Najelnik appeared. The 2016 budget includes an increase. In December of last year, there was an increase in building and licensing fees. Whenever there is a zoning code change, it goes to the Planning Commission first. They recommend the amendments. The last time there was a zoning fee study was in 2010, and there was an increase in 2011. This is a 3% increase. (No one appeared to speak.) Bill Dermody, Planning and Economic Development, appeared. Subject site is on Hudson Road near I-94. (He showed a map.) It has been vacant for a while. The Planning Commission recommended denial for the request to zone for 3 reasons: 1) represents spot zoning, 2) not listed as transitional use to residential, 3) not consistent with comprehensive plan. Council President Stark asked if anyone would like to be heard on Item 25. Robert G. Wicker, 702 Wilson Avenue, appeared and said he is here to speak in regards to the denial of the right to rezone the property at 805 Hudson Road. On the average, there are 22 cars parked in the lot from Hudson to Bates on Wilson. There are 6 cars parked in the backyards. People do not have room to park their cars. If this man comes in with this type of usage, it will be in denial of all the other aspects. He’s going to have food trucks, he is going to have help, there is no way anyone can allow that to happen. There is so much traffic on that street, there is no place to put a car. When they went into 217-219 Bates Avenue, we promised the City Attorney 2 cars in front of that building. We cut all the grass on that block, shovel the snow, plant the grass, trim the hedges, and plant the hedges. (No one else wanted to be heard in opposition.) Those in support are next. Pat Nseumen, owner of 805 Hudson. He appreciates the comments. From a food truck perspective, there will be no food truck and vending in that location. The truck will be vending in Minneapolis and Downtown. In terms of the other comments, the property itself has been run as different businesses. This request is not to make a change. It is in the middle of a residential area. With the support of the neighborhood, it has been operating as different businesses. He got a sign off from the effected neighbors. One side is the freeway and the other side is the neighbors who have signed off. That should warrant something type of consideration. In addition to that, he has gone through the process of working with the City to get it out of the vacancy category. As part of that, he submitted a $5,000 check to the City as a deposit of guaranteeing that he is to fulfill the promise he has laid out. He is not bringing uses beyond what is already allowed. If anything, he is looking at improving the neighborhood and bringing jobs to the neighborhood. Those involved see this as a net benefit. He will deal with any issues that may arise. Councilmember Prince said he had indicated that the drive-through component would not need to go forward. Nseumen responded that was just one aspect. It was more to scoop up any traffic driving by. The drive-through is not a hard requirement. Thao asked how many parking stalls. Nseumen responded there is enough space for 4 to 6 parking spots. Thao asked was that without the drive-though. Nseumen resp that adds 3 more spots. Thao said it is right across from the highway. Does that have more impact on the decision? Staff responded the freeway does not factor into the Planning Commision decision, at least on the spoken record. It can impact the 3 findings, particularly spot zoning. City of Saint Paul Page 8 City Council Minutes - Final January 20, 2016 Prince moved to close the public hearing. 5 in favor, none opposed Public hearing is closed Prince met with Nseumen. She used to take her dog there to be groomed. She knows the area well. He met the petition requirements of his neighborhors. TN2 zoning is not the right zoning. His willingness to eliminate the drive-though, would automatically make it T1 zoning, although it does not include the use he wants to have there. She is excited about having a business in that area He met the petition requirement of his neighborhood. TN2 zoning is not the right zoning for that lot. Eliminating the drive-through would make it T1 zoning. She is going to recommend denying the rezoning, but she would like Nseumen to know that she has conversations with the planning staff. It looks like there may be other variance options that might allow him to put a business in that building. The unanimous vote of the PC and spot zoning does not get close to meeting the requirements of TN2 zoning. Prince moved to deny the rezoning and will work with Nseumen and planning staff. Stark said it is unusual to get a rezoning and get a denial from staff and the Planning Commission. Thao said this is a difficult vote. We need to support small businesses in the City, especially a start up like this. Spot zoning could lead to other things. He will vote in support of Prince to deny. He will pledge to help any way he can. If it does not work here, there is plenty of space in Ward 1. Prince said she is helpful they can make something work at this address. 