In opposition:
Greg Mondry (2291 Benson ) requested a review of assessments on the block going
east from Madison because he felt the benefit to the condominium owners was the
same as for single home owners, but their assessments were much less. He asked
that the cost be divided equally among homeowners rather than based on front
footage.
Richard Anderson (2211 Benson) said he was retired and low income, and he had
read that there were CIB funds available to cover some of the RSVP costs . Council
President Lantry said that state law state required that 25% of the cost be paid by the
property owners.
Councilmember Brendmoen noted that there was a program which allowed older
home owners to defer payment until the property was sold.
Councilmember Tolbert moved to close the public hearing . Yeas - 7 Nays - 0
Councilmember Tolbert asked Public Works staff to connect with Mr . Mondry and Mr.
Anderson.

At the beginning of the public hearing for Item 25, business owner David Fish
expressed his frustration over the placement of a light pole next to the driveway for
his business.

24 RES PH 13-210 Ratifying the assessment for the Arlington/Rice area paving/lighting
project, constructed as part of the 2013 Residential Street Vitality
Project (RSVP). (File No. 19123, Assessment No. 135201)
In opposition:
Tom Pepinski (1363 N. Mackubin Street) said the assessment seemed excessive.
He said his home was in a two square block area that had never had curbs. He
asked whether there was alternate funding available.
Council President Lantry said the project was completed and there had been hearing
on whether to do the project, and property owners received advance notification of
the cost.
Councilmember Brendmoen noted that there were meetings prior to the project and
some neighbors had opted out of the project. She said there was also the option of
spreading payments out.
Fong Yang (1647 Woodbridge) asked if there was any assistance available to pay the
assessment. He said both he and his wife worked and they barely made enough to
cover expenses month to month.
Council President Lantry said the payments could be spread over 20 years on the
property taxes.

25 RES PH 13-211 Ratifying the assessments for the 2013 Right-of-Way Maintenance
Program and 2013 Above-Standard Lighting Operation and
Maintenance Program. (File No. 13ROW FINAL, Assessment No.
130032)
Public Works Director Rich Lallier said the proposed 2013 rate being ratified was a
2.7% increase over 2012 due to a shift in the debt on sidewalk replacement, debt
service for the fleet upgrade, costs for the COMET system, and inflationary costs. He
noted that some of the inflationary costs had been offset by using actual costs for
street sweeping and reducing salt usage. He said Public Works' recommendation
was ratification of the 2.7% increase.
In opposition:
Wayne Carlson (Edina, MN) said he had apartment buildings at Ohio and George,
and the assessment was 4% of the business profit and 50% of the last month's
income. He said he paid property taxes and wasn't getting anything for them, and he
he didn't understand why one side of building was being assessed at a higher rate
that the other. He expressed frustration with the fact that the bill arrived without
warning and allowed only 30 days to pay.
May Pa H. XeneXai (1649 Desoto Street) said her street was not paved, and the City
dumped dirt and gravel at end of street and it all drained down to her driveway when
it rained. She said she would like the City to address that issue. She said she called
about street paving and was told she could pay $25,000, but she did not want to pay
that since it wasn't her street.
Councilmember Brendmoen thanked Ms. XeneXai for coming and testifying, and said
she had checked the street that week. She noted that it was part of the following
year's RSVP schedule, and the question of the paving the street needed to be asked
and the expense considered. She referred Ms. XeneXai to Public Works staff
member Kevin Nelson to address the issue of erosion of material dumped at the end
of the street.
Mike Schumann (541 Dayton Avenue), business owner at Grand and Oxford,
distributed and reviewed a handout with comparisons of corner and mid-block
properties and commercial and noncommercial properties. He said 100% of the
burden for the side street assessment was borne by the corner properties even
though all properties on the block used the side streets to access the alley. He
expressed frustration that there was no venue in which to appeal the policy.
Councilmember Brendmoen said she agreed with Mr. Schumann and it was time that
something was done. She suggested that an ad hoc committee could be formed to
explore other options. Councilmember Stark said he agreed as well.
Bauz Nengchu (1486 Farrington) said the job was done unsatisfactorily, there were
scratches and chips in the pavement, and she would like her concerns addressed.
She said she had contacted Public Works staff Jamie Heiden and had shared her
concerns at a community meeting at North Dale but hadn't gotten a response.
Council President Lantry said that was an RSVP project, she referred Ms. Nengchu
to Public Works staff.
Councilmember Thune moved to close the public hearing and approve the resolution.

