32 RES 17-1418 Approving installation of bicycle lanes on Stillwater Avenue from
McKnight Road to Algonquin Avenue, and bikeway connections on Ruth
Street/Algonquin Avenue, Case Avenue, and Hazel Street.
Councilmember Bostrom said the Council had been through this a couple of weeks
before, and he was disappointed he hadn't been consulted since this was in the heart
of his district. He said there was an equity matter that hadn't been addressed, and
questioned why they were removing parking on Stillwater when other similar streets had
parking on both sides of the street and functioned with sharrows. He said there were
sharrows and parking on both sides of the street on St. Clair, which was 40 feet wide.
He said the request on Stillwater was to ban parking on one side with an exclusive
bike lane, but Stillwater was 44 feet wide. He said there was something wrong with
this, and asked why this was good enough for one part of town but on the East Side it
wasn't. He said it really frosted him, and he thought they were doing it on the East Side
just because they could and not because it was what the people wanted. He said the
business people needed the parking and there was plenty of room to do sharrows
there. He said there were 5000 cars a day on Stillwater and 11,800 on St. Clair and
they were doing it with sharrows. He said he was absolutely opposed to this, and the
day they did this on St. Clair he would support it, because what was good enough for
that part of town was good enough for the East Side. He said it was not good enough
for the East Side to take parking away from businesses and neighbors who
desperately needed it.
Council President Stark said the the situation on St. Clair wasn't comparable because
St. Clair wasn't part of the bike plan, and the sharrows were put in because it was an
opportunity to put in something. He said the equivalent in that part of town would be
streets like Jefferson and Cleveland where they did put in full bike lanes, and where, at
least in the case of Cleveland, there was parking lost. He said he understood the
sentiment about it.
Councilmember Noecker moved approval of the resolution.
Councilmember Prince said she had spoken to Public Works about St. Clair, and the
response was that it needed to be fixed and would be revisited when the bike plan was
updated because it wasn't functioning well.
Councilmember Bostrom said it worked there but not on the East Side and that's what
really griped him more than anything else. He said they could get four votes to do that
to them, and that's what they'd been suffering through for a long time on the East Side.
Councilmember Brendmoen said as a representative of the East Side she begged to
differ and had heard plenty of people begging for this kind of infrastructure and
investment on the East Side. She said the equity issue Councilmember Bostrom was
talking about was saying the East Side didn't get anything and then continuing to vote
against it. She said she would be supporting it.
Councilmember Noecker said she understood Councilmember Bostrom's objections.
She said she had brought this back because they'd had a public hearing where
everyone who came expressed support, and then they'd had a discussion that left a lot
of them feeling confused as to how they had declined something when she didn't feel
that was the intended outcome.

37 SR 17-102 Presentation by the Citizens League on the study regarding Payment In
Lieu of Taxes (PILOT) and Services in Lieu of Taxes (SILOT) programs
for the City of Saint Paul.
Sean Kershaw, Executive Director of the Citizens League, provided background on the
study. He introduced PILOT committee co-chairs Kaye Rakow and Joe Reid, who
presented data, findings, conclusions, and recommendations.
Ms. Rakow reviewed the findings of the study, and highlighted some of the
conclusions: s: 1) A St. Paul PILOT program should not and could not be viewed as a
solution to budget issues; 2) For a PILOT program to be successful there must be a
strong relationship between the City and its tax-exempt property owners, collaboration
on developing the program, and voluntary participation; 3) The relationships necessary
for a successful PILOT program in Saint Paul may be missing and certainly needed
attention.
Co-chair Joe Reid referred to recommendations in the written report and said, in
summary, that this was an opportune time for St. Paul to initiate discussions with
owners to consider a PILOT initiative that was voluntary and took into consideration the
ability of the tax-exempt organizations to contribute. He said the City could consider
appointing an administrator. He said part of the issue was due to state funding, and
they felt there should be enhanced consideration for tax exempt properties in
distribution of Local Government Aids.
Mr. Reid answered Council member questions. Council members thanked the
speakers.

ORDINANCES
An ordinance is a city law enacted by the City Council. It is read at four separate
council meetings and becomes effective after passage by the Council and 30 days
after publication in the Saint Paul Legal Ledger. Public hearings on ordinances are
held at the third reading.
First Reading
39 Ord 17-32 Amending Chapter 409 of the Legislative Code pertaining to private
Christmas parties.

