Sec. 21-60. Adoption of published code.
(a) Adoption of Code. The City Council hereby adopts, for the purpose of establishing administrative provisions,
rules, and regulations specific to one-family and two-family residential construction, alteration, enlargement,
repair, equipment, use, occupancy, maintenance, location, appurtenances, and accessory structures, that
certain building code known as the 2024 2021 International Residential Code for One and Two Family
Dwellings, published by the International Code Council, save and except such portions as are hereinafter
deleted, modified, or amended. Copies of the aforesaid code shall be maintained on file with the city
secretary and the city's department of development services. The aforesaid code is hereby adopted and
incorporated as fully as it set out at length herein, and from the date on which this section shall take effect,
the provisions thereof shall be controlling in the construction of all one-family and two-family dwellings and
other structures therein regulated within the corporate limits of the city.
(b) Controlling Law. Compliance with the provisions of the International Residential Code in the construction or
renovation of structures to which said code is applicable shall constitute a defense to a claim of
noncompliance with a provision of the International Building Code adopted at Section 21-60 of this Article,
the Existing Building Code adopted at Section 21-68 of this Article, the International Mechanical Code
adopted at Section 21-72 of this Article, the International Plumbing Code adopted at Section 21-75 of this
Article, or the National Electrical Code adopted at Section 21-82 of this Article. Compliance with the
provisions of the International Building Code adopted at Section 21-64 of this Article, the Existing Building
Code adopted at Section 21-68 of this Article, the International Mechanical Code adopted at Section 21-72 of
this Article, the International Plumbing Code adopted at Section 21-75 of this Article, or the National
Electrical Code adopted at Section 21-82 of this Article shall constitute a defense to a claim of noncompliance
with a provision of the International Residential Code other than Chapter 11 of the International Residential
Code.
Sec. 21-61. Definition.
(a) Wherever the term "building official" is used in the International Residential Code, it shall be held to mean
the director, as defined in Section 2-80 of the Victoria City Code.

Sec. 21-63. Amendments to published code.
(a) The following portions of the International Residential Code are hereby amended:
(1) Section R101.2 Scope. Exception: shall be amended to read: "The following shall be permitted to be
constructed in accordance with this code."
(2) Section R112 Board Means of Appeals is deleted in its entirety and replaced with the following:
"Section R112 Right of Appeal and Provisions Inconsistent with the International Residential Code.
R112.1 Right of Appeal. The Board of Adjustments and Appeals shall hear appeals and requests for
variances to the provisions of this code with respect to the trades represented by the provision being
appealed or varied. Said appeals and requests for variances shall be heard and recommended in
accordance with Sections 2-94 and 2-95 of the City Code."
(3) Chapter 2 Definitions is amended to add the following definition: "DECORATIVE COATING. A single coat
of plaster, cementitious or other approved material applied to a concrete or masonry surface for
cosmetic purposes only."
(4) Chapter 2 Definitions is amended to add the following definition: "PROJECTION FACTOR. The ratio of
the horizontal depth of an overhang, eave, or permanently attached shading device, divided by the
distance measured vertically from the bottom of the fenestration glazing to the underside of the
overhang, eave, or permanently attached shading device."
(5) Table R301.2(1) Climatic and Geographic Design Criteria is amended by adding the following entries in
the appropriate columns:

