Ilonka Ulrich spoke about civility during public comment and about repeated harassment
directed at Board members.
Shelly Patt spoke about the Village’s inclusionary zoning ordinance and asked the Board to
revisit it to require affordable housing rather than allowing fee-in-lieu payments.
Cathi White from Go Green Skokie, announced the April 24–27 City Nature Challenge in
partnership with Oakton College.
Kimberly Polka spoke about immigration enforcement concerns and asked the Board to consider
an ordinance establishing clear police protocols.
Peggy Tolleson and Marie Benyamin (Niles Township Trustees) spoke in support for the Mayor
and Trustees and appreciation for their service.

David Dalka asked for removal of an obstructive bush and installation of a four-way stop sign at
a local intersection; also spoke about a canceled Foreign Fire Board meeting notice and
requested improved communication regarding AT&T and fiber providers.
Ms. Kabir spoke about federal immigration enforcement and supported adoption of a local
ordinance providing guidance to police.
Rachel Vanhoose thanked Village staff for assisting an injured resident and raised concerns
about deteriorating property conditions along Oakton Street.
Emi Yamauchi spoke about developing police guidance related to immigration enforcement,
review of potential detention facility uses in large buildings, and stronger use of existing tools to
require affordable housing.

Motion to adopt an Ordinance approving a modification to the previously approved site plan for
a mixed-use development located at 5202-5250 Old Orchard Road, Skokie, Illinois in an OR
Office Research district. Item A is on the consent agenda for second reading and adoption. The
first reading was on January 20, 2026.
This item had been removed from the consent agenda. Emi Yamauchi addressed the board,
stating that her point was about the fee in lieu.
Trustee Schechter explained her support for the fee in lieu, noting the project predated the
affordable housing ordinance.
Trustee Robinson spoke about the ordinance’s limitations but noted it was not in place when the
project was proposed.
Mayor Tennes stated the ordinance created by the prior board was an important starting point for
future improvements.

Mayor Tennes acknowledged Dr. Alyssa Kritzman, a new Skokie resident and veterinarian who
would be serving on the Board of Health.
New Business
Trustee Schechter introduced a motion directing staff to prepare an ordinance addressing local
authority and public safety during federal immigration enforcement based on a proposed draft
ordinance she had circulated to the board.
Village Manager Lockerby advised caution, noting legal and operational complexities and
recommending discussion of concepts rather than advancing a Village-drafted ordinance at this
time. Manager Lockerby warned that bringing back a Village-drafted ordinance would be
advancing many steps and cautioned about the various nuances involving federal government
oversight processes and their limitations.

Corporation Counsel Elrod agreed the motion if seconded would be in order. He concurred with
the Village Manager's concerns about having an actual ordinance versus having a discussion due
to concerns about scope and governance structure.

Trustee Robinson expressed support for collaboration and discussion.
Trustee Lissa Levy stressed urgency given community concerns and supported moving forward
while allowing legal review.
Trustee Pure Slovin emphasized the importance of proper legal review and process, before
drafting and codifying an ordinance.
Trustee Iverson supported discussion and stressed the need for input from legal staff and the
police department.
At this time Village Manager Lockerby recommended the board not approve the proposed draft
ordinance as written because it put village employees in legal jeopardy as individuals and puts
the organization in liability concerns.
Mayor Tennes suggested discussing the entire subject matter at the March 16th Committee of the
Whole meeting to allow more thorough review and asked Trustee Schechter amend her motion.
Motion by Trustee Schechter, (as modified), to have a discussion at the March 16, 2026
Committee of the Whole meeting pertaining to local authority and public safety during
immigration enforcement activity.

concern about delays.
David Dalka raised questions about resources and implementation of ordinances.
Shelly Patt asked the Board to take action while acknowledging the need for careful
consideration.

Mayor Tennes announced the Committee of the Whole meeting will begin at 5:30 PM on March
16, 2026, and the previously scheduled video gaming discussion would be discussed at a date to
be determined.