40 Ord 17-40 Amending Chapter 66 of the Legislative Code to establish six new ‘Ford’
zoning districts and amending the Zoning Map as recommended in the
Ford Site Zoning Study.
Councilmember Tolbert said the City, the neighborhood, and the Ward 3 office had
been working on the redevelopment and repositioning of the Ford Plant site, and this
was a first draft based on hundreds of public meetings, a decade worth of
conversations and studies. He said the document before the Council was what the
Planning Commission had passed on, and he had an amendment related to maximum
allowed heights.
Council President Stark, Councilmember Prince and Councilmember Brendmoen
thanked Councilmember Tolbert for his work, and spoke in support of the amendment.
Councilmember Thao thanked Councilmember Tolbert for his work and for the
community meetings. He said he was not ready to support the amendment and felt the
overall plan was divisive and pit neighbors against each other.
Councilmember Noecker said she was not initially in support of the amendment, and
supported the level of density currently proposed.
Councilmember Prince asked for clarification as to how the proposed amendment
related to density.
Councilmember Tolbert spoke in more detail in support of the plan and amendment.
He said he felt the goals of the plan were generally supported, and they would continue
to work with the neighborhood.
Council President Stark made additional comments on the potential implications of the
amendment.

Councilmember Noecker thanked those who came to testify and for the work done in
the previous months. She said before voting on the changes she wanted to set the
bigger picture and the context. She asked Dan Niziolek, Department of Safety and
Inspections, to provide a report.
Mr. Niziolek provided a report and answered questions from Council members.

skyway open to 2:00 a.m., based on the findings presented.

60 RLH VO 17-36 Appeal of Jenifer Snavely to a Vehicle Abatement, Summary Abatement,
Condemnation as Unfit for Human Habitation and Order to Vacate at 575
ASHLAND AVENUE. (Legislative Hearing on September 5)
Legislative Hearing Officer Marcia Moermond gave a staff report on the order to vacate,
and vehicle and summary abatement orders. She described the unsanitary and unsafe
conditions leading to the vacate order. She said the property owner was deceased and
the house was not in probate, and there were seven siblings "In play". She said she
did not see a way to a good outcome in terms of the house being cleaned or repaired.
She showed photographs. She said in August the Department of Safety and
Inspections (DSI) recommended that the property be vacated within 1 week. She said
her recommendation was that the property be vacated within two weeks and into the
vacant building program, with access from 8:00 to 8:00 for cleaning and repairs only.
She said the appellant and some family members were present to testify.
Jennifer Snavely (575 Ashland) said she lost her mother in June, and was aware of the
mess downstairs and tried to get the City involved for a long time, but was not heard.
She said she had a traumatic brain injury, and her significant other, Charles, would
speak on her behalf. Charles Lee said they had long been aware of the problems, and
he was not present to defend anything. He said they lived upstairs and knew about the
problems with "Mom" downstairs but didn't want to upset her by intervening. He said
the doors were not blocked by furniture, and there was no intention to block anyone
out. He provided further explanation of the circumstances, and said they had been
working on the clean-up and could make the repairs.
Council President Stark said the recommendation was to give them two weeks to
vacate the house because inspectors didn't believe it was safe to occupy. Ms. Snavely
said it was safer than sleeping on the street. Council President Stark asked the
appellant to address the recommendation and what they were asking for.
Mr. Lee said they were asking for mercy and understanding, the opportunity to take
control of the situation until they could understand what was going on with the other
siblings. He said they didn't want to take a loss on the house and were willing to do
whatever it took. Ms. Snavely said they were already addressing the house right after
her mom's death.
Council President Stark said the problem was that, because the City was aware of the
unsanitary and unsafe conditions, it was the City's responsibility to make sure nobody
was living in those conditions.
Mr. Lee said some of the other people involved in the situation weren't on the same
page. He asked if there could be a temporary vacation while they brought conditions
up to a certain standard. Council President Stark said after the house was vacated,
work could still go on 8:00 to 8:00. Ms. Snavely said they were being given less than
20 days. Mr. Lee said there were multiple family members involved. Ms. Snavely said
they were already addressing the problem before the City came.
Council President Stark asked what the appellants were asking for. Mr. Lee said they
wanted to be able to take control and do what was necessary so they didn't lose the
house. Council President Stark said the Council wasn't in charge of the ownership.
Councilmember Thao said he wanted to help the appellants and wanted them to be
able to retain the house, but needed to know whether Ms. Snavely and her brothers

and sisters were willing to take responsibility to take care of the situation. He said he
wanted the appellants to propose something. Mr. Lee said they agreed with the
inspectors but got caught in a situation. He said they were asking for more time, and
for the opportunity to seek assistance and guidance in bringing the house into
compliance.
Council President Stark said the time was there to deal with those issues, just not
time to continue to have people living in the house. Mr. Lee said they were homeless.
Councilmember Thao said there were basic responsibilities that were part of owning a
home. He said we was going to deny the appeal, because based on the history and
looking at the notes, the appellants needed some sort of deadline so they could work
together as a team to save the home. He moved to support Ms. Moermond's
recommendation.

