FOR DISCUSSION
15 CO 13-21 Presentation from the Junshin Peace Singers 2013 in commemoration
of the Saint Paul - Nagasaki Sister City Relationship.
Mayor Coleman joined the Junshin Peace Singers at the podium. Council President
Lantry said the singers were from Junshin High School and University in St. Paul's
sister city Nagasaki, Japan, and were led by their teacher Yuko Matsumoto and
Sister Yoko Hamada. She said they would be singing at the Nagasaki
Commemoration event at Como Park on August 8, as well as at Carondolet Village
and the St. Paul Cathedral. She said St. Paul and Nagasaki had been sister cities
since 1955.
One of the students read a statement, and presented a greeting to Mayor Coleman
from the Mayor of Nagasaki. Mayor Coleman read the greeting. The students sang
the Thousand Origami Cranes Song.
Vision of Peace postcards were distributed to the students .

St. Paul.
Council President Lantry invited visiting community gardeners to the podium, and
read the resolution.
Jeremiah Ellis of Gardening Matters made brief comments about the importance of
community gardening, and thanked the Council for supporting gardening in St. Paul.

Councilmember Stark introduced amendments resulting from meetings with
stakeholders over concerns about some of the original staff language. He said the
new language represented a compromise.

at the Ford Dam site, as part of the Team Ortho Foundation - Women
Rock race event on August 31, 2013.
In opposition:
John Stewart (184 Washington Street) spoke in opposition to the portion involving
amplified music at 7:00 a.m. on Saturday of Labor Day weekend near Washington
Street and Shepherd Road. He asked the Council to reject the variance request.
Councilmember Thune asked Mr. Stewart whether the organization had spoken with
him about the activity taking place at that time. Mr. Stewart said he hadn't been
involved in any communications.
In support:
A representative from Team Ortho appeared on behalf of John Larson . She reviewed
the race schedule and said 7:00 a.m. there would be announcements and at 7:00
a.m., and the goal was to point the speakers towards downtown. She said G.B.
Leighton was performing at Upper Landing Park at 8:30 a.m. and the stage was
facing downtown.
Councilmember Thune said 8:30 a.m. was pretty early, and he asked to lay the
matter over for a week to get more information and talk to neighbors.
The Team Ortho representative spoke about measures taken to inform neighbors and
to work with community representatives and police to mitigate parking and traffic
problems in the neighborhood.
Councilmember Thune asked to postpone the vote so he could talk to the Team
Ortho representative and neighbors in the hallway.
The vote on the item was taken between items 48 and 49:

with the notation that soundchecks wouldn't happen before 8:00 a.m. and music
wouldn't start until 8:30 a.m.

