Board Bills for Review (The committee will discuss and take public comment on the following) Item Number 1 Board Bill Number 88 Introduced by Aldermen Michael Browning An ordinance updating Title Two, Elections, of the Municipal Code of the City of St. Louis. Updating, clarifying, and removing outdated language within the election code, including filing fees, the certificate for nomination, and containing procedures in the event of a tie. The Chair recognized Mr. Browning on Board Bill Number 88 Mr. Browning provided an overview of the Board Bill Number 88 and stated he had a speaker, Mr. Benjamin Borgmeyer, Board of Elections Democratic Director. Mr. Borgmeyer spoke on Board Bill Number 88. After no further comments from Mr. Browning, the Chair opened the meeting up to members of the public. Page 7 of 24 BOARD BILL NUMBER 152 INTRODUCED BY ALDERMAN RASHEEN ALDRIDGE COSPONSOR: PRESIDENT MEGAN GREEN 1 An Ordinance which amends certain sections of Chapter 8 of the St. Louis Revised Codes to 2 streamline mobile food vendor operations, to amend distance requirements and operating hours 3 in which mobile food vendors may operate, to establish a mobile food court pilot program within 4 a certain radius within the City of St. Louis, establishing regulations for designated City Park 5 days for mobile food vending, and amending vending districts. 6 WHEREAS, pursuant to Board Rule 61, the proposed amendments to Chapter 8 of the Revised 7 Codes of the City of St. Louis are set out in the body of this bill, with additions marked in 8 boldface underline and deletions marked with [brackets and boldface strikethrough]. 9 BE IT ORDAINED BY THE CITY OF ST. LOUIS AS FOLLOWS: 10 SECTION ONE. Vending Districts Designated. 11 Section 8.108A.030 of the Revised Code of the City of St. Louis, is hereby amended to be 12 read as follows: 13 A. “Citywide Vending District” shall mean the streets that are within or 14 immediately adjacent to zoning districts, "F" through "L " as designated under Chap. 26.12, 15 or their successor zoning districts. 16 A. "Downtown Vending District" shall mean the area bounded by the east side 17 of Fourth Street on the east, and the center lines of Cole Street on the north, 18 Eighteenth Street on the west and Chouteau Street on the south. 19 B. "City Park Vending Districts" shall mean any area maintained by the 20 Director of Parks, Recreation and Forestry. Page 1 of 13 Board Bill Number 152 Aldridge February 13, 2026 Page 8 of 24 1 C. "Wharf Vending District" as defined and regulated by Ordinance 61362, 2 June 6, 1989. 3 D. "Meramec Street Vending District" shall mean the area bounded by the west 4 curb line of South Broadway south from the south curb line of Meramec Street 5 to the southernmost part of the lot numbered 4257 South Broadway; and on and 6 on Ohio Street from the south curb line of Meramec Street to the north curb line 7 of South Broadway provided such vendors are licensed as provided herein. 8 Licensed vendors in this district may sell agricultural products and flowers only. 9 E. E. 10 F. Reserved. 11 G. F. 12 H. "The Grand Boulevard Vending District" shall mean the area along Grand 13 Boulevard from Natural Bridge Avenue to Interstate Highway 70. 14 I. G. 15 J. "Midtown Neighborhood Vending District" shall mean the area bounded by 3 Chouteau Avenue on the south, Leffingwell Avenue on the east, Vandeventer 4 Avenue on the west, and Delmar Boulevard and Olive Street via North Compton 5 Avenue on the north. 6 Q. K. 7 R. "Tiffany Neighborhood Vending District" shall mean the area bounded by 8 Chouteau Avenue on the north, Interstate 44 on the south, Grand Boulevard on 9 the east and 39th Street on the west. 10 S. L. 11 T. "Covenant Blu/Grand Center Neighborhood Vending District" shall mean 12 the area bounded by Dr. Martin L. King Drive to the north, North Compton 13 Avenue to the east, Olive Street to the south, and North Vandeventer Avenue to 14 the west. 15 SECTION TWO. Applicability of Health Code—Inspection. 16 Section 8.108A.100 of the Revised Code of the City of St. Louis, is hereby amended to be 17 read as follows: 18 All licensees must obtain a food permit and their employees shall be subject to and comply 19 with all applicable requirements and standards for dispensing and purveying food contained in 20 Title Eleven of the Revised Code, as amended, and rules and regulations promulgated thereunder Page 3 of 13 Board Bill Number 152 Aldridge February 13, 2026 Page 10 of 24 1 by the Health Commissioner. All food held, offered for sale, sold or given away by licensees 2 shall be subject to and comply with all applicable requirements for such food of the Revised 3 Code and the rules and regulations promulgated thereunder by the Health Commissioner. 