Councilmember Tolbert moved an amendment changing the responsibility for some
notification requirements from DSI to the contractor, saving the City money; and
adding a requirement for DSI to report back to the City Council in a year as to the
effectiveness of the construction management agreement. Yeas - 7 Nays - 0
Councilmember Tolbert asked to lay the matter over to August 27 to allow time for the
amendments to be considered and to align the item with a companion ordinance

19 RES 14-1318 Authorizing the Department of Planning and Economic Development
to apply to the Minnesota Department of Employment and Economic
Development (DEED) for a redevelopment grant for the New Phalen
Village Center project.
Councilmember Stark said he supported the project but had concerns about the
last-minute nature of the grant application with little interaction between staff and
Council members and the resolution coming before the Council after the application
had been submitted. He requested that the process generally be backed up so
conversations were taking place well in advance of the application deadlines to give
Council members a better picture of applications in the queue. He moved approval.
Council President Lantry said it was a good project and she would support the motion
out of respect for Councilmember Bostrom, but it was a multimillion dollar project with
no funds identified and she couldn't abide the way the item had come forward. She
noted that the application wasn't even attached to the resolution, and said it couldn't
happen this was again.
Councilmember Tolbert asked how the item could legally be on the Consent Agenda
if it was asking the Council to commit funds. Assistant City Attorney Rachel Tierney
said the funds were being committed for a future year so there was no budget to
amend.
Councilmember Brendmoen reiterated the concerns about passing the resolution
after the fact, and said the process needed to change.
Councilmember Tolbert said the Council was not a rubber-stamp body and perhaps
the resolution should be denied to send a message.
Councilmember Bostrom said the project had been underway for many years and
was needed on the East Side. He said he appreciated the concerns about the
process but asked for the other Council members' support. He moved approval.

Recreation and Parks Association (MRPA), of three Awards of
Excellence received by Saint Paul Parks and Recreation.
Parks and Recreation Director Mike Hahm introduced Michelle Snider, Executive
Director of the Minnesota Recreation and Parks Association. She described the
organization and awards program, and presented Awards of Excellence for Fun,
Fitness and Sports for Little People; the Great River Passage Master Plan; and the
St. Paul Regional Park Bike Patrol.

22 RES 14-1305 Denying the request for a stay of implementation of RLH VO 14-5
(ordering vacation of 328-330 NINTH STREET EAST), pending
appeal.
In opposition:
Attorney John Westrick appeared representing Robert Seltz. He said there were no
fire safety issues in Mr. Seltz' unit, and he asked that Mr. Seltz be able to stay and
keep an eye on the building which was attracting vagrants. He said Mr. Seltz didn't
require a Certificate of Occupancy because he was the owner/occupant. He noted
that one tenant was still occupying the building illegally.
Inspector Shaff gave a staff report on the situation and reviewed DSI's position and
recommendations.
Councilmember Thune said they'd tried very hard to make it work but he didn't feel
they had any choice. He moved approval of the resolution.

Todd Hurley, Office of Financial Services director, gave a brief staff report.
In support:
Vic Rosenthal (951 Laurel Avenue), Jewish Community Action, thanked the Council
and described the work of his organization related to banking services available in the
City. He said they felt Responsible Banking could be used as a new tool to collect
and analyze data, and identify areas that were underserved and under-represented.
He said the ordinance provided an opportunity to engage the community in an area
they hadn't traditionally been engaged in, and to provide transparency. He noted that
the banks were not speaking against the ordinance and said that this was an
opportunity for the banks and City to work together.