(6) Section R301.2.1 Wind design criteria is amended to read:
Buildings and portions thereof shall be constructed in accordance with the wind provisions of this code using
the ultimate design speed in Table R301.2(1) as adopted.
(7) Table R302.1(1). Table R302.1(1) is amended to reduce all requirements of a 5' separation distance to a
3' separation distance.
(7) Section R302.1.1 Exterior walls on zero lot lines is added to read as follows:
"The provisions of Section 302.1 shall not apply if the approved and recorded final plat of the
subdivision provides an interior side yard setback of a minimum of nine feet on one side of the lot, and
the setback contains an easement at least six feet wide running along the length of the side of the lot
that prohibits the construction of combustible building material in said easement."
(8) R302.5.1 Opening protection is amended to read: Openings from a private garage directly into a room
used for sleeping purposes shall not be permitted. Other openings between the garage and residence
shall be equipped with solid wood doors not less than 1 ⅜ inches (35mm) in thickness, solid or
honeycomb core steel doors not less than 1 ⅜ inches (35mm) thickness, or 20-minute fire-rated doors.
(10) R302.6 Dwelling-garage fire separation is amended to add Exception 1: "Exception: Concrete-filled
steel ally columns used in the structure supporting the separation shall not require a gypsum board
application."
(9) Section R311.2 R318.2 Egress door is amended to read: "At least one egress door shall be provided for
each dwelling unit. The egress door shall be side-hinged and shall provide a minimum clear width of 32
inches when measured between the face of the door and the stop, with the door open 90 degrees. The
minimum clear height of the door opening shall not be less than 78 inches in height measured from the
top of the threshold to the bottom of the stop. Other doors shall not be required to comply with these
minimum dimensions."
(10) Section R311.7.5.1 R318.7.5.1 Risers. The first sentence of the paragraph is amended to read: "The
maximum riser height shall be 8 inches (203 mm)."
(11) Section R311.7.5.2 R318.7.5.2 Treads. The first sentence of the paragraph is amended to read: "The
minimum tread depth shall be 9 inches (229mm)."

(12) Section R311.7.5.3 R318.7.5.3 Nosings. Exception is amended to read: "A nosing is not required where
the tread depth is a minimum of 10 inches."
(13) Section R311.7.8 R318.7.8 Handrails. All of Section R311.7.8 R318.7.8 is amended to read as follows:
"Handrails shall be provided on at least one side of stairways consisting of three or more risers.”
(14) Section R310.1 R319.1 Emergency escape and rescue opening required. The first sentence of the
paragraph is amended to read; "Every sleeping room shall have at least one operable emergency
escape and rescue opening." No other amendments are made to this section.
(15) Section R320.2 Height. is amended to read: “Handrails shall have a minimum height of 34 inches
(864mm) and a maximum height of 38 inches (965mm) measured vertically from the nosing of the
treads.”
(16) Section R320.5 Continuity. The first sentence of the paragraph shall be amended to read: “All required
handrails shall be continuous the full length of the stairs from a point directly above the top riser to a
point directly above the lowest riser of the stairway.”
(17) Section R312.1.1 R321.1.1 Where required is amended to read: "Guards shall be located along open-
sided walking surfaces of all decks, porches, balconies, stairs, ramps and landings that are located more
than 30 inches measured vertically to the floor or grade below. Insect screening shall not be considered
as a guard."
(18) Section R312.2 R321.2 Window fall protection shall be amended to read: "Where window fall
protection devices are provided, the device shall be installed in accordance with Sections R312.2.2
R321.2.1 and R321.2.2."
(19) Section R403.1.6 Foundation anchorage is amended to read: "Where wood sill and sole plates and
cold-formed steel framed walls are supported directly on continuous foundation walls or monolithic
slabs with integral footings, they shall be anchored to the foundation in accordance with this section.
Wood sole plates at all exterior walls, wood sole plates of braced wall panels at building interiors on
monolithic slabs with integral footings, and all wood sill plates shall be anchored to the foundation with
anchor bolts spaced a maximum of 6 feet (1829 mm) on center. Bolts shall be at least ½ inch (12.7 mm) in
diameter and shall extend a minimum of 7 inches (178 mm) into concrete or grouted cells of concrete
masonry units. A nut and washer shall be tightened on each anchor bolt. There shall be a minimum of two
bolts per plate section with one bolt located not more than 12 inches (305 mm) or less than seven bolt
diameters from each end of the plate section. Approved foundation anchorage spaced as required to provide
equivalent anchorage to ½-inch-diameter (13 mm) anchor bolts shall be permitted. Interior bearing wall sole
plates on monolithic slab foundations with integral footings that are not part of a braced wall panel shall be
positively anchored with approved fasteners. Sill plates and sole plates shall be protected against decay and
termites where required by Sections R317 R304 and R318 R305.
Exceptions:
1. Walls 24 inches (610 mm) total length or shorter connecting offset braced wall panels shall be
anchored to the foundation with a minimum of one anchor bolt located in the center third of the
plate section and shall be attached to adjacent braced wall panels at corners as shown in Item 9
of Table R602.3(1).
2. Walls 12 inches (305 mm) total length or shorter connecting offset braced wall panels shall be
permitted to be connected to the foundation without anchor bolts. The wall shall be attached to
adjacent braced wall panels at corners as shown in Item 9 of Table R602.3(1).3.
Exception 3 shall be added to read: Where the basic wind speed in accordance with Figure R301.2(2)
does not exceed 115 miles per hour (51 m/s), the seismic design category is A or B and Method GB in
accordance with Section R602.10 is used for a braced wall line on the interior of the dwelling, anchor

