4. Approval of Minutes – The minutes from the April 7, 2026, meeting was approved by a roll call vote.
5. Amendments to Agenda – A motion was proposed to strike item 6B (video gaming) from the agenda, but the motion
failed due to a lack of a second.
6. Discussion of Monthly Reports – No discussion or motions were made
7. New Business
a. New Liquor License Application: Puerto Nevo- The commission reviewed a request for a new liquor
license for Puerto Nevo (120 West Roosevelt Road). After confirming the business model is a family-
oriented restaurant where alcohol sales will not exceed 50% of gross receipts, the commission voted to
recommend approval of Class “Quad I” (Restaurant with Bar, No Video Gaming) to the Village Board for
consideration.
b. Discussion of Outstanding Underage Service Tickets - An update was provided regarding outstanding
underage service violations. Out of 18 total cases, 9 have been settled, with efforts continuing to resolve
the remainder. Hearings for remaining cases are scheduled for June 2nd
c. Discussion of 4/27/26 Village Board Meeting Suggestions - The Commission discussed potential
amendments regarding how corporate ownership changes (e.g., a 5% threshold) trigger the need for a
new license. Concerns were raised about the feasibility of publicly traded chains. Trustees and
Commissioners debated the risks for business owners who invest in property before receiving formal
liquor license approval. The idea of an "advisory role" for the Commission was proposed to guide new
businesses before full application submissions. Multiple proposed ordinance amendments—including
changes to commission structure, tavern license definitions, and video gaming cafe classifications—were
tabled for further research and discussion at the next meeting.
d. Discussion of Signage Enforcement - It was clarified that current signage enforcement is being
conducted based on existing ordinances, not new policies initiated by the liquor commission itself.
e. Discussion of Proposed Ordinance Amendments from Village Attorney - Discussed formalizing a 50%
gross receipts rule for restaurants (excluding gaming). Reviewed license classes (E, G, L, Z), specifically
moving to define "video gaming cafes" more clearly and prohibiting gaming on banquet licenses (Class
L). Proposed adding a section to renewal applications to report food, alcohol, and gaming revenue for
transparency. Discussed transitioning from one-time background checks to a 5-year recurring
requirement. Multiple proposed ordinance amendments—including changes to commission structure,
tavern license definitions, and video gaming cafe classifications—were tabled for further research and
discussion at the next meeting.

Sec. 3-202. - Local liquor control commission created.
(a) Created; membership. A local liquor control commission is created which shall be
composed of five (5) members, who shall be appointed by the village president. The village
president shall not be a member of the commission and chairperson, however the village
president shall not vote on any matter before the local liquor control commission. The remaining
four (4) members shall be appointed by the village president. The members shall be qualified
electors of the village who have resided therein for one (1) year immediately preceding their
appointment. The village president shall also name two of the appointed members of the
commission as the chairperson and vice-chairperson of the commission, respectively.
(b) Term. The term of the appointed members shall be one (1) year. Members shall hold
office for their designated terms and until their successors have been appointed.
(c) Meetings, purpose and duties. The chairman chairperson shall preside over all meetings
of the local liquor control commission. The purpose of the local liquor control commission shall
be to assess and make recommendations regarding liquor license applications, to assess and
make recommendations regarding liquor ordinances within the village, and conduct formal
disciplinary hearings involving any licensee and make disciplinary recommendations following
those hearings. In furtherance of those purposes, the commission shall have and exercise the
following powers and duties:
(1) To review and assess original and renewal applications submitted to the local
liquor control commissioner as provided in Article 3 of this Chapter.

