(Amended to razing and removal only) (Public hearing held and closed; laid over from July 16) Legislative Hearing Officer Marcia Moermond said inspectors had reported that clean-up was progressing as of 10:00 that morning, and a summary abatement order would be issued with a Monday deadline. She said the house might be a good candidate for rehab but they wouldn't be able to determine that for sure until it was cleaned up. She asked for a 1 month layover. Councilmember Thao moved to lay the matter over to July 16. (Public hearing continued from June 4) Paul St. Martin, Public Works, said the agreement went before the Transportation Committee, but only three members were present and one had to recuse himself. He said those present at the meeting were supportive of the car sharing concept but had concerns about the details. He said some members of the audience questioned whether there had been a robust public process and whether the potential effects on businesses and residential permit parking areas had been adequately considered. He said Car2Go was anxious for the deal to take effect, and the 18 month contract period would act as a trial period and opportunity for public input. He said there'd been discussions with the Office of Financial Services, and the agreement would be amended specify that revenue would go to the Right of Way Fund and the Parking Meter General Fund. Councilmember Bostrom said meters were designed for turnover, and he questioned where the revenue would come from if a Car2Go car stayed all day at a meter. He said the use of parking spaces by Car2Go vehicles would be an inconvenience to other drivers, and he opposed turning the public right of way over to private industry. Councilmember Thao asked whether it was it standard operating procedure for there to be a business deal without public process. Mr. St. Martin said he took full responsibility for the fact that there wasn't more public process. He said he was approached by Car2Go and it seemed like a good deal for St. Paul, with the 18 month duration allowing time for input. Councilmember Thao said he had spoken with the district councils and they didn't have information about the agreement. He said he had just seen Minneapolis' agreement, and felt it was very important to have a transparent process and to have all the information on the table and all questions answered. He asked how long a public process would take. Mr. St. Martin said a public process would take a month or two, depending upon the amount of controversy. Councilmember Stark said he strongly agreed that there should have been more process, but he was comfortable with the agreement, particularly since it was being treated as a pilot. He said he shared Councilmember Bostrom's concerns about the cars being used for free parking, but didn't feel they would be taking a significant number of spaces, given the number of cars in the agreement. He said he would like to move forward sooner rather than later, and reassess the program agreement after the 18 month period. Councilmember Brendmoen said she was excited to welcome Car2Go into St. Paul, and it was fortunate was they had a chance to get started and work out the bugs in Minneapolis. She said she felt the concerns about meter-hogging and clustering were overblown because the business and the users shared the City's interest in keeping the cars moving. She said the business had done everything asked of it in terms of outreach, and the agreement had gone before the Transportation Committee as requested by the Council, and now the Council should be prepared to let the agreement go forward. She said Mr. St. Martin had acknowledged the problem with truncated process, but the Council should honor its process and vote to support the item. Councilmember Thao said this discussion was similar to a recent one with PED, and presented a good opportunity for a discussion about process and transparency and City of Saint Paul Page 7 City Council Minutes - Final June 18, 2014 making sure the wishes of the voters were being heard. He said based on principle, the Council had the opportunity to make things right. Councilmember Bostrom reiterated his concerns Car2Go vehicles taking already limited parking, and about use of the public right-of-way for private business. He noted there'd not been a quorum to take formal action in the Transportation Committee. Council President Lantry stressed that it was an 18 month contract period during which Car2Go would want to be especially responsive to concerns because they wanted a longer term agreement. She noted that Car2Go representatives had invited Council members to talk. She spoke about data that had been received that day regarding meter revenue in Minneapolis, and noted that meters were enforced for more days and hours in Minneapolis than in St. Paul. In support: Theresa Cain (404 Annapolis St. W., West St. Paul), Metro Transit multi modal commuter programs, spoke about the way Car2Go would make it easier for people to use transit and enhance the growing multi-modal system in the Twin Cities. Damian Goebel (1158 Marshall Avenue), St. Paul Smart Trips, said he believed car sharing furthered their mission to improve access and mobility. He cited statistics showing reduced need for car ownership and increased use of other modes of transport when car sharing was available. He said they believed car sharing would increase safety, health and livability in St. Paul. He said car sharing in other markets had been shown to reduce transit use among members, which was troubling, but they were encouraged by the way the City addressed the issue in the agreement through the use of program evaluation from vehicle usage and survey data. He encouraged City staff to require questions about car ownership and usage rates, and changes in biking, walking and transit usage, to help understand the effect of car sharing on the transportation network as a whole. He said they supported the agreement with the understanding that City staff would use it as a learning opportunity going forward. Josh Johnson (320 Brooks Avenue W., Roseville) Car2Go location manager responded to concerns about downtown meter parking. He said they didn't want the cars to sit, and data from Minneapolis indicated that cars cycled, and if they didn't they could be moved. He said end of year data would allow for reconciliation for lost meter time, St. Paul would receive a full quarterly report as was the case in Minneapolis. He stressed the greater need for alternative transportation as the metro grew, and he spoke about evidence that car sharing increased the use of other types of mass transit. He said they had sent emails and followed up with phone calls in January to the District Council Collaborative and to Transit for Livable Communities and didn't get a response. He said the Grand Avenue Business Association was also approached and had not responded. He said outreach could continue up until the cars were on the road, and concerns would continue to be addressed after that. He said the agreement had been six months in the works with input from Paul St. Martin, Anne