10. Ordinance for First Reading
a. An Ordinance Amending Section 2-313(A) of the Municipal Code of the Village of Villa
Park, DuPage County, Illinois, increasing the number of Class EEEE Liquor Licenses.
This Ordinance is based on a recommendation from the Local Liquor Control
Commission to increase the number of Class EEEE liquor licenses, which are
designed for a restaurant without video gaming. This is a first reading.
11. Ordinance for Second Reading
a. An Ordinance of the Village of Villa Park, DuPage County, Illinois, Amending Section
3-409 of the Villa Park Municipal Code Regarding Video Gaming Licenses.
This Ordinance would prohibit the expansion of video gaming anywhere within the
Village. It would not affecting existing businesses. This is a second reading; the first
reading occurred on May 18, 2026.

Maryann Delulio: Talked about Mortadeli treatment. Stated employees of the Village are
embarrassed by what is happening in Villa Park. Specifically commented about situations
with President Patrick, Trustee Konstatos and Trustee Kozar. Thanked Trustees Cordova
and Kumar for their support and for being voices for this community.
Jenny McClellan: Disappointed that first reading was waived for an ordinance that was
talked about tonight. Need to allow time to get more input from the residents. Also feels like
all the board talks about is gaming while streets are crumbling and repairs/replacement
keeps getting put off. Infrastructure is being ignored.

Trustee Alfano asked for an explanation on the discrepancies on the police report. Chief Kubish
responded with and explanation of traffic stops versus traffic arrests. In addition, he explained that some
warnings could be verbal warnings and some are not just traffic stops but responses to a call.
11. Ordinance for First Reading
a. An Ordinance of the Village of Villa Park, DuPage County, Illinois, Amending Section
3-409 of the Villa Park Municipal Code Regarding Video Gaming Licenses.
This Ordinance would prohibit the expansion of video gaming anywhere within the
Village. It would not affect existing businesses. This is a first reading.
Trustee Kumar asked about revenue sources that might be coming on board to offset the lack
of video gaming revenue. Manager Rivas stated they are looking at passing some costs on
utility bills to the residents. He also discussed the hotel tax and an uptick on the recreation
fund. Also vehicle registration and food truck registration is being considered An uptick in
businesses is expected when the Union is completed. Another would be more businesses
when Hawthorne is completed. Home Rule is a possibility as well. Trustee Kumar agrees
with the increase in utility billing as well as taxation being a possibility. Stated that she would
like to get resident input on the revenue standpoint.
Manager Rivas explained that they are also looking at grants.
Trustee Sabri asked if they can find out the per capita of the gaming in Illinois and where do
we stand in Villa Park…how many we have, how many we need, what is the impact if we have
more.
Trustee Konstatos stated that the Village is not losing income by prohibiting additional gaming
establishments. The Comprehensive Plan does not call for us to use gaming as revenue for
our town.
Trustee Cordova discussed the 5-year revenue plan the board received from Director Mika.
There is a concern that future expenditures are greater than future revenues. The plan doesn’t
look great. We need a revenue strategy. Trustee Patrick stated that he agrees that we need

