Councilmember Jalali Nelson said she had laid the matter over to get more information
and determine the best course of action. She moved to reduce the fine to $1000 and
stay the license suspension pending further violations, to acknowledge the violations
were occuring but also acknowledge the communication challenges by DSI and the
progress made by the licensee toward meeting the requirements.
Council President Brendmoen said it was customary to place time parameters on the
stayed penalty. Councilmember Jalali Nelson said six months.

LEGISLATIVE HEARING ITEMS FOR DISCUSSION
26 RLH TA 18-564 Ratifying the Appealed Special Tax Assessment for property at 185
COMO AVENUE. (File No. J1901E, Assessment No. 198300)
Legislative Hearing Officer Marcia Moermond gave a staff report on the assessment for
excessive consumption, charged because the work was not done at the time of
re-inspection. She said orders were issued to remove show on April 18, and staff
re-checked on the 19th; she said the 24-hour turn-around was due to three snow
abatements in the previous month. She displayed a photograph of snow conditions at
the time of re-inspection. She said the Parks crew came on April 23 and found that the
work was complete, so the assessment cost being considered was not for work done
but for dispatching a crew out when it wasn't needed. She noted that the property had
transferred ownership since the Legislative Hearing. In response to a question from
Councilmember Thao, she said the assessment was $157.
Former property owner Patrick Carlone said the property was sold October 4, 2018,
and they were victim of a false complaint. He said the when City workers arrived a false
alert, they were dispatched to another location. He said he had never heard of a victim
paying for a false response by emergency responders or City public workers, and the
person who made the false complaint was in violation of the law. He said when City
crews came, the snow was already removed and they were merely relocated to another
location and no time was lost by the City. He said he didn't feel they should be
assessed the fine. He said if an investigation were conducted he was sure it would be
proven that a City or Ramsey County employee made the false report.
Councilmember Thao moved to close the public hearing. Yeas - 6 Nays - 0
In response to questions from Councilmember Thao, Ms. Moermond confirmed that
the property was under new ownership, and clarified that in most cases money would
be escrowed at closing to cover the cost of pending assessments. Councilmember
Thao confirmed with Ms. Moermond that Mr. Carlone understood or was at least
informed of that. Ms. Moermond said she hoped that was the case.
Councilmember Thao moved to adopt Ms. Moermond's recommendation.

Legislative Hearing Officer Marcia Moermond said she'd been asked to read into the
record that she was asking the Council to amend the resolution to state that the
nuisance condition had been abated and the Certificate of Code Compliance issued.
Councilmember Thao moved the amendment. Yeas - 6 Nays - 0
No one was present to testify. Councilmember Thao moved to close the public hearing
and approve the resolution as amended.

