Council President Stark said they had laid the item over a couple of times and now
had a more concise and well-toned set of comments. Councilmember Prince
recognized two young women present who had just biked from New Orleans to Lake
Itasca along the Mississippi River. She expressed appreciation to staff in pulling
together a consensus in comments.
Councilmember Tolbert thanked Josh Williams from Planning and Economic
Development for all of his work. He said there were a lot of interest groups and
interested parties, who all worked towards balance and consensus.

Councilmember Prince invited the delegation from RS EDEN to the podium.
Councilmembers Prince and Noecker made brief comments commending the group
for their service. Councilmember Prince introduced the participants present.
Representative made brief comments about RS EDEN and their service learning
project, and thanked the Council for their support.

43 RES 16-1148 Receiving the Department of Safety and Inspections and the
Department of Planning and Economic Development study on AirBnB
and similar companies' operations in the City.
an Niziolek, Department of Safety and Inspections (DSI), gave a staff report. He said
their recommendation for next step was to to assemble a workgroup representing
host platforms, hosts, hospitality industry, Visit St. Paul, and City staff to develop
specific language for recommended policy changes, and develop recommendations
for the Council’s consideration in the next 120 days. In response to questions from
Council President Stark, he said non-owner-occupied properties would be regulated
using Fire Certificate of Occupancy. He said one issue they struggled with was the
rental of owner-occupied condominiums, and that was one where they would need to
tweak the language a bit to ensure they were covered.
Councilmember Bostrom said it could be an intrusion on neighborhoods, and he
asked whether density would be regulated. Mr Niziolek said some cities had looked at
density, but DSI didn't envision looking at it currently. He said they were not seeing
an issue now but would monitor it. Councilmember Bostrom said they should be
aware of the potential for a large concentration.
Councilmember Noecker asked for clarification of the action is being taken by the
Council. Council President Stark said his interpretation was that the Council was
accepting the recommendations and next steps as part of the study, but they could
vary that. Councilmember Noecker said she appreciated the study but had concerns
about next steps. She said she wasn’t convinced this needed to be regulated right
now, and she had a lot of concerns about enforcement, costs for regulation. She said
she had seen the items on DSI’s work plan for 2017-17 and didn’t feel this was top
priority right now.
Councilmember Prince said she shared those with concerns, and she noted that the
item did say they were receiving the study and but didn’t say adopting the
recommendations of the study. Council President Stark said that was true, but the
recommendations were in the study. He said the Council could choose how much to
accept.
Councilmember Tolbert said he respectfully disagreed. He thanked Mr. Niziolek and
the Right Track intern who had assisted. He said Airbnb and VRBO were great
assets but were growing and needed regulation. He said renting houses to different
groups every day presented potential problems that the City should get ahead of. He
said there were also fairness issues for Bed and Breakfasts, and hotels which played
by a different set of rules. He said this didn’t have to be done immediately but was
something they should start considering in the City as they had with other areas
where technology met the old school way of doing things. He said with large events
coming and not enough hotel rooms, this could be a lucrative business for residents.
He said this did not require a lot of resources and a lot of work had been done
already. He moved to accept the report and move forward with the recommendations.
Council President Stark said he would speak in support of the motion. He said there
was not a lot of activity yet but he could see that changing quickly with something like
the Super Bowl. He said St. Paul wasn’t a tourist destination but it was still a good
idea to get ahead of it, and he noted that one of the recommendations was to have
short term rentals be an allowed use where it currently wasn’t. He said this wasn’t
further restricting the activity but calling it out and saying it was allowed and stating
the circumstances under which it was allowed.
Mr. Niziolek said regarding staff and resources, DSI would be licensing the host

websites and not individual properties.
Councilmember Bostrom said as he understood it, DSI was bringing back
recommendations in 120 days for the Council to act on, and this item didn't approve
anything. He said in that case he would support the motion.
Councilmember Noecker said there was a risk of trying to solve a problem that
doesn't exist and coming up with the wrong solution, and it would be better to
address problems quickly as they presented themselves. She said she understood
this was just asking for a report back in 120 days, but everything was a cost in time
and resources and she didn’t think they should spend any amount of time on it.
Councilmember Prince said she was leaning towards supporting the motion. She
asked how the work group would be assembled, and whether the Council would be
able to make recommendations. Mr. Niziolek said they would be open to that. He said
having the right people at the table would get the best outcome. Councilmember
Prince said she was struggling with this in terms of the priority, and the fact that
Minneapolis hadn't taken action yet. She said on the other hand she was hearing
Councilmember Tolbert’s feeling like this was a pressing issue, and like it was more
of an issue in Highland than on the Eastside. She said would make a leap of faith and
move this along to the next 120 days, and hope it didn’t become a drain on staff time,
with so many other important issues facing DSI.
Councilmember Bostrom said this reminded him of the process leading the
development of the Certificate of Occupancy program, in which it was rescinded after
complaints from landlords but reintroduced six years later when there were problems.
He said this gave the City a leg up.