49 RLH TA 13-527 Ratifying the Appealed Special Tax Assessment for Real Estate
Project No. J1312A, Assessment No. 138535 at 380 MAGNOLIA
AVENUE EAST.
Legislative Hearing Officer Marcia Moermond gave a staff report on the assessment
for tall grass and weeds. She said the property was a vacant building and the
property owner had testified that she'd had trouble getting out to mow because there
had been a lot of rain. She said the requirements for the sale of the vacant building
had been discussed in the Legislative Hearing. She noted that the grass was almost
a foot in height at the time it was mowed.
Property owner Gwen Ziehl said didn't receive notice until after the work was done.
She said she had noted on Vacant Building registration that mail would be received
by general delivery after house the house became a vacant building.
Councilmember Brendmoen moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Brendmoen noted that this was the second time they were hearing
about first class mail from the City being sent to a vacant building. Ms. Moermond
said the City was legally obligated to send mail to the owner of record with Ramsey
County, and it was incumbent on the property owner to provide that information on
the Vacant Building registration form.
Councilmember Brendmoen asked whether the mail was sent to the property and to
general delivery. Ms. Moermond said it was, and the delay was in picking up mail at
post office.
Councilmember Brendmoen said the system wasn't friendly to people who were
basically homeless and having mail delivered to the post office, but the bottom line
was that it's the responsibility of the property owner to care for property. She moved
to reduce the assessment by half.

58 RLH TA 13-524 Ratifying the Appealed Special Tax Assessment for Real Estate
Project No. J1312A, Assessment No. 138535 at 1240 RICE STREET.
Legislative Hearing Officer Marcia Moermond gave a staff report on the tall grass and
weeds assessment. She said the notification was mailed on a Monday and the work
done on Friday, and the property owner testified in Legislative Hearings he was in
town only on weekends. She said the property owner testified he hadn't received the
notice at all. She said the grass was a foot tall when City crews cut it. She noted
that DSI had been monitoring for the property for two years but it was not registered
as a Vacant Building, so she would waive the vacant building fee if the Certificate of
Occupancy were obtained. She said the property was for sale, and the Certificate of
Occupancy could replace a TISH or Certificate of Code Compliance.
Property owner Herb Zwirn said he did not receive the correction notice. He said
when he purchased the property in 2005 he proactively gave his contact information
and work schedule constraints to DSI. He said he was there every weekend
maintaining the property, but there was a period of time when it rained every
weekend and he couldn't mow. He said the City workers didn't mow but used weed
cutters. He said he had tended to the property and put over $50,000 into it, and it
had been for sale for three years. He said with regards to the Vacant Building status,
he felt he was being penalized.
Councilmember Brendmoen moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Brendmoen said a property owner's responsibility for property
maintenance extended beyond weekends. She moved to approve the assessment,
and encouraged Mr. Zwirn to work with Ms. Moermond on the Vacant Building
registration and on getting the property sold.

Legislative Hearing Officer Marcia Moermond gave a staff report. She said the
posting of the performance bond was an essential first step, and a scan of a bond
was emailed to staff but the original document needed to be filed as soon as
possible. She said the owner had applied for loan from Daytons Bluff Neighborhood
Housing Services and it would take a couple of weeks for an underwriting review to
be completed. She recommended a two-week layover.
Testifying:
Property owner Ronald Adams said the performance bond documentation would be
hand-delivered the following morning, and he thanked the people and organizations
that had offered help and support.
Leslie McMurray from District 5 Planning Council appeared in support of Mr. Adams.

The City Council is paperless which saves the environment and reduces expenses. The
agendas and Council files are all available on the Web (see below). Councilmembers use
iPads to review the files during the meeting. Using the iPad greatly reduces costs since most
agendas, including the documents attached to files, are over 1000 pages when printed.