Sec. 3-303. – Classification
Village retail alcoholic liquor licenses are hereby divided into classes as follows:

(a) Class A-1—Tavern, beer and wine only, restricted: Class A-1 licenses shall authorize the
sale at retail of beer and wine only to patrons alcoholic liquors for consumption on the
premises described in the license and the sale of beer and wine at retail in original
packages but no sales of any alcoholic beverages for consumption off the premises
provided package sales shall be allowed up to 20% of overall sales, shall only be
permitted while tavern is in regular operation, and package sales are taxed the same as
poured alcohol. Video gaming is allowed but may only be active while alcohol service is

in operation. No A-1 license shall issue unless the proposed licensee has possessed an A-
3 or A-4 license for a period of at least eighteen (18) months.
(b) Class A-2 A —Tavern, unrestricted: Class A-2 A licenses shall authorize the sale at retail
of alcoholic liquors for consumption on the premises described in the license and the sale
of any alcoholic liquor at retail in original packages for consumption off the premises
provided package sales shall be allowed up to 20% of overall sales, shall only be
permitted while tavern is in regular operation, and package sales are taxed the same as
poured alcohol. Video gaming is allowed but may only be active while alcohol service is
in operation. No A-2 license shall issue unless the proposed licensee has possessed an A-
3 or A-4 license for a period of at least 18 months..
Class A-2 AA —Tavern, beer and wine only, no video gaming: Class A-2 AA licenses
shall authorize the sale at retail of beer and wine only to patrons for consumption on the
premises described in the license and the sale of beer and wine at retail in original
packages for consumption off the premises provided package sales shall be allowed up to
20% of overall sales, shall only be permitted while tavern is in regular operation, and
package sales are taxed the same as poured alcohol. Video gaming is prohibited.
(c) Class A-3 AA —Tavern, beer and wine only, no video gaming: Class A-3 AA licenses
shall authorize the sale at retail of beer and wine only to patrons for consumption on the
premises described in the license and the sale of beer and wine at retail in original
packages for consumption off the premises provided package sales shall be allowed up to
20% of overall sales, shall only be permitted while tavern is in regular operation, and
package sales are taxed the same as poured alcohol. Video gaming is prohibited.
Class A-3 A —Tavern, unrestricted: Class A-3 A licenses shall authorize the sale at retail
of alcoholic liquors for consumption on the premises described in the license and the sale
of any alcoholic liquor at retail in original packages for consumption off the premises
provided package sales shall be allowed up to 20% of overall sales, shall only be
permitted while tavern is in regular operation, and package sales are taxed the same as
poured alcohol. Video gaming is allowed but may only be active while alcohol service is
in operation. No A-3 license shall issue unless the proposed licensee has possessed an A-
1 or A-3 unrestricted license for a period of at least eighteen (18) months
(d) Class A-4 AAA Tavern, unrestricted, no video gaming: Class A-4 AAA licenses shall
prohibit video gaming terminals but shall authorize the sale at retail of alcoholic liquors
for consumption on the premises described in the license and the sale of any alcoholic
liquor at retail in original packages for consumption off the premises provided package

sales shall be allowed up to 20% of overall sales, shall only be permitted while tavern is
in regular operation, and package sales are taxed the same as poured alcohol. Video
gaming is prohibited. No A-4 license shall issue unless the proposed licensee has
possessed an unrestricted license for a period of at least eighteen (18) months
.

(i) Class E-1 E —Restaurant, restricted, beer and wine only: Class E-1 E licenses shall
authorize the sale at retail in restaurants of beer and wine only to patrons at tables on the
premises described in said license. Patrons are to be served only if they are seated at a
table. The alcoholic beverages are to be consumed only in the portion of the premises
described in the license in which food is ordered and served to patrons, and then only as
part of the food ordered by and served to said patrons provided that the sale of liquor may
only occur while food service is in operation and available to the public. Video gaming is
allowed. Full kitchen service must be available to the public during all operating hours
while alcoholic liquor is served, except the final two hours before closing. No E-1 license
shall issue unless the proposed licensee has possessed an E-2 or E-4 license for a period
of at least 18 months. produces less than fifty (50) per cent of the total gross receipts for
such restaurant and that a restaurant holding this license must derive at least fifty
percent (50%) of its annual gross receipts, excluding gaming revenue, from the sale
of food and non alcoholic beverages served in the restaurant, and shall provide
proof of compliance upon application, renewal, and upon request by the Village.
(j) Class E-2— Restaurant, beer and wine only, no video gaming: Class E-2 licenses shall
authorize the sale at retail in restaurants of beer and wine only to patrons on the premises
described in said license. The alcoholic beverages are to be consumed only in the portion
of the premises described in the license in which food is ordered and served to patrons
provided that the sale of liquor may only occur while food service is in operation and
available to the public, except the final two hours before closing. Video gaming is
prohibited and that a restaurant holding this license must derive at least fifty percent
(50%) of its annual gross receipts,, from the sale of food and non alcoholic beverages
served in the restaurant, and shall provide proof of compliance upon application,

