Councilmember Brendmoen invited Paul Austin from Conservation Minnesota and Sheila Smith from Minnesota Citizens for the Arts to the podium. She read the resolution. Ms. Smith spoke about impact of Legacy Amendment funding on St. Paul and surrounding area, and made a presentation recognizing St. Paul for Legacy projects in the arts, culture, and outdoors. Councilmember Brendmoen thanked Mr. Austin and Ms. Smith, and moved approval of the resolution. Councilmember Brendmoen said she had stumbled upon the event the previous year and it was a great event, and she was pleased to support the variance. Keller. Geoffrey Karls, Assistant City Attorney representing the Department of Safety and Inspections (DSI), gave a staff report on the adverse action. He said DSI's recommendation was revocation of the license, and the applicant did not dispute the facts but had asked for the hearing to address the remedy. Geoffrey Karls, Assistant City Attorney representing the Department of Safety and Inspections (DSI), gave a staff report on the adverse action related to a November 2013 conviction for possessing a weapon without a permit. He said DSI's recommendation was revocation of the license, and the applicant did not dispute the facts but had asked for the hearing to dispute the proposed remedy. In opposition: Lamont Brown (1068 Western Avenue N.) said the gun didn't have anything to do with the taxi cab license and was legally purchased. He said he really needed taxi cab license. Councilmember Stark moved to close the public hearing. Yeas - 7 Nays - 0 Council President Lantry moved to accept DSI's recommendation and revoke the license. Adopted Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, City Council President Lantry, Councilmember Stark, Councilmember Thao, Councilmember Thune and Councilmember Tolbert Nay: 0 City of Saint Paul Page 12 City Council Minutes - Final May 21, 2014 LEGISLATIVE HEARING ITEMS REQUIRING DISCUSSION 83 RLH RR 14-7 Ordering the rehabilitation or razing and removal of the structures at 1022 MINNEHAHA AVENUE WEST within fifteen (15) days after the April 16, 2014, City Council Public Hearing. (Amended to razing and removal only) (Public hearing held and closed; laid over from June 18) Legislative Hearing Officer Marcia Moermond said there had been three no-show Legislative Hearings since the previous public hearing. She said the property had been a registered vacant building for 11 1/2 years, with a Code Compliance Inspection and Remove or Repair Order in 2006 which had not been followed up on. She said a new Code Compliance Inspection and performance deposit were needed, and she expressed concerns about the property owner's ability to manage the project based upon attendance issues at hearings and lack of compliance the the notice to abate a nuisance building. She said there were reports of maintenance issues and feral cats at the property, and while 18 Summary Abatement Orders in 11 years has resulted in only two Work Orders, there were reports that neighbors were taking care of some maintenance. She said it was a unique situation with an older property owner facing additional issues, and a partnership with other organizations might be a possibility. She said she would like to lay the matter over for two weeks with a Legislative Hearing in one week to lay out expectations. She said she would ask that the performance deposit be paid and Code Compliance inspection application submitted within the two weeks. She said the owner was present. Councilmember Thao asked why this had gone on for so long, and what conditions could be set over the next two weeks which would help it be resolved. Ms. Moermond said in this case there was an inability to correct the situation, and she was not sure what the breakdown was in 2006. She said the property continued to be a source of concern for the neighborhood. She reviewed the Council's standard conditions including posting of the performance deposit, payment of taxes and fees, submission of a work plan based on a current Code Compliance Inspection, and documentation of finances. She said in this case she would ask that money be put in escrow or managed by the third party, and that the project be managed by an outside person. No one appeared in opposition; Councilmember Thao moved to continue the public hearing to June 4.