more Economic Development. He asked Trustee Cordova to not only post his ideas on social
media but also bring them to the board where they can be discussed. Trustee Cordova
also stated that when he sends an email to staff, he would appreciate at least a receipt of that
email. President Patrick asked him to cc Manager Rivas on those emails.
Trustee Konstatos went back to the gaming. She explained what other towns have compared
to Villa Park. They are larger towns and have less establishments. Trustee Kumar stated that
while she was campaigning, she heard a lot about gaming, but also heard a lot about
infrastructure. President Patrick agreed with Trustee Kumar also about how to find additional
revenue sources. Trustee Alfano explained that all complaints can be true but we are here to
make decisions that are best suited for our village. When the Comprehensive Plan was being
done, residents never stated “we want more gaming”. They did say they want more family-
oriented businesses and not to rely on low hanging fruit. She also talked about the issues with
the st. Charles TIF. We need to stick to the Comprehensive Plan. Trustee Sabri also
mentioned that they have discussed a senior development in the past and seniors are
desperately asking for that. I believe that will bring in more revenue.
b. An Ordinance Amending Section 3-313a of the Municipal Code of the Village of Villa
Park Increasing the Number of Class IIII Liquor Licenses
This Ordinance is based on a recommendation from the Local Liquor Control
Commission to create the first Class IIII liquor license, which is designed for a
restaurant/bar without video gaming. This is a first reading.
Trustee Cordova asked if the Liquor Commission has had a chance to work on the
restructuring and will they have a better understanding of the ordinances at the next June
meeting. President Patrick responded that they are still working on it. He also suggested that
he watch past meetings and see what happens at the upcoming meeting.
Trustee Kumar made a motion to table this until after the Liquor Commission meets on June 2.
Trustee Cordova seconded that motion. Trustee Konstatos stated there is no need to table
this since it will be up for second reading at the June meeting.
Trustee Alfano asked why they are doing this since it was a recommendation from the Liquor
Commission. Trustee Kumar said she wants the wording addressed. The Village Attorney
explained that the wording is already in the code and this is just to increase the number of
licenses for this type of license (and this seems to be the first one of this type).
Trustee Kozar asked what the issue is that Trustee Kumar is trying to clarify. Trustee Kumar
responded with her concerns. The Village Attorney explained the license they are seeking.
Trustee Kozar explained that there are no changes to the ordinance….this is how we always
issue liquor licenses for any business in Villa Park. He asked the business owner when they
planned on opening their business. They stated they have been ready for 3 months and are
just waiting on the license.
Trustee Kumar rescinded her motion to table and Trustee Cordova rescinded his second to
that motion.

Trustee Kozar made a motion to waive the first readding and seconded by Trustee Alfano.
Trustee Cordova said he was okay with it, however he brought up the March 23rd meeting
discussion of licenses and to revisit them and to issue any other licenses until it is done.
Trustee Konstatos stated that she recalls that during that meeting President Patrick asked the
board to send their asks to the Liquor Commission and I was the only who sent it.

a. Resolution of the Village of Villa Park, DuPage County, Illinois, Approving a Grant
Agreement with the State of Illinois Department of Commerce & Economic Opportunity
for Grant Number 25-203286 in the Amount of $200,000.00
This Resolution authorizes the Village President to execute a grant agreement with the
State of Illinois Department of Commerce & Economic Opportunity (DCEO). DCEO
has awarded the Village a grant in the amount of $200,000.00 to use for all prior
occurring costs associated with roadway improvements for the Wisconsin Avenue
Improvement Project (Vermont to Stone).

Trustee Cordova inquired if there is a timeline on this. Assistant Village Manager Guerra
explained that this is a reimbursement for work that has already been done. Trustee
Kumar asked about the status for the construction of the south portion of Wisconsin
Avenue. Guerra explained that it is in the final design stage. That project is combined
with other projects. Funding is very competitive. We hope for the spring with hopes to be
done in 2027.

15. Unfinished Business
Trustee Sabri directed to Manager Rivas and Director Mika that he is still waiting for the
forensic financial audit and we are only receiving a financial analysis. In reviewing a
document we received from Director Mika on February 9 in reference to the Parks and
Recreation Center, can you elaborate on this. Numbers given to Baker Tilly and the board, we
have a lot of invoices that are not accounted for and payment checks issued. Manager Rivas
stated they will prepare a report and send it to the Trustees. President Patrick asked for a
suggestion from Baker Tilly on what we should do moving forward. Trustee Sabri also asked
for more detail since we paid a large amount to Baker Tilly for a 5-year forensic audit and we are
getting just 2025 forensic analysis and our Finance Director is uploading information that is
incomplete. We spent $21M on the project and we budgeted for $15M. We asked why we went
over. We should have gotten answers in January or February. We got a preliminary answer but
we’re looking for a 5 year audit and we got one year. I’m sending emails and getting no
responses. President Patrick stated he would like some of the answers also. We are still
waiting for answers from Baker Tilly. Give staff a little time to get those answers from Baker Tilly.
Trustee Kumar stated there was discussion that Baker Tilly brought up some trend analysis but
has not been able to access it. I would like to see it. I have asked them for access but have not
gotten it. We should all have that information – a consolidated final report. Trustee Alfano
discussed that she explained to Baker Tilly that their presentation wasn’t a final. Trustee
Konstatos asked Baker Tilly to look into the Rec Center and failed to do so. Director
Mika had to do a report for us. I feel our counsel needs to get involved since they have yet to
give us what we are asking for.