Niles Township Supervisor Bonnie Kahn Ognisanti, thanked attendees for civic engagement,
recognized Trustees Benyamin and Tolleson, acknowledged Women’s History Month, and
announced a feminine hygiene product drive for the Niles Township food pantry, encouraging
donations due to lack of SNAP coverage.
Eric Finkelstein discussed immigration and suggested bringing immigration attorneys to Skokie
to help residents begin applications at lower cost.
Mike Koplow - immigration offices could expose individuals to enforcement actions when
completing paperwork.
Lauren Grodnicki spoke about climate change, sustainability and planting more trees.

MINUTES of training session for the Village Boards and Commissions of the Village of
Skokie, County of Cook, Illinois held in Council Chambers of the Village Hall at
6:30 PM on February 12, 2026.
In attendance were Mayor Tennes, Clerk Desai, Trustees Iverson, Lissa Levy and Pure
Slovin along with commission chairs, vice chairs and staff liaisons.
Mayor Tennes announced that Corporation Counsel Elrod would conduct a Board and
Commission training for the Chairs, Vice Chairs, and staff liaisons covering official
topics related to municipal law and governance.
Corporation Counsel Elrod led a training session covering key aspects of municipal law.
The session included discussion and case samples relevant to
municipalities.
Corporation Counsel Elrod reviewed the roles and responsibilities of commissions,
expectations for members, communication practices, and general meeting procedures.
Following the presentation, the Mayor invited each commission to speak briefly about its
purpose, current projects, and goals, providing an opportunity for shared updates and
discussion.
The training session ended at 8:30 PM.

the Human Relations Commission. She expressed gratitude for their many years of service to the
Village and extended condolences to their families.

a. D219 Dance Marathon
Mayor Tennes introduced a presentation on the District 219 Dance M'arathon by sponsor Dena
Lichterman, English teacher at Niles West High School.
Students Ayan Khan (Niles North), Adam (Niles North), Isabella Valencia (Niles West), and
Orly Eisenberg (Niles West) provided an overview of the student-led nonprofit, noting its 24-
year history and more than $1.2 million raised. They outlined committee structure, fundraising
efforts, and community partnerships, and announced that the 2025-2026 primary beneficiary is
the Niles Township Food Pantry, with 10% of proceeds supporting the Education Foundation.
Mayor Tennes thanked the students for their efforts in raising funds to support important
nonprofits in the community. She asked when the Dance Marathon would be held, and the
students responded that it is scheduled for May 23.
Trustee Robinson thanked the students for their presentation and encouraged community support
of their fundraising efforts.
Trustee Iverson thanked the students for their impact and leadership.

Public Comment (3 minutes per person, maximum of 30 minutes)
Mayor Tennes explained that the public comment periods are for addressing the Village Board
regarding items not on the agenda for action. Each speaker is allotted three minutes, and the
Board will listen but likely not respond. She noted that normally they allow up to 5 speakers for
agenda items, but for the 4600 Main Street project, they would extend to 10 speakers - 5 in
support and 5 opposed. During a 5-7 minute break. Deputy Village Clerk Luke and Clerk Desai
would manage sign-up sheets for speakers.
Lauren Grodnicki spoke about energy and sustainability.
Mayor Tennes called a recess for 5-7 minutes for speakers to sign up. The meeting resumed at

Report of the Village Manager
a. Recommendation to Provide for a Rebate Program for Lead Service Line
Village Manager Lockerby presented a recommendation to establish a rebate program for lead
service line replacements. He noted that the Village's 2022 program capped private costs at
$3,090, with a financing option.
StaiET recommended a rebate program for approximately 230 homeowners who independently
replaced their service lines since 2022. Eligible homeowiters would receive either a $750 cash
rebate or a $1,250 utility bill credit for qualifying replacements completed &om January 2022 to
the present.

Trustee Schechter asked how the rebate amounts were detennmed. Finance Director Prendi
explained that the $750 cash rebate reflects immediate impact to the water fund, while the $1,250
utility bill credit is recognized over time.
Trustee Robinson asked about the application process and language access. Director Prendi
stated the Village would notify approximately 230 eligible households by mail and provide an
online and in-person application process with required documentation. Village Manager
Lockerby noted website information can be translated.
Mayor Tennes summarized the three ways the village is addressing the unfunded mandate:
households along construction corridors can opt in with costs capped at $3,090; those not along
construction routes can apply for service with the same cap; and tonight's proposal provides
some equity to those who ab-eady completed work independently.