4 SECTION THREE. Rules and regulations 5 Section 8.108A.150 of the Revised Code of the City of St. Louis, is hereby amended to be 6 read as follows: 7 A. The business of sidewalk or vehicle vending shall only be permitted between the 8 hours of 6:00 a.m. and 11PM. 9 B. No pushcart or other vehicle related to the operation of a vending business shall 10 be located on any City sidewalk or other public way during non-vending hours, nor 11 shall any such pushcart or other item be parked, stored or left overnight; 12 C. A licensed vendor may not block the passage of the public through a public area 13 or interfere with access to ramps, curb cuts or other conveniences for individuals with 14 disabilities. If a sufficient crowd gathers to transact business with a licensed vendor 15 such that the passage of the public through a public area is blocked or that access to 16 ramps, curb cuts or other conveniences for individuals with disabilities is blocked a 17 police officer may disperse that portion of the crowd that is blocking the passage of 18 the public. 19 D. A licensed vendor many not conduct a vending business in a public area so as to 20 obstruct access to private property, except with the prior written consent of the owner 21 or manager of the property. Page 4 of 13 Board Bill Number 152 Aldridge February 13, 2026 Page 11 of 24 1 E. The conduct and behavior of all licensed vendors shall comply in all respects with 2 existing noise ordinances. 3 F. No licensed vendor shall conduct a vending business within 100 feet from another 4 licensed vendor or an existing business which sells or offers for sale comparable 5 goods or merchandise. 6 G. During non-business hours of brick-and-mortars businesses, licensed 7 vendors may operate within a 100-foot radius of brick-and-mortar businesses 8 with written consent of the business unless exceptions are present. 9 H. No licensed vendor shall conduct a vending business within 300 feet of a fair or 10 festival unless such vendor has first obtained the written permission of the permit 11 holder of the fair or festival and has been issued a festival vendor's license under the 12 provisions of this chapter. 13 I. Licensed vendors shall keep the sidewalks, street and other spaces adjacent to 14 their vending sites or locations clean and free of paper, peelings and refuse of any 15 kind. All trash or debris accumulating within fifteen (15) feet of any vending stand 16 shall be collected and disposed of by the vendor each day of operation. 17 J. Persons engaged in food or beverage vending shall affix to their pushcart a 18 receptacle for litter that shall be maintained and emptied regularly and marked as 19 being for litter. Licensed vendors may not put refuse from the operation of their pushcart in or 2 beside any public trash container or in any drain along or in the streets or sidewalks. 3 K. Licensed vendors may not leave their pushcart unattended at any time. 4 L. A pushcart shall not be motor powered. Nothing in this paragraph shall prohibit 5 the transportation of a licensed vendor's pushcart to and from the licensed vendor's 6 authorized location by a motor-powered vehicle. 7 M. The Director of Streets shall create and annually update a map of vending 8 zones within the City. 9 N. The Director of Streets shall create a portal for comments and or complaints 10 regarding mobile food vendors and determine a revocation system. 11 O. The Director of Streets shall formulate any additional rules and regulations 12 necessary for the proper administration of this chapter. Rules and regulations 13 shall be maintained in the office of the Director of Streets and shall be available 14 for public inspection during ordinary business hours. 15 SECTION FOUR. Establishing a Mobile Food Court 16 A designated "Mobile Food Court" is hereby established that within the geographic area 17 bound by 1200 to 1320 Market Street within the City of St. Louis. Mobile food Vendors 18 within the boundaries of the Mobile Food Court may operate in accordance with the 19 provisions set forth in this ordinance and any additional regulations established by the 20 City. Page 6 of 13 Board Bill Number 152 Aldridge February 13, 2026 Page 13 of 24 1 SECTION FIVE. Vending in City Parks 2 It is hereby established that mobile food vendors are authorized to operate on Fridays in 3 City Parks. The Parks Department shall designate in which City Parks mobile food 4 vendors may operate, the times of operation of mobile food vendors in such designated City 5 Parks, and publicly post such information on City webpages. The Parks Department shall 6 create a portal for mobile food vendors to reserve time slots. Mobile Food Vendors may 7 only register for one time slot each Friday, unless there are open slots on the Parks 8 Department portal 48 hours in advance. The Parks Department shall open the registration 9 portal seven days prior to each Friday. Mobile food vendors wishing to vend in parks must 10 be registered and licensed with the City and in good standing. Food trucks shall adhere to 11 all regulations as established in the ordinance and any additional prescribed by the Parks 12 Department. 