Council President Lantry acknowledged the application review committee and organizational committee, and introduced Joanne Tromiczak-Neid. Ms. Tromiczak-Neid described her late husband's devotion to volunteerism and the establishment of the award. She introduced the past winners in attendance, and Karl Neid's sister, Trudy Kelly. Mayor Coleman thanked Council President Lantry for her work on the award. He spoke about winner Captain Richard Zech's roles as a firefighter team member and as a community volunteer. He presented the award plaques and gift certificates donated by area businesses. Captain Zech thanked Bill Rondeau who had nominated him for the award, and his family for their support. He spoke about the rewards he found in his volunteer work. (Public hearing held June 5; laid over from June 26) Legislative Hearing Officer Marcia Moermond said the conditions for allowing time for rehabilitation had not been met, and she recommended ordering the building's removal within 15 days with no option for repair. City of Saint Paul Page 9 City Council Minutes - Final July 10, 2013 34 Ord 13-38 Amending Legislative Code Chapter 74 by enacting a new section designating the St. Paul Gas Light Company Island Station at 380 Randolph Avenue as a Saint Paul Heritage Preservation Site. Amy Spong, Heritage Preservation Commission (HPC) staff member, said the HPC recommended that the site met designation criteria related to the character, interest, value, and location of the site. She said the owner's representative had testified against and two neighbors had testified in favor of designation at the May 23 HPC public hearing, and the HPC had voted unanimously to recommend that the site be designated as a Heritage Preservation Site. She said the Planning Commission had voted that the designation was consistent with the City's Comprehensive Plan and would have a positive effect on the surrounding area, and the State Preservation Office concluded the site was a good candidate for local designation. She spoke about the proposed role of Island Station within the Great River Passage Plan, she reviewed the designation process, and described the building and its history. Councilmember Tolbert asked what local designation meant in terms of future development restrictions. Ms Spong said local designation would make the building subject to design guidelines, and any permits would have to be reviewed by the HPC. She noted that designation didn't necessarily mean that the building would be preserved or restored. Ms. Spong submitted two letters of support into the record. In opposition: Paul Breckner, (3450 West Burnsville Parkway, Burnsville), said his family had provided financing for a development project at the site in 2004, but in the fall of 2006 it was determined the project was unfeasible. He referred to materials in the packet and said they had tried for years to come up with an idea for redevelopment that made economic sense, but the lack of floor plates in the high volume building made redevelopment unfeasible. He said the property was rapidly deteriorating and unsafe, had become a magnet for problems, and there was nothing to be gained by trying to preserve it. He displayed photographs showing the condition of the site. In response to questions from Councilmember Thune, Mr. Breckner said they were asking $6 million for the property and he thought the assessed value was about $3.5 million. He said there had been some interest in the property for significantly less than the asking price, including a proposal from Parks. He asked for the City's support to allow the building to be demolished and the site redeveloped. In support: John Yust (256 Goodrich Avenue), said he'd been a practicing architect in the West Seventh area since 1981. He said he had just completed three years on the Great River Passage Plan, and the plan clearly stated the community's and committee's wishes for the site. He distributed copies of a section of the plan, copies of a plan developed in the 1980s, and another from when he worked for Val Michelson, all of which he said represented a long term commitment. He said the site's location above the river represented a great opportunity for redevelopment. He displayed a brochure of a repurposed power plant in Denver. He said the previous developer took good care of the building and it was in good shape when the current owner took over. Jocelyn Sweet (123 Isabel Street W.) said it was a gorgeous building and could be turned into great recreation area. She said there was potential if one looked at preservation rather than profit. City of Saint Paul Page 10 City Council Minutes - Final July 10, 2013 Abigail Schmidt (223 8th Avenue S.E.) said she was a recent grad of the UM architecture program, and felt the iconic structure provided potential for a climbing wall, river access, an educational venue about power generation, an entertainment venue, beautiful views of the river, and a destination and amenity for residents of the new Schmidt Brewery lofts. She distributed a list of ideas for redevelopment. Kent Peterson (503 St. Clair Avenue) said the building was an integral part of the Great River Passage Plan, and there could be a synergy between the brewery development and Island Station. Richard Miller (26 West 10th Street) said the slides showing the current condition of the site reminded him of the Mill City Museum prior to its restoration and redevelopment, and that where there was a will there was a way. Naomi Austin (90 Garfield Street) said they had moved to the West Seventh neighborhood because of the history, and knew from experience with their home that restoration took time and money. She said St. Paul was a unique city, and adding river