Michael Solomon, Office of Financial Services, gave a staff report on the bond sale. Tarek Tomes gave a brief staff report on the resolution to continue the current agreement to the end of the year to allow continuation of negotiations. In opposition: Ben Pearce (2173 Marshall Avenue) spoke about the limited options available to St. Paul residents and the advantages of allowing competition with other providers. He said the current agreement was good for the City but not good for the residents, and he felt St. Paul should consider a municipal fiber option. He noted that Mayor Coleman's brother worked for Comcast, and said if the contract was extended beyond the six month period it would be nepotism and not beneficial for the residents of St. Paul. In support: Mr. Tomes said the City of St. Paul had numerous internet service providers within the City, and the franchise agreement gave access to the right-of-ways but did not preclude competition. Councilmember Thune said Mayor Coleman was scrupulous about not having communication with his brother about the franchise. Councilmember Thune moved to close the public hearing. Yeas - 5 Nays - 0 Councilmember Stark said, accusations aside, he appreciated the testimony. He said everyone agreed with the need for competition, but the franchise agreement didn't preclude competition. He said a municipal fiber system was cost prohibitive. He said this was just an extension of the existing agreement and there were still a lot of moving parts. Councilmember Thao said he admired Mr. Pearce's passion and his taking of the long view towards having municipal fiber optics, but he wasn't sure there was the capacity at this time. He said he would be glad to continue the conversation about partnerships that could be formed to further serve the community moving forward. He said extending the contract with Comcast made sense at this point. (File No. S1403, Assessment No. 145303) (To be withdrawn) Withdrawn City of Saint Paul Page 9 City Council Minutes - Final July 23, 2014 33 RES PH 14-58 Final Order approving a new sidewalk improvement along the west side of Davern Street from Saint Paul Avenue to Colvin Avenue. (File No. S1402, Assessment No. 145302) (Public hearing continued from June 11) In opposition: Attorney Brian Alton appeared representing the Foussards. He said the new 880-foot sidewalk would affect six property owners, four of whom were being assessed. He said the Foussards were being assessed for $13,000 for approximately 417 feet of the sidewalk, which represented a significant burden. He said they were sensitive to the safety concerns but there were other issues to be addressed. He noted that the Highland District Council supported the sidewalk as long as there were conditions which mitigated the assessment and maintenance burden on the Foussards. He said there was a question of whether the proposed sidewalk was outside of any public easement and whether the city had a legal right to build a sidewalk at that location. He said the historic status of the property was another issue, and any sidewalk alteration of the site would need to be consistent with the historic designation. He said the sidewalk would have significant physical and environmental impacts related to loss of trees and vegetation an increase in impervious surface, and increased erosion. He said the sidewalk would be difficult to maintain due to the slope and its location adjacent to street, and the location and difficulty with maintenance might make it more dangerous for pedestrians. He said the sidewalk would represent an onerous burden on the property owners, and would cause a diminution of property value, loss of trees and privacy, and potential legal liability. He requested that the assessment not be approved until all of the issues could be resolved. Phillip Foussard (1173 Davern Street) said in addition to the other issues he was disappointed in how this had all played out. He said they had received notice of the assessment after the Department of Public Works had filed the variance request, and it seemed appropriate that they should have received notification that someone had filed for a variance affecting their property. He said they had expressed a willingness to work with the City and had met with Councilmember Tolbert and his staff. He said they were told that the assessment had been reduced, but the information currently in the file did not reflect a reduction. He said they were frustrated that they'd had to retain an attorney to learn the facts and that they were being depicted as hostile people by the press and others. He said they were stewards of the property and, while they understood the public safety issue, but were being faced with a real diminution of value in the property, a large financial burden for maintenance. He said the property was not currently being maintained by the City, which lead to the questions about the City's legal right to build the sidewalk. He said they were confused about the way neighbors had been assessed in the past, and they had been un-invited to meetings and unable to get questions answered. In favor: Laura Nichols (1754 Field Avenue) said she became aware of the sidewalk issue through the Shepard Davern Task Force. She said the task force was not averse to finding alternative methods to get children safely up and down the hill, and it might be helpful to connect Public Works staff, school transportation staff, and the property owner to find a solution. Councilmember Stark moved to close the public hearing. Yeas - 5 Nays - 0 Councilmember Tolbert asked Deputy City Attorney Gerald Hendrickson to clarify the amount of the assessment. Mr. Hendrickson the issue currently before the Council was whether to order the project, and the hearing on the assessment would take City of Saint Paul Page 10 City Council Minutes - Final July 23, 2014 place after the project was completed. He said the assessment figure in the file now was an estimate. Councilmember Tolbert said he appreciated Mr. Foussard's testimony and the concerns about the assessment and maintenance, but it was a public safety issue, and he believed having sidewalks was part of the urban environment. He said he hadn't seen the legal opinion mentioned by Mr. Alton, but the sidewalk had been under discussion for six months and no other solutions had been presented. he said he would move approval, and the legal issues could be addressed if necessary. No one appeared in opposition; Councilmember Bostrom moved to close the public hearing and approve the resolution. He said it had been a long process to establish some temporary parking. He said they were very successful at Ward 6 and he wanted to see them continue. Paul Kurtz gave a brief staff report on the transfer of funds, and responded to questions from Councilmember Stark. No one appeared in opposition; Councilmember Stark asked for a staff report and moved to close the public hearing. Yeas - 5 Nays - 0 Paul Kurtz. Public Works, gave a brief staff report, responded to questions from Council members Stark and Tolbert. Councilmember Stark suggested that it would be helpful if Public Works, perhaps working with the Office of Financial Services (OFS), could clearer descriptors for the funds. Mr. Kurtz said the CIB Committee had expressed the same concern, and it had been brought forward to OFS staff. Councilmember Stark moved approval. John Maczko, Public Works, gave a staff report on the financing of the 2014 Street Repair Plan Project, and answered Council member questions. Council members were in agreement that the work was necessary, but a better long term financing solution was needed. Councilmember Bostrom amended the resolution to specify the streets being done. Adopted as amended Yea: 5- Councilmember Bostrom, Councilmember Stark, Councilmember Thao, Councilmember Thune and Councilmember Tolbert Nay: 0 Absent: 2- Councilmember Brendmoen and City Council President Lantry LEGISLATIVE HEARING ITEMS REQUIRING DISCUSSION 68 RLH TA 14-360 Ratifying the Appealed Special Tax Assessment for Real Estate Project No. J1409A, Assessment No. 148526 at 959 EUCLID STREET. Legislative Hearing Officer Marcia Moermond gave a staff report assessment for snow removal. She said the landlord and tenant were present at the Legislative Hearing, and landlord had said the tenant was responsible for shoveling or for the cost. She said the landlord was pleading poverty on the part of the tenant. Ms. Moermond said it was a private matter between the two of them, and she moved approval of the assessment. Darlissa McDonald (959 Euclid Avenue) said she had lived there for three years and never had a problem before, but this was a tough winter. She said she had done the best she could, and she asked that the Council try to take that into consideration. Councilmember Thao moved to close the public hearing. Yeas - 5 Nays - 0 In response to a question from Councilmember Bostrom, Ms. Moermond confirmed that the City had performed the work, and said there was no history of previous Work Orders at the property. Councilmember Bostrom moved to approve the assessment. Councilmember Stark said he would support the motion. He was said he sympathetic to the cost, but the City had incurred the cost of doing the work and it would be unfair to the taxpayers to give one person a break. Ms. Moermond said a layover would allow time for some problem solving and for the property to begin to go through the tax forfeiture process.