83 RLH RR 16-15 Ordering the rehabilitation or razing and removal of the structures at
1325 ARKWRIGHT STREET within fifteen (15) days after the July 6,
2016, City Council Public Hearing. (Amend to remove within 15 days
with no option for repair)
Legislative Hearing Officer Marcia Moermond gave a staff report. She said the appeal
involved a proposal to remove a property following a fire that had occurred about two
years before. She displayed a photograph of the house. She said one of the owners
had expressed an interest in rehabilitating but didn't have the resources, and, in
addition, the City had been maintaining the property for two years. She said those
things together made the property a bad candidate for a grant of more time for
rehabilitation. She said there were a couple of layovers Legislative Hearings to try to
marshal resources either for rehab or towards long term housing needs. She said the
attorney for the appellant had discovered that there was a small amount of insurance
money, in the $30-$40,000 range. She said requirements of a building-only code
compliance inspection, a performance bond, real estate taxes, and proof of financing
hadn't been forthcoming, and the insurance money wasn't adequate for rehab. She
said the other issue was the length of time this nuisance property had remained in an
otherwise healthy neighborhood. She recommended ordering removal of the property
with no option for rehabilitation. She noted that the next item on the agenda was a tax
assessment for unpaid vacant building fees, and said if the Council voted to order
removal she would recommend deletion of that assessment.
In opposition:
Daniel Saley, Southern Minnesota Regional Legal Services (SMRLS), said he was
surprised that demo was being considered given that there hadn't been a push to do
anything in the last two years. He said since the abatement order, Ms. Matodi had
retained an attorney, cleaned out the property and kept it maintained. He said the
insurance money might well be adequate to make the property livable. He said he felt
it was premature to go to demolition of the structure.
Ms. Moermond read from a letter regarding the conditions and set during the
Legislative Hearing. made significant progress in the previous six weeks and he felt
they were doing everything they could to move this along. Council President Stark
said he thought they should hear from Ms. Matadi. Mr. Staley said Ms. Matadi was
arrested by police officers a couple of weeks prior when she was trying to clean her
home.
Property owner Florence Matadi said she was surprised she had to be present since
she was doing everything possible to clean and maintain the house. She said she
had spent money on a dumpster and couldn't afford it. She said people from church
and the lawyer were helping her out. She said if they wanted to demolish the
property, why did they have her working day and night cleaning out the property. She
said she could maintain it and do the remodeling, and she asked the Council to
reconsider and let her do what she could with the help of her lawyer and others. She
said she didn't want her work to go in vain.
Mr. Saley said the additional insurance money went to pay the liens on the property,
so the house was free and clear, and it would be easier for Ms. Matadi to pay the
back taxes.
Council President Stark said the things required were to make sure the rehab would
be successful. He said the worst outcome would be for more resources to be
invested, but the work not completed and the demolition have to take place anyway.

Councilmember Brendmoen said the property was in very bad condition, and she felt
the better course of action was to raze and remove, and use the insurance to move
forward. Mr. Saley said the insurance money could only be used for repairs.
Councilmember Brendmoen moved to close the public hearing. Yeas - 6 Nays - 0
Councilmember Brendmoen said it was compelling to have Ms. Matadi present, but
she (Councilmember Brendmoen) had had her eye on the property for a long time
and a lot of neighbors had complained about it for two years. She said it was hard to
hear Ms. Matadi ask for more time because in the two years Ms. Matadi had done
nothing on the property, the neighbors had lived next to a burnt out house.
Councilmember Brendmoen said she wanted to make sure Ms. Matadi understood
what was going on and what sort of resources she had, and Ms. Moermond also had
laid the matter over to ensure that happened. She said if two more weeks would allow
Ms. Matadi to get her ducks in a row and determine for sure whether or not she could
meet the requirement she would make that motion, but she was afraid this property
was doomed to be razed and removed.
Councilmember Bostrom said this was a situation where the Council could approve
the resolution and bring it back if the appellant came back with information.
Councilmember Brendmoen said that was reasonable, and she moved to adopt Ms.
Moermond's recommendation.
Councilmember Noecker asked for clarification of what was being asked of the
appellant. Ms. Moermond said if the City received a performance deposit, taxes, and
request for Code Compliance inspection by July 20 she would set up another
Legislative Hearing. She noted that the performance deposit and taxes would take an
$11,500 bite out of the available money.
Council President Stark asked if it would come back before the Council in that case.
Ms. Moermond said she would draft a stay of enforcement of the order to raze for the
COuncil to consider. In response to a request from Ms. Moermond for confirmation of
the procedure, Deputy City Attorney Gerald Hendrickson said they would just have to
see where the situation was in two weeks and Ms. Moermond could bring it back in if
there was compliance.

