25 RLH FCO 15-75 Appeal of Will Anderson, for MFCA, to a Fire Inspection Correction
Notice at 374/376 MARIA AVENUE.
Marcia Moermond said she has some minor changes. They are basically the same
points but written more clearly. They will be asking that the Council look at this draft.
This has been in front of her and the Council for several months. Her first
recommendation was to deny the appeal. She has met with building owner,
business owner, city staff, visited the building several times, reviewed documents.
Different proposals have passed back and forth. She believes they have reached an
impasse as to whether or not there should be a drape or curtain over the door. She
is recommending the restaurant continue to use the mezzanine for 16 patrons as they
have in the past if these other conditions are met: lighting, alarm system, signs giving
directions, occupancy sign for the balcony. The rub is the curtain. When the drape
is up, people have to move around the drape or put it aside. One of the alternatives
is to use the adjacent commercial space and building something that can be used.
An alternate exit has been rejected by the facility. She has wrote that if they are to
use the balcony, they have to remove the drape. When coming down the staircase,
the door is right there. Councilmember Finney had made available STAR dollars to
assist in doing physical changes to the space. That still didn’t override their
aesthetics. Again, she is left with no other options. Her recommendation: allow 16
seats under the conditions she enumerated. Additionally, is a fuel burning equipment
test has not been done, but they were holding that in abeyance.
Steve Ubl, Building Official for the City, stated there is noncompliance in one area of
the building. The mezzanine exceeds the building code. The building code now
stated 5 occupants. It also means he has to reflect the intent of the code. He has
been out to the site a couple of times. The conditions he has put down were good
conditions to allow them enough time to get out. Another option: put in a early
notification system. They do have two required exits. One of the conditions was to
keep things clear and accessible to that door. The two primary exits are for the
occupants on the main level. He has a concern about responders. It has conditions
to allow more than 5 occupants.
Finney said he has been more than knowledgeable. He is seeking ways to mitigate
the needs of the City and the needs of the business and building owner to do what
they feel is profitable. The City has expended a great deal of effort trying to satisfy
them. We have extended, laid over, and made final decisions on this 5 times
(Legislative Hearing 2 times and 3 times for council). They are down to a curtain
issue. We have heard from the Legislative Hearing Officer, Building Official Ubl,
heard from DSI. In order for us to have a safe environment for customers and first
responders in case there is a emergency there, it is the obligation as a City to make
sure customers and clients know that when they go into a city business in Saint Paul
that their safety has been considered and that they have a good time and should the
worse happen they will survive that situation.
Finney made a motion to accept the recommendation of the Legislative Hearing
Officer.

26 RLH SAO 15-43 Appeal of Robert J. McCarthy to a Vehicle Abatement Order at 1356
JEFFERSON AVENUE.
Moermond showed a picture of a parking surface. When they discussed last, they
talked about the appellants request to use some other kind of surfacing and allowing
Class 5 in this space would be appropriate. The owner met with someone about river
rock. It is not a good surface when wet and less safe. The recommendation is to
grant the appeal and allow Class 5.
Councilmember Tolbert moved approval and said the recommendation is a good
new. Appellant is opposed to it. The Legislative Hearing Officer made the right
choice.

27 RES 15-1724 Celebrating Saint Paul District Councils' 40th Anniversary during
October 2015.
Council President Stark said the district councils is a 40 year system. It was unique
when it started. It is great to be here and celebrating the legacy.
Kristin Beckmann, Deputy Mayor, read the resolution.
Former Mayor Larry Cohen appeared and said it’s been a long time since he’s been
here. In the early 1970’s, the Council Chambers were full of residents trying to speak
out against some plan that the City deemed appropriate. By the time they learned
about something affecting their neighborhoods, it was too late to have input. Shortly
after he was Mayor, he appointed a committee on citizen participation. It was no
doubt that the citizens affected by the actions of the City were in an excellent position
to advise the Mayor. In 1975, the City Council adopted a resolution establishing the
district council system across the City made up of residents. Every Council would
plan for their specific area of housing, recreation, health, safety, and environment
protection. To assist with the rules, regulations, and complexities of government, a
citizen participation coordination position was created. The position was eliminated
along the way. He is happy that the position has been reinstated. Congratulations
on 40 years of participation in this great City.
Stark thanked Diane Wanner, District Council Coordinator, for organizing this event
and her work with district councils for several years.
Councilmember Thune said he was in City Council before the district councils were
created. He suggested the City increase the allotment to district councils. We have
been bleeding them for too many years.
Councilmember Bostrom said the district councils do a wonderful job. He thanked
Cohen.
Councilmember Brendmoen stated she came to the seat through the district council
system and through Childrens Home Society. By the time things get to the City
Council, a lot of it has been sifted through. There is much appreciation and happy
anniversary to them.