bolts shall not be required for the wood sole plates of the braced wall panels. Positive anchorage with
approved fasteners shall be provided."
(20) Section R502.3.3 Floor cantilevers is amended to read: "Floor cantilever spans shall not exceed the
nominal depth of the wood floor joist. Floor cantilevers constructed in accordance with Table
R502.3.3(1) and shall be permitted when supporting a light-frame bearing wall and roof only. The ratio
of backspan to cantilever span shall be at least 3 to 1."

(22) Section R602.8 Fireblocking required is amended to read: "In concealed spaces of stud walls and
partitions, including furred spaces, at the ceiling and floor level. Batts or blankets of mineral or glass
fiber or other approved non-rigid materials shall be allowed as fireblocking in walls constructed using
parallel rows of studs or staggered studs or in accordance with Section R302.11".
(20) Section R703.7.2 Plaster is amended to add the following sentence at the end of the first second
paragraph: "Decorative coatings applied to a concrete or masonry surface shall be installed in
accordance with the manufacturer's installation instructions and are not required to comply with Table
702.1 (1)."
(21) Section R905.2.6 Attachment is amended to read: “Asphalt shingles shall have the minimum number of
fasteners required by the manufacturer’s approved installation instructions, but not less than six
fasteners per strip shingle or two fasteners per individual shingle. Where the roof slope exceeds 21
units vertical in 12 units horizontal (21:12, 175 percent slope), shingles shall be installed in accordance
with the manufacturer’s approved installation instructions.”
(22) Section R908.3 Roof replacement is amended to read: "New roof coverings shall not be installed
without first removing existing roof coverings where any of the following conditions occur:
1. Where the existing roof or roof covering is water-soaked or has deteriorated to the point that the
existing roof or roof covering is not adequate as a base for additional roofing.
2. Where the existing roof covering is wood shake, slate, clay, cement, or asbestos-cement tile.
3. Where the existing roof has two or more applications of any type of roof covering.
Exceptions:
1. Complete and separate roofing systems, such as standing-seam metal roof systems, that are
designed to transmit the roof loads directly to the building's structural system and that do not
rely on existing roofs and roof coverings for support, shall not require the removal of existing
roof coverings.
2. Metal panel, metal shingle, and concrete and clay tile roof coverings shall be permitted to be
installed over existing wood shake roofs when applied in accordance with Chapter 9 of the
Victoria City Code.
3. The application of new protective coating over existing spray polyurethane foam roofing systems
shall be permitted without tear-off of existing roof coverings."
(23) Section N1101.4 Above code programs is amended to read: "The building official or other authority
having jurisdiction shall be permitted to deem a national, state, or local energy-efficiency program to
exceed the energy efficiency require by this code. Buildings approved in writing by such an energy-
efficiency program shall be considered in compliance with this code."
(24) Section N1101.13 Application is amended to read: "Residential buildings shall comply with Section
N1101.13.5 and Sections N1101.13.1, N1101.13.2, N1101.13.3, N1101.13.4 or shall meet the
requirements as per Table N1102.1.3 and meet the requirements of Sections 1101 through 1104 as
amended."
(25) Section N1102.1 General is amended to read: "The building thermal envelope shall comply with the
requirements of Sections N1102.1 through N1102.5 or shall meet the requirements as per Table
N1102.1.3 and meet the requirements of Section 1101 through 1104 as amended."

