Adopted Yea: 7- Councilmember Bostrom, City Council President Brendmoen, Councilmember Thao, Councilmember Tolbert, Councilmember Stark, Councilmember Noecker and Councilmember Prince Nay: 0 LEGISLATIVE HEARING ITEMS FOR DISCUSSION City of Saint Paul Page 8 City Council Minutes - Final January 3, 2018 35 RLH TA 17-428 Ratifying the Appealed Special Tax Assessment for Property at 1165 BUSH AVENUE. (File No. J1801A, Assessment No. 188500) Legislative Hearing Officer Marcia Moermond gave a staff report on the assessment for a property clean-up. She said the notice was sent to the owner of record with Ramsey County, and it was the opinion of the property manager that they should have been notified as well. Ms. Moermond said if there was information in the system regarding the property manager's contact, notification was sent to them, but the legal requirement in the code was that notice be sent to the owner of record. She said based on property tax records for the years preceding and following the summary abatement she was satisfied that the notice was sent to the correct person at the correct address. She said this was a tax assessment and not a Fire Certificate of Occupancy (C of O) matter and that's why the owner was involved. She displayed photos of the materials cleaned up, and said the deadline was short due to the presence of raw garbage. Christina Harding (1643 5th Street) said she had evicted two horrible tenants, and everyone in the neighborhood came and dumped there as well. She said her maintenance man had cleaned it up and invoiced her, but she never received the letter said her maintenance person picked it up. She said notice was sent to the previous property manager. She said she had sent C of O forms with her name twice by email and twice by fax, and had numerous calls, messages and emails with (inspector) Leanna Shaff and now knew Ms. Shaff didn't do the updating but delegated it to someone else. She said the property owners lived in Burbank and worked for Disney and were never home, but if she had gotten the notice she would have handled it herself. She said she was well-known on the East Side and didn't work for slum lords. She repeated that she'd updated her information four different occasions, and said don't know what else to do. Council President Brendmoen confirmed that Ms. Harding was not disputing that the garbage was removed. Ms. Harding said she didn't dispute it but would have picked it up herself. She said the inspectors knew her and had her personal cell phone to let her know if a letter was going out. Council President Brendmoen said she appreciated that Ms. Harding typically took care of issues, but in this case the City did pick up the trash. Councilmember Thao asked Ms. Harding how many properties she managed. Ms. Harding said she managed 78 units, all in St. Paul. Councilmember Thao said with that many properties it seemed the correct address would have been on file. Ms. Harding said there were different owners for each property. Ms. Moermond said she had spoken with Ms. Shaff that afternoon and there was apparently some miscommunication between Ms. Harding and the Fire C of O program. She emphasized that the City's legal obligation was to notify the owner of record, and it was a courtesy to notify the property manager. She said the liability for the costs incurred by the City lay with the property owner under Chapter 34. Council President Brendmoen asked for clarification of whether the address was collected by way of the County or by way of the C of O, and what the C of O address form was used for. Ms. Moermond said her understanding was that the summary abatement orders did pick up the C of O information. She said Ms. Shaff and Ms. Harding had a difference of opinion about whether the address information was communicated clearly for every property. She reiterated that what was in front of the City of Saint Paul Page 9 City Council Minutes - Final January 3, 2018 Council was the clean-up assessment. Ms. Harding said the issue was that she used to work for RC Enterprise and they sold off all of their properties, and in the process she started her own management company. She said she stayed on at some of the properties with the new owners, and when Ms. Shaff was getting some of the forms they were getting put in the address of RC Enterprises. She reiterated that she didn't argue that the trash was picked up, but she was not notified. Councilmember Bostrom moved to close the public hearing. Yeas - 7 Nays - 0 Councilmember Bostrom said it was confusing, but there was no confusion about the face that it was a mess and the City cleaned it up. He said in consideration of that he would recommend removing the administrative fee leaving a total cost of $402. He said that was his motion. Adopted as amended (assessment reduced) Yea: 7- Councilmember Bostrom, City Council President Brendmoen, Councilmember Thao, Councilmember Tolbert, Councilmember Stark, Councilmember Noecker