep our

AN ORDINANCE AMENDING CHAPTERS 22, 46 AND 86 OF THE
SKOKIE VILLAGE CODE RELATING TO BUILDING CODE
MODIFICATIONS
1 WHEREAS, Chapter 22, 46 and 86 of the Skokie Village Code contains provisions for
2 building and construction regulations, including fees and work regarding public property; and
3 WHEREAS, from time to time the Community Development Department reviews
4 various building and Village Code sections adopted by the Village to determine if they are up
5 to date and to eliminate conflicts with other codes. The Community Development Director has
6 completed such a review and is recommending various amendments to the Skokie Village
7 Code, as stated in her Memorandum, dated January 24, 2025; and
8
9 WHEREAS, many of these code changes clarify and strengthen the building code.
10 They include but are not limited to the following:

12 Requiring proof of insurance, in place of bonds,
13 Allowance for a Temporary Certificate of Occupancy in certain circumstances,
14 Requiring new multi-faml!y buildings to include a fireproof storage room for electronic
15 mobility devices, ensuring protection of property In the event of a fire caused by
16 improperly stored or charged batteries; and
17 WHEREAS, the Village Manager recommended that the Village Code be amended in
18 accordance with the Community Development Director's recommendations; and
19
20 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on February
21 3, 2025, concurred in the aforesaid recommendation of the Village Manager;
22 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the
23 Village of Skokie, Cook County, Illinois;
24 Section 1: That Chapter 22, of the Skokie Village Code be and the same is
25 hereby amended in the manner hereinafter indicated. The new material is highlighted in

1 WHEREAS, the Village of Skokie ("Village") is a home rule municipal corporation duly
2 organized and existing under the laws of the State of Illinois; and

4 WHEREAS, pursuant to the applicable provisions of and authority under the Nfinois
5 Constitution and Article 28 of the Illinois Election Code, the following referendum question
6 passed by Village of Skokie Resoiution Number 24-7-R-1573 and initiated by voter petition,
7 was placed on the ballot for the November 5, 2024 General Election in the Village of Skokie:

10 Ordinance amending the Skokie Village Code to enact term limits for the elected

AN ORDINANCE AMENDING CHAPTER 10, ARTICLE I, SECTION 10-10
AND ARTICLE II, SECTION 10-63 OF THE SKOKIE VILLAGE CODE
PERTAINING TO ALCOHOLIC LIQUOR
1 WHEREAS, Chapter 10 of the Skokie Village Code (hereinafter "Code") provides
2 for rules and regulations pertaining to the sale of alcoholic liquor in the Village of Skokie
3 (hereinafter "Skokie"); and
4 WHEREAS, the Village recently acquired property at 4051 Main Street, with the
5 purpose of creating a location where the Village could host a variety of events such as art
e exhibitions, culinary experiences and cultural performances with a focus to serve as an
7 "art and small business incubator"; and
s WHEREAS, it is anticipated that this space wi!l serve as a driver of foot traffic,
9 supporting !oca! businesses and enhancing the vibrancy of the area. The Village's
10 creation of 4051 Main Street is designed to attract diverse audiences from both within the
n local community and beyond; and
12 WHEREAS, many of these events wou!d be enhanced by offering liquor through
13 vendors who have businesses with current Skokie liquor licenses in the Village. Currently,
14 Section 10-10 (a) of the Skokie Village Code prohibits the consumption of alcohol on any
15 property owned or leased by the Village. While Section 10-10(b), does provide for some
16 relief, this carve out was designed to accommodate rare or annual events that lend
17 themselves to such temporary use of alcohol, such as Skokie's Annual BacklotBash; and
is WHEREAS, In order to allow alcohol at 4051 Main Street for Village of Skokie
19 sponsored events, Section 10-10 of the Skokie Village Code should be amended to
20 exempt 4051 Main Street from the current prohibition of selling or consuming liquor on
21 Village owned property. Any liquor sold or served at 4051 Main Street sha!) be provided
22 only within the building interior of the property, as part of a Village sponsored event or
23 activity; and

25 WHEREAS, a Skokie Liquor Licensee may be eligible to set! and serve alcoho! at
26 4051 Main Street, however the Licensee shall be required to obtain a Temporary Liquor
27 License for each event, pursuant to Section 10-40. Each event wi!l count toward the
28 number of Temporary Liquor Licenses an entity can receive in a 12 month period and that
29 the Liquor Licensee must provide staff who are BASSET trained; and

1 WHEREAS, amongst the classifications of licenses added to respond to expanding
2 business in Skokie is the Class E, Class M, and Class "P-right/P" license structures; and
3
4 WHEREAS, the Mayor, as Liquor Commissioner, has received inquiries and
5 requests from existing and potential restaurants and other establishments for liquor
6 licenses in the Viiiage. In an effort to foster economic activity, the Mayor has previously
7 stated that he will recommend that additional licenses be created; and

9 WHEREAS, the Local Liquor Commissioner recommended to the Board of Trustees
io that Chapter 10, Article I, Section 10-10 and Article II, Section 10-63 of the Skokie Village
n Code be amended accordingly; and
12 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on
13 February 18, 2025, concurred in the aforesaid recommendation of the Local Liquor
14 Commissioner; and
15 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the

24 public rights-of-way.