61 RLH TA 18-656 Ratifying the Appealed Special Tax Assessment for property at 1240
RICE STREET. (File No. J1905A, Assessment No. 198504)
Legislative Hearing Officer Marcia Moermond gave a staff report on the assessment for
a property clean-up; she reviewed the dates and displayed photographs. She said the
owner stated in Legislative Hearings that he had received the orders but was having
problems with the occupant who had purchased the property on a contract for deed,
and he didn't feel safe going to the property. She said this was the first of at least three
assessments heard in Legislative Hearings, and she had taken his concerns under
advisement. She said her recommendation was to approve the assessment, as City
crews had done the work and it was not the responsibility of the taxpayers to step into
this private dispute to make sure the property was maintained. She showed
photographs. In response to questions from Council President Brendmoen, she said
the additional assessments would be coming before the Council. The before and after
videos of the clean-up were shown, showing that the front yard had already been cut
when crews arrived, and the side and back yards were cut by City crews.
Council President Brendmoen invited the appellant to testify. She said it didn't appear
he was disputing that the work had been done by the City, so the issue to be
addressed was whether the work should be paid for by the property owner or the rest of
the taxpayers.
In opposition:
Property owner Herbert Zworn, Moundsview, said he understood the orders and his
responsibilities. He said he had initiated eviction proceedings prior to the orders being
issued and the situation became acrimonious. He said, in addition, the courts were so
backlogged, the matter was carried over for an additional six weeks, which caused the
problem being discussed. He noted that the video showed that the front yard had been
done; he said he had gone over and started to to that, and there as a drive-by situation
where his life was threatened. He said he was held hostage when he tried to collect
rent, and police were called to the property on four separate occasions because of
death threats against him. He said they destroyed the property. He said extra deputies
were present during the court proceedings due to the hostile situation, and he was
prevented from doing any work at the property by the suggestion of the court. He said
he had conversations with the inspection department and had an agreement where they
understood the situation and would work with him on it; he said that was with
(inspector) Sean Westenhofer. He said he then received a letter from another
inspector, Richard Kedrowski, telling him that he wanted the additional work done. He
said he called Mr. Kedrowski who said he didn't care what the previous agreements
were, and the orders had to be complied with. He asked the Council what he was
supposed to do given the situation, and said he felt it was unfair that he be assessed
all of these charges. He said he had entered into an agreement (with Ms. Moermond)
that the assessments would be reduced but hadn't received documentation of that. He
said he wasn't sure what was going on but didn't feel it was his responsibility to pay
these levies.
Council President Brendmoen said she could understand if there was some confusion,
especially if there were several different orders; she said the video showed other issues
besides the tall grass and weeds being considered in this hearing. Mr. Zworn said he
entered into an agreement with the inspection department, but because of what he
thought were ego problems and poor communication in the inspection department, he
was being assessed penalties and fines. He said he entered into an agreement in full
faith that he was working with the inspection department and it was overridden by
another inspector, and it was his understanding that when you were working with the

inspection department on a property you only had to deal with one.
Council President Brendmoen moved to close the public hearing. Yeas - 6 Nays - 0
Council President Brendmoen asked Ms. Moermond to clarify the agreement with
inspectors. Ms. Moermond said Mr. Zworn mentioned in the hearing that he believed
there was going to be a forbearance on enforcement due to his private legal dispute.
She said there was testimony from the department that they did not enter into
forbearance agreements or agreements not to enforce the code, although they wanted
to be aware of these circumstances and to do what they could. She said this was not a
circumstance where there would simply not be an order issued if there was a violation
of the code. She clarified that this was not a fine or fee, but the cost the City incurred
in doing the work. She said she believed she had amendments to the other
assessments Mr. Zworn referred to, but, as with all changes, they would come forward
in the form of an amended resolution so it was a public document. She said it was not
standard practice to send a separate letter sent to the appellant, although in this case
Mr. Zworn had received an email informing him of Ms. Moermond's recommendation for
this assessment.
Council President Brendmoen said she was sorry that this investment and the contract
for deed ended up being a bad risk and had become a scary situation, but that City
staff did go out and do the work, and unfortunately that was a cost that needed to be
borne by Mr. Zworn or the tenant. She said she would move to adopt Ms. Moermond's
recommendation but her office would assist Mr. Zworn in getting the property back on
line as a rental property.

Council Meeting Information
The City Council is paperless which saves the environment and reduces expenses. The
agendas and Council files are all available on the Web (see below). Council members use
iPads to review the files during the meeting. Using the iPad greatly reduces costs since most
agendas, including the documents attached to files, are over 1000 pages when printed.
Web
Meetings are available on the Council's website. Email notification and web feeds (RSS) of
newly released minutes, agendas, and meetings are available by subscription. Visit
www.stpaul.gov/council for meeting videos and updated copies of the agendas, minutes, and
supporting documents.
Cable
Meetings are live on St Paul Channel 18 and replayed on Thursdays at 5:30 p.m., Saturdays at
12:30 p.m., and Sundays at 1:00 p.m. (Subject to change)