Mayor Tennes explained that on December 15th, the board had unanimously adopted a
resolution appointing Steven Elrod ofEIrod Friedman LLP as Corporation Counsel in a hybrid
system with existing in house Counsel. The board had continued working on an arrangement
where a majority of work would be covered under a monthly retainer. A revised engagement
letter dated February 10, 2025, with a monthly retainer agreement was now before them.
Mayor Tennes reminded everyone that the Corporation Counsel's office would come in under
budget for fiscal year 2026 and the budget would be flat for fiscal year 2027, barring unforeseen
litigation.
Establishment of a Skokie Youth Commission.
Mayor Tennes introduced the proposed Skokie Youth Commission, emphasizing the importance
of youth engagement in local government,
AIex Franz, Assistant to the Village Manager presented the proposal, noting that staff began
exploring the concept in August 2025 and reviewed models from comparable Illinois
communities. He outlmed the commission's purpose to elevate youth voices and foster civic
engagement.
Assistant to the Village Manager Franz explained the commission would include 16 Skokie high
school students, appointed by the Mayor with Board consent, serving one-year terms aligned
with the school year and meeting bimonthly, with Annemarie Benuzzi as staff liaison. He also
summarized recruitment efforts and anticipated first-year activities, including orientation to
Village government, participation in community events, and preparation of an annual report.
Trustee Kimani Levy expressed support and asked about ensuring diversity. Assistant to the
Village M.sn.ager Franz explained the proposed 16-member commission would include
representatives &om local public and private high schools, plus at-large members, with broad
recruitment efforts across student groups.
Mayor Tennes noted she would share the initiative with her faith leaders council. Trustee Pure
Slovin called it an exciting initiative and asked about the selection process; Mr. Franz stated
appointments would follow the standard mayoral appointment process, with additional applicants
kept engaged for future opportunities.

Trustee Lissa Levy asked about background checks; Mayor Tennes clarified the commission

Trustee Robinson voiced strong support, highlighting the value of civic engagement. Mayor
Tennes and Trustee Iverson emphasized encouragmg participants to share their experiences with
peers.
Tom Whitaker suggested participation qualify for National Honor Society service credit. Mayor
Tennes indicated the Village would explore the idea with the schools.
The ordinance will return for second reading on March 2, 2026.
Plan Commission
a. Plan Commission Case 2025-12P - Planned Development Site Plan Approval for
4600 Main Street.
Planning Manager Kate Portillo presented a request on behalf of Arie Crown Day School and
Fulton Street Companies for planned development approval at 4600 Main Street.
Planning Manager Kate Portillo presented a request for planned development site plan approval
for 68 townhomes on a 3.92-acre R4-zoned site. The Plan Commission recommended approval
(8-0, 1 absent). The project meets density requirements and includes four underground
stonnwater systems.
Public benefits include two publicly accessible park areas, two public EV chargers, and
permeable payers. One relief request was presented to reduce the northern drive aisle width from
24 feet to 20 feet. The developer proposed a $450,000 cash payment in lieu ofon-site affordable
housing units. Proposed building height is 32 feet plus a 3-foot parapet (exempt).
Katie Jahnke Dale, DLA Piper, representing the developer, stated the site plan is unchanged from
2023 approval, with updated elevations featuring over 50% masonry materials and compliance
with open space and surface requirements.
Ross Babel, Fulton Street Companies, introduced the development team and stated they had
engaged with neighbors over the past sbc months. He described outreach efforts following
community meetings and email exchanges.
Fire Chief Eschner confirmed the project meets international fire code requirements and that
emergency vehicles, including the ladder truck, can access the site.
Trustee Schechter read a statement opposing the proposal, citing lack of park space, limited
community benefits, and absence ofon-site affordable housing, and requested the developer
return with a redesigned plan.
Representatives from Fitzgerald Architects outlined proposed sustainability measures. The
developer stated fmancial constraints prevent inclusion ofon-site affordable units and that added
density would be required to offset costs.
Corporation Counsel Elrod advised that requiring on-site affordable units would requu-e
returning -to the Plan Commission due to notice requirements.
Trustee Pure Slovin in support of the development, citing economic mvestment, property fax
benefits, fee-in-lieu contribution, aesthetic improvements, and reduced traffic compared to the
former school use.
Trustee Iverson acknowledged community concerns and fmancial constraints, noting the long-
term balancing of interests.
Trustee Robinson confirmed fire safety compliance and received the developer's commitment to
pursue local contractor participation.

