Kathleen Kelso, Chair of the Advisory Committee on Aging, distributed copies of the Committee's 2014 Annual report, and made a brief presentation on directions and ongoing activities for 2015, with a focus on housing initiatives. Amy Moser, Committee Secretary, spoke about the Communities for All Ages paradigm. They answered questions from Council members. Received and Filed ORDINANCES An ordinance is a city law enacted by the City Council. It is read at four separate council meetings and becomes effective after passage by the Council and 30 days after publication in the Saint Paul Legal Ledger. Public hearings on ordinances are held at the third reading. Second Reading 28 Ord 15-6 Amending Chapter 39 of the Saint Paul Administrative Code pertaining to Payroll Deductions for Nonprofit Entities. Laid over to February 18 for third reading/public hearing First Reading 29 Ord 15-5 Amending Chapters 63, 65, and 66 of the Saint Paul Legislative Code pertaining to driveway setback requirements, land use standards, and business, industrial, and traditional neighborhood district uses and standards. Laid over to February 11 for second reading SUSPENSION ITEMS Councilmember Stark moved suspension of the rules. Rules suspended Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, City Council President Lantry, Councilmember Stark, Councilmember Thao, Councilmember Thune and Councilmember Tolbert Nay: 0 City of Saint Paul Page 6 City Council Minutes - Final February 4, 2015 RES 15-258 Accepting the donation of travel expenses from Visit Saint Paul with support from Travelers Foundation for Ross Currior and Joe Spencer to have a site visit of the Fox Theater in Oakland and the Riviera Theater in Chicago for the purpose of informing the design of the Palace Theater. Councilmember Thune moved approval of the resolution. Adopted Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, City Council President Lantry, Councilmember Stark, Councilmember Thao, Councilmember Thune and Councilmember Tolbert Nay: 0 Council members shared information about upcoming events in their wards. The Council recessed at 3:48 p.m. PUBLIC HEARINGS The Council reconvened for Public Hearings at 5:32 p.m. Present 7 - Councilmember Dan Bostrom, Councilmember Amy Brendmoen, City Council President Kathy Lantry, Councilmember Russ Stark, Councilmember Dai Thao, Councilmember Dave Thune and Councilmember Chris Tolbert Councilmember Thune noted that at the 3:30 portion of the meeting the Council had adopted an item approving adverse action against licenses held by West Side Groceries, and he acknowledged neighbors present who had hoped to testify on the issue. He congratulated them for their perseverance in helping to crack down on a notorious problem property. City of Saint Paul Page 7 City Council Minutes - Final February 4, 2015 30 RES PH 15-8 Final Order approving the alley reconstruction improvement in the block bounded by Juliet Avenue, Palace Avenue, Lexington Parkway, and Oxford Street. (File No. 19177, Assessment No. 155001) In opposition: Chris Thyen (412 Lexington) said he was opposed mainly based on the cost. He said it was an unimproved alley, the neighbors had been able to handle it in the past, and they were looking for a greener solution than a hard surface. He said the cost seemed like a lot for what was essentially a driveway shared by two abutting properties. He said if they said yes at this point, they didn't know what they were saying yes to since the specific plans hadn't been developed or the costs determined. Debra Thyen (412 Lexington Parkway and 1080 Juliet Avenue) said she was opposed to it for now until the drainage issue was figured out. She said she would like a better understanding of what was going to be done and what they were being assessed for. She said they weren't opposed to working with the City if it was done properly, and they would rather work with their neighbors. In support: Richard Sorensen (408 Lexington Parkway S.) referred to comments and pictures submitted. He said the alley was falling apart and needed to be rebuilt to current design standards. He said the slope was so steep that it was dangerous in the winter, and the slope should be considered in the redesign along with the drainage issue. Mark Stennes (1083 Palace) said he had no use for the alley but apparently have 7%. He said he had no opposition to being assessed to improve the alley. He said he agreed with everyone that it ought to be done right, but it should certainly be addressed. Councilmember Tolbert moved to close the public hearing. Yeas - 6 Nays - 0 (Councilmember Thune not present for vote) Councilmember Tolbert thanked everyone for their testimony. He said not everyone agreed on what needed to be done, but alley was very dilapidated and needed to be resolved. He said approving this would allow Public Works to move forward, and they would work with neighbors to do something sustainable. He moved approval. He said there had never been a sidewalk and not much pedestrian traffic, and there were lots of walking paths nearby at Como. He said he didn't need a sidewalk to shovel, didn't need and couldn't afford the assessment. He reiterated that four of the six residents didn't want it. Councilmember Brendmoen moved to close the public hearing. Yeas - 7 Nays - 0 Councilmember Brendmoen clarified that because it was RSVP there wouldn't been an assessment, but said she agreed that it didn't make sense to add a sidewalk there. Deputy City Attorney Gerald Hendrickson suggested procedures for voting down the resolution. Councilmember Thune moved approval of the resolution. Legislative Hearing Officer Marcia Moermond gave a staff report on the vacant building registration fee. She said it had been a vacant building since March 13, and this assessment was for the registration from March to March. She said the property owner was very short on funds, and she recommended approving the assessment and dividing the payment over 5 years. She said the property owner had gotten the code compliance inspection to facilitate the sale and rehabilitation of the property, and was concerned about impact of the vacant building assessment. She said it was a registered vacant building and fee waivers had been granted to that point. In opposition: Property owner Irwinna Mitsch said she had lived in the home since 1974 and raised her children there. She said she was selling the house and this was adding a lot of money to everything, and she would like to keep it down as much as possible. Council President Lantry clarified for Ms. Mitsch that Ms. Moermond's recommendation was to spread the assessment over 5 years, and any unpaid installments would come out of the closing statement. Councilmember Bostrom moved to close the public hearing. Yeas - 7 Nays - 0 Council President Lantry move to adopt Ms. Moermond's recommendation. She said Ms. Moermond had figured out a way to make it as painless as possible, but the City was out there doing the work and the assessment had to be paid.