(k l) Class E-4 EEE —Restaurant, Uunrestricted, (Nno video Ggaming): Class E-4 EEE
licenses shall prohibit video gaming but shall authorize the sale at retail in restaurants of
alcoholic liquors to patrons at tables on the premises described in said license. Patrons are
to be served only if they are seated at a table. The alcoholic beverages are to be consumed
only in the portion of the premises described in the license in which food is ordered and
served to patrons, and then only as part of the food ordered by and served to said patrons
provided that the sale of liquor may only occur while food service is in operation and
available to the public, except the final two hours before closing. Video gaming is
prohibited. produces less than fifty (50) percent of the total gross receipts for such
restaurant. No E-3 license shall issue unless the proposed licensee has possessed an
unrestricted license for a period of at least 18 months and that a restaurant holding
this license must derive at least fifty percent (50%) of its annual gross receipts, from
the sale of food and non alcoholic beverages served in the restaurant, and shall
provide proof of compliance upon application, renewal, and upon request by the
Village.
(l m) Class G F—Special events, by the day: Class G F licenses shall authorize the sale at retail
of beer and wine only by a bona fide educational, fraternal, political, civic, religious, or
nonprofit organization only, and only on special occasions, and only for consumption on
the premises described in the license, and only on the specific dates designated in the
license. Such license may be issued by the local liquor control commissioner, but only
upon evidence of proper liquor liability insurance coverage.
(n) Class G—Video Gaming Café: Class G licenses shall authorize the sale at retail of
alcoholic liquors for consumption on the premises described in the license and only if the
primary focus of the establishment is video gaming, to which the service of alcohol and
food is incidental to the operation of video gaming. An establishment shall be considered
a video gaming café if at least 60% of its gross revenue on an annual basis exclusively
from video gaming activities. The holder of a Class G license shall provide certified
financial records to the Village upon request to verify the establishment’s qualifications
for a Class G license. The pertinent financial records shall include financial statements,
business financial reports, State of Illinois tax information, and any other record deemed
acceptable by the Village.

(m o) Class H—Package, grocery or drug store: Class H licenses shall authorize the sale at
retail of beer and wine only, and only in original packages, and in no event to be
consumed on the premises described in the application of said license.
(n) Class I—Restaurant sit-down bar, unrestricted: Class I licenses shall authorize the sale at
retail of alcoholic liquor in restaurants to patrons, the same to be consumed by patrons
only at tables or at a bar on the premises described in said license. Patrons are to be
served only if they are seated at a table or at a bar.
(o) Class IIII—Restaurant sit-down bar, unrestricted: Class IIII licenses shall prohibit video
gaming terminals but shall authorize the sale at retail of alcoholic liquor in restaurants to
patrons, the same to be consumed by patrons only at tables or at a bar on the premises
described in said license. Patrons are to be served only if they are seated at a table or at a
bar.

