Adopted 3 RES 13-1123 Authorizing the Police Department to enter into a lease agreement with the Minnesota State Agricultural Society to lease portions of the fairgrounds for the Impound Lot's use during snow emergencies. Adopted 4 RES 13-1137 Authorizing the Department of Parks and Recreation, Como Park Zoo and Conservatory, to accept the gift of travel and lodging expenses, not to exceed $2,750.00, from the Taipei Zoo for staff member Megan Elder to travel to an in-situ primate conservation symposium in Taipei, Taiwan, from November 1-3, 2013 - plus travel days. Adopted 5 RES 13-1143 Creating the classifications of DSI Inspector I, occupation code 485B, DSI Inspector II, occupation code 486B, and DSI Inspector III, occupation code 487B, in the AFSCME Technical, Employee Group 02 Salary Schedule, in Grades 28L, 36L, and 42L, respectively. Adopted 6 RES 13-1145 Preliminary Order setting the date of Public Hearing for September 4, 2013 to consider approval of improvements on Bayless Avenue and Bayless Place (File No. 19152, Assessment No. 145202). Adopted 7 RES 13-1150 Accepting the gift of travel expenses and lodging from the League of Minnesota Cities and the National League of Cities for the Mayor and Mayor Office staff to prepare for and attend the National League of Cities’ Presidential swearing-in ceremonies in Seattle Washington in November, 2013. Adopted 8 RES 13-1154 Authorizing the Police Department to enter into an amended lease agreement, addendum #5, with the Hamline Park Plaza Partnership for leased office space for the department's Employee Assistance Program (EAP) unit. Adopted City of Saint Paul Page 2 City Council Minutes - Final August 14, 2013 9 RES 13-1155 Authorizing the Police Department to accept the grant in the amount of $13,968 from the State of Minnesota, Department of Public Safety for the 2014 Juvenile Accountability Block Grant which includes a match amount of $1,552. Adopted RES 13-1180 Approving the Memorandum of Agreement between the City of Saint Paul and Saint Paul Supervisors' Organization (SPSO) regarding the classification of Information Services Manager and retirement qualifications and eligibility. Laid over to August 21 for adoption Councilmember Tolbert joined the meeting. Present 7 - Councilmember Dan Bostrom, Councilmember Amy Brendmoen, Councilmember Nathaniel Khaliq, City Council President Kathy Lantry, Councilmember Russ Stark, Councilmember Dave Thune and Councilmember Chris Tolbert City of Saint Paul Page 3 City Council Minutes - Final August 14, 2013 ORDINANCES An ordinance is a city law enacted by the City Council. It is read at four separate council meetings and becomes effective after passage by the Council and 30 days after publication in the Saint Paul Legal Ledger. Public hearings on ordinances are held at the third reading. Final Adoption 11 Ord 13-22 Amending Legislative Code Chapters 60, 62, 63, 64, 65, and 66 pertaining to industrial zoning districts and regulation of industrial uses. (Public hearings held May 15 and July 17; amended and laid over August 7 and 14) Councilmember Thune moved an amendment striking all references to industrial uses for intermediate-sized metal shredders. He said the original language about metal shredders was included for a specific project which did not go forward. Council President Lantry explained that the matter would lie over for another week before final adoption but did not need another public hearing. Councilmember Tolbert asked whether this change had been run by the group that had worked to develop the ordinance. Councilmember Stark said it was outside of the scope of what that group had been working on. Councilmember Thune said it was a housekeeping issue. Council President Lantry clarified that metal shredders were not being removed as an industrial use, but references to intermediate metal shredders, which were added for a specific project, were being removed because the project did not happen. Deputy City Attorney Gerald Hendrickson confirmed that it was not a substantive change. Councilmember Tolbert reiterated his concerns and said introducing amendments at the table was not a good practice especially for items that had already had a public hearing and with none of the stakeholders present. Alan Torstenson, Planning and Economic Development, echoed the characterization and explanation made by Mr. Hendrickson and Council President Lantry. He said Councilmember Thune had spoken to him about the change, and after consulting the Port Authority and others it was determined that the change would have no practical effect on existing businesses. Councilmember Khaliq introduced an amendment striking references to B3 and B5 and adding only T4. Yeas - 7 Nays - 0 (Amendment approved) Amended and laid over to August 21 for third reading/public hearing Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, Councilmember Khaliq, City Council President Lantry, Councilmember Stark, Councilmember Thune and Councilmember Tolbert Nay: 0 First Reading 13 Ord 13-49 Amending Chapter 189 of the Saint Paul Legislative Code pertaining to timeframes for evaluation filing, creating a duty for an agent of a buyer to report missing TISH evaluations, and updating and eliminating redundant and outdated language. Laid over to August 21 for second reading Councilmembers shared information about upcoming events in their wards. ADJOURNMENT Councilmember Bostrom moved adjournment.