and Councilmember Prince Nay: 0 City of Saint Paul Page 10 City Council Minutes - Final January 3, 2018 92 RLH TA 17-413 Ratifying the Appealed Special Tax Assessment for Property at 657 SHERBURNE AVENUE. (File No. VB1801, Assessment No. 188800) Legislative Hearing Officer Marcia Moermond gave a staff report on the vacant building fee assessment. She said the the building entered the vacant building program January 2017, and a 90-day waiver was granted. She said there were two open permits at the time of the hearing, and she recommended approving the assessment with payments spread over 5 years with consideration for financial hardship. Property owner Aychoen Tea said Ms. Moermond kept saying "the building" but this was her house. She said she had live there for 8 years, and it had already passed the inspection for everything. She said there was no tenant, only her and her family. She said when the inspector called and wanted to get into her house, she told the inspector she lived there, and the inspector said if she let her in the house it would be okay. She said the inspector came to the house with another inspector and he condemned it and wanted her to go to Code Compliance. She said she threw all furniture away and a friend gave her new furniture. She said she had some family problems too, that her son broke window, and she said whatever she needed to fix she would fix. She said the items inn the order were simple things for her to fix but when she went to the Legislative Hearing Ms. Moermond gave her five days to fix them, until December 31. She said on New Year's Eve (the inspector) came to yell at her and said her place was not good and then he condemned her house. She said he told her what to fix and she told him it was not problem. She said the inspector told her he didn't want the dog in the house when he was there, and when he came she took the dogs out and had cleaned everything. She said she rented an apartment and knew how inspectors pass and not pass. She said she waited and the inspector didn't show up and she went to the City (interrupted) Ms. Moermond said the building was condemned with gross unsanitary conditions the previous December (2016), and she heard an appeal of the vacant building registration in February. She said at that time the order to vacate had passed and what came before the Council then was the vacant building status. She said the building clearly needed to be Category 2 based on the condemnation and conditions. She said now the 90 day extension had expired, the code compliance inspection was done and permits were pulled, and all of the items needed to be done in order for the life safety to be satisfied and the code compliance certificate to be issued. Council President Brendmoen asked whether the home was still uninhabited. Ms. Moermond said it was in the vacant buildings program and didn't have its code compliance yet. She said since this was 12 out of 12 months of the year in the vacant building program she recommended that the Council approve this and spread it over 5 years, and have consideration for the next year's vacant building fee if it was done quickly. Council President Brendmoen asked how much it would be per year. Ms Tea asked if she could ask a question. She asked if it was the law that she could appeal one time. She said she had never come before the Council, and Ms. Moermond had sent her there with no time to prepare. She aid she had done all of the work in the orders and she should be done. She said it was her house and if they wanted her to fix things they had to let her stay in her house and she would fix things. She asked why she had been sent to the hearing without her signature. She said she was asking to have the fee waived. She send she had been sent there without a chance to prepare. She said it was her house and she was sleeping outside. City of Saint Paul Page 11 City Council Minutes - Final January 3, 2018 Councilmember Thao moved to close the public hearing. Yeas - 7 Nays - 0 In response to a question from Councilmember Thao, Ms. Moermond clarified what was before the Council. Councilmember Thao said he sympathized with Ms. Tea and appreciated her making Ward 1 her home. He said she had a generous offer to have the fee spread out over five years, and he moved to approve Ms. Moermond's recommendation. He said he would be happy to work with Ms. Tea on whatever help was needed to bring her home up to code. Ms. Tea said she didn't have money to fix anything else. Council President Brendmoen said the public hearing was closed but Councilmember Thao would speak to Ms. Tea after the hearing. Adopted Yea: 7- Councilmember Bostrom, City Council President Brendmoen, Councilmember Thao, Councilmember Tolbert, Councilmember Stark, Councilmember Noecker and Councilmember Prince Nay: 0 City of Saint Paul Page 12 City Council Minutes - Final January 3, 2018 77 RLH VO 17-50 Appeal of Aaron Livingston to a Notice of Condemnation as Unfit for