Trustee Sabri discussed the 5-year plan from Director Mika. He asked her if she had a chance
to look at the email he sent about some missing information. Director Mika stated that she used
the information she was given by the departments. We are missing information from the Public
Works Department. So, yes, that is not complete information. Trustee Sabri asked when he will
get the projections. Assistant Village Manager Guerra stated they are just finishing it up. They
are trying to be as complete as possible. They have financed several things and those
financings will have to be projected over the next 5 years. Trustee Sabri also asked what is the
equipment for the next five years. There are a lot of line items missing.

few changes and we are moving forward. It has been a privilege to serve you and thank you
for your trust.

The F.U.N. Commission is having a 250th Anniversary Poster Contest. Pick up your poster

RECOMMENDED ACTION:
BACKGROUND:
A unique circumstance recently presented itself within the Fire Department, where a probationary
employee will require three months' leave for a medical situation. In the interest of reinforcing the
Village's commitment to its workforce in a competitive job climate, the Administration has decided to
give this employee unpaid leave with job protections under the Family Medical Leave Act (FMLA)
even though the Act does not apply to employees who have not been employed for at least a year.
Additionally, under the collective bargaining agreement, an employee on unpaid FMLA leave
becomes responsible for the entire cost of insurance while on leave. As part of the waiver of the one-
year eligibility requirement, the employee will be able to continue paying the same amount for
coverage, instead of the full amount, while on leave.
DISCUSSION:
To provide unique benefits to one employee in a collective bargaining unit, a memorandum of
understanding is required between the Village and the Union. Both parties have agreed that the
administration may elect "to continue covering the employer's portion of health insurance for a
mutually agreed-upon period" in the rare situation where a probationary member requires significant
time off for personal or medical circumstances. The MOU expressly does not establish a past
practice or precedent.

RECOMMENDED ACTION
Staff requests authorization to purchase HVAC compressors and associated installation supplies necessary to
repair the HVAC system at the Public Works Facility located at 11 W. Home Avenue, at a total cost of
$11,930.38. Staff also requests authorization to approve a labor-only agreement with Acitelli Heating and
Piping Contractors, Inc. to assist Village staff with the installation of the replacement HVAC equipment. The
cost of the labor agreement shall not exceed $10,752. Funding for this project will be provided through the
2026 Building Fund Capital Budget, Account No. 11-206-540102.
BACKGROUND
The Public Works HVAC system relies on two compressors operating in tandem to provide cooling to the
facility. One of the compressors has failed, and as a result, contaminated fluids from the failed unit have
circulated throughout the system, including into the remaining operational compressor. Although the system
fluids were replaced to extend the service life of the equipment and allow additional time for replacement
planning, the remaining compressor is expected to fail due to the contamination. Once the second compressor
fails, the HVAC system will no longer be able to provide cooling to the Public Works facility.
Village staff contacted Munch’s Supply and obtained a proposal for the purchase of two replacement
compressors in the amount of $10,430.38. In addition, refrigerant will be required to charge the new
compressors at an estimated cost of $1,000. Miscellaneous installation materials and supplies are also
anticipated and are estimated at $500.
Village staff will perform a portion of the installation work; however, specialized labor assistance is required to
complete the project. Staff requested a proposal from C. Acitelli Heating and Piping Contractors, Inc. to provide
installation support. C. Acitelli has previously installed several critical components of the HVAC system and
possesses extensive knowledge of the equipment and system configuration. The proposal from C. Acitelli
Heating and Piping Contractors, Inc. provides labor at a rate of $168 per hour, with total labor costs not to