5 in favor, none opposed Motion of Intent-Application is denied Motion of Intent - Application Denied Yea: 5- Councilmember Thao, Councilmember Tolbert, City Council President Stark, Councilmember Noecker and Councilmember Prince Nay: 0 Absent: 2- Councilmember Bostrom and Councilmember Brendmoen LEGISLATIVE HEARING ITEMS FOR DISCUSSION City of Saint Paul Page 9 City Council Minutes - Final January 20, 2016 34 RLH SAO 15-78 Appeal of Kanongyang Vue to a Summary and Vehicle Abatement Order at 948 BRADLEY STREET. Marcia Moermond, Legislative Hearing Officer, said this is an order to remove the disorder in the yard: boxes, buckets, and overflowing garbage containers. There are two concerns: 1) One is the condition of the yard. These things have to be properly stored. 2) Not allowed to have a commercial vehicle in a residential district. Her recommendation is to deny the appeal to keep the yard clean and the van removed. (She showed several photographs.) Kanongyang Vue said some of the boxes were ordered to be removed. Regarding the two containers, they are not allowed to open the cover. Minneapolis is allowed to be open. Moermond said in Saint Paul they need to be flat. These are consistently propped up. Vue said the containers are open. Every container in Saint Paul is open. If she is not allowed to open the containers, they can send someone to inspect everyone in Saint Paul area. Her trash delivery is every Tuesday. It is for the full weekend. Due to the large family, that is why it is kind of full. Every family on East Side with a big family as hers has a full container. I believe the last time they discussed the container, it was moved to the commercial truck. Councilmember Tolbert asked is the appeal about a fine or correction notice. Moermond said this is a Summary Abatement Order meaning if the orders are not complied with, the City will take action to correct. Tolbert asked has she complied with those orders going forward. If appeal is denied, all she has to do is not keep the bins out there and not have the truck in the lot. Moermond responded the remaining items is the tops being open and the panel vans being used there. Tolbert asked do you have a problem with not putting the truck in that spot and keeping the container the way the City has asked. Appellant responded she has already removed the boxes. She is requesting to let the truck load and unload on Friday. She is a single mom and she needs the business to help the family. Tolbert asked about using it to unload and load is not the problem. Moermond responded it is a commercial vehicle used in a residential area. Council President Stark said this concern has been brought to him about the Hmong farmers association in general for allowing truck to be allowed during the growing season. There may be a change in the future. Councilmember Thao asked does the commercial truck include tow trucks. Moermond responded yes. Thao asked is she recycling. That may help with some of the boxes. (Thao spoke in Hmong to the appellant.) Stark asked for clarification on what Thao said. Thao responded that he asked about recycling and that commercial vehicles cannot be there. If he allowed her to have it, they would set precedent. City of Saint Paul Page 10 City Council Minutes - Final January 20, 2016 Vue said she is willing to take any recommendation from the Council. She is happy to hear about the farmer program. The driveway is large enough for the truck. She would like the Council to look at that space and see if it is big enough. If Thao could help her work this out, if he could show her business places could park, that would be fine with her. Councilmember Noecker said she got a letter from Open City. She asked if there something that could have been done earlier. Appellant responded she first received a letter that made her worry about that which is why she saw her doctor about this matter. Stark said we will make a decision. Thao will help find a spot for the truck in the future. We can stay in touch about allowing farm vehicles in residential areas in the City. We don’t want to allow any commercial vehicles to park in the city, but maybe we can exempt family use farm vehicles. Councilmember Prince moved to close the public hearing. 5 in favor, none opposed Public hearing is closed Tolbert said we will uphold the recommendation of the Legislative Hearing Officer with the understanding that there are a number of things to work out. Thao asked should there be a time line to figure out a solution. He would need time for a temporary space and work with the family. Prince said at the present time the vehicle is not there. Stark said they bring it in during the growing season. It is stored out at the farm in the winter. There is an issue for the growing season, but it is not immediate. Moermond said she will make sure everyone has information. Prince said she will help in any way. It is probably not a big change to the ordinance. 