(27) Section N1102.2.3 N1102.2.4 Eave baffle is amended to read: "For air-permeable insulation in vented
attics, a baffle shall be installed adjacent to soffit and eave vents. Baffles shall maintain a net free area
opening equal to or greater than the size of the vent. The baffle shall extend over the top of the attic
insulation. The baffle shall be permitted to be any solid material. The baffle shall be installed to the

(29) Section N1102.3.2 N1102.4.2 Glazed fenestration SHGC exception is amended to add the following
paragraph and table: "In Climate Zone 2, permanently shaded vertical fenestration shall be permitted
to satisfy the SHGC requirements. The projection factor of an overhang, eave, or permanently attached
shading device shall be greater than or equal to the value listed in table N1102.2.3.1 (see below) for

Division 12. Swimming Pool and Spa Requirements
Section 21-87 Adoption of published code Requirements
There is hereby adopted by the city for the purpose of establishing rules and regulations for the
design, construction, installation, repair or alteration of swimming pools, public and private, and
equipment related thereto, that certain code known as the Standard Swimming Pool and Spa
Requirements Code, published by the Southern Building Code Congress International, Inc., being
particularly the 1982 edition thereof, save and except portions as are hereinafter deleted, modified
or amended, or which a copy is on file with the city secretary and a copy is on file with the
development services department and the same is hereby adopted and incorporated as fully as if
set out at length herein, and from the date on which this section shall take effect, the provisions
thereof shall control the matters to which they relate within the corporate limits of the city.
Section 21-88 Definitions
(a) Wherever the term "administrative authority or building official " is used in the swimming pool
and spa requirements code, it shall be held to mean the director, as defined in Section 2-80 of the
Victoria City Code.
(b) Wherever the term "swimming pool" is used in these requirements said code, it shall be held to
mean swimming pools and other constructed or prefabricated pools over eighteen (18) inches in
depth designed or used for swimming, bathing, relaxation, or therapeutic purposes.
(c) Commercial Public and Commercial Private swimming pools and spas shall comply with the
latest edition of the International Swimming Pool and Spa Code (ISPSC) as adopted by Chapter
214, Texas Local Government Code.

Section 21-89 Deletions to published code Permits, construction and maintenance.
(a) The following portions of the swimming pool code are hereby deleted:
(1) Chapter I, except section 105.3 - Application for Permit, and section 106 - Inspections,
which remain in effect.
(a) It shall be unlawful to hereafter construct, install or enlarge any swimming pool or spa
within the City without first obtaining a permit issued by the administrative authority.