40 RES PH 14-213 Approving the application of Team Ortho Foundation for a sound level
variance in order to present outdoor iPod music and amplified
announcements at the Women ROCK Event on Saturday, August 30,
2014 on Mississippi River Boulevard, south of Ford Parkway near the
Lock and Dam No. 1 Site.
In opposition:
Gary Marx (500 Mississippi River Boulevard), representing neighbors south of the
Ford Plant, distributed a list of objections. He said the events were all about money
for large corporations, and a statement from Team Ortho regarding the type of
experience they want to provide their participants was in conflict with desires of
residents. He said some residents would be "landlocked" and unable to enter or
leave the area during the event, and during past events communication and the
access lane were inconsistent. He said residents could contribute to planning if they
were included. He said they paid taxes and should be able to enjoy their
neighborhood. He said he appreciated the support from Councilmember Tolbert in
starting to make changes.
Councilmember Brendmoen asked for clarification as to whether this was just a cheer
zone.
Dawn Roberts (2906 N. 2nd Street, Minneapolis), race director, said that point on the
course is the farthest from the start/finish and they needed to be able communicate
with participants in the case of an emergency. She said the spot also was provide
entertainment and was strategically selected because it was 1/3 mile from the closest
resident. She said police at both ends of the cone lane monitored decibel levels.
Council President Lantry asked again whether it was a cheer zone. Ms. Roberts said
it was a cheer zone with music, and in response to a question from Councilmember
Thune she said it was a turn-around with an ipod hooked up to speakers, but no
cowbells. She said they had made changes from the previous year in response to
resident concerns, including shortening the route which eliminated road closures and
shuttles. She said the time could be reduced to end at 9:40 rather than 10:00 a.m.
Councilmember Thao asked for a response to the comment that residents were not
engaged. Ms. Roberts said notifications were sent to residents and businesses about
40 days prior to their events.
Councilmember Tolbert reviewed the City's requirements for any road closure, and
changes that had been instituted for the access lane for residents.
Ms. Roberts stressed that there are no other race activities going on in front of those
homes.
Councilmember Thune asked whether there was a phone number people could call
and get an answer. Ms. Roberts said it was included on the letter. She said they had
implemented a command center in the past year and communication would be readily
available. In response to a question from Councilmember Thune she said volunteers
and police would be well-trained with regards to the access lane.
Councilmember Tolbert moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Tolbert said he had communicated with Mr. Marx and other
neighbors, and while they had raised good points and legitimate issues, this was
strictly a sound variance. He said the request was from 8:00 to 10:00 a.m. in an area

with no houses, and noted that Team Ortho had made changes. He moved approval,
and asked that Team Ortho discourage cowbells.
Councilmember Thune said work was being done on longer term ways to address
these issues, and progress was being made.
Councilmember Stark asked that the organizers be careful about sound-checks prior
to the event.

42 APC 14-2 Public hearing to consider the appeal of Payne Phalen District 5
Planning Council to a decision of the Planning Commission approving
an expansion of nonconforming use to increase the number of parking
stalls for outdoor auto sales at 1265 Arcade Street.
Bill Dermody, Planning and Economic Development (PED), gave a staff report on the
application, variance conditions, and the key disputed findings in the appeal.
Appellant:
Al Oertwig, president of Payne Phalen District 5 (D5) Planning Council, distributed a
letter stating D5's position. He said the neighborhood had been repeatedly plagued
by business-owned cars being parked on the public streets. He read from comments
made at the District 5 meeting at which the issue was discussed, mostly having to do
with illegal parking. He said there were also complaints about the snow not being
shoveled and the grass not being mowed, and he noted a pending hearing on license
violations. He said it was an incompatible use and inconsistent with the area plan.
He said the Planning Commission erred because they did not take seriously the
current license violations. He said they were also asking for refund of appeal fees.
In support of appeal:
Kris Oyen (7630 Southridge Ct, Savage), attorney for International Auto Sales, said
the complaints cited by Mr. Oertwig and District 5's position were taken into
consideration when the Planning Commission made its decision. He noted that ten
neighbors had signed a petition as required. He said there was currently a license
violation which International Auto Sales disputed and for which a hearing was
scheduled on August 20. He said the business did not have a body shop or
mechanics, and the only employees were the office manager and manager. He
displayed photos showing the condition of the exterior lot and landscaping, and said
the owner put considerable work into making the business attractive and minimizing
the impact on the neighborhood. He said the 14 parking spaces in the original site
plan were two to three feet wider than required by code, and 28 spaces was the
appropriate number for the size of the lot.
Nasseh Ghaffari, manager, said the business was an eyesore when they took it over
but they had worked hard to make it more appealing. In response to a question from
Councilmember Brendmoen he said they had taken over the business six years
before. He said they were in a neighborhood with a lot of successful businesses
which also contributed to the traffic. He said they had just hired bilingual staff to help
communicate parking regulations with their customers. He said it seemed clear that
there were members of D5 who just didn't want auto-related business, but his
business didn't do mechanic work and filled a need in the neighborhood. He said
they were just asking for the appropriate number of spaces so they could conduct
their business and fit into the community.
Jose Pabon (1085 Jackson Street) business owner and acquaintance of Mr. Ghaffari,
said neighbors had no complaints about the business, and he urged the Council to
uphold the variance.
In response to questions from Councilmember Thao, Mr. Oyen said there was an
overflow lot on University Avenue. He said there were a lot of break-ins and
vandalism in that area, and the expansion would allow all of the cars to be kept on
site. He said the inventory turnover rate varied.
Rosa, area resident, said she visited Mexican bakery across from the business and
never saw anything detrimental to the neighborhood. She said it was one of the