Mayor Tennes stated that if the project is approved, a draft ordinance will return to the Board.
Mayor Tennes asked Corporation Counsel EIrod to address financing protections and additional
standard provisions to be included in future land use ordinances.
Corporation Counsel Elrod stated that, should the Board move forward, the forthcommg
development ordinance will include comprehensive protections for the Village. He noted the
ordinance will require proof of fmancial viability, including loan commitments and
documentation, prior to issuance of building permits and again before vertical construction.
Corporation Counsel EIrod also stated the ordinance will include detailed construction
management requirements, mcluding on-site supervision, posted contact information, designated
truck routes and parking, fencing, and additional best-practice provisions to protect the Village
and neighboring properties.

Mayor Temies acknowledged the difficulty of the discussion and thanked attendees for
maintaining decorum. She stated the Village would work with the developer to minimize
construction impacts and expressed confidence the developer would be a good neighbor. She
also noted the Board will review the inclusionary housing ordinance at a future committee
meeting.
Presentations and Reports
a. Downtown Hotel Status by Rodney Lewis, Attorney for Poisinelli.
Rodney Lewis provided an update on the stalled Oakton Street hotel project. He reported
productive meetings with lienholders and contractors, with commitments to reduce or release
claims to facilitate resolution. Seven hotel developers have expressed interest. Staff anticipates
preparing a development package within approximately three months.
Village Manager Lockerby and Rodney Tonelli confiiTned the structure remains satvageable
following recent structural analysis. Manager Lockerby also clarified that $4,5 million in
previously approved TIP funding remains allocated to the project, with no fiinds spent.
Mayor Tennes noted that Corporation Counsel Ekod has been involved in the discussions,
Submission of Consolidated Annual Performance and Evaluation Report (CAPER) for
Community Development Block Grant (CDBG) Program Year 2024 for Public Comment,
Justin Malone, Neighborhood and Housing Coordinator, explained this was an. additional public
comment period for the same CAPER report presented in December, as requested by HUD
especially given potential federal shutdowns, No members of the public offered comments.
Public Comment (3 minutes per person, maximum of 30 minutes)
David Dalka referencing Reverend Jesse Jackson and asked Village leadership to focus on
fairness and equality. Spoke about public safety concerns and community standards.
Emi Yamauchi commented on the hotel update, asked for careful review of developer fmances,
and concerned about neighborhood impacts from the earlier development decision.

The Solid Waste Agency of Northern Cook County (SWANCC) Is an
intergovernmental agency that was established in 1988 to facilitate the delivery of
effective, competitive and environmentally sound municipal waste operations. The
Village of Skokie is one of 23-member communities with the Mayor serving as the
Director and the Village Manager serving as Alternate Director. The Resolution
authorizes the appointment of Mayor Ann Tennes as the Director and Village
Manager, John Lockerby as Alternate Director for a two-year term to expire April
30, 2028. I respectfully request the Village Board approve the Resolution.

A MUNICIPAL JOINT ACTION AGENCY
1 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village
2 of Skokie, Cook County, Illinois as follows:
3 Section 1: It is hereby found and declared that:
4 (a) The Village of Skokie ("Village") is a member of the Solid Waste Agency of Northern Cook
5 County ("Agency"), formed pursuant to an Agreement establishing the Solid Waste Agency of
6 Northern Cook County as a Municipal Joint Action Agency ("Agency Agreement");
7 (b) The Mayor and Board of Trustees had previously appointed by resolution in accordance with
8 Section 8 of the Agency Agreement and the By-Laws of the Agency, providing for the
9 appointment of Ann Tennes as Director to the Agency's Board of Directors, as successor to
10 George Van Dusen to serve the remainder of a two-year term;
n (c) The Mayor and Board of Trustees had previously appointed by resofution in accordance with
12 Section 8 of the Agency Agreement and the By-Laws of the Agency, providing for the
13 appointment of John T. Lockerby as Aiternate Director to the Agency's Board of Directors for
14 a two-year term;
15 (c) Pursuant to the Agency Agreement, the Village is obligated to appoint a Director and an
16 Alternate Director to the Agency's Board of Directors for two-year terms expiring April 30,
17 2026;
18 (d) The individuafs appointed in Section 2 of this Resoiution meet the qualifications stated in
19 Section 8.2 of the Agency Agreement and the By-Laws of the Agency for serving as Director
20 and Alternate Director, respectively.
21 Section 2: The Mayor and Board of Trustees hereby appoint Ann Tennes as Director and John
22 T. Lockerby as Alternate Director to the Agency's Board of Directors, in each case for a two-year term expiring
23 April 30, 2028,or untii a successor is appointed,
24 Section 3: The Clerk of the Village is hereby authorized and directed to send two (2) certified
25 copies of this Resolution to the Executive Director of the Agency within five (5) days of the adoption and
26 approval of this Resoiution.