(b) Failure to maintain any swimming pool, spa, and its appurtenances in a safe and sanitary
condition is hereby prohibited and declared to be a public nuisance.
(c) Applications for pool/spa permits shall be submitted for review accompanied by a detailed
dimensioned plot plan and pool construction or installation plan. The review may require
submission of other necessary plans, including an engineer seal, specifications and data
including capacity, rate of filtration, skimmers and suction devices, drain entrapment
prevention, backflow prevention and backwash devices, and drainage to an outlet point.
Applicable fees are as adopted by city ordinance.
(d) Plans to construct a swimming pool or spa shall be approved by the administrative authority
and by the local electrical and gas provider where applicable before construction is started.
(e) Construction of a swimming pool or spa shall not detour above ground water drainage to
the neighboring property and shall maintain the natural flow of drainage to the public storm
sewer.
(f) Swimming pools and spas shall comply with the required setbacks as adopted by the
Uniform Development Ordinance (UDO) and shall not encroach into easements unless
allowed under the UDO.
(g) Swimming pool placement shall maintain a five (5) foot separation from structures with
permanent foundations and three (3) feet open space on all other sides. For the purpose of
this requirement, attached spa pools, water features, and landscaping may encroach the
open space.
(h) All direct connections between swimming pools and the public potable water supply shall
be prohibited without a proper backflow prevention device or by an air gap as determined by
the adopted plumbing code.
(i) All direct connections between the swimming pool and the public sewer system shall be
prohibited. Swimming pools may be drained or pumped into the above-ground public storm
sewer. Swimming pools drained or pumped into the underground storm or sanitary sewer
shall be by means of an approved airgap and approved by the administrative authority.
(j) Where wastewater from swimming pools, backwash from filters and water from pool deck
drains discharge to the building drainage system, the discharge shall be through an indirect
waste pipe by means of an approved airgap.
(k) Pool equipment piping and design shall be by a certified pool installer.
(l) Swimming pool construction shall be maintained behind a temporary or permanent fence
with controlled construction access, and the pool shall not be filled with water without the
fence and locked or self-closing gates in place.
(m) Above ground swimming pools are exempt from subsections c, d, f, and g of Section 21-89
of these requirements.
(n) Swimming pools and Spas shall comply with the installation requirements set forth by the
latest adopted respective National Electrical Code or International Residential Code
electrical requirements.
(o) Pool Bond shall be installed bonding the body of water.
(p) All new associated electrical pool wiring including existing wiring surrounding the pool that
is in violation of the electrical pool code clearances or protection shall require a permit and
inspection and approval as new wiring or upgraded wiring as needed.

(q) New gas line piping shall require a permit, inspection and approval as required by the fuel
gas code.
Section 21-90 Amendments to published code Inspections
(a) It is the responsibility of the contractor of the permitted work to contact the administrative
authority for required inspections.
(b) Pool steel reinforcement shall be minimum #4 (1/inch) and concrete deck reinforcement
shall be minimum #3 (3/8 inch) rebar on 12” (inch) center minimum. Reinforcement
placement shall meet the requirements of the International Building Code. The inspections
shall be conducted before any concrete or Gunite or other cover material is installed.
(c) Pool steel and deck steel shall have a continuous unbroken #6 bond with approved bonding
clamps on at least four sides as per the International Residential Code and National
Electrical Code. All metal parts within the pool area shall be bonded including lights,
ladders, diving boards and chair lifts.
(a) The following sections of the swimming pool code are hereby amended:
(1) Section 315 - Final Inspection – (d) Final Enclosure Required. This section shall read as follows:
“All swimming pool and spa installations shall be completely enclosed with an approved wall,
fence or other substantial structure not less than four (4) feet in height and constructed as not to
have holes, gaps or openings more than (4) inches apart measured on a horizontal plane. Fences,
walls and structures shall not have any openings or gaps if constructed horizontally to create a
ladder effect.
All gates and doors opening through the required enclosure shall be equipped with an approved
and effective self-closing device and be self-latching for keeping the gate or door closed at all
times. The doors to the main dwelling unit or structures are exempt from the device.
The area under which the gate or door swings shall have a landing made to prevent the growth of
grass or vegetation that prevents the door from closing with additional hand pressure or force.
Gates and doors used for utility vehicle entrances or additional gates other than the main entrances
to the yard need not be designed to be self-closing if a lock is installed on the gate or door.
Permanent benches, structures and other appurtenances shall not be constructed within (3) foot of
the exterior side of the (4) foot fenced enclosure creating a step. Fences over (4) foot are exempt
from this requirement
; provided, that
Where a swimming pool or spa is not over thirty (30) inches in depth and sixty-five (65) cubic feet in
capacity, a substantial cover approved by the director equipped with child-proof locks
may be substituted for such enclosure. The owner shall have ultimate responsibility for
having the minimum size fence, enclosing wall, cover, or other substantial structure

A certificate of approval shall be issued for both the pool and the pool enclosure before the pool
