23 RES PH 15-13 Adopting the Shepard Davern Area Plan and amended District 15
Plan Summary as addenda to the City of Saint Paul Comprehensive
Plan.
Michelle Beaulieu, Planning and Economic Development, gave a staff report on the
Shepard Davern Area Plan. She reviewed the process leading to the development of
the plan, and said a number of strategies were being proposed, including a
neighborhood park, a better balance of housing types, improved safety and
walkability on West Seventh, and improvement in accessibility to riverfront
recreational areas. She said the plan was being recommended to the City Council for
adoption as an addendum the St. Paul Comprehensive Plan and updated language in
the current summary of the Highland District Community Plan. In response to a
question from Councilmember Tolbert she clarified the difference between the item
being considered and the zoning ordinance following.
Testimony:
Tia Anderson (2091 Pinehurst Avenue), representing the Highland District Council,
said the Community Development Committee of the Highland District Council
supported the new strategy of exploring public uses for McDonough Park, but
recommended that the strategy be given a low rather than medium priority in light of
the higher priority parks strategies for that area and limited resources available in the
area. She said the Committee also supported the sub-strategy to develop branding
and signage for the neighborhood as a gateway to St. Paul.
Bill Rosenblum (1893 Worcester), member of the Davern Shepard Task Force and
the Community Development Committee, urged the Council to support the high
priority for McDonough Park. He said because of its topography it wouldn't be
competing with more traditional parks, but would be more of an eco-area for learning
and a great neighborhood amenity. He said it currently was a terrible eyesore.
Arthur Kourajian (1800 Graham Avenue), member of the board of directors of a
condominium near the Shepard-Norfolk Avenue development, expressed concern
about the rerouting of traffic off of eastbound Seventh onto Norfolk. He presented a
petition from neighbors opposing that plan, and said they were in favor of
redevelopment of the site, but asked that the neighborhood be respected.
Council President Lantry apologized and said there was an amendment that should
have been introduced prior to the public hearing. She said the usual 15 minutes per
side allowed for testimony would be increased if people wanted to speak again after
hearing the amendment. Councilmember Tolbert moved the amendment, which he
said added language to better articulate the importance of the area as a gateway into
St. Paul, and emphasizing the high priority of land use strategies to have high quality
design in commercial redevelopment. Yeas - 7 Nays - 0
Greg Campbell (1335 Kenneth Street), co-chair of Shepard Davern Task Force,
reviewed the concerns and priorities of neighbors as reflected in the plan.
Patti Brady (1800 Graham Avenue) said pedestrians needed longer traffic lights to
cross West Seventh and Davern. She said she loved the neighborhood and would
like it to be upgraded a little bit, but nothing drastic.
Lynn Bach (2265 Youngman Avenue), Task Force member, said they thought long
and hard on this, and asked for the Council's support.
Barbara Sommers (2275 Youngman Avenue), Regency Community resident, said
she was excited about the unique opportunity presented by a small low-maintenance

park which would be a win for students and for elderly residents who weren't
comfortable crossing Shepard Road.
Councilmember Tolbert moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Tolbert said it had been a long process, and he acknowledged
everyone who contributed. He said it was a great community-building exercise, and
while it was not perfect there was general consensus on priorities.

Merritt Clapp Smith, Planning and Economic Development, gave a staff report.

Rick Varco (2265 Youngman Avenue) expressed concern about the effect of the
proposed changes on the cost of housing in the area. He said he felt the restrictions
would price families out of the area by restricting the construction of large multi-family
housing, and more high-density housing should be added elsewhere to compensate.

Councilmember Stark said issues of land use and growth were the most challenging
ones currently facing St. Paul. In response to the concerns raised by Mr. Varco, he
said it appeared more land was being upzoned than downzoned, resulting in greater
overall density being allowed.
Councilmember Tolbert again acknowledged the work of staff and the community.
He said he felt the plan was good for the area and for the future of St. Paul.
Councilmember Thao acknowledged the comments made by Mr. Varco, and said T2
and T3 zoning had been beneficial in Ward 1, and other tools such as the density
bonus could be applied. He said he understood the concept of having greater
density but felt this was a great package and would support it.

