of Zoning Appeals stating that the Zoning Administrator's October 30,
2017 determination letter was not in error in determining that the West
Addition to the Commodore Restaurant was, for zoning purposes, never
legally established as a restaurant space.
Councilmember Thao said he didn't find error in the BZA's finding, and was committed
to working with Mr. Rupp and DSI to help Mr. Rupp through the process so he could
create a legal restaurant space. He moved to deny the appeal.
Council members Noecker and Prince thanked Councilmember Thao and spoke in
support.
Councilmember Thao said he appreciated Mr. Rupp's contributions to the community.

53 RLH RR 17-48 Making finding on the appealed nuisance abatement ordered for 544
MINNEHAHA AVENUE WEST in Council File RLH RR 17-12. (Public
hearing held February 28)
Legislative Hearing Officer Marcia Moermond gave a staff report. She said 180 days
were granted at the end of last June, and it had been back and forth between
Legislative Hearings and City Council since then to try to get it to 50% compliance,
which would allow the $5000 bond to be continued. She said the building official
determined 30% completion as of February 14, which would normally mean that she
would ask that the bond be forfeited and DSI allowed to abate the nuisance. She said
in this case it was a community development corporation involving extra contracting
concerns which was a special circumstance and the reason she had continued the
matter in Legislative Hearings. She said one of the requirements was a new work plan,
and at 3:00 that day she had received an excel spreadsheet with a timeline but with no
supporting documents in the form of construction statements or contractor bids. She
recommended that the Council find that the work plan was inadequate. She said she
had hoped that rather than forfeiting the bond, the CDC would post an additional $5000
bond for more time, but that had not happened. She said, in terms of financing, a
certificate of estimated development costs had just been provided and distributed, and
she had an unsigned master credit agreement from the Twin Cities Community Land
Bank received on the 18th. She said she felt there weren't good connections being
made in terms of timeline, bids and financing; and the fact that things were coming in
at 3:00 and 3:40 that day was an indication they didn't have things together in a way
that would allow granting another 180 days. She said it was disconcerting that there
had been at least three summary abatement orders, one for tall grass, one for
securing and cleaning, and a work order for clearing the site and cleaning the sidewalk.
She said these were basic maintenance items, and she asked how they could put
together a plan to rehabilitate the property and the situation. She said she had she had
been unsuccessful in getting a work plan, a deposit posted, and the property
maintained. She said the Council could provide additional direction, but her
recommendation was to find that the nuisance was not abated and allow DSI to go
forward with removal of the building.
Council President Brendmoen referred to estimated costs listed on the document just
submitted, and asked whether there were acquisition costs or the HRA had any money
in the project. Ms. Moermond said she didn't have an answer to those questions. She
said it was an existing house, and the project was a rehabilitation.
Councilmember Noecker asked Ms. Moermond why she was not recommending that
more time be allowed for the new deposit and a better work plan, as was done in other
cases. Ms. Moermond said they had been asking for those things for two months, and,
to date, that very clear expectation had not been met. She said the Council could ask
that more time be granted.
Councilmember Thao said he had finally gotten a hold of the Nieeta (Presley) with the
CDC, and he would be requesting another layover to help her get this straightened out.
He asked for a one-week layover.
Council President Brendmoen suggested the public hearing be held.
In opposition:
Dr. Loyce Foreman, CDC said there had been a number of challenges and setbacks
from the beginning. He said they were a non-profit and hired community contractors,

and the first was commercial contractor and unable to pull permits for the residential
project. He said they had been compiling documents to meet the requirements, but the
$5000 bond discussion was only two weeks old. He said it was being requested in
cash or credit card, and was not a bond, and was a financial burden. He said the
scope of the project had changed from bringing a two bedroom, two bathroom house
up to code (interrupted). In response to a question from Council President Brendmoen,
he said they acquired the house in November 2015 from the Twin Cities Land Bank.
He said it was part of a package of two properties, and in order to acquire 550
Minnehaha, which was built in 2007, they would have to take and rehabilitate 544. He
said they took that on, and found that the original structure was almost beyond repair.
He said they had gutted the property and shored it up, and added 1000 square feet of
new construction for a third bedroom and bathroom.
Councilmember Henningson asked whether the amount in the financial document was
is inclusive of what had been done and would be done. Dr. Foreman said it was.
Councilmember Thao asked what was keeping them from taking care of maintenance.
Dr. Foreman said it had snowed two days before, and he had hired contractor who
didn't do the work. He said no one resided at the property, and had contractors there
intermittently. Council President Brendmoen said it had snowed on Saturday, and they
(Council members) had all shoveled. Dr Foreman reiterated that no one resided at the
property and he had hired a contractor. He said one question was question is could
they do this (the rehabilitation). He said the funds allocated exceeded the cost
estimate, and they felt they could complete it within their budget.
Councilmember Thao asked Dr. Foreman what they were asking for to be able to meet
Ms. Moermond's requirements, and whether they could do the $5000 bond. Dr.
Foreman said it would be a hardship but they could if given time. He repeated that he'd
only heard about it two weeks before, and were asked for cash. He said they were
bondable through their insurance company. He said he had hoped to have the full
amount that day, and in talking to Nieeta, it was her understanding that Ms. Moermond
was possibly going to suspend the request. He said they were ready to comply, but
needed a little more time, and he didn't understand why it had to be cash out of their
pocket.
Councilmember Thao moved to close the public hearing. Yeas - 6 Nays - 0
Councilmember Thao said the Council could give one week to come up with that. He
said the City went out of their way to ensure their non-profit partners were successful,
and the CDC had done a great job on the neighboring house. He said the expectations
for a non-profit had to be the same as for a private business.
Council President Brendmoen said the everyone wanted the project completed and
contributing to the community. She said she understood the challenges the CDC had
encountered, but it was possible this property had been a blight to the neighborhood
for a decade, and it wasn't fair to the neighbors for the City to keep kicking the can
down the road. She encouraged Dr. Foreman take advantage of the week layover and
work with Mr. Thao.
Ms. Moermond said she wanted to clarify for the record, the City Council's
expectations, which would be confirmed with a letter. She said a $5000 performance
deposit should be posted in addition to the current bond; she noted that was originally
discussed at the end of December as part of determining whether it was at the 50%
mark and was covered in three hearings. She said she needed a sworn construction

statement with bids to support the timeline, and she needed clear financing
documentation. She said it went without saying that the property should be maintained,
and DSI would be sending out a Parks crew the next day, a week after their deadline.
Council President Brendmoen said that was a long list of things, and winging it wasn't
going to work.
Councilmember Thao said it was a demanding list; he moved to lay the matter over for
two weeks.
Council President Brendmoen said with getting the letter out the door she felt that was
reasonable, recognizing that at some point it's the end of the line. Councilmember
Thao agreed.
Councilmember Noecker said she wanted it on the record that this was the end of the
line for her too.

Council Meeting Information
The City Council is paperless which saves the environment and reduces expenses. The
agendas and Council files are all available on the Web (see below). Council members use
iPads to review the files during the meeting. Using the iPad greatly reduces costs since most
agendas, including the documents attached to files, are over 1000 pages when printed.
Web
Meetings are available on the Council's website. Email notification and web feeds (RSS) of
newly released minutes, agendas, and meetings are available by subscription. Visit
www.stpaul.gov/council for meeting videos and updated copies of the agendas, minutes, and
supporting documents.
Cable
Meetings are live on St Paul Channel 18 and replayed on Thursdays at 5:30 p.m., Saturdays at
12:30 p.m., and Sundays at 1:00 p.m. (Subject to change)