48 RLH AR 13-24 Ratifying the assessments for Demolition Services during December
2012 at 315 LARCH STREET. (File No. J1307C, Assessment No.
132006)
Legislative Hearing Officer Marcia Moermond gave a staff report on the assessment
related to the demolition of the buildings and the abatement of the nuisance
conditions on the site, and she recommended approval of the assessment. She said
the property owner was given proper notice and a number of opportunities to abate
the nuisance conditions, and there were no-show Legislative Hearings and Council
public hearings. She said the value of materials removed was negligible, and they
were not removed in the time allotted and were considered abandoned. She said the
value of the materials was taken into consideration in the contractors' demolition bids,
and the assessment accurately reflected the City's costs. She said the bid for
removal of the building was low, and hazardous materials costs were high and
included emergency cleanup costs for mercury contamination discovered by the
demolition contractor.
Councilmember Khaliq asked why the lowest bid not taken for the hazardous material
removal. Ms. Moermond said it was an emergency situation and had to be
addressed immediately. Councilmember Khaliq asked whether that was required by
federal and state law. Ms. Moermond said it was.
In opposition:
Terry Duggins (315 Larch Street), attorney, appeared with property owner John
Norris. He showed photographs of materials that had risen to the top of the black
dirt put on the lot after the demolition, and said there was a lot of metal and other
material still on the lot. He said the value of the items taken were not negligible, and
included 120,000 pieces of merchandise. He said the demolition contractor held
seven online auctions, and he presented evidence from auction number 3 indicating
that the value of the items removed was $90,000 to $96,000. He said the disposal,
by the demolition contractor, of 3400 fluorescent light bulbs in a dumpster created
hazardous waste. He submitted approximately 350 pages of additional information
about proceeds from internet auctions and said they'd like to see the amounts
deducted from the assessment.
Council President Lantry asked why the information hadn't been submitted sooner
and whether Mr. Duggins wanted the Council to consider it before making a decision.
She said the Council might not be able to vote on the matter that night if they had to
consider that amount of new information. Ms. Moermond said the information was
already part of the record.
Council President Lantry asked Assistant City Attorney Rachel Tierney for assistance
in determining what the Council could consider in making a determination about the
matter before them and whether the material being submitted was relevant. Ms.
Tierney said the contractor bid included the expectation of benefiting from the value
of the items at the property, and Mr. Norris was compensated for the loss of the
material by the low bid.
Councilmember Stark asked whether the cost for the environmental remediation was
outside of the contract for the work. Ms. Tierney said the purchase order explicitly
stated that costs for removal of hazardous waste were in excess of the bid price, and
that was the standard practice of the Department of Safety and Inspections (DSI).
Councilmember Tolbert clarified that the only issue before the Council was the
demolition assessment.

Mr. Duggins said the order to proceed was issued in May and the City approved the
increase in December, and he questioned the characterization of the situation as an
emergency. He said they questioned the accuracy of subcontractor pay rates
provided in response to a request for documentation supporting the amount of the
assessment, and they were concerned about whether the work could have done
more cheaply. He said they were not comfortable with the fact that they hadn't been
able to get the supporting information they'd requested.
Councilmember Brendmoen said Mr. Norris could have controlled costs by doing the
demolition himself. Mr. Duggins said they weren't given that option. Councilmember
Brendmoen asked what kind of business it was. Mr. Duggins described the salvage
operation. He said Mr. Norris spent 4000 hours trying to come into compliance, but
they couldn't get clarification as to what the City wanted.
Council President Lantry asked Mr. Norris whether he'd asked the demolition
contractor for information about the costs. Mr. Duggins said the contractor's attitude
was "go ahead and sue me and I'll sue the City."
Mr. Norris said they were charged for hazardous disposal of items that were
auctioned. He said he'd never had or handled mercury, and was never given
information about where it was or how it was handled.
Councilmember Khaliq moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Khaliq asked whether the contract was based on time and material
or just the complete job. Ms. Moermond said she didn't know. Ms. Tierney said
$11,500 was a straight contract price, but DSI had required some invoices. She said
the part of the work related to hazardous materials had significantly more detail than
the part related to just demolition.
Councilmember Khaliq asked whether the appellants had been given that
information. Ms. Moermond said all of those materials were attached to the record.
Councilmember Tolbert asked for the City's total cost to deal with the nuisance
condition of the property. Ms. Moermond said it cost the City $239,000 to clean up
the site. She said that amount was paid out to the qualified contractors, and the bill
was paid in January.
Council President Lantry reiterated that the appellant had the opportunity to address
this, and it had been going on for years.
Councilmember Khaliq moved to approve the assessment.

