Passage Conservancy, and if approved, accept the grant, and enter into
agreements with the Saint Paul Foundation as are necessary to accept
the funding.

47 RES PH 17-191 Approving adverse action against the the Liquor On Sale - 100 seats or
less, Liquor On Sale-Sunday, Entertainment B and Gambling Location
licenses held by Midway Enterprises, LTD d/b/a Hot Rod’s Bar & Grill
(License ID #0016294) for the premises located at 1553 University
Avenue West in Saint Paul.
Therese Skarda, Assistant City Attorney representing the Department of Safety and
Inspections (DSI), gave a staff report on the license condition violations related to
required security personnel and producing video surveillance within 48 hours. She said
the licensee admitted to the violations but requested a public hearing to dispute the
penalty. She said the licensee had met with DSI staff and police in May to discuss
their security plan. She reviewed previous violations and penalties. She said DSI was
recommending a $2000 penalty and 10 day license suspension, as this was the third
violation in 18 months. In response to request for clarification by Council President
Stark, Ms. Skarda read the condition regarding security personnel. Council President
Stark said it was his recollection from the last time that the recommendation had been
for a certain number of days for required security, and they had ended up with one less
day than recommended. Ms. Skarda said that was correct. She said the requirement
was for Friday, Saturday and Sunday.
In opposition:
Jeffrey O'Brien, attorney representing the licensee, appeared along with licensee Sean
Bigaouette. Mr. O'Brien said they weren't contesting the that the violations occurred; he
said the violations were all related to the conditions imposed in December. He referred
to a letter that had been submitted and said they felt they had taken significant steps
to comply with and exceed the conditions. He said they'd met with DSI staff and police
to go through specific expectations, and their security plan was approved by police
after some changes. He said they had private, licensed bonded security from 9:00 to
1:30 on the required nights, in addition to on-staff security who were there the rest of
the nights, which was not required by the license conditions. He said they had hired a
night manager, so there was additional staff presence and the bartender was not
doubling as the night manager. He said given the expense to modernize the
surveillance system and hire new staff suspending the license for 10 days would have
a severe adverse economic impact. He said they were willing to pay a fine but were
asking that the suspension not be imposed given the efforts they had made to go
above and beyond the license conditions.

Council President Stark asked Ms. Skarda about the meeting in May and the level of
positive reaction to the issues and problems. Ms. Skarda said DSI had no reason to
believe that those items hadn't happened, but as to their effectiveness, she hadn't had
any comment from them.
Council President Stark said he appreciated the licensee coming down and the efforts
to comply. He said the violations were important and significant, and fortunately there
hadn't been significant events or problems at the bar recently. He said he would
propose imposing the $2000 matrix penalty and imposing the 10-days, with 5 days
pending any same or similar violations over the next 18 months.

months there would be the 5 days plus the additional penalty for the new violation.

the two items.
Deputy Chief Iovino gave a staff report, and responded to Council members' comments
and questions. Todd Hurley, Office of Financial Services, also answered questions.
Council President Stark said the intention was to lay the matter over to explore some
different fee structures; he asked whether there were any time constraints. Deputy
Chief Iovino said there were none for Police. Mr. Hurley said the budget was 2017
adopted with the anticipation of an increase in permit and false alarm fees. He said he
would like to follow up with Council members and staff to try and find a revenue-neutral
number, and come back at the next available public hearing.
Council President Stark said he would express intention to lay the matter over for at
least a week, with new public hearing on August 2 if needed.

Council President Stark clarified where the City was in the process. He reviewed the
steps already taken and what was currently before the Council. He said the process
was largely outlined in State law and the alternative to accepting this proposal or
something similar, would be for the City to go out with a Request for Proposals for
trash collection.
Anne Hunt gave a staff report. She thanked staff for their work, and described the
agreement with the haulers, the services to be provided, and the costs. She said her
understanding was that testimony would be taken and the item might be laid over. She
reviewed the timeline going forward and said they anticipated starting in the fall of

62 RLH FCO Appeal of Tim Parmer to a Correction Notice - Re-Inspection Complaint
17-105 at 1384 BUSH AVENUE.
Legislative Hearing Officer Marcia Moermond gave a staff report on the order to
maintain the parking pad. She showed a photograph of the parking surface and an
aerial photographs of the property. She said the property owner argued that rental
properties were unfairly targeted, and code did not specify that the driveway approach
was covered under Chapter 34. Ms. Moermond said she didn't believe that to be the
case and had also consulted with the zoning attorney. She recommended granting an
extension to October 15 for compliance.
In opposition:
Property owner Tim Parmer (1083 McLean Avenue) displayed a photograph of the
property and said it was not a problem property, and no neighbors complained about
tenant or condition of the property. He said other orders were quickly complied with. He
said the pavement was deteriorating but the tenant didn't park there and it provided
access to the garage. He said he felt it thought threatening criminal citation or
revocation was a little over the top for an A or B property. He read from the code, and
said he was not looking to expand the existing driveway. He reiterated that his renter
didn't park there and had agreed not to. He said there were multiple examples in his
neighborhood and he felt every neighborhood set its own standards. He said most
code compliance was complaint driven, unless they were under this (Certificate of
Occupancy) program. He showed photographs of properties across the alley with cars
parked on the grass, and showed photographs of 11 park worker and City vehicles
parked on the grass at Mounds Park. He said it should start at the City level and apply
to everyone.
Mr. Parmer and Ms. Moermond answered questions from Councilmember Prince.

Council Meeting Information
The City Council is paperless which saves the environment and reduces expenses. The
agendas and Council files are all available on the Web (see below). Councilmembers use
iPads to review the files during the meeting. Using the iPad greatly reduces costs since most
agendas, including the documents attached to files, are over 1000 pages when printed.
Many people are extremely sensitive to scented products. Please refrain from wearing or
using fragrances, such as perfumes, lotions, aftershave, scented aerosol products, including
hair spray, and other such products.

Meetings are available on the Council's website. Email notification and web feeds (RSS) of
newly released Minutes, Agendas and Meetings are available by subscription. Please visit
www.stpaul.gov/council for meeting videos and updated copies of the Agendas, Minutes and
supporting documents.
Cable
Meetings are live on St Paul Channel 18 and replayed on: Thursdays at 5:30 p.m., Saturdays at
