Legislative Hearing Officer Marcia Moermond said all of the pieces were in place, and she asked that the Council grant 180 days for the rehabilitation or removal of the structure. The item was recalled by Councilmember Stark following the Legislative Hearing Consent Agenda to allow a constituent to testify. Yeas - 6 Nays - 0 In opposition: Winston Nguyen, co-owner of 850-854 University, said Light Rail was tough for business and parking had been lost, and the sewer was from the street to the sidewalk and not on the property. He said he was a 76-year-old vet who had served in the US Army, and he asked for a waiver of the charge for his property. He said the work belonged to the Light Rail and not to the property. Councilmember Thao moved to close the public hearing. Yeas - 6 Nays - 0 Councilmember Thao thanked Mr. Nguyen for coming and expressing his concern, and thanked him for his service to the country and community. He said he would love to help, but he would then have to offer help to other businesses. He noted that payments could be spread over 20 years. Councilmember Stark said the sewer service connection was optional for property owners. He said it was cheaper to do it when the City was doing other street work than when there was a problem, but it was still optional. He agreed with Councilmember Thao that it wouldn't be fair to other property owners if help were offered to Mr. Nguyen. Mr. Nguyen said businesses had supported construction of the Light Rail, and the City should support them. He said he couldn't afford the assessment and he asked for help. Councilmember Thao said he couldn't offer help but would speak to Mr. Nguyen after the meeting. He moved approval. The item was recalled by Councilmember Thao so another constituent could testify. Yeas - 6 Nays - 0 In opposition: Xia Lor Vang, owner of 302 University Avenue West, said Light Rail construction had killed business, and the amount of the assessment was $ 1100. She said she couldn't rent the building and had no income for her mortgage and taxes. She asked for a waiver or a reduction in the amount of interest charged. She said she needed the City to do something different or offer some assistance. Councilmember Thao moved to close the public hearing. Yeas - 6 Nays - 0 Councilmember Thao acknowledged the difficulties and disruptions related to Central Corridor, but said it would not be fair to other business owners if help was offered to some. He said he would speak with Ms. Vang after the meeting. He moved approval. Tschida, Selby-Dale LLC, to a Summary Abatement Order at 600 SELBY AVENUE. Legislative Hearing Officer Marcia Moermond said the appeal involved a summary abatement order for the removal of an abandoned sign. She said a determination was made by the Department of Safety and Inspections (DSI) in 2007, and enforcement action was taken in 2007 and 2008 related to the removal of the sign. She recommended denying the appeal. In opposition: Appellant Alan Tschida (600 Selby Avenue), one of the owners of Selby Dale LLC, said he had received permission from Yaya (Diatta from DSI) to have the sign. He said the sign had contained a For Sale sign which apparently had blown out or been vandalized, and he hadn't realized the sign was empty until he received the summary abatement notice. He said he thought code allowed a For Sale sign on the property. He said the property was zoned commercial, and the For Sale sign had been in continuous use since Yaya (Diatta) gave permission. He asked that he be allowed to replace the For Sale sign. Councilmember Brendmoen asked why a regular For Sale sign could not be used. Mr. Tschida said the existing sign was prominent and allowed by city ordinance , and he would like to preserve the use of the sign. He said he thought the sign predated the sign ordinance and the historic preservation ordinance. Council President Lantry clarified that Mr. Tschida could put a For Sale sign at the property regardless of the outcome of the appeal hearing. Mr. Tschida said he didn't get to the property that often but was sure the For sale sign was intact in late fall. Councilmember Thao moved to close the public hearing. Yeas - 6 Nays - 0 Councilmember Thao asked Mr. Tschida how often the sign was checked. Mr. Tschida said properties were checked monthly. He said the sign was a valuable attribute for possible future development. Ms. Moermond said the City Attorney had stated that a real estate sign was by definition a temporary use, and this situation had existed since 2007 and was therefore not an acceptable use. Councilmember Thao moved to deny the appeal.