(s) Class L— Class L licenses shall authorize the retail sale of alcoholic liquor for
consumption on premises described in the license where the business is that of a banquet
facility. A banquet facility is any place kept, used, maintained, advertised or held out as a
place where a prearranged private party, function or event for a specific social or business
occasion may be held, either by invitation or reservation and not open to the general
public, where the guests in attendance are served in a room designated and used
exclusively for a private party, function or event, and where prepared meals and alcoholic
beverages are sold pursuant to a contract. Video gaming is prohibited.
(t) Class LLLL—Class LLLL licenses shall prohibit video gaming terminals but shall
authorize the retail sale of alcoholic liquor for consumption on premises described in the
license where the business is that of a banquet facility. A banquet facility is any place
kept, used, maintained, advertised or held out as a place where a prearranged private
party, function or event for a specific social or business occasion may be held, either by
invitation or reservation and not open to the general public, where the guests in
attendance are served in a room designated and used exclusively for a private party,
function or event, and where prepared meals and alcoholic beverages are sold pursuant to
a contract.
(u t) Class Z—Family recreation and entertainment center: Class Z licenses shall prohibit
video gaming terminals but shall authorize the sale of alcoholic liquor to patrons in the
licensed premises where the premises are used for a family recreation and entertainment
center business, subject to the following terms and conditions:
(1) Alcoholic liquor shall be ordered only in the designated alcohol service area, and
alcoholic liquor shall be consumed only in the designated alcohol service area of
the premises;

(2) The licensee shall provide both physical limitations and employee supervision to
prevent ordering or consumption of alcoholic liquor out of the designated alcohol
service area; and
(3) The designated alcohol service area shall be delineated on a floor plan on file with
and approved by the liquor commissioner, together with a plan to limit service
outside of the designated alcohol service area of the premises.
(4) Notwithstanding the foregoing prohibition on video gaming terminals, any
Class Z licensee lawfully operating video gaming terminals pursuant to a
validly issued license on or before may continue such
operation, provided that the Class Z license remains continuously active and
is not surrendered, revoked, or transferred to a different location; any Class
Z license issued after (insert date) shall be prohibited from operating video
gaming terminals.
For purposes of this Section, a Class Z license shall be deemed “surrendered”
if the licensee voluntarily relinquishes the license, fails to timely renew the
license, allows the license to lapse or expire, ceases operations under the
license, or otherwise takes any action or omission resulting in the termination
of the licensee’s lawful authority to operate under the Class Z license.
(v) Class ZZZZ—Family recreation and entertainment center: Class ZZZZ licenses
shall prohibit video gaming terminals but shall authorize the sale of alcoholic liquor to
patrons in the licensed premises where the premises are used for a family recreation and
entertainment center business, subject to the following terms and conditions:
(1) Alcoholic liquor shall be ordered only in the designated alcohol
service area, and alcoholic liquor shall be consumed only in the
designated alcohol service area of the premises;
(2) The licensee shall provide both physical limitations and employee
supervision to prevent ordering or consumption of alcoholic liquor
out of the designated alcohol service area; and
(3) The designated alcohol service area shall be delineated on a floor
plan on file with and approved by the liquor commissioner,
together with a plan to limit service outside of the designated
alcohol service area of the premises.
For purposes of this Chapter 3, “Banquet Facility” shall mean any place kept, used,
maintained, advertised or held out as a place where a prearranged private party, function
or event for a specific social or business occasion may be held, either by invitation or
reservation and not open to the general public, where the guests in attendance are served in

a room designated and used exclusively for a private party, function or event, and where
prepared meals and alcoholic beverages are sold pursuant to a contract.
"Restaurant" as that term is used in any of the provisions of this or any other section relating to
alcoholic liquor shall have the same meaning as defined in the 235 ILCS 5/1-3.23. [That current
definition is: any public place kept, used, maintained, advertised and held out to the public as a
place where meals are served, and where meals are actually and regularly served, without
sleeping accommodations, such space being provided with adequate and sanitary kitchen and
dining room equipment and capacity and having employed therein a sufficient number and kind
of employees to prepare, cook and serve suitable food for its guests.]
For purposes of this Chapter 3, "Restaurant" shall mean any public place kept, used, maintained,
advertised, and held out to the public as a place where meals are actually and regularly prepared,
cooked, and served on the premises for immediate consumption, without sleeping
accommodations. Such place shall have adequate and sanitary kitchen and dining room
equipment and capacity and shall have employed therein a sufficient number and kind of
employees to prepare, cook, and serve suitable for its guests. Video gaming and the sale of
alcohol shall be secondary to that of food service. In addition, a restaurant shall:
• Maintain a full-service kitchen with equipment necessary to prepare meals to order;
• Employ sufficient staff to prepare and serve food;
• Provide suitable indoor seating and tables for dining;
• Not primarily offer prepackaged or ready-to-eat food;
• Ensure that full-kitchen food service is available to the public during all operating hours
while alcoholic liquor is served, except the final two hours before closing;
Restriction. No "restaurant" license shall be issued or reissued unless the sale of liquor produces
less than fifty (50) percent of the total gross receipts for any such restaurant.
Restriction. No "restaurant" license shall be issued or renewed unless the establishment operates
as a bona fide restaurant. Compliance shall be determined based on operational and physical
characteristics in accordance with the above definition, including but not limited to:
(1) availability of a full-service kitchen;
(2) preparation of food to order on the premises;
(3) seating and dining facilities;
(4) two hours prior to closing the full kitchen food service being available relative to alcohol
service; and
(5) floor area devoted to dining versus gaming or bar use.