RECOMMENDED ACTION
Staff request authorization to complete plumbing improvements at Village Hall at 20 S Ardmore Ave in an
amount not to exceed $29,600. Funding for this project will be taken from the 2026 Building Fund Capital
Budget, GL 11-206-540102.
BACKGROUND
The plumbing system at Village Hall has been experiencing recurring sewer backups. A review of the
underground sanitary piping system identified multiple sections of pipe with bellies, or sagging areas, that have
developed over time. These low points allow wastewater and debris to accumulate within the lines, resulting in
frequent blockages and sewer backups.
Each backup event requires hydro jetting to thoroughly clean and restore the system to proper operation. The
frequency of these incidents has increased significantly, with Village Hall now experiencing sewer backups
approximately once per month.
To address these ongoing issues, staff is recommending the abandonment of the existing underground
sanitary piping system and the installation of a new overhead PVC plumbing system. An overhead system will
help eliminate the risk of basement sewer backups, provide easier access for future maintenance and repairs,
and minimize disruptions to facility operations and staff during installation.
The Village solicited proposals from three qualified contractors and received three responsive proposals. The
lowest proposal was submitted by Midland Plumbing and Sewer Services of Villa Park, Illinois, in the amount of
$29,600. Staff recommends approving a contract with Midland Plumbing and Sewer Services for the plumbing
improvements outlined in their Plumbing Estimate dated April 29, 2026.

4. General Conditions:

5. Permits and Approvals:
The customer will be responsible for the cost of all local permits and bonds necessary for
performing the specified work.
6. Change Orders (Mid-Performance Amendments)
Midland Plumbing & Sewer Services and the customer recognize that:
a. The contractor’s original cost and time estimates may prove too low due to
unforeseen events or to factors unknown to the contractor when the contract was
made.
b. The customer may desire a mid-job change in the specifications that would add
time and cost to the specified work.
c. Other provisions of the contract may be difficult to carry out because of
unforeseen events, such as a materials shortage.
If these or other events beyond the control of the parties require adjustment of this contract,
the parties will make a good faith attempt to agree on all necessary particulars. Such an
agreement shall be put into writing, signed by the parties, and added to this contract.
7. Liens and Waivers of Liens
Upon final payment to Midland, the customer shall be supplied with lien waivers, lien
releases, or acknowledgement of full payment from Midland, each subcontractor, and each
material provider.
8. Insurance:
Upon acceptance of this estimate as a contract, Midland will provide proof of general liability
and worker’s compensation if requested.
9. Invoicing and Payment Terms:
Midland Plumbing & Sewer Services will submit invoices to the customer at the above
rates upon completion of the service performed at the job site. All payments are due upon
receipt of the invoice. Any payments not made within thirty (30) days will be subject to an
annual finance charge of eighteen percent (18%). The customer understands and accepts
the fact that any delay in payment made to Midland Plumbing and Sewer Services may
result in appropriate legal action being taken to collect monies owed to Midland Plumbing
and Sewer Services. The customer understands and agrees that the costs of such legal

suit, may be passed on to the customer, and the customer accepts this condition. The
contract shall be binding inure to the benefit of the parties and their heirs, executors,

10. Warranties:
All materials and labor will be guaranteed for a period of one year unless otherwise
specified by the manufacturer of any product installed by Midland.
11. Dispute Resolution
If any disputes arise under the terms of this agreement, the parties agree to select a mutual
agreeable neutral third party to help them mediate it.