Item A is on the consent agenda for second reading and adoption. The first reading was on
January 20. 2026.
This Ordinance wil! modify the site p!an previously approved on April 15,2024, for a mixed-
use development, located at 5202-5250 Old Orchard Road. This development will include
two residential buildings, the North and South Towers, The modifications include
replacement of the approved site plan, landscape plan, and elevations plan with updated
plans, to effect the following changes: 1) minor fa?ade changes, reconfiguration of the
exterior balconies, relocation of first floor residential units to higher floors for both the North
and South Towers, 2) removal of the amenity deck from the roof of the existing parking
garage due to structural concerns and removal of the vegetated screens on the exterior
sides of the garage, 3) the addition of recreational amenities at the ground level of the
property adjacent to the perimeter of the existing garage structure and on the first floor of
the North and South Towers, 4) the removal of 35 parking spaces along the perimeter of
the garage to accommodate those amenities, and 5) additional landscaping along the
northwest elevation of the garage.
AdditionaHy, the developer shal! pay $1,000,000 for an affordable housing
contribution in two parts: $500,000 upon the issuance of the required permits for
conversion of the North Tower to residential use and $500,000 upon the issuance
of the required permits for the conversion of the South Tower to residential use.
"8. Ordinancei Skokie Youth Commission, Code Amendment
Item B is on the consent agenda for second reading and adoption. The first reading was on
February 17,2026.
This Ordinance will amend Chapter 2, Article VI t of the Village Code by establishing the
Skokie Youth Commission (SYC). The SYC will be comprised of high school students and
the term of membership on the commission will parallel the academic year. The SYC is being

established in order to foster civic engagement, and strengthen connections between
youth. Village government and the broader community. This will be a positive format to
allow young people to contribute meaningful!y to civic life while assisting in shaping

C. Ordinance, Code Amendments
Item C is on the agenda for second reading and adoption. The first reading was on February
17,2026.
This Ordinance will amend Chapter 2, Article III of the Village Code which sets forth the
rules, regulations, and qualifications necessary for election, appointment and employment
for Village officers and employees, to provide for the Deputy and Assistant Corporation
Counsels to be appointed by the Village Manager.

13 the Appearance Commission on November 12, 2025. Certificates of Appropriateness were issued
14 by the Appearance Commission, on both occasions; and
15 WHEREAS, Petitioner is also requesting modification of the designated 5% of units in the
16 South Tower as affordable housing at 120% AMI for 25 years to eliminate said units; and
17 WHEREAS, Petitioner has offered to pay a total of $1,000,000 for an affordable housing
is contribution in two parts: $500,000 upon the issuance of the required permits for the conversion
19 of the North Tower to residential use and $500,000 upon the issuance of the required permits for
20 the conversion of the South Tower to residential use. This total affordable housing contribution is
21 intended to serve as a fee-in-lieu-ofthe provision of any affordable units at the Subject Property
22 upon its conversion to residential use; and
23 WHEREAS, the Corporation Counsel, Plan Commission Chairman and Community
24 Development Director reviewed the request and found that the requested modifications: (i) are in
25 substantial compliance with the site plan approval granted pursuant to the 2024 Ordinance; and (ii)
26 do not change the intent of the site plan that was attached to the 2024 Ordinance; and
27 WHEREAS, the Corporation Counsel, Plan Commission Chairman and Community
28 Development Director determined that the approval for the site plan for the Subject Property could
29 be amended utilizing the modified review procedure pursuant to Chapter 118, Section 118-34 of the
30 Skokie Village Code; and
31 WHEREAS, the Corporation Counsel, Plan Commission Chairman and Community
32 Development Director recommended to the Mayor and Board of Trustees that the requested
33 modification be granted, subject to the modified condition contained in the Skokie Plan Commission
34 Chairman's memorandum dated January 20,2026;and
35 WHEREAS, at a public meeting duly held on January 20, 2026, the Mayor and Board of
36 Trustees concurred in the aforesaid recommendation of the Corporation Counsel, Plan Commission
37 Chairman and Community Development Director;
38 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village
39 of Skokie, Cook County, Illinois that:

22 approval and recordation as provided by law. Except as amended by this Ordinance, the 2024
23 Ordinance remains in full force and effect.

1 WHEREAS, Chapter 2, Article VII of the Skokie Village Code ("Code") provides for
2 the establishment of, and regulations for, Village of Skokie Boards and Commissions
3 ("Commissions"); and
4 WHEREAS, these Commissions are an integral and valued part of the Village of
5 Skokie's ("Village") participatory, good government; and
6 WHEREAS, Commissions provide direct public engagement and participation in the
7 day to day life of the Village and serve to advise the Mayor and Board of Trustees by offering
8 recommendations for new activities, programs or policy considerations; and
9 WHEREAS, from time to time, new commissions may be established to assist in
10 addressing a public need or finding a new perspective to assist in good governance on
n various issues; and
12 WHEREAS, the need for a new commission has been determined in order to focus
13 on the perspectives of the youth of Skokie and encourage their contributions to the Village
14 through participation in local government; and
15 WHEREAS, Village staff recommend the establishment of a new Commission to be

AN ORDINANCE AMENDING THE GOVERNANCE PROVISIONS OF
THE VILLAGE CODE CONCERNING THE OFFICE OF CORPORATION
COUNSEL AND THE OFFICE OF VILLAGE MANAGER
1 WHEREAS, the Village is a home rule municipal corporation in accordance with Article VII,
2 Section 6(a) of the Constitution of the State of Illinois of 1970 with the authority to exercise any
3 power and perform any function pertaining to its government and affairs including the power to
4 regulate for the protection of the public health, safety, morals and welfare; to license; and to tax;
5 and
6 WHEREAS, Chapter 2, Article III of the Village Code sets forth the rules, regulations, and
7 qualifications necessary for election, appointment, and employment for Village officers and
8 employees; and
9 WHEREAS, the Mayor and Board of Trustees believe that the effective operation of the
10 Village requires retention of qualified and experienced legal counsel to advise on municipal matters,
n represent the Village in legal proceedings, protect Village interests, and assist in ensuring
12 compliance with federal, state, and local law; and
13 WHEREAS, the Mayor and Board of Trustees has determined the Village should amend
14 certain provisions of Chapter 2, Article ill regarding the office of the Corporation Counsel's office to
15 allow for certain personnel within that office to be appointed by the Village Manager; and
16 WHEREAS, the Mayor and Board of Trustees have determined that it is in the best interest
17 of the Village and its residents to amend the Village Code as set forth in this Ordinance; and
18 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the Village
19 of Skokie, Cook County, Illinois;
20 Section 1: Incorporation. That the recitals above are hereby incorporated as Section
21 1 as if restated herein.
22 Section_2: Amendment to Chapter 2. Article III, Division 4. Division 4, titled "Village
23 Manager," of Article III, titled "Officers and Employees," of Chapter 2, titled "Administration," of the
24 Village Code is hereby amended as follows, with additions in bold and double-underlined and
25 deletions struck through:
26 "DIVISION 4. - VILLAGE MANAGER
27 See. 2-133. - Powers and duties.
28 The Village Manager shall be the chief administrative officer of the Village. The Manager
29 shall be responsible to the Mayor and Board of Trustees for the proper administration of
30 all the affairs of the Village. The Manager shall have the power and is required to:

1 (4) Appoint, suspend or remove all department heads, appointed staff and

3 this authority. This shall not be taken to include the elected officers, consultants
4 retained by the Mayor and Board of Trustees, the Corporation Counsel and the
5 Assistant CorporQtion Coyftsete, employees in the uniformed fire and police
6 service appointed by the Board of Fire and Police Commissioners, the Plan
7 Commission, and all appointed board and commission members and other
s committees created by the Mayor and Board of Trustees. Such appointments,
9 suspensions or removals sha!! be based upon the merit and fitness of such officer
10 or employee, without regard to political belief or affiliation. The Manager may
n authorize the head of a department or office to appoint, suspend or remove
12 subordinates in such department or office.
13 (5) Exercise control of all departments and divisions, except the Corporation
14 Counsel and Assictont Corporation Counsels, now in existence or that may
15 hereafter be created by the Mayor and Board of Trustees, except as limited or
16 restricted by ordinance.
17 (6) Make recommendations to the Mayor and Board of Trustees concerning
is compensation for each appointive office and position in the Village service, except
19 the Corporation Counsel and Assistant Corporation Counoolo, including minimum,
20 intermediate and maximum rates."

24 "Administration," of the Village Code is hereby amended as follows, with additions in bold and

26 "DIVISION 5. - OFFICE OF THE CORPORATION COUNSEL
27 See. 2-161. - Creation; composition.
28 There is hereby created an executive office of the Village which shall be known as the
29 Office of the Corporation Counsel and which shall consist of a Corporation Counsel an4
30 Deputy, and Assistant Corporation Counsels, together with such additional employees
31 as the Corporation Counsel may from time to time require in the performance and
32 discharge of the duties of the Corporation Counsel. The Corporation Counsel may be
33 either ta} an individual who practices law full-time and in-house at the Village or
34 fbi an individual who practices law at a law firm that represents individuals and
35 entities in addition to the Village.
36 See. 2-162. - Appointment of attorneys and other personnel.
37 (a) The Corporation Counsel and Assistant Corporotion Counsels shall be
38 appointed by the Mayor with the consent of the Board of Trustees^, and they
39 shall hold office until their rospective successors shall be duly appointed and
40 qualified. The terms of engagement of any Corporation Counsel who
41 practices at a law firm shall be approved bv the Board of Trustees. The
42 Corporation Counsel shall be chosen solely on the basis of such

1 person's legal acumen and municipal law experience without regard to
2 such person's political beliefs.

4 (b) All In-House Deputy and Assistant Corporation Counsel, Agll additional
5 employees other than attorneys, required from time to time by the
6 Corporation Counsel, and the Village's personnel and labor relations

s subject to suspension or removal bv the Village Manager.
9 See. 2-163. - Qualifications of attorneys.
10 The Corporation Counsel, Deputy Corporation Counsel, and Assistant Corporation
n Counsels shall be duly licensed by the Supreme Court of the State, shall be members of
12 the bar in good standing, and shall otherwise be qualified by law to serve as the attorneys
13 for the Village.
14 See. 2-164. - Duties of Corporation Counsel.
15 (a) The Corporation Counsel shall be the head of the Office of the Corporation
16 Counsel and shall have full charge of all the law business of the Village and
17 shall be and act as legal advisor of the Mayor and Board of Trustees and of
is the several officers, boards, commissions and departments of the Village.
19 The Corporation Counsel shall represent, or shall assign an In-House
20 Deputy or Assistant Corporation Counsel to represent, the Village in any
21 legal action or matter to which the Village is a party or in which the Village
22 has an interest, before any court, tribunal or commission, unless excused by
23 the Mayor and Board of Trustees.

25 (b) The Corporation Counsel shall regularly attend the meetings of the Board of
26 Trustees; however, the Corporation Counsel may designate an assistant to
27 attend any meeting and empower such assistant to act in the place and stead
28 of the Corporation Counsel.

30 (c) The Corporation Counsel shall direct the other members of the Law
31 Department and shall call upon other members of the legal staff for
32 assistance in performing the duties required of the Corporation Counsel, and
33 may, with the Igmtapproval of the Mayor and the Village MangfleEt Boaret
34 of Trustees, engage such additional specialized counsel as the Corporation
35 Counsel may require.