Councilmember Bostrom thanked everyone for coming to testify. He said he wasn't
convinced the expansion would be good for the neighborhood, and he felt the
Planning Commission erred in Finding #1 that it could be expanded. He said the
original 1994 Conditional Use Permit license limited the lot to 14 spaces which had
been exceeded many times. He noted that the building was in a residential
neighborhood and said the Planning Commission erred in Finding #6 related to the
impact of the business on the character of the neighborhood. He said leaving the
number of spots at the original 14 was appropriate and what they had agreed to
initially, and should have known initially if it wouldn't work financially. He moved to
grant the appeal.
Assistant City Attorney Rachel Tierney asked Councilmember Bostrom to clarify the
number of the first finding he mentioned. Council Bostrom said he'd intended to say
Finding #3.
Councilmember Stark commented that, rather than stating some conditions were or
were not met, the staff report used the words "can be met" indicating they could be
met if the lot were maintained. He said the subjectivity made the situation more
complicated.
Following the vote on the appeal, Councilmember Bostrom moved to refund 50% of

43 RES PH 14-218 Approving adverse action against the Cigarette/Tobacco license held
by Little Grocery, LLC, d/b/a Little Grocery located at 1724 University
Avenue West.
Geoffrey Karls, Assistant City Attorney representing the Department of Safety and
Inspections (DSI), gave a staff report on the adverse actions for selling contraband
cigars, and a tobacco compliance check failure. He said DSI was recommending a
matrix penalties of $700 for the contraband sales and $200 for the compliance check
failure. He said the licensee had admitted to the facts but had requested a hearing
on the penalty.
One of the owners of Little Grocery appeared and said they understood seriousness
of violation, but were new to the business venture and didn't understand everything.
He said they had purchased the cigars from a wholesaler not realizing they weren't
supposed to sell them in Minnesota. He said they moved the product to the back
room as soon as they discovered the mistake and that was where the inspector found
them. He said the products found on shelf had been purchased legally. With regards
to the compliance check, he said the salesperson read the identification incorrectly,
and it was an honest and they didn't want to sell to minors. He asked for leniency,
and said they were a new business and couldn't afford penalties, and were working to
correct problems from the previous owner.
Councilmember Brendmoen asked the owner when they had taken over the store.
He said they'd taken over in July 2012.
The owner displayed a tax form showing they made less than $4000 last year.

Councilmember Stark said he appreciated the testimony. He said it was a highly
regulated business and he appreciated that the mistakes might have been innocent
and unintended, they were serious. He moved to adopt the recommendation of DSI.

44 PH 14-9 Public hearing to consider the report of the Administrative Law Judge
concerning the Taxicab Driver license (License ID #: 0048592) held by
Patrick Emmet Murphy.
Geoffrey Karls, Assistant City Attorney representing the Department of Safety and
Inspections (DSI), gave a staff report on the violation and the Administrative Law
Judge ( ALJ) hearing. He said the recommended penalty was license revocation.
No one appeared in opposition; Councilmember Stark moved to close the public
hearing and adopt the findings and recommendations of the ALJ.

Council President Lantry added a second motion to add the costs of the ALJ Hearing
to the penalty since the licensee had requested an ALJ hearing but did not put up any
defense. She suggested that the Council make this their practice going forward.
Councilmember Thao said those requesting hearing should be notified of that in
advance.
Mr. Karls said the costs would be about $1000, and that people requesting hearings
were notified initially that they might be charged for costs under certain
circumstances. He said he would take the comments as guidance going forward.
Assistant City Attorney Rachel Tierney asked for confirmation that the Council was
asking for the ALJ fees billed to City and not for City staff costs. Council President
lantry said that was correct for the present time.