32 RES PH 15-291 Adopting the Gold Line Station Area Plans as an addendum to the
Comprehensive Plan, amending the Comprehensive Plan and the
Saint Paul Bicycle Plan, and decertifying the Sun Ray-Suburban Small
Area Plan.
A staff report was given on the gold line station area plan and rezoning. The gold line
is a bus rapid transit line, which would have five new stations in St. Paul and six in
the Union Depot. The RT is a fancy bus on its own road. The road would be built on
the north side of I-94.
(He showed several slides and explained them.)
They had the standard open houses, had small open houses, went to community
festivals, contracted the St. Paul Design Center for Sun Ray. They talked to
apartment dwellers, businesses, and single family homes. It’s a 69 page document.
It will take decades to change Sun Ray.
Eric Galatz, 1472 Raymond Avenue, representing owners of Sun Ray Shopping
Center, said he would like to reserve his comments until after the rezoning. Stark
responded he can wait until the next item.

Paul Sawyer, district council, said he will split his comments between the new items.
They are supportive of the stationary items. This need is to better connect to the rest
of the region. They see a lot of benefit in the stationary plans. There are lots of
barriers in the community to safely move by bike or foot. They understand this will
take a lot of time. This is where they want to see the district move. This is a strong
vision.

33 Ord 15-48 Amending the Zoning Map of Saint Paul as recommended by the Gold
Line Station Area Plans.
Mr. Dermody said this is the rezoning of 246 properties.
Eric Galatz stated he is not speaking in opposition. This is more of a friendly
amendment. Brixmor Property Group is not opposed to the plan as presented. They
are concerned about how the rezoning effects their property. This is decades off.
For decades, the shopping center will continue to be what it always was: a successful
shopping center. They provide important services to the community around them.
There are a lot of people employed there, and a lot of people shop there. They are
happy about the rezoning; it increases the types of uses for the shopping center. The
market study identifies the use as long term. In the short term, the commercial uses
are viable. The rezoning is immediate and permanent. The bus won’t stop there for
5 years. There will be decades before we see higher density development. In the
meantime, the strategy is to depress the value of permanent development and
discourage continuing maintenance development of this shopping center until the
market is ready to displace it with something new. It has been generous to allow
them to stay what they are indefinitely. Cub Foods is an example; Hy Vee is moving
into the neighborhood. If Cub Foods wants to rebuild, they will be doing that under
the new model. There have been exchanges with staff and councilmembers about
the generosity of the ordinance. They are concerned about requirements and
materials. With respect to height and density, will they be able to meet the
requirements. In terms of what they are asking for, it is simple: a proposed
amendment to the T4 district. Basically, they are asking them not to make this a
nonconforming structure. It is more than a matter of semantics. They are not asking
to be allowed to do anything different than the code is allowing them to do. They are
confident they can do what they do under the code, but they are fearful about being a
nonconforming use. The biggest concern is the period of time over this
redevelopment would happen. It is decades. During this time, they don’t want their
hands tied.
Paul Sawyer, District 1 Community Council, said they support the zoning changes.
They would like dense, mixed use. Development is going to happen. What is
important is they have acknowledged that it will be the largest transit center outside
the Union Depot. They can be flexible. Everything done on this site will move toward
that vision. Any incremental development, they want to make sure it is aiming toward
this new standard. They have set this as their vision and where they want to go.

