City Attorney Prell addressed the committee reporting that an agreement
had been made with WI Cstore owner Mallik Panda in which the owner
agreed with all aspects of the City’s Complaints, and further agreed that
the Committee should recommend non-renewal of the licenses at both
locations to the City Council. Mr. Panda, after hearing the explanation
from City Attorney Prell expressed his agreement to the committee.
Pursuant to Wisconsin Statute § 19.85(g), which states: “Conferring with
legal counsel for the governmental body who is rendering oral or written
advice concerning strategy to be adopted by the body with respect to
litigation in which it is or likely to become involved,” upon motion made
and seconded, the Committee will go into Closed Session.

Chair Graskey addressed the hearing attendees: “The committee the
committee has decided to adopt the recommendation of the City Attorney
to non-renewal the licenses stated in the city's complaints for 311 and 406
Belknap Street. The committee adopts the facts stated in those complaints
on the basis that the city and the owners agreed with the statements in the
complaints. I will ask the owners of that to confirm once again, on the
record, that they agree with the complaints. (Mr. Panda expressed verbal
agreement). The committee will issue a written statement with by mail to
be delivered to you in five to six days. This hearing is now adjourned.”

City Attorney Prell addressed the committee reporting that an agreement
had been made with owners of Alyce’s Palace. The licensee has now
relinquished their request for renewal and no action would be required
from the committee or council. Their current license remains active
through June 30, 2026.
MOTION TO RECEIVE AND FILE by Councilor Herrick, was
seconded by Councilor Sweeney, and carried via voice vote.
4.2. Pursuant to Wisconsin Statute § 19.85(g), which states: “Conferring with legal counsel

Re: Ordinance No. O26-xxxx – Citation Authority for Designated Trails and Routes
Background
The attached ordinance proposes amendments to Chapter 1 of the City Code to provide a
clear enforcement mechanism for violations of City Code § 90-360, governing designated
trails and routes.
While § 90-360 establishes the regulations applicable to designated trails and routes, it is
not currently included within § 1-14 of the City Code, which identifies ordinance provisions
that may be enforced through the municipal citation process. This amendment addresses
that omission.
Summary of Proposed Changes
The ordinance makes the following changes:
1. Adds Section 90-360 to the list of ordinances enforceable by citation.
o The ordinance amends Section 1-14(b) to include City Code Section 90-360
(Designated trails/routes) among those provisions that may be enforced
through issuance of a municipal citation.
2. Assigns citation authority.
o The ordinance designates both the Chief of Police and the Director of Parks
& Recreation as enforcement officials authorized to issue citations for
violations of Section 90-360.

o This change recognizes that Parks & Recreation staff are often responsible
for oversight and management of the City’s trail system and places citation
authority with personnel who routinely observe violations in those areas,
while preserving concurrent enforcement authority for the Police
Department.
3. Establishes the applicable forfeiture deposit.
o The ordinance amends Section 1-14(c)(1) to add Section 90-360 to the
existing deposit schedule.
o Violations would carry a $50.00 deposit, plus applicable penalty
assessments and court costs, consistent with several other municipal
ordinance violations.
Purpose
The proposed amendments provide an efficient and practical enforcement mechanism for
trail and route regulations. By expressly authorizing designated City officials to issue
municipal citations and by incorporating Section 90-360 into the City’s deposit schedule,
the ordinance promotes consistent enforcement, encourages compliance with trail
regulations, and improves the City’s ability to address violations without requiring
additional ordinance amendments in the future.
Recommendation
I recommend that the Licensing and Fees Committee approve Ordinance No. O26-xxxx and
forward it to the Common Council with a recommendation for adoption.

