Council President Lantry and Mayor Coleman thanked Councilmember Khaliq for his work and leadership. The Council members expressed their appreciation and gratitude for Councilmember Khaliq's contributions, their pride in the opportunity to have worked with him, and hopes to continue to work with him in the future. Councilmember Khaliq made brief comments. He thanked his family for their support. He spoke about his past as a community activist, and about the challenges faced by Council members and the importance of earning public trust. He expressed appreciation for the assistance of Council support staff, especially his Legislative Aide Noel Nix, his Executive Assistant Joan Phillips, Legislative Hearing Officer Marcia Moermond, and Deputy Mayor Paul Williams. He encouraged the Council to work on the issues of equity and social justice, and said he hoped to continue to work on those issues as well. Jake Reilly, Planning and Economic Development, reviewed the code changes , and said the most prominent change was the ban on dynamic display signs, except for gas station signs displaying the price of gas. In support: Tia Anderson (2019 Pinehurst Avenue), Highland District Council President, summarized the driving forces behind the changes. Councilmember Tolbert thanked Mr. Reilly and Ms. Anderson for their work. No one appeared in opposition; Councilmember Tolbert moved to close the public hearing. Adopted Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, Councilmember Khaliq, City Council President Lantry, Councilmember Stark, Councilmember Thune and Councilmember Tolbert Nay: 0 City of Saint Paul Page 8 City Council Minutes - Final November 20, 2013 26 RES PH 13-295 Approving the application of Veit and Company Inc. for a sound level variance in order to allow pile driving of beams for retaining wall shoring during building excavation at Fifth Street East and Broadway Street, for up to three (3) days from 7:00 a.m. to 5:00 p.m. between December 9, 2013 and December 20, 2013. Withdrawn City of Saint Paul Page 9 City Council Minutes - Final November 20, 2013 27 PH 13-19 Public hearing to consider the report of the Administrative Law Judge concerning all licenses held by Jamal & Saed Co., d/b/a St. Paul Grocery Store at 712 University Avenue West. Geoff Karls, Assistant City Attorney representing the Department of Safety and Inspections (DSI), gave a staff report on the on the license background, the allegations, and the Administrative Law Judge (ALJ) findings. He said the ALJ found that all allegations had been proven by the City, and the City had substantial and compelling reasons to revoke any licenses issued to St. Paul grocery. He said DSI's recommendation was that the Council adopt the findings of the ALJ and revoke all licenses held by Jamal and Saed Company, doing business as St. Paul Grocery. In opposition: Carl Newquist (6401 University Avenue N.E., Fridley), attorney representing licensee Jamal Aden, reviewed the Mr. Aden's personal and business background. He said much of what was said to the ALJ was hearsay, and Mr. Aden had never been charged with or convicted of a crime. He said if a tobacco compliance violation had occurred, the City should impose the matrix fine for that violation, rather than revocation of the license, which he felt was arbitrary. He said there was crime in the neighborhood before Mr. Aden arrived and there would continue to be if he left. He said Mr. Aden respectfully asked that his licenses not be revoked, and had offered to give up his tobacco license. He said he would advise Mr. Aden to voluntarily give up his license if Mr. Aden were convicted of a crime. He asked that the Council impose the matrix penalty. Councilmember Khaliq moved to close public hearing. Yeas - 7 Nays - 0 Councilmember Khaliq asked Mr. Karls what the standard was for revocation. Mr. Karls said revocation in this sort of situation would be based on compelling reasons to go outside of the matrix, and there could be any number of compelling reasons. He said he felt the impact of the business on the community presented sufficient compelling reasons to justify going outside of the penalty matrix, as noted by the ALJ. He said the ALJ had found there was more than probable cause to believe the licensee knowingly engaged in illegal activities, and that the City could reasonably consider those known facts in making licensing decisions. Councilmember Khaliq asked Mr. Newquist whether he believed holding a license a right or privilege. Mr. Newquist said it was a privilege. Councilmember Khaliq said that right came along with duties and responsibilities and Mr. Newquist agreed. Councilmember Khaliq said as a resident of the neighborhood he was familiar with the problems at the location, and knew that other businesses in the area didn't attract the same kind of problems. He moved to adopt the findings of fact, conclusions, and recommendations of the ALJ. In response to Mr. Newquist's contention that Mr. Aden had not been convicted of a crime, Council President Lantry noted that testimony at an Administrative Law Judge hearing was given under oath. Councilmember Khaliq said he understood and appreciated the plight of licensee, but there were problems along University Avenue and one way to improve the area was to cut out businesses such as this one. Motion of Intent - Adopted the Findings of Fact, Conclusions of Law, and Recommendations of the Administrative Law Judge (licenses revoked) City of Saint Paul Page 10 City Council Minutes - Final November 20, 2013 Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, Councilmember Khaliq, City Council President Lantry, Councilmember Stark, Councilmember Thune and Councilmember Tolbert Nay: 0 28 RES PH 13-297 Approving adverse action against all licenses held by Kopilenko International Wines & Liquors, d/b/a International Wines & Liquors at 710 Cleveland Avenue South. Geoff Karls, Assistant City Attorney representing the Department of Safety and Inspections (DSI), gave a staff report on liquor compliance check failures in 2006, 2007 and October of this year. He said DSI was recommending a $500 fine, due to the length of time between violations. He said the licensee had admitted to the facts but had requested a public hearing. In response to a question from Councilmember Tolbert he reviewed the fines for the previous violations . No one appeared in opposition; Councilmember Tolbert moved to close the public hearing and adopt the recommendation of DSI. No one appeared in opposition; Councilmember Thune moved to close the public hearing and approve the resolution. Legislative Hearing Officer Marcia Moermond gave a staff report. She said the issue had been resolved with assistance from Southern Minnesota Legal Services and water service was restored. She recommended denying the appeal and allowing re-occupation. No one appeared in opposition; Council President Lantry moved to approve the resolution. Adopted (reoccupation allowed upon restoration of water service) Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, Councilmember Khaliq, City Council President Lantry, Councilmember Stark, Councilmember Thune and Councilmember Tolbert Nay: 0 City of Saint Paul Page 13 City Council Minutes - Final November 20, 2013 49 RLH VO 13-55 Appeal of Letitia Henderson to a Revocation of Fire Certificate of Occupancy and Order to Vacate at 533 SMITH AVENUE. Legislative Hearing Officer Marcia Moermond gave a staff report on the appeal by the tenant of the revocation and order to vacate, which were the result of long term noncompliance with orders. She said in Legislative Hearings she had allowed for occupancy through mid-December so the tenants could find alternative housing. She recommended denying the appeal and granting an extension to mid-December for vacation. In opposition: Property owner Ira Kipp (3966 Minnehaha Avenue S., Minneapolis) said the revocation and order to vacate were because he was remiss in getting work done on time, but everything except a few minor items had been completed. He said none of the remaining items were safety issues, and the tenants wanted to stay but weren't paying rent because of the order to vacate. He said the insurance was probably also in default because of the order, and he asked that the tenants be allowed to stay and the Certificate of Occupancy be reinstated. Councilmember Thune moved to close the public hearing and adopt the recommendation of the Legislative Hearing Officer.