Hunt, and Mike Klobuchar. He said he felt this was good for the City, and they were excited to start on the July timeline and hoped it could move forward. Councilmember Brendmoen moved to close the public hearing. Yeas - 6 Nays - 0 Councilmember Bostrom asked how meter use was tracked. Mr. St. Martin said it was estimated at $500 per car per year and reconciled every six months based on Car2Go data. Councilmember Bostrom said he had never seen anything like this in the public right of way with so little process, and he couldn't support it at this time. City of Saint Paul Page 8 City Council Minutes - Final June 18, 2014 Councilmember Thao said he had concerns for the Snelling & Selby Development and Central Corridor which were important business areas his ward. He noted that there hadn't been a quorum at the Transportation Committee meeting, and the agreement could be interpreted by some as a back door agreement He said he liked the concept but could not support it without a transparent process and a conversation potential conflicts of interest. He said Car2Go may have reached out, but his District Councils had not heard about the proposed agreement. He said a company passionate about their product would understand the need for process and input. He moved to lay the matter over for 1 to 2 months so District Councils to provide input. Councilmember Bostrom said business associations should also be consulted. Councilmember Stark said he supported the basic sentiment of having a better community process around things like this, but didn't feel it was Car2Go's responsibility to have done better than they did. He said Car2Go was not directed by City staff to do more, and they were now being sent a mixed message. He said it was not the Council's responsibility to decide based on the process that had already taken place. Councilmember Tolbert asked about the City's ability to terminate contract early, to tow cars, and about tools for adverse action Mr. St. Martin read from the agreement that the City could restrict the service area at any time, and that Minneapolis had been happy with Car2Go's response time to problems. Councilmember Thao asked how hard it would be to address conflicts of interest and equal pay for women. Mr. St. Martin said those things were covered elsewhere in City policy. Council President Lantry said Car2Go vehicles would pay for meter parking like any other vehicle, and it was not in the company's interest to let cars just sit there. She said the item could be laid over for two months to go to District Councils and business organizations, but it would be an education effort since it wouldn't be possible to draft a contract to please all of those interests. She said being philosophically opposed was one thing, but public process would happen naturally through the marketing process. She said she observed Car2Go in Seattle and felt it provided another great option. She said she was in support of the agreement, and passing it didn't stop the conversation about process. Councilmember Bostrom said Car2Go didn't have any investment in the right of way. Councilmember Stark said food trucks parked at meters and construction contractors blocked the public right of way, and this was the same idea. He said the City would have to rely on Car2Go data, but parking enforcement people would know anecdotally if cars were sitting in spots all day. Councilmember Bostrom said food trucks and constructions vehicles had to get permits, and Car2Go wouldn't be paying anything. Council President Lantry said Car2Go was paying $500 per car up front. Mr. St. Martin clarified the amount that Car2Go would pay per vehicle including adjustments for lost meter revenue. Council President Lantry noted other situations in which private entities paid to use public right of way. Following continued discussion, Councilmember Thao move to lay over to July 23. Councilmember Brendmoen questioned what would be accomplished in a month, and asked what would satisfy the Council. Councilmember Thao said a month would give City of Saint Paul Page 9 City Council Minutes - Final June 18, 2014 his District Councils the opportunity to have a discussion. Councilmember Brendmoen asked whether education of the District Councils could continue after the item was passed. Councilmember Thao said he didn't feel it was necessarily strictly an issue of education. Councilmember Tolbert said he was comfortable approving the agreement, but would support Councilmember Thao's motion out of courtesy. Councilmember Stark said he would support a layover if he thought outcome would change, but he didn't feel it would, especially given the flexibility in the agreement. Council President Lantry noted that the item had already been laid over for two weeks at the request of the Council, and people with questions had a responsibility to seek out answers and not just wait to be approached. She said she didn't see what one month would accomplish, and conversation could continue anyway. Councilmember Brendmoen said she believed in community process but the Council couldn't keep moving the finish line. Legislative Hearing Officer Marcia Moermond gave a staff report on the tax assessment for snow shoveling. She said there had been three no-show public hearings, and her recommendation was to approve the assessment based on the staff report and her viewing of the clean-up video at the most recent hearing. She said two weeks passed between the issuance of orders and the snow removal. She showed the clean-up video and displayed a photo of conditions present when the crew arrived. She said the assessment was for $40 plus a $160 administrative fee. In opposition: Property owner ShamShudin Hassan said the snow removal was done early in the morning before they were open and while they looked for the snow blower, and when they arrived to blow the snow it had already been done. He said the photo showed that their property was cleared as well as others on the street, and they had put down salt and done as much as they could. He said they didn't receive didn't receive letter telling them to remove the snow. He said they were new at that location and had cleared the snow as well as they could, and he asked to be forgiven for this time. Ms. Moermond confirmed with Mr. Hassan that the addresses to which the notices were sent were the correct addresses. Councilmember Stark said he was willing to defer to Councilmember Thao's judgment, but noted that this was a common and difficult problem for property owners on arterial streets. He stressed the need to be vigilant to keep the snow from becoming ice. Councilmember Thao asked whether the property owner had said he hadn't received notice. Ms. Moermond clarified that one was sent to the home address and to Occupant at the business address, and there was no returned mail. Councilmember Thao moved to close the public hearing. Yeas - 6 Nays - 0 Councilmember Thao said he received many complaints from disabled constituents in the Rice Street area about not being able to go to and from work or wherever they needed to go. He moved to adopt Ms. Moermond's recommendation.
