Councilmember Henningson moved to close the public hearing. Yeas - 6 Nays - 0
Councilmember Henningson said she recognized how difficult lot-line issues could be
and regretted that it had pitted neighbor against neighbor. She said she felt the matter
needed to be resolved in quick fashion, and she noted that staff time spent on the
issue was not being spent serving library patrons. She said there was no resolution to
the property line issue without court action, and not going to court saved the City
money on litigation, and sale proceeds would be returned to the branch library. She
said the main point was that the library did not feel this would affect library operations
or potential expansion. She said she thought it was notable that the Library
Association was staying neutral.
Councilmember Prince referred to the District 12 letter of March 1, and said she felt
there might have been a possibility of finding a middle ground. She said she
appreciated that the line had been moved twice, but she wished the City had closed
the loop and gone back to the community for one last pass. She said this kind
neighborhood involvement might have saved three rec centers that were closed on the
East Side. She said she felt moving the line a small amount to accommodate the
gardeners would not significantly impact the Foss's ability to use the hill. She said she
could not vote for the resolution as it stood.
Council members Tolbert and Thao spoke in support of the resolution.

82 ABZA 18-3 Public hearing to consider the appeal of Kyle Coglitore to a decision of
the Board of Zoning Appeals to revoke the Student Housing Certificate of
Occupancy status at 2083 Marshall Avenue (a single family dwelling) due
to over occupancy.
Jerome Benner, Department of Safety and Inspections (DSI) gave a staff report. DSI
Inspector A.J. Neis provided additional information.
Councilmember Noecker asked whether the BZA was made aware there was an error
in DSI's recording of results of a March 2016 inspection (as noted in Mr. Neis's staff
report). Mr. Benner said the BZA was not made aware of the error at the time of the
hearing. Councilmember Noecker said that meant the BZA made their decision based
on the assumption that this was the third violation. Mr. Benner said that was correct.
Appellant:
Loren Solfest, attorney representing property owner Kyle Coglitore, referred to a letter
he had submitted and said the revocation was made in error and should not be applied.
He said the revocation was based on September 15 and not on September 14. He said
there was a statement to Mr. Coglitore on the 15th, when there was no over-occupancy,
that it was not being revoked and he had one additional time or warning. He said it was
based upon the call from Mr. Coglitore's girlfriend, so he was trying to comply and
make sure there was no over-occupancy, and he was never made aware of alleged
over-occupancy in 2016. He said this was a pre-existing nonconforming property, and
was rented to students for many years prior to the 2012 ordinance. He said he was
asking that the Council acknowledge the property was not subject to the 2012
ordinance, otherwise it would be an unconstitutional taking.
Council President Brendmoen asked whether that was a taking because he couldn't
rent to anyone or because he couldn't rent to students. Mr. Solfest said it was because
it was limiting who it could be rented to and limiting the use. He said technically there
was no requirement for a Certificate of Occupancy as a student dwelling because it
was a pre-existing nonconforming use. He said there had been no proceeding or just
compensation given for the taking based on a revocation. He said there were a number
of other factual and legal errors, including the procedural issue of not providing a
warning before any revocation. He said it was his understanding, based on testimony
at the BZA hearing, there had never been another revocation of the student housing
ordinance. He said there was a state to Mr. Coglitore by the City that if there was
another violation they would revoke the Certificate of Occupancy. He said they were not
waiving the argument that Mr. Coglitore was exempt from the ordinance but wanted to
point out the actions from a fairness standpoint. He reviewed the circumstances.
Council President Brendmoen told Mr. Solfest to focus on the errors in the BZA
decision, and asked what Mr. Solfest was driving at. Mr. Solfest said his point was that
Mr. Coglitore acted on what he was told, and the City took action directly converse to
that. He said Mr. Coglitore had improved the property and tried to be a good neighbor,
and wanted to be on good terms with the City. He said he was asking that the Council
acknowledge or confirm that this was a nonconforming pre-existing use, overturn the
revocation, and re-issue the Certificate of Occupancy.
Appellant Kyle Coglitore said this was his only source of income and it was being
taken away. He said the story was being told in a certain way to portray him in a certain
way, and he understood that they didn't want college kids on that block. He said via a
phone call Inspector Neis told him the property was over-occupied but via email he