ENGLISH STREET. (File No. CRT1711, Assessment No. 178212)
Legislative Hearing Officer Marcia Moermond gave a staff report on the assessment for
a Fire Certificate of Occupancy bill. She said the Certificate of Occupancy inspection
was precipitated by a complaint, and the certificate was due for renewal. She said the
complaint was of a bug infestation, which the owner disputed, but there were photos
introduced into the record documenting it. She said the owner came to an arrangement
with the inspector to take care of it, so it didn't appear in the orders. She said the
owner alleged that the building was not entirely inspected and he shouldn't have to pay
for those services. She said the orders reflected items from each unit in the building
so her finding was that the entire building was inspected. She noted that the owner was
being charged only for the Certificate of Occupancy fee itself plus one re-inspection
and the administrative fee for a total of $687.50.
In opposition:
Property owner Paul Sprosty (633 Keller Parkway, Little Canada) said this was 1676
English, and he had his family living there. He said they shot his daughter-in-law, her
two children, and her dad. He said four people were killed in the building because the
inspector accused him of having bugs. He said he and the inspector had 80 years of
combined experience locating bugs, and he was positively sure there were no bugs. He
said the bed bug treatment cost thousands of dollars and was a lot of work.
Councilmember Bostrom moved to close the public hearing and adopt Ms. Moermond's
findings. He offered condolences to Mr. Sprosty on the tragic loss of his family, but the
City incurred costs that had to be covered.

Legislative Hearing Officer Marcia Moermond gave a staff report on the assessment
ratified in April and further violation in July. She noted that the owner indicated he
received the summary abatement letter, although it had been sent to the previous
owner and to Occupant of the building due to miscommunication between Ramsey
County taxation and the City's system. She said the owner received notice as the
occupant of the building and that was considered legal notification. She said the City
did do the clean-up and there was video available. She displayed photographs of the
items present and showed the video. She said the owner had reported it to the City as
dumping, and thought he didn't have to clean it up, which was why she made her
recommendation. She said there was a subsequent order in July for removal of debris
in the back of the yard and overhanging vegetation, but the City did not have to do a
clean-up on that occasion. She said she recommended approval of the first
assessment and there was no second assessment. In response to a question from
Council President Stark she said the first assessment was for $526.
In opposition:
Maher Safi (1 Maycomb Lane, North Oaks) said the first incident was dumping. He
said he moved into the house, and bought another home a few months later and went
out if the country for two months in the middle of that. He said the first time it wasn't
him, and the second time he wasn't really sure what happened. He said he later learned
from his brother that he drove by and saw some garbage. Mr. Safi said he had garbage
service and also someone to mow the lawn, but he told his brother to take care of it.
He said he later found out that garbage service was stopped because his credit card
was cancelled when he left the country. He said it was unintentional.
Council President Stark said it could have been dumping, but the fact of the matter
was that the City did go out and take care of it and spend resources. He said he
appreciated that Mr. Safi's brother took care of the second instance but felt it was fair
based on the circumstances of the first hearing that Mr. Safi pay at least part of the
assessment. He recommended reducing the assessment by half.

Legislative Hearing Officer Marcia Moermond gave a staff report. She reviewed the
history and current conditions. She recommended making two of the units (2 and 5)
vacant buildings and allowing occupancy of the other four (1, 4, 6, and 7) while work
was continuing; and if work was completed by October 6, the vacant building fee be
waived for 30 days to allow the remainder of the work to be done. She said she had
discussed the recommendation with the building manager, who asked to keep Unit 6
occupied, and she had modified her recommendation to allow for that. She said a
second request was regarding the re-grading of the exterior, and she recommended an
extension to May 31. She answered questions from Council members.
Councilmember Thao said it was a complicated situation and he thanked Ms.
Moermond for her due diligence.

Council Meeting Information
The City Council is paperless which saves the environment and reduces expenses. The
agendas and Council files are all available on the Web (see below). Councilmembers use iPads
to review the files during the meeting. Using the iPad greatly reduces costs since most
agendas, including the documents attached to files, are over 1000 pages when printed.

Meetings are available on the Council's website. Email notification and web feeds (RSS) of
newly released Minutes, Agendas and Meetings are available by subscription. Please visit

Cable
Meetings are live on St Paul Channel 18 and replayed on: Thursdays at 5:30 p.m., Saturdays at
12:30 p.m., and Sundays at 1:00 p.m. (Subject to change)
