Todd Hurley, Office of Financial Services, gave a staff presentation. This ordinance is granting a competitive cable franchise for Qwest Broadband Services, doing business as Century Link. The City negotiating team are all in attendance: Todd Hurley, representing the Administration; Trudy Moloney, representing City Council; Michael Reardon and Tarek Tomes, representing Cable and Technology; Geoffrey Karls, City Attorney's Office; Brian Grogan, Lawson Barnett, was outside counsel. The ordinance is a franchise for cable services in Saint Paul for Century Link. It is an identical franchise that is already in place with the incumbent Comcast. There are discounts for low income, seniors, disabled. If you qualify for one of several needs-based programs, then you would qualify for the discount. They are to provide internet training for seniors in Saint Paul. It does maintain the same customer service standards and same financial commitments. There are fees just as with Comcast. They are confident cable will be available for more than 60% of the City. It ensures Century Link will have an equitable build out through the City and in each ward. Staff recommends approval of this franchise. Councilmember Thune asked was this a transparent process. Hurley responded it was. (No one appeared to speak.) (File No. 16ROW FINAL) (Public hearing held November 4) Kathy Lantry, Director of Public Works, gave a staff report. This will be decided on the rest of the budget in December. The right of way fund maintains services in the public right-of-way: flushing, sweeping, enforcement of right-of-way, winter street maintenance, seal coating, keeping the overlay program continuing through the aggressive schedule put forward in 2014. As part of the overlay program--especially on the new street--they are proposed to raise the rate about 2½ percent. That will raise about $720,000 per year. That will keep them o pace with the overlay as they continue to do the curb cuts. Mike Schumann, 541 Dayton Avenue, he and his wife own Traditions Furnishings on Grand Avenue. He has talked to the Council about a dozen times. He is here because there are a small number of property owners where the assessment was unfair. The last time, the Council was going to take a look at it and fix it. They are here to authorize this and they are able to fix the way it is allocated for commercial properties and Downtown churches. He would like to encourage the Council to fix this once and for all. Ferdinand Peters stated he is here about properties he owns with his wife and a business. He bought properties on corners. He suffers the discrimination of having to pay more. That is the main thing he is complaining about. He has letters to provide. It is an assessment. All of these things have been covered by appeals to district court. He is waiting for the churches to be resolved. (He gave letters to Trudy) He hopes they provide change to the programs. Winston Nguyen and Diana Bowie (phonetic), 850 University Avenue, said they contested last year about assessment. They still pay over $5,000. This year, they have more assessments. They are over 70. They would like Council to reconsider. Every year they pay a lot. The property taxes are high too. They would like the Council to reduce 50%. (He gave Trudy a document) (No name.) Rates keep going up. House is not worth what they say it. Councilmember Brendmoen asked it is rental. Male responded it is a home. It was an apartment. building. Council President Stark said they are setting the rates for next year. Male stated he looked at his paper and it is up 3 to 4 times what it was. It went from $42 to $227. They have until now and December to decide. There is interest in having a Council work session. Bostrom said his heart goes out to those folks. Instead of waiting for something to happen, if they could request Public Works to equalize that. If there is a difference in the way this is laid out if there is a figure of what the change would be. City of Saint Paul Page 9 City Council Minutes - Final November 4, 2015 Stark said a few years ago, there was data on that: charging for primary side. Lantry said Public Works will work with OFS. They provide a service. Deciding what formula would be the Council’s decision. (Public hearing held November 4) Kathy Lantry, Director of Public Works, said Public Works and the Office of Financial Services asked the financial advisors Springsted to come forward with best practices on how to run a utility. The sewer system has many fixed costs, but the rates can also be dependent on the weather. The goal was to stabilize the fund. They have a $1 Billion dollar asset. They are trying to add some stability to the rates so they can continue to invest in that system. In 2016, storm sewer rates, 3½% inflationary increase, averages about $3 per year for the average customer; Sanitary Rates, $1 per month fixed rate fee, which is $12 annually; and a 3½% increase on the rate side for inflationary factors, which adds up to about $8 for the average customer. Councilmember Finney asked is it monthly. Lantry responded the fixed rate would be $12 annually, and the $8 is the actual annual cost.