41 RLH RR 15-4 Ordering the razing and removal of the structures at 722 CONCORDIA
AVENUE within fifteen (15) days after the January 7, 2015, City
Council Public Hearing. (Public hearing continued from January 7 -
See RLH RR 14-24)
Legislative Hearing Officer Marcia Moermond gave a staff report on the order to
remove or repair a structure. She said there was a significant fire at the property,
and the matter was coming forward now rather than last year because the City's
demolition budget was depleted at that time. She said no rehabilitation plan was
brought forward, and they were talking strictly about notification concerns. She
reviewed the City's method for determining who should receive notification. She said
given the lack of a work plan and the posting of a performance deposit, her
recommendation was to order removal within of the building with no option for
rehabilitation. Council President Lantry clarified that the fire had occurred on October
30, 2013, and she noted that there were photographs in the file.
In opposition:
Lee Mosher, real estate attorney representing the life tenant of the property, said the
dispute arose from the split in ownership of the property. He reviewed the ownership
circumstances, and said a remainder owner with a fee interest in the property had not
received any notice of this proceeding even though her interest was recorded with
Ramsey County. He said they had paid the vacant building fees; spent over $11,000
to have the building cleaned out, which was not reflected in the pictures provided;
and had a Code Compliance inspection. He said the problem was with a recalcitrant
part-owner, and a lawsuit had been initiated. He said they'd initially wanted to
demolish the property, but the half-owner objected. He said they would like 6 months
to resolve the issue or fix up the property, and felt the request was justified given that
the City hadn't done anything with the property in the year after the fire, and the part
owner had not received notification.
Councilmember Thao moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Thao confirmed with Ms. Moermond that notification was sent to all
owners on record with Ramsey County. Ms. Moermond said there was also an
encumbrance report, so there was a pretty extensive process to notify owners and
interested parties. She said the building was posted as well. In response to
questions from Councilmember Thao, Ms. Moermond reviewed the sequence of
events since the fire, and said given the remaining value of the property and the
estimated cost for demolition, there wasn't much equity in play.
Councilmember Thao asked whether the homeowner had had a year to put together
a plan and finances for sale or rehabilitation of the property. Ms. Moermond reviewed
the standard expectations set forth in the Legislative Hearing process, including a
Code Compliance inspection report, $5000 performance deposit, work plan, and
evidence of financing. She said in this case DSI was estimated rehabilitation costs of
$90,000 to $100,000, and the Council should look for that amount unless there were
credible bids brought forward for less money.
Councilmember Thao moved to adopt Ms. Moermond's recommendation.

68 RLH OA 14-35 Appeal of Meeghan Francisco to an Encroachment Permit Denial at
155 SIDNEY STREET EAST.
Legislative Hearing Officer Marcia Moermond gave a staff report on the request to
build a fence within the right of way in order to incorporate a sidewalk between a
house and garage into the private property. She said Public Works staff felt there
were alternatives to using the right of way to connect the house and garage, since
the sidewalk was very old and there was no door on the side of the house where the
sidewalk ended. In response to questions from Council President Lantry and
Councilmember Brendmoen, she said it was not a public sidewalk, and it was an
unusually large right-of-way. She noted that a neighbor's fence was also built in
violation. She recommended denying the encroachment application, as it was
reasonable for it to be moved over onto private property.
Property owner Meeghan Francisco said she purchased property in June 2014,
assuming that the property line was at the top of the driveway apron rather than 20
feet from the curb. She said she wanted to build a fence because people walked
through her yard and she'd already had things stolen off of her property. She said
there was a concrete patio behind the house that would have to be incorporated if the
fence and sidewalk were to be moved out of the right-of-way. In response to a
question from Council President Lantry she said she was asking to go a maximum of
six feet into the right-of-way, and had been told that the City needed at least 10 feet
for boulevard maintenance.
Councilmember Thune moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Thune said he felt the property owner was doing the best she could
at making practical use of the space while leaving the City lots of boulevard space.
He moved to grant the appeal.

73 RLH VO 15-1 Appeal of Jai Vang to a Revocation of Fire Certificate of Occupancy
and Order to Vacate at 432 UNIVERSITY AVENUE WEST.
Legislative Hearing Officer Marcia Moermond gave a staff report on residential use of
the second and third floors of a commercial space. She said there was furniture in
the space, and it was used as sleeping quarters for visiting guests. She said
appropriate safety features were not present, and the property was not zoned for
residential. She said the owner did meet with a project facilitator in the Department of
Safety and Inspections to find out what would be necessary to convert the space, but
she didn't know the outcome of the meeting. She noted that these same orders had
been written at the property a number of years ago, and the situation was abated.
She said the inspector indicated there was compliance as of the day before.
Hoang K. Tran, Esq. (121 S. 8th Street, Minneapolis), appeared. He said he had
worked with the City in his positions with the Center for Asian and Pacific Islanders
and the Southeast Asian Refugee Community Home, and it was an honor to appear
before the Council for the first time. He said in this case the issue was moot, but they
had appealed on principle. He said his client had purchased the property in
November 2013, and the previous owner left a lot of junk in the building.
Councilmember Thao asked for clarification as to whether Mr. Tran was the building

worked with Jai Vang. Mr. Tran said both Jai Vang and Wei Tran were small
business people struggling with their lives, and the order to vacate would be too
much for them. He said he had advised his clients to comply with the orders, and he
was appearing before the Council out of respect. He said if the order to vacate were
to stand, it would create a huge unfairness for Jai Vang and Wei Tran.
Councilmember Thao moved to close the public hearing. Yeas - 7 Nays - 0
Councilmember Thao moved to adopt the recommendation of the Legislative Hearing
Officer. He thanked Mr. Tran for his service in the community, but stressed the
importance of safe buildings for members of the community.