37 (d) The Corporation Counsel and. if applicable, the Corporation Counsel's
38 law firm. shall devote ail the time that may be required to superintend and
39 conduct such law business of the Viliage as is committed to the Corporation
40 Counsel's charge. The Corporation Counsel shalUa/ifh the assistance of
41 the Corporation Counsel's legal staff, draw such ordinances as may be
42 required of the Corporation Counsel by the Mayor and Board of Trustees, or
43 any board, commission or department of the Village. The Corporation
44 Counsel shall, with the assistance of the Corporation Counsel'sjfigsil
45 staff, draw contracts, leases, deeds and other documents and papers

1 connected with any department of the Village, when required by the head of
2 such department, and approve all bonds as to form. The Corporation Counsel
3 shall, with the assistance of the Corporation Counsel's legal staff, prosecute
4 all violations of Village ordinances.

6 (e) The Corporation Counsel shall, when requested, furnish written opinions
7 upon subjects submitted to the Corporation Counsel by the Mayor and Board
8 of Trustees, or any Board of Trustees member, with the approval of and
9 transmission via the Mayor; or any department head, with the approval of and
10 transmission via the Village Manager; and shall perform such other legal
n services on behalf of the Village as the Board of Trustees may from time to
12 time direct.
13 See. 2-165. - Required records; inspection of records.
14 The Corporation Counselr with the assistance of the Corporation Counsel's legal
15 staff, shall keep in proper records to be provided for that purpose by the Village a
16 register or docket of all actions in court prosecuted or defended by the Corporation
17 Counsel's office, and all proceedings had therein, which books and records shall at all
is times be open for inspection by the Mayor and the Board of Trustees.
19 See. 2-166. -Reports.
20 The Corporation Counsel shall each year report to the Board of Trustees the
21 transactions of the Corporation Counsel's office during the previous year, with such
22 recommendations as the Corporation Counsel deems necessary and proper, and in
23 addition shall make such further reports as the Mayor and Board of Trustees may from
24 time to time request.
25 See. 2-167. - Authority to compromise actions.
26 (a) The Corporation Counsel, with the consent and approval of the Mayor and
27 Board of Trustees, may compromise any action or cause of action, by or
28 against or involving the Village, upon such terms and conditions as to the
29 Corporation Counsel seem equitable and just, either before or after the filing
30 of an action at law or in equity, when in the judgment of the Corporation
31 Counsel the public interest is thereby served.

33 (b) The Corporation Counsel, or any member of the Corporation Counsel's legal
34 staff, under the direction of the Corporation Counsel, may compromise with
35 the party complained of, either before or after an action has been brought for
36 any violation of a Village ordinance, when, in their individual judgment, public
37 interest does not require that such action be prosecuted, and the Corporation
38 Counsel or they, individually, shall have the power to discontinue any such
39 action, upon terms and conditions as may seem equitable and just.
40 See. 2-168. - Compensation of Corporation Counsel and Assistant Corporation Counsels.
41 The Corporation Counsel shall be compensated in the manner provided in the
42 Corporation Counsel's terms of engagement approved bv the Board of Trustees.

2 and Board of Trustees shall fix from time to time by ordinance.
3 See. 2-169. - Duty of Corporation Counsel to turn over records upon leaving office.
4 Upon the resignation or removal from office of the Corporation Counsel, the Corporation
5 Counsel shall forthwith, upon demand, deliver to the Mayor and Board of Trustees all
6 books, deeds, periodicals, leases, contracts, files, records and other documents and
7 papers belonging to the Village or its officers, including all documents pertaining to
s actions prosecuted by the Corporation Counsel, Deputy Corporation Counsel. or
9 Assistant Corporation Counsels then pending and undetermined, together with the
10 register or docket referred to in Section 2-165."
n Section 4: Continuation. All provisions of the Village Code not amended herein will
12 remain in full force and effect.
13 Section 5: Severability. If any Section, paragraph, or provision of this Ordinance will
14 be held to be invalid and unenforceable for any reason, the invalidity or unenforceability of such
15 Section, paragraph, or provision will not affect any of the remaining provisions of this Ordinance.
16 Section 6: Repeal. All ordinances, resolutions, motions, or parts thereof in conflict with
17 this Ordinance are hereby repealed.
18 Section 7: Effective Date. That this Ordinance shall be in full force and effect ten days
19 after its passage, approval and publication in pamphlet form as provided by law.