Mark Gaertner (24 E. 4th Street) asked for clarification of what the project was.
Council President Lantry said it was for a storm sewer connection and the work had
already been performed.
Lynn Moser, Real Estate, said the co-owner had requested that the work be done as
other work was being done in the area. She said Public Works covered the cost of
rock excavation and it was agreed that the remainder would be paid by the property
owner.
Council President Lantry asked Mr. Gaertner whether he was a new owner. Mr.
Gaertner said he was a co-owner; he asked whether there had been written approval.
Council President Lantry said that could be clarified, but since the work had been
done, the cost would be assessed. Ms. Moser said this public hearing was to
approve the project but not to ratify the assessment.
Mr. Gaertner said they were informed that the City was building the connection but
they didn't request or approve it it.
Councilmember Thune moved to close the public hearing and lay the matter over for
a week to allow time for Mr. Gaertner to have his questions answered.

Public Works under the Griggs Avenue and Jefferson Avenue Bicycle
and Streetscape projects by transferring $678,213.00 and recognizing
additional financing of $243,000 Federal TLC Funds.
In opposition:
Benita Warns (1440 Lafond Avenue) said she'd been involved with District 11
neighbors on the bike trail along Pierce Butler/Lexington Parkway, and this project
was taking funds away from their project. She said they went through the CIB
process and received the funding. She said a lot of work went into obtaining the
support and funding, the project was in the budget, and now the money was being
taken away and the project closed out. She suggested scaling back the Jefferson
project, taking funding from a lower-ranked project, or putting the Pierce
Butler/Lexington project at top of list for the next round. She said this undermined
citizens' confidence in the process, and she was looking for assurances that their
project would be built and the funding wouldn't be completely rescinded.
Councilmember Thune moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Thune said the Palace playground project was in a similar situation,
and they would be applying for additional CIB money. He said they couldn't predict
what future Councils would do, but it was his intention to move the project to the top
of the list for funding.
Councilmember Thune moved to reopen the public hearing to allow testimony from
someone who hadn't had a chance to speak. Yeas - 7 Nays - 0
Sherri Moore (4237 29th Avenue S., Minneapolis), spoke about the importance of
Palace Recreation Center programs and improvements for area children. She said
she was in opposition to diverting funds, and children were more important than the
bike path. She suggested putting the Jefferson project on hold.
Councilmember Thune moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Brendmoen said she supported funding the project but felt the
process was something that should be discussed in the future. She said it wasn't fair
to others who had gone through the CIB process and been awarded fund.
In response to questions and comments from Council President Lantry and Council
members Thune and Stark, Paul Kurtz, Public Works, said all $200,000 from the
Pierce Butler/Lexington project was being moved to Jefferson/Griggs, which closed
the project for 2014. Councilmember Thune suggested leaving $1 in the project and
keeping it open. Mr. Kurtz said the best option suggested by Ms. Warns was to make
Pierce Butler/Lexington the top project in the next cycle, although there was no
guarantee that would happen.
Councilmember Tolbert asked about budget and time over-runs on the Jefferson
project. Mr. Kurtz said bids came in higher than expected. He said the process
began in 2010 and 2012, and costs had gone up; and the Griggs, Jefferson, and
Charles bike corridors were first ones done and estimates were not as precise as for
RSVP. He said the City was under contract to complete the project and had to find
the money, and if this wasn't the right funding it would have to be found somewhere
else. As to the delay in completion, he said there was an extensive community
process, after which the project was re-bid because bids came in too high.

Council President Lantry asked about CIB contingency funds. Mr. Kurtz said they
were kept in the Office of Financial Services. Council President Lantry read from the
code regarding the Council's ability to pre-promising money to complete a project in a
subsequent year.
Councilmember Stark moved to lay the matter over for one week to allow time for a
resolution to be drafted to recommit the diverted funds for Palace and Pierce
Butler/Lexington.

inspections had started with a complaint in March 2014, and there had been many

house for parking was previously heard by Council, and a July 15 deadline was
given. She said a site plan was recently submitted but compliance hadn't been
verified. She recommended denying the appeal with an August 8 compliance
deadline and September 1 vacate deadline. She said September 1 had been
requested by the property owner and she had no objection.

Property owner Anton Soukhanov (1144 Blue Heron Court) said there were 23 items
on deficiency list and most had been addressed. He said he didn't realize he couldn't
replace his own outlets and the electrician said it took three weeks to pull a permit.
He said he would like would like a one-month extension. He reviewed the items that
had been completed, and said the one uncooperative tenant had been given 30 days.
He said he planned to live at property himself starting at the end of August, and
would have everything completed in a month.

The City Council is paperless which saves the environment and reduces expenses. The

iPads to review the files during the meeting. Using the iPad greatly reduces costs since most