5 in favor, none opposed Resolution is adopted Adopted Yea: 5- Councilmember Thao, Councilmember Tolbert, City Council President Stark, Councilmember Noecker and Councilmember Prince Nay: 0 Absent: 2- Councilmember Bostrom and Councilmember Brendmoen City of Saint Paul Page 11 City Council Minutes - Final January 20, 2016 56 RLH SAO 16-1 Appeal of Eng Tat Ng to a Summary Abatement Order at 558 GROTTO STREET NORTH. Marcia Moermond, Legislative Hearing Officer, said this is also a Summary Abatement Order. There is rudimentary teepees with plastic. There are concerns for a number of reasons. The purpose of the parcel is an art installation. If this were to be accepted, any of these structures would be an accessory structure. This is an empty lot, so there is no primary structure to be associated with. This is a fire hazard. The items constitute a nuisance condition and should be abated. The storage would not be allowed in the outdoors. According to the fire marshall, it is way too large. The initial intention is to use it for fires. Her recommendation is to deny the appeal and require the timbers, plastic to be removed immediately, more time for straw and other things frozen to the ground Eng Ng said she rented the land. She decorated the art on the land itself. The teepee was taken down and vandalized by the neighbors. (Ng showed his cell phone on the overhead.) Ng said it does not look bad at night. The City complained about the structure. Those are removed. The Fire pit is decorative. It is just a rock around the land. If you build a fire pit, you have to get it approved by the fire marshall. It is not that big. You can see the teepee. The City complained about those fire hazards. That teepee wrap is just decorative. Anita Hollman leased the property. At first, she started her art project. She didn’t have a concrete idea. removed everything that was not acceptable. This art is for invitation, family, and community for events about sustainable growing. Thao asked does she have a current photo. Hollman said it is not too clear. Those are removable plastic covers for the teepees. (Hollman showed two photographs.) If they remove the hay, asked Councilmember Thao, is that in complaince with the request of the fire department. Moermond responded no. The plastic sheeting is combustible and can take flight and be a hazard. The timbers are not helpful. It is not a structure. It is boards supporting one another. It does not have footings. It is not stable. That is a concern. The photo on the phone looks like all is taken care of except timber and plastic sheeting. Thao asked what kind of materials they should use. Council President Stark responded people should not walk away with half of it. There are people that can talk to you about art that would pass muster. We can’t allow anything to go up on a piece of property and call it art. There are materials and types of temporary structures that are acceptable. This structure itself is not a real structure. She can talk to DSI about what is allowable. Hollman said she cannot remove everything from the yard. Marcia Moermond said this is a Summary Abatement Order issued with a 6 day turnover for these items to be cleaned up. The tire needed to be removed. There is a videotape. (Photo shown) (Video shown – no audio) Moermond said her recommendation is to approve the assessment for the cleanup. It is $518. A lot of that is the tires. They have charged a lot for cubic yard. Joe Schmidt said he did own it and never saw that video where they showed the dumpster. He ordered a dumpster. He cleaned up a lot of it. That was back in June. He picked up stuff. He didn’t know if the tires were hers or someone else’s. He put it in the pile. It was stacked nice and neat. It got mailed January 31, and he did not receive it until that Wednesday. He called and ordered another dumpster. The video showed the dumpster. The document he has shows the delivery of the dumpster. The dumpster in that video is empty. It showed up the next day to take care of it. It was gone. Then he got the notice . He didn’t understand what was going on. If they gave him two more days, how is he supposed to get it done? He already had the tires taken care of. For him to have to pay for this, he bought the dumpster for this purpose. It is beautiful property. He put it all in one location. He was disapppointed when he got the bill. He spent $10,000 on the brick. He got this letter and took care of it right away. Noecker said he ordered the dumpster as soon as you got the notice. Schmidt said he had workers there, but they got there before his crew. Noecker said it was clear from our letter when it needed to be cleared up by. Schmidt responded it was 5 days. Moermond said the date of the order is July 21. The deadline is August 5. The cleanup crew showed up Friday, August 7. Schmidt said he doesn’t understand why they didn’t see that the dumpster was there. They can’t assess on the site what someone intends to do. Noecker responded the timing seems strange. On another case, we’re giving until April for some materials. Moermond explained: there is an opportunity to appeal the order and look for a different date. Another opportunity is to call the inspector and tell him you will be taking care of it.