13 SECTION SIX. Rules and regulations for Downtown Vending District. 14 Section 8.108A.300 of the Revised Code of the City of St. Louis, is hereby amended to be 15 read as follows: 16 [In addition to all other requirements of this chapter the following provisions shall apply 17 to every vending business in the Downtown Vending District. The provisions of this section 18 shall supersede any other provision of Chapter 8.108A of the City Code if such provisions 19 are inconsistent. 20 A. Every vending business in the Downtown Vending District must operate 21 from a fixed location on a public sidewalk or public right-of-way, other than a Page 7 of 13 Board Bill Number 152 Aldridge February 13, 2026 Page 14 of 24 1 roadway except when licensed as a festival vendor under the provisions of this 2 chapter. 3 B. Vendors must apply for and obtain a permit to operate a vending business in 4 the Downtown Vending District as provided in this section prior to obtaining a 5 vendor's license. Vendor's permits shall be issued by the Director of Streets (the 6 "Streets Director") for locations in the Downtown Vending District which are 7 not within the City Parks Vending District, and by the Director of Parks, 8 Recreation and Forestry (the "Parks Director") for locations in the Downtown 9 Vending District which are within the City Parks Vending District. 10 C. No person, partnership or corporation shall be issued more than two (2) 11 vendor's permits for locations within the Downtown Vending District, including 12 areas in the Downtown Vending District which are within the City Parks 13 Vending District, at any one time. No vendor's permit may be issued for any 14 location which is within one block of any part of the City Parks Vending District 15 and outside such district. 16 D. Vendors' permits in the Downtown Vending District shall be approved prior 17 to issuance by the Board of Public Service. No such permit shall be approved 18 unless it has been recommended by the Director of Streets, or in the case of 19 locations within both the Downtown Vending District and the City Parks 20 Vending District, by the Parks Director, who shall certify in their 21 recommendation that prior to such recommendation such Director consulted Page 8 of 13 Board Bill Number 152 Aldridge February 13, 2026 Page 15 of 24 1 with the Partnership for Downtown St. Louis concerning the matter and 2 complied with the requirements of Subsection F of this section. This subsection 3 does not apply to permits regulated by Subsections H and I of this section. 4 E. The minimum annual fee for a vendor's permit shall be $500.00; provided, 5 this fee may be increased by the Board of Public Service, in its discretion, to an 6 amount up to $1,000.00, after request of the Streets Director and the Parks 7 Director, identifying increases in regulatory costs to the City justifying the 8 proposed fee increases. All revenue derived from vendor's permit fees shall be 9 held in the Downtown Vending District Parks Fund established by Ordinance 10 No. 68603. 11 F. When the Streets Director or the Parks Director determine that a vending 12 permit should be issued for a location within the Downtown Vending District or 13 for a location within part of the City Parks Vending District which is within the 14 Downtown Vending District: 15 1. Such Director shall establish criteria, as follows: 16 a. Vending location; 17 b. Items to be sold, e.g. food, beverages, clothing; 18 c. Hours of vending; Page 9 of 13 Board Bill Number 152 Aldridge February 13, 2026 Page 16 of 24 1 d. Type of vending structure, ee.g. food cart; provided, the 2 criteria shall expressly provide that no vending may be done from 3 shopping carts; 4 e. Contribution to diversity of products available from vendors, 5 and diversity of appearance of vendors' facilities, within the 6 Downtown Vending District or within the City Parks Vending 7 District within the Downtown Vending District; 8 2. Such Director shall issue a solicitation for permit applications, which 9 shall: 10 a. Be published in two newspapers of general circulation in the 11 metropolitan area and on the City's website for two weeks; 12 b. Identify the vending location; 13 c. State the criteria; 14 d. Request permit applications, which shall: 15 i. Require applicants to indicate whether they will pay the 16 City sums above the minimum fee; ii. Require appropriate applicant identity information; 17 iii. Require photographic and other information about the vending structure, e.g. food cart; 18 iv. Contain detailed information about items to be sold and prices and suppliers; 19 v. Require additional information as deemed appropriate; and Page 10 of 13 Board Bill Number 152 Aldridge February 13, 2026 Page 17 of 24 1 e. State the due date for applications. 