Note that Subsections 9.05(aa)1. – 3. are not being amended by this Ordinance. 9.05(aa) Except as herein permitted, no person may park, stop, or leave standing any vehicle in the following places unless authorized by permit issued by the City of Stevens Point or a designated representative. The City reserves the right to allow any unrented stalls to be returned to general purpose parking which is consistent with the other parking in the area in which case the Ordinance governing time limits and restrictions of adjoining non-rented parking in Section 9.05 (aa) of the Revised Municipal Code shall apply. No permits shall be issued to any vehicle or other instrumentalities designed for or modified to accommodate human habitation. Such restriction includes but is not limited to recreational vehicles, campers, camper vans, camper trailers, and other similar vehicles. Any permit which is issued for a vehicle of a type not allowed under this section is automatically. SECTION II: That Subsection 9.09(4) of the Revised Municipal Code, Exceptions to the Abandoned Vehicles ordinance, is hereby amended to read as follows: 9.09(4) Exceptions. This Section shall not apply to a vehicle in an enclosed building, a vehicle in an appropriate storage space or depository maintained in lawful place and manner authorized by the City of Stevens Point or a vehicle parked in a metered or paid lot or parking space where the required fee has been paid and meter activated. For vehicles parked in a City-owned parking lot where overnight permit parking is allowed and for which a parking permit has been issued by the City for such vehicle, the 48-hour rule under Subsection (3) shall not apply. However, any such vehicle must be property registered and must be operable. Any vehicle parked in any City-parking lot which is not registered and operable may be considered abandoned under this Section if it remains in such state for a period longer than 72 hours. SECTION III: This ordinance shall take effect upon passage and publication, as provided by law. APPROVED:_________________________ Mike Wiza, Mayor Page 23 of 26 ATTEST: _________________________ Susan Pagel, City Clerk Dated: June 10, 2026 Approved: July 20, 2026 Published: July 24, 2026 Page 24 of 26 ORDINANCE AMENDING THE REVISED MUNICIPAL CODE OF THE CITY OF STEVENS POINT, WISCONSIN The Common Council of the City of Stevens Point do ordain as follows: SECTION I: That subsection 24.57 of the Revised Municipal Code, Prohibited Use of 911 System, is hereby created to read as follows: 24.57 HABITATION IN VEHICLES UPON CITY STREETS AND PROPERTY PROHIBITED (1) Definitions. (a) “City street” means the entire right of way area of every street identified on the official street map of the City of Stevens Point as such term used in Wisconsin Statutes § 62.23(6). (b) “Human habitation” shall mean the use of a vehicle for a dwelling. Evidence of human habitation shall include activities such as sleeping, housekeeping or cooking, and/or any other activity where it reasonably appears, considering all of the circumstances, that a person or persons is using the vehicle as a living accommodation. The use of a vehicle for six or more consecutive hours for eating, resting, recreating and/or sleeping shall per se constitute “human habitation” for purposes of this Section. (c) “Vehicle” means any car, truck, van, trailer, camper, RV or other enclosed or semi-enclosed device used for the transportation of persons, goods, materials or other items. This includes convertibles and other vehicles without rooves or with removable body panels and/or doors. This also includes trailers of all kinds regardless of whether they are connected to a motor vehicle. (2) Habitation in vehicles prohibited: (a) No person shall engage in human habitation in any vehicle parked upon any public street within the City of Stevens Point. (b) No person shall engage in human habitation in any vehicle parked upon any property owned, occupied, or in the possession of the City of Stevens Point. This includes but is not limited to City-owned parking lots. This prohibition applies regardless of whether the vehicle being used for habitation is lawfully parked or whether the vehicle is subject to a permit allowing it to be parked overnight in any City-owned parking lot. SECTION II: That a portion of Subsection 24.27 of the Revised Municipal Code of the City of Stevens Point, Exhibit A Schedule of Cash Deposits, is hereby created to read as follows: 24.57 Vehicle Habitation Prohibited………………..……………..First offense $50.00 Page 25 of 26 Second and Subsequent offense $100.00 SECTION III: This ordinance shall take effect upon passage and publication, as provided by law.