35 Ord 15-49 Amending Chapter 34 of the Legislative Code, Minimum Property
Maintenance Standards for All Structures and Premises, to include
Outdoor Swimming Pools.
Ricardo Cervanes, Director of Department of Safety and Inspection (DSI), said there
was a tragedy on May 25 when 2 boys were trapped in a pool. One of them died.
That set them in motion examining the laws around pools. The State does not
inspect pools that are currently in use or licensed with the State. There was a memo
sent to Council that they would quickly respond to pools and come back with
regulation. 21 complaints were filed. Of those, the fire chief would pump out pools
that were abandoned. The Fire Chief pumped out 5 pools. DSI has responded to all
21 complaints. Within 21, there were 5 vacant buildings. Staff has looked at 29
cities. 11 of them were in the State of Minn. Definitions varied. They looked at how
other cities managed nuisances. St. Paul has a good ordinance to address these
issues.
Travis Bistodeau, Deputy Director to DSI, has 4 changes: definition of pool (24 or
more inches deep and surface area), the fence has to be maintained and
constructed, for out of service pools, if they are out of service for more than year, but
they cannot have stagnant water and be maintained. For nuisance pools, any pools
not currently maintained, lacking appropriate fence, lacking standing water, are out of
service.

Thao asked how are they tracking these pools. Travis responded they have been
tracking since the tragedy in May.

Councilmember Brendmoen stated it took a horrible tragedy to see this gap. She
thanked DSI.

38 Ord 15-53 Amending Chapter 157 of the Saint Paul Legislative Code pertaining
to parking for larger vehicles.
Tolbert stated he plans to lay this over for two weeks. The Council passed it a year
ago and there have been some unintended consequences. Councilmember Thune
and he are working on language and sat down with the attorney today for better
language.
Kim Hyers, Ward 2, spoke in favor of the current ordinance. She has one of many
images. (She showed pictures.) This is one of 3 trailers parked a couple of blocks
from her house. This spent the entire summer there in 2015. It was covered with a
tarp. When she called to have them taken care of, Parking Enforcement could not
tell it was moved. They would chalk the tire or put a penny on it, and these things
would be taken off. In a two block area, there were 6 to 10 trailers parked in violation.
She owns a travel trailer. When she bought it, she built a pad for it in her yard, which
cost about $200. It is not hard or costly. If you can afford a trailer, you can afford a
place to put it. She has never had to park it for more than 3 hours to load or unload
it. Parking Enforcement says it is unenforceable. They can’t tell if it was moved a
foot. This limits parking for residents. She considers this an eyesore. She does not
need to see it in front of her house. She is in favor or how it stands today. If it is
reopened, they should be careful in making it enforceable.
Carol Neumann, 694 Oakdale Avenue, said they have a tool to control what they
have to look at on the street. Up the street is a homeowner and drug dealer and car
repair guy. He does his car repair in the street. There are car parts everywhere,
grease, and oil all over the street. It is a danger for kids. He leaves jacks in the
street. This is a quality of life issue. Calling the police is not the answer because their
hands are full. So, she talked to DSI (Department of Safety and Inspections), who
said it was private parking. She was told to call the right-of-way supervisor. She
talked with him. He said there is a law, but she said she knew of the law, but no one
was enforcing it. These are all disconnected trailers. He came out and had a long
talk with one of the people. Parking Enforcement made a case with another person.
Another person got a ticket and eventually got rid of his trailer. If it hadn’t been for
the fellow that came from Public Works, the stuff would still be there. The trailer
issue effects the quality of life, the value of the house, the safety of the community.
The issue should be the same for everyone. If you have additional vehicles, you
should take care of them. The suburbs do not let their vehicles be parked on the
road like that. If the ordinance passes, there should be a cost of doing business on
the street. It takes up parking spaces. There should be a permitted system so they
only have so much time to be there.

Mark Eldridge, 1869 Iglehart Avenue, was ticketed for parking his boat trailer in front
of his home for an hour and a half. He thought he could put it out there for 24 hours
without a problem. Until the State Fair, his son had gone fishing the night before, he
disconnected the boat, and he came back and the parking guy was there writing a
ticket. He added on a two car garage to house his vehicles. Boat trailers are
registered by the state; boat tires have federal excise taxes and that goes to road
fees. Any vehicle that is licensed by the state should have the opportunity to park on
the street like any other vehicle.
Ryan Carlson, 1767 Eleanor Avenue, stated he started this possibly. He has a pop
up trailer that he leaves out on the street the night before when he leaves to go out of
town the next day. So, he goes to work on a Friday, comes home while it is packed,
and then leaves with it. (He showed a picture.) When he comes home from a