AN ORDINANCE INTRODUCED BY THE LICENSES AND FEES COMMITTEE
AMENDING THE CITY CODE, CHAPTER 1 – GENERAL PROVISIONS, SECTION 1-
14 – CITATIONS AND DEPOSIT FOR VIOLATION OF CERTAIN PROVISIONS, TO
ASSIGN CITATION AUTHORITY FOR DESIGNATED TRAILS AND ROUTES
The Common Council of the City of Superior, Wisconsin, does ordain as follows:
SECTION 1. City Code, Chapter 1 – General Provisions, Section 1-14 – Citations and
Deposit for Violation of Certain Provisions, Paragraph (b) – Listing of sections enforceable by
citation, is hereby amended by adding the following:

SECTION 2. City Code, Chapter 1 – General Provisions, Section 1-14 – Citations and

(1) Sections 22-2, 22-5, 22-31, 22-35, 70-61, 90-360, $50.00 plus penalty assessments and
costs;
SECTION 3. All ordinances and parts of ordinances in conflict herewith are hereby
repealed.
SECTION 4. If any section, subsection, sentence, clause or phrase of this ordinance is for
any reason held to be invalid or unconstitutional by reason of any decision of any court of
competent jurisdiction, such decision shall not affect the validity of any other section, subsection,
sentence, clause or phrase or portion thereof.
SECTION 5. This ordinance shall take effect and be in force from and after its passage
and publication, as provided by law.

RE: License Process & Ordinance Review: Outdoor Alcohol and Sidewalk Cafes
The Clerk's Office is seeking feedback from the License and Fees Committee regarding the
City's Outdoor Alcohol Consumption License and Sidewalk Café License ordinances.
In working with businesses utilizing these licenses, we have found that their use has evolved
over time beyond the ordinance-prescribed framework. There may be opportunities to simplify
the licensing process, reduce overlap between the two provisions, and improve how licensed
premises areas are identified and reported. One concept for discussion is whether use of City-
owned sidewalks could be incorporated into the Outdoor Alcohol Consumption License rather
than maintaining a separate Sidewalk Café licensing process.
This item is for discussion only. Committee feedback will help guide the Clerk's Office in
evaluating potential ordinance amendments for future consideration.

Sec. 14-58. Premises.
(a) No holder of a license authorized by this chapter may enlarge the licensed premises without first submitting
to the fire chief and chief of building inspection, or their designees, and the common council a specific
written description of the enlargement, or statement as to why the enlargement is needed and an
illustration showing the location of fixtures, entrances and furniture in the enlarged areas. No premises shall
be enlarged unless the provisions of this section have been met and the enlargement has been inspected by
fire and building inspection representatives, and approved by the fire chief, chief building inspector and the
common council.
(b) Each individual partnership/corporation wishing to amend their premises for a special event must complete
an application provided by the clerk which includes information required by the fire inspector, building
inspector, health inspector and police chief. Application must be filed 15 days prior to council action. No
premises may be amended for a special event unless the provisions of this section have been met and the
application has been approved by the fire inspector, building inspector, health inspector, police chief and
common council.
(c) Outdoor alcohol consumption license. No licensee authorized under this section shall permit the sale, service,
or consumption of alcohol on any unenclosed part of the licensed premises or adjacent premises owned or
leased by the licensee except when granted an outdoor alcohol consumption license by the common council.
The license is a privilege in which no rights vest and therefore, may be revoked for violations of any
provisions.
(1) Application. An application shall be made in writing on the form prescribed by the city clerk and must
include a site plan drawn to scale and dimensions showing the location of fixtures, entrances/exits and
furniture; and shall accurately describe the outdoor area and the nature of fencing or other measures
intended to provide control over the operation of the outdoor seating area. The area in which the
outdoor alcohol license is to be granted must be clearly delineated from the adjacent non-licensed
property by the installation of a fence, railing, wall, or by an obvious change in the surface such as
paving stones or concrete slab. (All applicable building/fire codes apply.)
(2) Approval.
a. All initial applications must be approved by the common council, after recommendation for
approval by the following departments: police and fire, and the license and fees committee.
Renewals will be approved by the common council with other applicable alcohol renewal
applications.
b. In making their determination on whether or not to recommend approval of an outdoor alcohol
consumption license, the license and fees committee shall, on a case-by-case basis, take into
consideration public safety; size of the outdoor area; location with respect to adjacent residential
uses and neighborhood conditions; noise; parking; hours of operation; harmful, offensive or
otherwise adverse impact to the surrounding neighborhood; and security and monitoring of
alcohol consumption when recommending the license be granted as requested, modified for
denied.
(3) Control over area. A licensed operator shall have control over the outdoor seating area at all times the
outdoor seating area is in operation and the area shall be capable of being constantly observable by
serving or security personnel.
(4) Amplified sound. Amplified sound, such as music, is permitted but may not be audible outside of the
outdoor seating area unless a one-day outdoor cabaret license has been obtained. Outdoor music is
limited to the following hours: Sunday—Thursday from 12:00 p.m.—10:00 p.m., and Friday—Saturday
from 12:00 p.m.—12:00 a.m.

