Approval of the Consent Agenda Councilmember Thao moved approval of the Consent Agenda. Adopted 2 RES 17-328 Approving the Release from Liability Agreement between the City of Saint Paul and Amy Elizabeth Krekelberg and her attorneys Sapientia Law Group, PLLC & Sieben, Grose, Von Holtum & Carey. Adopted City of Saint Paul Page 1 City Council Minutes - Final February 22, 2017 3 RES 17-339 Approving the City of Saint Paul Continuity of Government (COG) Plan as the official city directive describing how the city government will continue essential operations in the event of a serious disruption. Adopted 4 RES 17-230 Preliminary Order setting a date for the City Council public hearing on March 15, 2017 to consider approving the reconstruction of the I35E Trail between St. Clair Avenue and Grand Avenue. (File No. 19226, Assessment No. 175209) Adopted 5 RES 17-335 Approving the Mayor’s appointments of Derek Anders-Turner, Kaylan Punsack, Mustafa Hassan Diriye, and Juliana Wilkins; and reappointment of Jeremiah Ellis to serve on the Neighborhood STAR Board. Adopted 6 RES 17-239 Approving a limited use permit with the State of Minnesota Department of Transportation for a bicycle and pedestrian trail in the right-of-way of Interstate 94 at Pelham Boulevard. Adopted 7 RES 17-214 Amending RES PH 16-341, 2017 Sanitary Sewer and Storm Rates, to establish new fees for 1-inch single family dwelling accounts that are equal to those of similar accounts. Adopted 8 RES 17-296 Approving a Liquor Outdoor Service Area (Sidewalk) license with conditions for New Bohemia St Paul, LLC, d/b/a New Bohemia Wurst & Bier Haus (License ID #20160003866) at 222 Seventh Street West. Adopted 9 RES 17-331 Approving the extension of the 2016 Performance Agreement between the Saint Paul Neighborhood Network and the City of Saint Paul through April 30, 2017. Adopted City of Saint Paul Page 2 City Council Minutes - Final February 22, 2017 FOR DISCUSSION 10 RES 17-300 Celebrating Rick Cardenas on the occasion of his 75th birthday, and recognizing his extraordinary contributions toward a better Saint Paul. Councilmember Noecker invited Rick Cardenas to the podium and said it was a pleasure to present the resolution on behalf of Councilmember Prince and herself. She read the resolution. Mr. Cardenas made brief comments. Council President Stark expressed appreciation for Mr. Cardenas’ many years of activism to St. Paul. Councilmember Prince said she had attended Mr. Cardenas’ birthday party and there had been a great cheer after each “Whereas” of the resolution as it was read. She said it was an astonishing list of things where Mr. Cardenas had made a great difference, and they were so grateful. Councilmember Noecker moved approval of the resolution. Adopted Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, Councilmember Thao, Councilmember Tolbert, City Council President Stark, Councilmember Noecker and Councilmember Prince Nay: 0 ORDINANCES An ordinance is a city law enacted by the City Council. It is read at four separate council meetings and becomes effective after passage by the Council and 30 days after publication in the Saint Paul Legal Ledger. Public hearings on ordinances are held at the third reading. Final Adoption 11 Ord 17-3 Amending Chapter 61 of the Legislative Code pertaining to Zoning Fees. Council President Stark moved approval. Adopted Yea: 7- Councilmember Bostrom, Councilmember Brendmoen, Councilmember Thao, Councilmember Tolbert, City Council President Stark, Councilmember Noecker and Councilmember Prince Nay: 0 City of Saint Paul Page 3 City Council Minutes - Final February 22, 2017 First Reading 12 Ord 17-4 Repealing Chapter 50 of the Saint Paul Legislative Code pertaining to Individual Sewage Treatment Systems in its entirety and replacing it with new Chapter 50 language pertaining to Subsurface Sewage Treatment Systems. (To be withdrawn.) Laid over to March 1 for second reading ADJOURNMENT Councilmember Tolbert moved adjournment.