denial by the building official a fence permit to add height to a fence. She displayed
photographs of the existing stone retaining wall/fence and of the corner property and
intersection, and said within that proximity to a corner, the fence could not exceed its
current height. She said if it were a fence that could be seen through it could
sometimes work but that is not the case here. She said John Maczko from Public
Works had also looked at the corner property and proposal, and recommended
denial of the permit. She recommended denial of the appeal. She answered
questions from Council members Brendmoen and Noecker.
Michelle Mick, property owner, spoke in opposition to the recommendation.

90 RLH VO 16-23 Appeal of Daniel Furlong to a Fire Certificate of Occupancy
Revocation and Order to Vacate at 880 CLARK STREET.
Legislative Hearing Officer Marcia Moermond said she thought they'd reached
resolution on this before; so she would restated the report for the record. She said
this was revocation of the Fire Certificate of Occupancy due to long term
non-compliance with orders. She said a number of the issues on the revocation list
were critical life safety items and had been addressed. She said she had requested a
work plan for the balance of the items, and it was which was developed and
submitted. She said she had given a deadline of July 22 for compliance because of
the long period of time the inspection process had gone on.

Dan Furlong (16788 Ides Circle, Lakeville), property owner, spoke in opposition to the
recommendation. He asked for a September deadline.

In response to a question from Councilmember Noecker, Ms. Moermond clarified that
Mr. Furlong was asking for an extension to September for major items that required a
contractor, and she was hesitant to give more time because the orders were old. She
said the tenant was present at the Legislative Hearing and was aware of her
contribution to the problems and need for corrections.
In response to a question from Council President Stark, Mr. Furlong clarified which
items he needed more time for. He said he was not a handyman, was working two
jobs, and had been unemployed for a long time. Council President Stark said three
months was a long time.
Councilmember Bostrom said this had gone on long enough, and he noted that in
photographs from February the property looked rough. He said he would like to see
current photographs before he’d be comfortable granting a long extension.
Councilmember Brendmoen said the deadline was still a few weeks out. She asked
for clarification of what the Council was voting on, and whether and when the
property needed to be vacated. Ms. Moermond said this was a revocation of the
Certificate of Occupancy, and if there wasn’t compliance by July 22, the vacate date
was July 25. She said the Council had other options available to gain compliance
besides revocation and order to vacate.
Councilmember Brendmoen moved to adopt Ms. Moermond’s recommendation.
Council President Stark said that was reasonable. He said there’d been a fair amount
of time given to comply. He said if Mr. Furlong got most of the stuff done and needed

Legislative Hearing Officer Marcia Moermond gave a staff report on the vacant
building assessment. She said the Certificate of Code Compliance had been issued
the previous week and her recommendation was to reduce the vacant building fee by
half. She said the owner wanted to argue for an additional reduction.
Lingling Fung said the house was in very bad condition when they bought it and they
spent a lot of money on it. She said a lot of contractors had signed a contract but left
before completing the work, and she misunderstood and thought the work was all
done. She said the central air conditioning unit was stolen and they were hesitant to
get another because they were afraid it would be stolen again. She said the house
had been sold, and the price didn't cover their costs. She said she wanted the City to
understand they tried to do their best, and would like the fee to be waived.
Council President Stark moved to close the public hearing. Yeas - 6 Nays - 0
Council President Stark said in Councilmember Thao’s absence, he understood the
situation but the issue was that the property was vacant for part of the year and City
incurred costs overseeing the property. He said essentially what Ms. Fung was
asking was for the other taxpayers to subsidize her situation. He said for that reason
he wouldn’t support a further reduction.
Councilmember Bostrom said he thought that was reasonable. He said it wasn’t as
though it wasn’t in the vacant building program, and , traditionally, if this happened at
the first of the year, the bill would have been due and payable whether they got it
done in two months or eight months. He said he thought this was a fairly generous
offer to help them through a difficult time.
Council President Stark moved to adopt Ms. Moermond’s recommendation to reduce
the assessment by half.

The City Council is paperless which saves the environment and reduces expenses. The
agendas and Council files are all available on the Web (see below). Councilmembers use
iPads to review the files during the meeting. Using the iPad greatly reduces costs since most
agendas, including the documents attached to files, are over 1000 pages when printed.
