Councilmember Tolbert moved an amendment to restrict work hours to 7:00 a.m. to 7:00 p.m. Monday through Friday, and 9:00 a.m. to 6:00 p.m. on Saturday. Yeas - 6 Nays - 0 John Marshall, Xcel Energy, thanked Councilmembers Thune and Tolbert. He said the variance was critical, and the amended variance would work. Legislative Hearing Officer Marcia Moermond asked for an amendment to grant 180 days for the rehabilitation or removal of the building. She said all conditions had been met. No one appeared in opposition; Councilmember Thune moved to close the public hearing and approve the resolution as amended. Legislative Hearing Officer Marcia Moermond said the assessment was for a Vacant Building fee for a property that entered the program on September 18, 2013. She said the owners had moved out and the property was in foreclosure. She recommended approval of the assessment. In opposition: Angelita Phipps (754 Magnolia Avenue East) said she did a Chapter 7 bankruptcy and was discharged in July 2013. She confirmed with the Council that the assessment would be charged to the mortgage company. Councilmember Thune moved to close the public hearing and approve the assessment. Legislative Hearing Officer Marcia Moermond gave a staff report on the summary abatement assessment including dates and photographs, and noted that additional time was given between the compliance date and the date Parks performed the work. She said the appellants questioned the amount of assessment which included a $520 abatement fee and $560 for general refuse, with two hours of staff time. She said the head of work crew said there may have been a miscommunication about the meeting time with the worker from the container company. She said the City charges were based on the amount of material removed from the container and the time spent cleaning around the container, and the company might have additional charges related to taking the container to be emptied. She recommended approval of the full assessment. In opposition: Property owner Rose Blalock (3701 Woodvine Lane, Brooklyn Center) said the dumpster wasn't picked up because her contractor hadn't paid for the pick-up, and she was going after the contractor with her lawyer. She said she was now responsible for paying for the container plus the City charges, and she asked for a reduction. She said it was only a ten-yard dumpster, and the container contractor said the container was overflowing but there were no materials on the ground that had to be picked up. Terrence (the property owner's son) said the container company employee they did the work and the City didn't do any, and he asked that the Council at least look at the fees. He said they understood it was their responsibility but they were asking the Council to consider a reduction. He said it was hard to believe it took two hours for a ten yard dumpster. Councilmember Stark moved to close the public hearing. Yeas - 6 Nays - 0 Council President Lantry asked whether the City workers were there for two hours. Ms. Moermond said they were; she read notes from the crew leader detailing the work and the charges. She said based on Parks' notes and her review of the photographs, it was a 20 yard and not 10 yard container, although the charge was based on weight so the size of the container was beside the point. Council President Lantry said she was inclined to support Ms. Moermond's recommendation. She said someone had lived next door to the overflowing dumpster for 20 days. She said the City charges were high to encourage property owners to care for things themselves. Councilmember Thune moved approval of the assessment. Adopted Yea: 6- Councilmember Brendmoen, City Council President Lantry, Councilmember Stark, Councilmember Thao, Councilmember Thune and Councilmember Tolbert Nay: 0 Absent: 1- Councilmember Bostrom City of Saint Paul Page 12 City Council Minutes - Final March 19, 2014 66 RLH TA 14-55 Ratifying the Appealed Special Tax Assessment for Real Estate Project No. J1405A, Assessment No. 148504 at 290 STINSON STREET. Legislative Hearing Officer Marcia Moermond gave a staff report on the assessment for a summary abatement. She showed photographs and said the conditions were essentially unchanged on the compliance date. She recommended approval of the assessment and noted that additional assessments were coming forward on the property, which she would try to pull them together in the Legislative Hearing process. In opposition: Property owners Mohamed Sewiden and Piper Van Ness appeared . Mr. Sewiden said the photographs showed his neighbor's garbage, and that his was on the other side. He said the freezer belonged to a tenant and was functional and approved by Section 8. He said the City inspector was there weekly or twice a week, and there was always some problem. He said he felt the house was being targeted, and he hoped to be able to talk about the issue further. Council President Lantry asked Mr. Sewiden if he had received notice of the summary abatement order. Mr. Sewiden said he had, and he went and removed the materials near the alley as directed in the letter, even though the items had been dumped there. He said the letter didn't address materials in the yard, and he didn't know the City could open the fence and come into the yard and take things. Council President Lantry noted that the orders said "rear yard and near rear alley." Ms. Moermond said she didn't have the video available but the council could request it. Council President Lantry said she didn't believe there was any dispute that the City had taken the couch and freezer. Mr. Sewiden agreed but said he was also charged for clean up of the neighbor's trash, and he had already cleaned up his own trash before the City came. Councilmember Thao moved to close the public hearing. Yeas - 6 Nays - 0 Councilmember Thao moved to reduce the assessment by $76 to $400. Councilmember Stark asked whether the reduction was on the basis that some of the trash might not have been the neighbor's. Councilmember Thao said that was correct. Council President Lantry said she didn't necessarily buy that but would go along with it. Councilmember Brendmoen said dumping was frustrating, but property upkeep discouraged dumping. She said she and Councilmember Thao would be happy to help Mr. Sewiden be a better landlord.