26 (a) No person shall possess an open container of alcoholic liquor or consume alcoholic
27 liquor on (i) property owned by, or leased to, the Village, or (ii) public rights-of-way, except
28 for an area or location that the Village has approved such possession or consumption, as
29 specified in paragraphs (b) or (c) of this section.

31 (d) An exception to paragraph (a) in this section shall be the property located at 4051

PLAN COMMISSION RECOMMENDATION AND ANALYSIS
At the January 9, 2025, meeting of the Plan Commission, the request from 3450 Touhy,
LLC, on behalf of Second City Pickleball, LLC, for a special use permit for a recreation
facility at 3462 Touhy Avenue in a B2 Commercial zoning district was recommended as
APPROVED by a vote of 8 ayes and 0 nays, with 1 member absent.
The request includes the following:
The establishment of a 9-court indoor pickleball facility within approximately
24,149 square feet of vacant commercial space.
A lobby area, an event space, restrooms, seating areas, lockers, a pro shop, and
a refrigerator and/or vending machine that will offer beverages and pre-
packaged food for sale.
The use of 65 existing parking spaces by patrons of the facility.
A new trash corral, which will be constructed on the west side of the building.
The Plan Commission concurred with staff’s recommendation to grant the special use
permit, subject to the attached conditions.
ADDITIONAL PLAN COMMISSION ANALYSIS
One commissioner asked whether food would be cooked on site and whether liquor
would be served. The petitioner responded that all food will be grab and go. Patrons
can bring their own alcoholic beverages, but it will not be sold or served by the facility.
Another commissioner requested that a trash can be provided at the front door by the
petitioner, due to food being available at the facility. A detailed discussion of the case
is provided in the attached Staff Report and minutes.
In advance of the first reading before the Board of Trustees, the petitioner submitted a
revised site plan that depicted the placement of a trash can outside the front entrance
of the facility.
INTERESTED PARTIES
Legal notice was properly posted, advertised, and delivered to all property owners in
the area of the subject site as prescribed by the Zoning Chapter. No interested parties
spoke regarding the case.

the final Village approved Site Plan, dated January 12, 2025, and Floor Plan,
received October 15, 2024;
2. Prior to the issuance of an occupancy permit, the property owner must:
a. Reconfigure the parking space striping along the north side of the building so
that the existing accessible loading space near the front entrance to the
proposed use aligns with the existing ADA-accessible ramp.
b. Remove all existing reserved parking signage from the subject site.
c. Stripe a stop bar at east end of the east-west driveway to the north of the
building.
d. Raise the existing stop sign to a height of 7 feet measured vertically from the
bottom of the sign to the ground at the east end of the east-west driveway to
the north of the building.
3. The petitioner shall submit to the Planning Division electronic files of the site and
floor plans in their approved and finalized form.

A motion to approve the minutes of the December 19, 2024 meeting was made
by Commissioner Scott Berman and seconded by Commissioner Jeff Burman.

a. Case 2024-40P: Special Use Permit: 3462 Touhy Avenue - Pickleball
3450 Touhy, LLC, on behalf of Second City Pickleball, LLC, requests a

Mike Voitik, Planning Coordinator, requested the staff report be accepted into the
record as written. He presented the positive Findings of Fact and reviewed staff’s
recommended conditions. The site plan and information on site access were
presented. Staff is in support of the petitioner’s request for a special use permit.
The facility will have 9 pickleball courts, a small area for snacks and beverages,
and a pro shop offering pickleball accessories for purchase. As the facility will
share the site with XSport Fitness, there is sufficient parking. A garbage corral
will be located on the west side.
Emmanuel Byarm, attorney from Shain Banks, along with Hillary Gelfman and
Ken Rice, business owners, provided an overview of their request and
represented that the use is consistent with the Comprehensive Plan, compatible
with other area uses, and will not create any traffic issues.
The business owners wish to repurpose a single-story warehouse building into
an indoor pickleball facility available for drop-in play, court reservations, lessons
& clinics, tournaments, and private events. They will be open from 7 AM to 10
PM seven days a week with staff on-site at all times.
Scott Berman inquired about any cooking on site. The petitioner responded that
they will be selling only grab and go type snacks but will be applying for a liquor
license to be able to offer BYOB.
One commissioner asked that a trash receptacle be placed at the entrance.

Corporation Counsel, Kobylski determined that notice was not properly fulfilled
and therefore, Cases 2024-30P through 34P will need to be heard at a future
meeting. The cases will be re-advertised and re-noticed within 45 days.
The chairman opened the floor to general comments only.
Nadiia Vasilj asked if comments would be saved to be addressed at the next
meeting. She also asked how members of the public could join boards and
commissions.
Jay asked if cases are granted approval by the Plan Commission and the use
changes, is there a new hearing for the new use. He cited a change of use at a
site where he did not get notified. The Chairman responded that he could not
address the inquiry and the individual was referred to staff for further assistance.