camping trip, he leaves it out to dry so it won’t mold. He does not have a slip in the
alley. The estimate would be $20,000 because he has to dig it into the hill. He pays
to store it elsewhere. He is looking for a change to the current ordinance so he can
dry it out overnight and pack it up. The picture here depicts it cannot open all the
way. He dropped it off after camping, ran his kids to a tennis match, came back after
20 minutes, and it was ticketed. He thought it was 24 hours. He is looking for a
change to the current ordinance, so he can park it there overnight so he does not
have to drive it to work in the morning and drive it back when he is leaving town.
Jason Noble, 755 Butternut Avenue, says he is in support of this. He is a boat
owner. He has parked it on the street since he bought it. It is not easy to park in
Saint Paul: alleys are small, driveways are small, driveways don’t fit them. He
looked at houses and none have a garage that fits a boat. There are people opposed
to trailers full of junk. If they are looking for a law to go after trailers and junk, it is
also going against pickup trucks driving down the alley picking up junk. It is not just
trailers. There are plenty of nice trailers and campers in Saint Paul.
Brendmoen asked is it on the street all year round. Noble responded he stores it.
Molly Noble, 755 Butternut Avenue, says she is in support. People in Minnesota live
here for access to outdoors. Being able to have a boat or camper and having easy
access--right outside your home--is important to enjoy the outdoors. The law as it
currently stands is to have a garage large enough or pay for storage. It seems like
an elitist law that discriminates against the average Joe. The way it is written now
that is has to be attached to a vehicle that can tow it means it will be basically driving
the boat to work, grocery store. That kind of thing puts wear and tear on the street.
They have a nice yard. To add a parking pad would ruin the aesthetic. That is not a
benefit to the City. They got two tickets in two business days. They didn’t know
about the law. In order to find storage, that is not enough time. They paid the
neighbor $100 to store it in their garage.
Tolbert said it is a hard thing for the police to enforce. They made a law that has
gone too far. Pulling out a boat the night before, giving them a ticket, does not seem
right. They are still trying to have a law for those people who are abusing the street
and leaving junk trailers out there. Laying it over for two weeks is better so they can
find a compromise. They are trying to accommodate everyone. The people this law
is for are not here.

39 AHPC 15-3 Public hearing to consider the appeal of the Central Presbyterian
Church to a condition of approval by the Heritage Preservation
Commission regarding one condition to restore and use metal ridge
caps at 500 Cedar Street. (Public hearing held on October 7, 2015.)
Amy Spong, Heritage Preservation Commission (HPC), reported that this church was
constructed in 1889. The building was listed on the national register in 1983. The
appellant is the church representatives. They came into the HPC on September 10
asking for a complete roof replacement. The HPC accepted a metal product that
conveys an asphalt shingle look. The commission accepted the materials, but did not
accept the decorative shingle to be on the ridges. The HPC said yes you can do the
metal product but there is a condition that they want the metal ridges to go back and
the peaks on the church. The appellant is appealing the one condition. They have
cited cost as a factor. The contractor was not available to talk about the ridges and
the shingle product. There is also new information that the HPC did not have. One
of the letters was sent to the Council. The shingle product cannot be installed with
copper or led ridging. That is a new issue that the commission has not seen yet.
They are able to do galvanized steel. There are still some questions that the
commission could not get answers to.
Councilmember Thune asked could this happen fast. Spong responded they could
discuss at the next meeting. They would not have to renotice this.
David Colby, 500 Cedar Street, said the church building is in the historic register.
They have been raising funds for four years and getting estimates. They have come
to learn that any appeal of HPC decisions can be heard by the City Council.
Because there are a number of length documents, they created one page.

Fluryanne Leach, representing the church, said Central has been working on the plan
to replace the roof for four years. (She showed a picture of the church.) It is a
complicated roof. Because they are on the national historic register, because they
care about their church, and because they share the values of the HPC, they looked
at various options to do something that would resemble the original materials, which
was slate. To replace the roof with slate was $3 million. They have only 225
members, so that is out of their reach. They looked at other materials. The lowest
estimate for synethetic slate was $702,000. The lowest bid for asphalt shingles was
$615,000. They are both well above the budget. After extensive research, they were
pleased to get a bid of $267,000 for the deca stone coated metal shingles. They
reported this estimate to the HPC. They were not asked to supply the paper
numbers to them. The deca materials are the most cost effective solution. They are
still attractive and becoming more common on churches in the Midwest. She
personally visited four churches that had these installed by the same contractor.