access and tying the city's history to the river was important. Councilmember Thune asked those present in support of the ordinance to stand. In opposition: Crystal Graves (860 Albemarle) said her main objection was that it was going until midnight. She said there were many families with young children in the neighborhood, and she had to be at work at 6:00 a.m. She said it was a mixed use neighborhood and music would bounce off the buildings. She said she would like a 10:00 p.m. ending time. In support: Applicant Carnetta Givens (845 Albemarle Street) said the event was for her 23rd anniversary. She requested an 11:00 p.m. ending time. Councilmember Khaliq moved to close the public hearing. Yeas - 6 Nays - 0 Councilmember Khaliq confirmed with both parties that a 10:30 p.m. ending time would be acceptable. Adopted City of Saint Paul Page 12 City Council Minutes - Final July 10, 2013 Yea: 6- Councilmember Brendmoen, Councilmember Khaliq, City Council President Lantry, Councilmember Stark, Councilmember Thune and Councilmember Tolbert Nay: 0 Absent: 1- Councilmember Bostrom City of Saint Paul Page 13 City Council Minutes - Final July 10, 2013 39 ABZA 13-5 Public hearing to consider the appeal of Soua Xiong to a decision of the Board of Zoning Appeals (BZA) denying a request for a variance to legalize an existing paved parking space constructed in the front yard at 1108 Wilson Avenue. Yaya Diatta, Department of Safety and Inspections (DSI), gave a staff report on the variance request and appeal. He said the property was inspected in response to a complaint that part of the front yard had been paved for parking; he showed photos taken before and after installation of the parking surface. He said orders were issued to either remove the pavement or apply for a variance, and the Board of Zoning Appeals (BZA) denied the variance request. He said the district council had supported the request based on limited parking on Wilson , the condition of the property, the lack of alley access, and the location of the property on a dead end street. Councilmember Brendmoen asked Mr. Diatta whether the applicant had pulled a permit for paving the yard. Mr. Diatta said site plan approval was required, but the applicant said he wasn't aware of the requirement. Appellant: Appellant Soua Xiong appeared with his brother Vang Xiong who spoke on his behalf . Vang Xiong said his brother had only been in the country a few years and wasn 't aware of the policy or need for permission. He said it was a dead end street, and the property had a one-car garage and narrow driveway which restricted parking especially in the winter. He said his brother had called a blacktop company and they had come and paved the yard. He said the BZA had denied the request because only 50% of the neighbors supported it, but that was not accurate because some neighbors were never home and there were no houses to the east. He said there was 100% support from the surrounding neighbors, and the east district supported it. He asked for the City Council's support based on the difficulty of the parking situation. Council President Lantry moved to close the public hearing. Yeas - 6 Nays - 0 Council President Lantry said she found no error in BZA's decision and would move to deny the appeal. She said having half the front yard paved did change the character of the neighborhood. She said she felt terrible that they had paid for paving that shouldn't have been done, but lots of people dealt with limited parking. She said she knew the appellant would be a good steward of the property, but future owners might not be and might put a boat or horse trailer on the paved area. Councilmember Khaliq asked whether the blacktop contractor was licensed. Mr. Vang Xiong said he believed so. Councilmember Khaliq asked whether the contractor had an obligation to make sure requirements were met before doing the work. Assistant City Attorney Rachel Tierney said contractors should pull a permit when required, but she wasn't sure of the City's power to take action against the contractor. She said she would check with DSI. Council President Lantry said she would pass along any information about possible recourse. Legislative Hearing Officer Marcia Moermond said the appellant was not present, but someone from Southern Minnesota Regional Legal Services (SMRLS) was present representing the tenants. Ms. Moermond said the issue was the revocation of the Certificate of Occupancy and condemnation of three units in the 18-unit building due to over-crowding and lack of electric. She said a fourth unit was condemned and the tenant relocated. She reviewed the inspection history at the property and said the next item on the agenda involved an appeal of a condemnation at the same property related to another significant complaint and long term noncompliance with subsequent orders. She said permits had been pulled for the corrections but the work had not been completed. She said most tenants were on Section 8 assistance, and the Department of Safety and Inspections (DSI) staff had offered assistance to expedite relocation. She noted that the building was occupied primarily by homeless and non-English speakers with limited resources, and the SMRLS representative would speak about their perception of the problems. She said her recommendation was to deny the appeal and grant until July 19 for compliance with all orders, or the revocation would stand. Tovah Flygare, SMRLS, said they were present to help the tenant-clients achieve the best outcome, and were assisting with their relocation. She asked that special consideration be given to the situation of the tenants so that they did not become homeless due to the actions or inactions of the landlord.