2 2. After receipt of permit applications, the Streets Director or the Parks 3 Director, as applicable, shall rank the applications based on completeness, 4 desirability of product, proposed payments to the City, suitability of 5 vending structure for the location, and contribution to diversity of products 6 available from vendors and diversity of appearance of vendors' facilities, 7 within the Downtown Vending District or within part of the City Parks 8 Vending District within the Downtown Vending District; 9 3. Such Director shall then consult with the Partnership for Downtown 10 St. 11 Louis concerning the matter; 12 4. Such Director may reject all applications and shall retain records of 13 his or her proceedings. 14 G. A sidewalk vendor shall be required to operate a vending business a 15 minimum of ninety (90) days per year for a minimum of four (4) hours per day. No 16 pushcart or other item related to the operation of a vending business shall be located 17 on any City sidewalk or other public areas during non-vending hours, nor shall any 18 such pushcart or any other item be parked, stored or left overnight in the 19 Downtown Vending District or in any part of the City Parks Vending District within 20 the Downtown Vending District. Vendor's permits issued pursuant to this section shall be valid for three (3) 2 years beginning on January 1 following approval of an application and ending on 3 the third subsequent December 31, subject to payment in advance of the annual 4 vendor's permit fee by December 31; provided, the Streets Director or the Parks 5 Director as applicable may recommend to the Board of Public Service by December 6 1 of each year during the term of a permit that the permit be revoked as of the 7 subsequent December 31 for noncompliance with this section or applicable 8 regulations or failure to maintain a vendor's license. Following the expiration or 9 revocation of a license, the applicable director may initiate a new solicitation 10 process, if he or she believes continued vending at the location is in the City's 11 interests. 12 I. Notwithstanding the provisions of this section, no person shall be permitted 13 to vend on any public sidewalk or within any public right-of-way within the 14 following-described area (also depicted in the diagram attached to Ordinance No. 15 68603 as Exhibit A) in the Downtown Vending District, which includes the area 16 known as the South Downtown Project Area as defined in Ordinance 17 65668, unless such person is a designated redeveloper for the South Downtown Project 18 Area or has entered into a valid vending agreement with a designated redeveloper for the 19 South Downtown Project Area and such person has otherwise complied with all 20 requirements of this section and Ordinance 65061: 1 A tract of land being located in all of 21 Blocks 6465, 6466, 6467, 106, 6509, Page 12 of 13 Board Bill Number 152 Aldridge February 13, 2026 Page 19 of 24 1 1409, 160, 161, 162, 147, and 148 and part of Blocks 188, 425, 417, 418, 419, and 422 of the 2 City of St. Louis, Missouri being more particularly described as follows: 3 2 Beginning at the intersection of the Easterly line of former 9th Street vacated by 4 Ordinance No. 9191 and the Southerly line of Walnut Street, thence along the easterly line 5 of former 9th Street and its direct prolongation Southerly to the Northern Line of Gratiot 6 Street, thence along last said Northerly line to the 7 Westerly line of 4th Street, thence along last said Westerly Line to the Southerly 8 line of Walnut Street, thence along last said Southerly line to the Easterly line of former 9th 9 Street, and the Point of Beginning. 10 J. The bill modifies vending district definitions, operating distances, and hours of operation; establishes a mobile food court pilot program; authorizes mobile food vending in designated City parks; and assigns administrative responsibilities to City departments including mapping, permitting coordination, regulatory oversight, and creation of public-facing vendor and comment portals. The bill also maintains provisions governing vendor permit fees.