For purposes of this Chapter 3, “Video Gaming Café” shall mean any establishment where
at least 60% of its gross revenue on an annual basis exclusively from video gaming
activities.
Sec. 3-305 – Investigation and fingerprinting of applicant
(a) No license shall be issued pursuant to the provisions of this chapter until the applicant shall
have been investigated by the local liquor control commission and a report filed in the records of
the commission approving the issuance of such license. As a part of this investigation, all new
applicants not heretofore licensed or any manager not heretofore approved shall be fingerprinted
and photographed by the village police department. A copy of fingerprint cards and photographs
shall be held on record by the police department and a copy of the same shall be held by the local
liquor control commission.
(b) Completed investigations for license applications shall be valid for a period of ninety (90)
days after the license applicant has been notified of approval by the local liquor control
commissioner. Any applicant who fails to take all required action, including payment of original
issuance fee and annual fee, to obtain a license within ninety (90) days after notification shall not
be eligible for a license until a new background investigation is completed and additional
investigation fees paid.
(c) In addition to the initial investigation required herein, all licensees, managers, and other
individuals required to submit fingerprints shall undergo updated fingerprinting and background
investigations every five (5) years. Such updated investigation may shall be required as a
condition of license renewal. The cost of such investigation shall be paid by the applicant or
licensee unless otherwise determined by the village board.
Sec. 3-309. – Persons eligible for license.
No retail liquor license shall be issued to:
(1) A person who is not of good character and reputation in the community in which he they
reside.

(22) A person who knowingly makes a false statement, misrepresentation, or omission of
material fact in any application, renewal, report, or other submission to the local liquor control
commission.
Sec. 3-309.2. – False statements; penalties.

Any applicant or licensee who knowingly provides false, misleading, or incomplete information
to the local liquor control commission shall be subject to suspension, revocation of license,
and/or fines, as determined by the local liquor control commissioner in accordance with this
chapter, and may also be subject to prosecution and any other remedies or penalties
permitted under applicable law.
[Sec. 3-314. – Original issuance fee.
The original issuance fees for all liquor licenses within the village shall be as hereinafter set
forth:

Sec. 3-316. – Annual fee. License Fees
(a) The annual fee for liquor licenses in the village shall be as follows commencing January 1,

(d) In addition to the annual fee set forth herein, there is hereby established a uniform initial
license fee, which shall be required for the issuance of any new liquor license regardless of
classification.
(e) The initial license fee shall be set by resolution of the village board and shall apply equally to
all license classifications. Such fee shall be paid at the time of application and shall be
nonrefundable.
(f) No initial license fee shall be required for the renewal of an existing license unless the
applicant is required to submit a new application pursuant to this chapter.
Sec. 3-318.1. – Change in use of licensed premises.
Any license issued pursuant to this chapter shall automatically terminate upon a change in the
use of the premises described in the license.
If any licensee intends to change the use of the premises described in the license, the licensee
shall submit a new application for a local liquor license to the local liquor control commissioner

in accordance with the requirements of this chapter, including payment of any applicable
nonrefundable application fee.
Such application shall be submitted no less than thirty (30) days prior to the proposed change in
use taking effect.