(5) Improved surface. The outdoor area must be suitable for pedestrian traffic. The appearance, lighting,
signage, visual barriers must be reasonably compatible with the surrounding area.
(6) Fee. There shall be an initial application fee of $100.00; and no renewal fee if there are no changes to
the outdoor area.
(7) Time of operation. The outdoor seating area may only be open during regular business hours. No one
may be in the outdoor seating area beyond those hours unless they are employees of the licensed
premise and are actually involved in the process of clean-up, maintenance or repair. The shift
commander of the police department has the authority to order any outdoor seating area to be closed
down at any time the shift commander believes it is in violation of this ordinance.
(8) State statutes enforced within outdoor seating area. Every licensee under this section shall comply with
and enforce all provisions of Wis. Stats. ch. 125, applicable to Class "B" licensed premises, except
insofar as such provisions are clearly inapplicable. Violation of the provisions of Wis. Stats. ch. 125,
shall be grounds for immediate revocation of the outdoor alcohol beverage license by the common
council.

ARTICLE X. SIDEWALK CAFÉ LICENSE
ARTICLE X. SIDEWALK CAFÉ LICENSE
Sec. 74-260. Definition.
Establishments holding a full service restaurant license from the State of Wisconsin may be eligible for a
sidewalk café license to allow sidewalk café seating for service of food and beverages on the public sidewalk
directly adjacent to the establishment.

Sec. 74-261. License required; application; license fees.
No person or establishment may operate a sidewalk café within the city without having secured a license
from the city clerk. Application for [a] sidewalk café license shall be made in writing on the form prescribed by the
city clerk and must include a site plan drawn to scale and shall accurately describe the café area and furniture, and
shall indicate the nature of fencing or other measures intended to provide control over the operation of the café
seating area. The license period is July 1—June 30. There shall be an initial application fee of $100.00; and no
renewal fee if there are no changes to the outdoor area.

Sec. 74-263. Surface.
(a) The entire sidewalk surface for the proposed sidewalk café must be paved. For purposes of this section, a
paved surface includes: concrete, asphalt, cement, brick, pavers, or other impervious surface. The
appearance, lighting, signage, visual barriers must be reasonably compatible with the surrounding area.
(b) An establishment is not eligible if the café placement would present a safety hazard due to any other
elements of the topography or layout of the sidewalk, regardless of the width or square footage of the
adjacent public sidewalk, or would impede pedestrian traffic.

Sec. 74-264. Hours.
All tables, chairs, barriers and other items relating to the sidewalk café may not be in place prior to 10:00
a.m. and must be removed by 10:00 p.m. nightly.

Sec. 74-265. Lease and insurance requirements.
A lease with the City of Superior, and a certificate of commercial general liability insurance, in the amount of
$1,000,000.00, designating the City of Superior as an additional insured for the sidewalk café site, is required.

Sec. 74-266. Outdoor alcohol consumption at a sidewalk café.
(a) If a sidewalk café has an outdoor alcohol consumption license, as outlined in chapter 14, food service shall be
required to be available at all times the sidewalk café is open. Consumption of alcohol shall be limited to
persons seated at tables in the sidewalk café site.
(b) Each sidewalk café serving alcohol shall be responsible for control of the area to be sure customers are of the
legal drinking age, and that alcohol beverages are not removed from the sidewalk café area.