Human Habitation and Order to Vacate plus Summary Abatement Order at 1124 MATILDA STREET. (Public hearing continued from December 6) Legislative Hearing Officer Marcia Moermond said the public hearing had been continued repeatedly, and she had been working on this property since October. She said her recommendation on December 20 was to grant the appeal if conditions were met by January 2; she read the conditions. She said no plumbing permit had been pulled and the electrical permit hadn't been finalled, and she said she didn't have information on the other conditions. She recommended denying the appeal as she didn't think this was a productive line anymore. In opposition: Danielle Sobaski (1124 Matilda Street) said she was currently living in North Branch at her aunt's. She said she had attempted multiple times to pull the plumbing permit and plumbers were reluctant to do so because they were not understanding. She said the electrical inspector was through the house and pointed out a few items remaining and said he wasn't even sure why he was there. She said the inspector gave him an update on the electrical code and left. She said the one plumber who was willing to come wanted to meet with inspector before pulling the permit. She said she went to try to pull a permit on Tuesday after Christmas and there was a skeleton crew at DSI, and she learned she was not allowed to pull permits because she was apparently pre-emptively put on the vacant buildings list. She said she went and spoke to Ms. Moermond the following day and was approved to pull permits, and was able to pull the electrical permit herself, but wan't left with much time. She acknowledged that the kitchen was a mess, and said it had been cleaned up; she said pictures were provided at the December 6 public hearing. She said the CO had been fixed. She reiterated that she'd had limited time due to the holidays and DSI not permitting her to pull permits. She said the electrical inspector had been through and she didn't know why he didn't finalize it. Council President Brendmoen confirmed with Ms. Sobaski that the plumbing permit had not been pulled and the electrical had not been finalized. Ms. Sobaski repeated her testimony about the electrical inspector and that the CO detectors had been fixed. She said she was not sure how they were condemnable issues; she said it was not an issue of public safety. She said she understood that junction boxes without covers were a little frightening looking but she didn't see it as a condemnable offense. She said she read the condemnation code and it sounded like a tornado had to take out half the building. She said on December 6 there was a condemnation on an apartment building on Duluth and they were allowed re-occupancy when the electrical was restored in the halls, yet they were not allowed to re-occupy because of a basement bathroom that was installed (interrupted) Council President Brendmoen said Ms. Sobaski's issue was the one being addressed. Ms. Sobaski said they hadn't put in the bathroom and had lived there for five years but all of a sudden couldn't live there. Appellant Aaron Livingston (1124 Matilda) said the illegal basement bathroom was installed before they bought the house, and was illegal because it didn't have a sink. He said there was a fully functioning code compliant bathroom upstairs. He said the waster had been shut off and the toilet pulled in the basement. Council President Brendmoen said the five minutes for testimony was up, but the issues Ms. Moermond put forth about the plumbing and electrical permits were not City of Saint Paul Page 13 City Council Minutes - Final January 3, 2018 being disputed, and it sounded like there were plenty of things the appellants were continuing to work on. Mr. Livingston he was disputing those things. Ms. Sobaski said they had made progress every step of the way. Mr. Livingston said electrical was finalized. Council President Brendmoen moved to close the public hearing. Yeas - 7 Nays - 0 Council President Brendmoen said she was willing to work with the appellants on this matter, she said it sounded like they had a ways to go according to the code. She said right now the conditions that Ms. Moermond put forward had not been met; she moved to adopt Ms. Moermond's recommendation. Councilmember Stark said he would support the motion support. He said the Council members were not experts on the building code and had to rely on the experts in terms of what was done and what was reasonable in a given period of time. He said it wasn't that the appellants hadn't been heard but that this was the process that had to be followed. He said he felt a reasonable period of time was set for the work that needed to be done, and it didn't happen. After the vote Mr. Livingston asked for clarification of what determination had been made. Ms. Moermond she would talk to Mr. Livingston after the hearing. Mr. Williams said he could talk to her but was still homeless.