50 RLH TA 13-390 Ratifying the Appealed Special Tax Assessment for Real Estate
Project No. CRT1309, Assessment No. 138210 at 860 LAWSON
AVENUE EAST.
Legislative Hearing Officer Marcia Moermond gave a staff report on the assessment
of the Fire Certificate of Occupancy Fee. She said a reinspection was done during a
time that enforcement should have been stayed because of a dispute over payment
of a contractor. She recommending deleting that charge and an administrative fee,
and reducing the assessment from $650 to $400.
In opposition:
The property owner's son John Gartner (860 E. Lawson) said he'd been told by
inspector Wayne that if they were in compliance by a certain date the fees wouldn 't
be charged. He said there had never been problems at the property in the past, and
they had never been charged those fees. He said his mother had cancer which had
caused her to have to miss and reschedule hearings. He said his mother got soaked
for a ventilation issue that should have been caught by FHA.
Council President Lantry clarified that the charge was because inspectors had come
to the property numerous times for the same issue. Mr. Gartner said his mother
didn't know the plumber wasn't doing the work and had ripped her off. He said
inspector Steve knew about the problem and was going to make a note. He said
Wayne had only been to the property twice. He displayed an inspection invoice
showing all of the inspections on the same date.
Ms. Moermond said corrected invoice was sent. Mr. Gartner said they hadn't seen it
and were not aware of the inspector having been there that many times. He said his
mother did end up paying a lot for a ventilation issue that should have been caught by
FHA when the house was purchased, and had spent a lot on the other corrections.
He reiterated that he only met Wayne twice, and Wayne did say he wouldn't charge
for the visits if the work got done, and it did except for the plumbing.
Councilmember Bostrom moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Bostrom asked for clarification of inspection invoice. Ms. Moermond
reviewed the inspection dates and explained her recommendation for reduction.
Councilmember Bostrom moved to reduce the assessment to $400.

59 RLH FCO Appeal of Nkia Pao Vang to a Fire Certificate of Occupancy Correction
13-158 Notice at 1133 RICE STREET.
Ms. Moermond said the daughter of the property owner was present and would be
interpreting. Ms. Moermond gave a staff report on the order for removal of the large
storage containers. She reviewed applicable code, and recommended ordering the
structures' removal with a deadline of December 1, 2013 to allow time for materials to
be removed from the containers.
In opposition:
Maolee Vang testified on behalf of her parents. She said the storage container had
been on the property since 2002 and never been cited. She said the store was now
being leased, and her parents' materials from the store were in the container. She
said the inspector had stated he didn't see the container in 2012. She said it was in a
commercial area with other businesses, and a zoning blueprint from 2002 showed the
container there.
Councilmember Brendmoen said she appreciated that the appellants had taken the
time to come to her office. She said she felt Ms. Moermond's recommendation was
reasonable, and said she hadn't seen similar structures elsewhere. She said great
things were happening on Rice Street, and it was time for the container to go. She
urged the appellants to come to her office for help with resources. She moved to
deny the appeal and grant until December 1, 2013 for compliance.

Hearing and the property looked abandoned. She recommended ordering the
property's removal within 15 days with no option for rehabilitation.
Council President Lantry noted that there had been four work orders and it had been
a registered vacant building since November 16, 2012.

40 RLH RR 13-35 Ordering the razing and removal of the structures at 949 GALTIER
STREET within fifteen (15) days after the August 7, 2013, City Council
Public Hearing.
Legislative Hearing Officer Marcia Moermond said the Code Compliance inspection
report had been issued but no other conditions met, and she had no option but to
recommend ordering the building's removal with no option for rehabilitation.
In opposition:
Bryan Castle (1122 122nd Lane, Blaine) said he had a lot of money into the property
and in payment to contractors but because of his handicap and hardships he hadn't
been able to complete the work. He said he had reached an agreement with a
contractor that day, and permits would be applied for the next week and the work
would be done in 60 days. He said it was a decent property and the home was in
good standing order.
Councilmember Khaliq moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Khaliq asked Ms. Moermond whether she had a copy of the
agreement with the contractor. Ms. Moermond said she did not and she also did not
have evidence of financing to pay the contractor. Mr. Castle said he could provide
those things.
Councilmember Stark said one option would be to go ahead with the resolution as
proposed, and if Mr. Castle was able to produce the information within 15 days the
action could be stayed. Councilmember Khaliq clarified for the appellant.