Councilmember Thune said these are still panels and he wonders about the rounded
edges. Leach responded she did not know. The contractor is not here to address
these conditions. They can’t use copper lead. The decra metal system is a system
of interlocking parts. When they reviewed the warranty, deca will not warrant the
shingles if they are not installed per the manual. They would like to use the system
the HPC approved. They are not able to do that if they are not allowed to use the
ridge caps. They have also not been able to get costs to address that.

Thune asked about the false start. Colby responded he will get to that. The bulk of
the conversation were the deca materials. If the Council approves the appeal, they
will complete the project as seasons allow. If the City Council denies their appeal,

Oke Onah stated he owned rental property at 1153 W. Central Avenue. The tax for
this property is killing him. It is a fourplex. He pays about $7,000 in property taxes.
After paying that, he started receiving right of way. Every year, he struggles to pay it.
It is yearly increasing. He does not make that kind of profit from his rental property.
All apartment buildings are not equal. It is impossible for him to raise rents. He was
asked why he doesn’t sell it, but everyone has their own philosophy. He has a
special type of clientele that gets satisfaction that he provides low cost rent. If he
sold the property, they would knock it down, and they would not be able to afford it.
The Council should reconsider the taxes he has to pay. It is increasing yearly. That
is why he is here.
Mike McGuire, 115 W. Plato Bolevard, business owner and property owner, agrees
with fellow that the taxes are killing him. Council President Stark responded there are
people in the room he can talk to. (A staff member gave him a card.) For 2016,
there will be a 2.5% increase. He asked why vendors get a 2% increase. Stark
responded this is about 2015. The reason for the increase in 2016 is to allow them to
do ADA compliant corners.
Mike Shuemann, 941 Dayton, said he and wife own a business. The right of way
assessment process is unfair to properties on corners. Your rule is any property on
the corner has to pay all the streets abutting that property. He pays the frontage on
Grant and frontage on Oxford. His property pays almost three times the right of way
assessment. Being on the corner, he has to pick up the entire freight for the
north-south streets. They are using it just as much as he. A friend owns a 12 unit
apt. building on the corner. He has no parking in front or on the side. He is paying
three times the right of way assessment of the same size apartment building next
door to him and it has parking in front of the building. Commercial properties should
be treated the same as residential properties. For adjusting, the middle of the block
would be increased by 5%. He pays about $30,000 in taxes a year. He is here out of
principal. If you go to one of the older parts of town, the right of way assessment is
half of their property tax bill. It should be consistent and fair. He doesn't mind paying
taxes, but they need to be fair.

Councilmember Stark explained the right of way fee. The sidewalks are on a 100
year cycle.
Councilmember Finney asked why is the same formula is not used for commercial
and residential. Stark responded commercial benefits more of the in and out access
of vehicles. That formula was created a long time ago.

Councilmember Bostrom said he is not sure if there is an advantage of a property
being on a corner.
Tolbert said no commercial lot owner would switch with an inner lot owner. Delivery
is easy. There is a huge advantage to being on the corner.

Marcia Moermond said this is a vacant building fee. Her interest is getting the
property into compliance. Half the year has been spent in the vacant bulding
program. She usually does not recommend deleting. Her recommend is to approve
the assessment.
Craig Gelderman, property owner, appeared at the Legislative Hearing on July 7. At
that time, Moermond said if he got the permits approved, she would be able to do
that. An inspector came out and found deficiencies. One was a dryer hose exhaust.
The work was completed. At that point, they found the gasket connected to the dryer
was not code. It took a while to get the plumber to come out and correct the
situation. The inspector came out this morning, looked at the work, and approved it.
He is waiting for the City fire inspector to come out tomorrow. The other work was a
hand railing. The biggest complaint is the lack of response from the inspectors.
Councilmember Bostrom moved to close the public hearing and adopt the findings. It
is past 6 months on this, so it is not realistic.

Council Meeting Information
The City Council is paperless which saves the environment and reduces expenses. The
agendas and Council files are all available on the Web (see below). Councilmembers use
iPads to review the files during the meeting. Using the iPad greatly reduces costs since most
agendas, including the documents attached to files, are over 1000 pages when printed.

Meetings are available on the Council's website. Email notification and web feeds (RSS) of
newly released Minutes, Agendas and Meetings are available by subscription. Please visit
www.stpaul.gov/council for meeting videos and updated copies of the Agendas, Minutes and
supporting documents.
Cable
Meetings are live on St Paul Channel 18 and replayed on: Thursdays at 5:30 p.m., Saturdays at