said he hadn't seen it over-occupied but had been told by the tenant. He said when Mr.
Neis checked the following day there was no one there; Mr. Coglitore said he had never
seen it over-occupied. He said Mr. Neis told him if he messed up again he would lose
his student rental license. He said after Mr. Neis left he spoke with "the boys," who
said they were going to move back in. He said he didn't know what kind of situation
that would put him in, so he had his girlfriend call in the complaint, and then he was
blind-sided by the revocation. He said Mr. Neis told him the revocation was based on
an anonymous complaint, and he told Mr. Neis he had made the call. He said Mr. Neis
didn't believe him in spite of documentation he provided. He said he got everything else
done, tried to comply, to be translucent and do what the City wanted him to do. He said
Mr. Benner said his only chance to get (the Certificate of Occupancy) back would be
to get approval from the district council. He said he went to District 13 and found it was
a setting where it was hard for him to get his story across. He said Mr. Neis attended
the meeting and shared information that wasn't true. He said the same thing happened
at the BZA meeting, and he was portrayed in the wrong light and not given a chance.
He said he was asking to be given a chance. He said he had done everything that had
been asked of him and was attending Landlord 101 the next day.

Councilmember Henningson moved to close the public hearing. Yeas - 6 Nays - 0
Councilmember Henningson said it was not about behavior or about sending a
message, but was about over-occupancy. She said reviewing the facts in the record
she didn't see any errors. She said the March 2016 discrepancy was of concerns but,
the student zoning overlay it didn't say a property had to be over-occupied twice to
have the Certificate of Occupancy revoked. She moved to deny the appeal and adopt
the finding of the BZA.
Councilmember Noecker asked Mr. Neis whether a follow-up inspection was conducted
after the call came in, allegedly from the girlfriend. Mr. Neis said at that time the home
was vacant. He said they had decided to vacate the entire home, and the owner then
did the renovations. Councilmember Noecker asked for clarification. Mr. Neis said he
didn't have the record of when he went back, and would have to look it up.
Council President Brendmoen said the exact date wasn't necessary; she asked
whether he had re-inspected in September following that second phone call. Mr. Neis
said he couldn't recall when the next inspection was, but he remembered Mr. Coglitore
saying he was going to vacate the home at that time. He said when he re-inspected
everything was done and the house was vacant.
Councilmember Noecker confirmed with Mr. Neis that there was one documented
complaint and find of over-occupancy. She said she appreciated Councilmember
Henningson's clear laying out of the issue before the Council. She said in this case the
facts in front of the BZA were concerning to her, and the question regarding the March
2016 allegation of over-occupancy was significant because the City didn't function on a
one strike and you're out basis. She said the minutes of the BZA showed there was

discussion about the March 2016 incident which never happened, and she was
concerned that the BZA made their decision in part on a fact that wasn't correct.
Councilmember Henningson noted that March 13 was the deadline for a decision and
an extension had already been granted. She noted that AMANDA showed an
inspection on September 18 at which orders were issued. Mr. Neis clarified that the
over-occupancy after September 15 never occurred because it was prevented by DSI
finding out about it proactively. Councilmember Noecker again confirmed that it only
happened once.
Council President Brendmoen said it was difficult to evaluate, but the over-occupancy
was clear. She sai she would support the denial of the appeal but was open to input
from her colleagues. She said it was complicated but the over-occupancy was clear
and was proven.
Councilmember Noecker reiterated her concerns and said she would vote against the
denial of the appeal.
Councilmember Tolbert asked Assistant City Attorney Virginia Palmer whether she
had any concerns about the findings on which Councilmember Henningson was basing
her motion.
Ms. Palmer said the Council had look at the findings as a whole and not as individual
facts. She said she didn't think they were in a position to determine whether that one
fact impacted the outcome. She said the Council's review of any decision would be
based on the record in its entirety.
Councilmember Henningson said the other thing to note was that in the five years of
the student zoning overlay there had never been a revocation, because the bar for
proving over-occupancy was high, and it was proven in this case.
Councilmember Tolbert said based on all of the facts together, it was very clear, and
the Council should deny the appeal.
