Adopted FOR DISCUSSION 15 RES 16-187 Appointing McGrann Shea Carnival Straughn & Lamb, Chartered as special counsel, and approving the Agreement for Outside Counsel Services between the City Attorney's Office and McGrann Shea Carnival Straughn & Lamb, Chartered. Councilmember Noecker said she had questions about where the $75,000 was coming from and whether a ceiling had been set on the predevelopment budget for the stadium, and she asked for a one week layover to have those questions answered. Councilmember Tolbert asked if there would be a staff report and whether the information had been requested from the Office of Financial Services (OFS). Councilmember Noecker said OFS would brief her prior to the next meeting. Councilmember Prince said she also had questions she would share with Todd (Hurley, OFS Director) one of which was that it was dated back to October 2015 and she was curious as to why the Council was just approving it now. Councilmember Bostrom questioned whether the action was premature given the City didn't have site control of the property yet. Council President Stark said it was his understanding that they had already started work, because there was already budget identified for it, and this was just a question of acknowledging the agreement, and the timeliness of the resolution was a valid question. Councilmember Noecker moved to lay the matter over for one week. Laid over to February 10 Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, Councilmember Thao, Councilmember Tolbert, City Council President Stark, Councilmember Noecker and Councilmember Prince Nay: 0 18 RES 16-204 Honoring John Maczko's City Engineer of the Year award and his commitment to serving Saint Paul. Council President Stark congratulated John Maczko on being recognized as the City Engineer of the Year in Minnesota, and acknowledged his work on the Green Line. Councilmembers Tolbert, Prince, Thao, and Bostrom expressed their thanks and appreciation for Mr. Maczko's dedication and work. Mr. Maczko made brief comments. Councilmember Stark moved approval of the resolution. Adopted Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, Councilmember Thao, Councilmember Tolbert, City Council President Stark, Councilmember Noecker and Councilmember Prince Nay: 0 City of Saint Paul Page 4 City Council Minutes - Final February 3, 2016 19 RES 16-202 Requesting that the Human Rights and Equal Economic Opportunity Commission convene a task force to recommend a proposed ordinance that requires earned sick and safe time for workers in Saint Paul. Council President Stark thanked Councilmembers Thao and Tolbert for their leadership, and the other council members and Administration for their support. He said there was an event following the Council meeting to provide the opportunity for further discussion. He said the resolution was the starting point for setting up a task force, and applications to serve on the task force would be coming out shortly. Councilmember Brendmoen said she was pleased that North End business leaders she had spoken with had expressed interest in being part of the task force in spite of having some concerns, and she looked forward to hearing more comments. Councilmember Prince stressed the importance of reaching out to neighborhood business associations and locally owned independent businesses, who were the ones who would be impacted by the legislation. Councilmember Tolbert moved approval. It is read at four separate council meetings and becomes effective after passage by the Council and 30 days after publication in the Saint Paul Legal Ledger. Public hearings on ordinances are held at the third reading. First Reading 20 Ord 16-2 Amending Chapter 409 of the Saint Paul Legislative Code to prohibit the issuance of Consumption and Display Permits. Laid over to February 10 for second reading City of Saint Paul Page 5 City Council Minutes - Final February 3, 2016 BUDGET AMENDMENT PUBLIC HEARINGS 21 RES PH 16-11 Establishing the financing and spending budgets in the Department of Parks and Recreation in the amount of $205,000 for Metropolitan Council Clean Water, Land, and Legacy Amendment projects, detailed below; and accepting grant funds from the Metropolitan Council and through the Clean Water Land and Legacy Amendment funds through the Parks and Trails program. No one appeared in opposition; Councilmember Thao moved to close the public hearing and approve the resolution. Adopted Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, Councilmember Thao, Councilmember Tolbert, City Council President Stark, Councilmember Noecker and Councilmember Prince Nay: 0 22 RES PH 16-30 Accepting $13,255 from Arts-Us for facility upgrades at the Dunning Recreation Center and authorizing the Department of Parks and Recreation to establish a financing and spending plan of $26,510 for the Dunning Recreation Center Star Grant improvement project. No one appeared in opposition; Councilmember Thao moved to close the public hearing and approve the resolution. Council President Stark said the Parks Department had requested that the resolution be withdrawn and would bring a replacement forward at a later date. Withdrawn Council members shared good news from their wards. Prince 24 RES PH 16-26 Approving the application of Carol March, c/o Public Kitchen and Bar LLC for a sound level variance in order to present amplified live music on Saturday, March 12, 2016 during the Luckytown Public Kitchen Event on 6th Street between Wacouta Street and Sibley Streets by Mears Park. No one appeared in opposition; Councilmember Noecker moved to close the public hearing and approve the resolution. Josh Williams, Planning and Economic Development (PED), gave a brief staff report on the process and plan. Kris Harkness (1482 Midway Parkway) spoke in support of the process and the plan. Councilmember Brendmoen said she enjoyed watching the process and appreciated being able to use the community's perspectives and values to set her own priorities as a council member. She thanked Ms. Harkness and ted Blank for their leadership. She said she looked forward to moving ahead on the plan with District 10. No one appeared in opposition; Councilmember Brendmoen moved to close the public hearing and approve the resolution. (File No. J1604A, Assessment No. 168503; amended to File No. J1604A1, Assessment No. 168520) (Public hearing continued from February 3) Legislative Hearing Coordinator Mai Vang said this had been a no-show legislative hearing, and no one had appeared for the rescheduled hearing. She said the Legislative Hearing Officer's recommendation was approval of the assessment. In opposition: Tenant Denisha Simmons said she had received two notices in the mail stating that the City had picked up a bed and then some garbage. She said her landlord was charging her for the charges, but the stuff was never picked up and she removed the items before the City picked them up. She said she worked from 6:00 a.m to 6:00 p.m. and wasn't able to get off work to attend the legislative hearings, but had taken time off that day because it was very important to get the issue resolved. Council President Stark asked whether the items were hers. Ms. Simmons said there was a twin-sized bed that she'd taken a picture of that day, and an extra garbage container that hadn't been picked up when the garbage vendor had changed hands and a new container was dropped off. She said she didn't know what she was expected to do with a company garbage can. Ms. Vang said there was a video of the clean-up, and the orders were for clean-up of overflowing containers and bags on the ground. The video was shown. Ms. Simmons said the garbage man didn't come for two or three weeks and she didn't know what she was supposed to do with her garbage. She said if the landlord had received notification he should have let her know, and the old garbage can should have been removed promptly when the company changed. Council President Stark asked whether that issue had been resolved. Ms. Simmons said it had been resolved and the extra garbage container had been picked up, either by the company or the City. She said she couldn't afford the $500 and was trying to comply with the City and her landlord but didn't feel she had been at fault. Councilmember Prince asked that the matter be referred back to Legislative Hearings and the public hearing continued to March 2. Ms. Simmons said she had a picture of a twin mattress she had removed herself. She was trying to move by March 31 and couldn't move if she owed the landlord anything. She asked how soon there could be another hearing. Ms. Vang said it would go back to Legislative Hearing on February 16 at 9:00 a.m., and the public hearing would be March 2. Ms. Simmons said it was hard for her to get off work but she was trying to get the days right so she could attend the hearing. Councilmember Prince moved to continue the public hearing to March 2. Ms Vang said Item 46 was for the same address. Ms. Prince said she would take the same action on that item. In response to a question from Councilmember Brendmoen, Ms. Vang clarified that the summary abatement orders went both landlord and property occupant, but the assessment just went to the owner. Councilmember Brendmoen said this was a dispute between the landlord and tenant.