RECOMMENDED ACTION:
This Ordinance approved ZBA-26-09 for a Special Use to permit an Animal Shelter/Boarding use on
the property located at 31 W Saint Charles Road per exhibits A and B. The Zoning Board of Appeals
recommended approval by a vote of 4-0, one abstained.
BACKGROUND:
The Petitioner, Cat Guardians, requests approval of a Special Use to permit an Animal
Shelter/Boarding use on the property located at 31 W Saint Charles Road.
This Special Use permit would allow the space to function as an animal shelter. This property has
2,000 sq ft and would allow for space to house rescued cats, host outreach events, and educational
events. The building would be primarily used to house the cats in care, but would also have spaces
for organization administration, a public space to welcome people coming in to look at adoptable
cats, and utilitarian spaces for storage, laundry facilities and an examination room for visiting vets.
The goal is to make the public spaces flexible so that they can be converted to spaces that can hold
events and raise money for the organization. The expanded facility would allow more space for the
cats, allowing them to continue to provide the best possible care for the cats at the rescue center.
The business currently operates by appointment only and would retain that initially. They will also
have regular events, once every month or two, which will allow drop-in access if people want to see
the cats without an appointment. Cat Guardians is run entirely by volunteers.
DISCUSSION:
The Zoning Board of Appeals noted that the property was previously used as a veterinary clinic and
an animal shelter would be an appropriate use for the space. The Commission noted concerns over
where the trash enclosure would be located. The petitioners are working with staff to find a suitable
location for the trash enclosure that complies with all applicable regulations.

WHEREAS, the Village of Villa Park (the "Village") is a duly organized and validly
existing non-home-rule municipality created in accordance with the Constitution of the State of
Illinois of 1970 and the laws of the State of Illinois; and,
WHEREAS, pursuant to the Illinois Municipal Code (65 ILCS 5/1-1-1 et seq.), the
President and Board of Trustees of the Village (the “Corporate Authorities”) may enact zoning
regulations to regulate the development and use of real property within the corporate boundaries
of the Village; and,
WHEREAS, the Village has heretofore adopted an ordinance entitled the “Zoning
Ordinance of the Village of Villa Park, Illinois” (the “Zoning Ordinance”); and,
WHEREAS, pursuant to the Illinois Municipal Code (65 ILCS 5/11-13-5), the Corporate
Authorities may determine and vary the regulations of its Zoning Ordinance; and,
WHEREAS, Section 11.4, entitled “Special Use,” of Article 11 of the Zoning Ordinance
sets forth the authority and standards by which special use permits may be granted; and,
WHEREAS, Cat Guardians Inc. (the “Petitioner”), as contract purchaser of the Property
owned by Land Trust Company, as Successor Trustee, under Trust No. 891, dated December 23,
1975 (the “Owner”), submitted an application for a special use permit for an animal boarding and
shelter use (the “Special Use”) on the property located at 31 W. St. Charles Road, Villa Park,
Illinois, as legally described on Exhibit A (the “Property”); and,
WHEREAS, the Zoning Board of Appeals (“ZBA”) held a public hearing on May 13,
2026 (the “Public Hearing”) to consider whether the Special Use should be approved, at which
time all persons present were afforded an opportunity to be heard; and,

WHEREAS, a public notice in the form required by law was given of said Public
Hearing date; and,
WHEREAS, after taking into consideration all evidence and testimony presented at the
Public Hearing, the ZBA reviewed the standards set forth in Section 11.4.8 of the Villa Park
Zoning Ordinance and voted to recommend to the Corporate Authorities approval of the Special
Use; and,
WHEREAS, the Corporate Authorities deem it advisable and in the best interest of the
health, safety, and welfare of the residents of the Village to grant the Special Use subject to the
conditions identified herein.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of
the Village of Villa Park, DuPage County, Illinois, as follows:
Section 1. The above recitals and legislative findings are found to be true and correct
and are hereby incorporated herein and made a part hereof, as if fully set forth in their entirety.
Section 2. The Village President and Board of Trustees of the Village have duly
considered the ZBA’s findings of fact and recommendation and hereby adopt by reference the
findings of fact of the ZBA as the findings of the Corporate Authorities of the Village as if fully
set forth herein. All documents and exhibits submitted at the Public Hearing are also
incorporated by reference into this Ordinance.
Section 3. In addition to the findings set forth in Section 2 hereof, the Corporate
Authorities further find in relation to the Special Use as follows:
1. That the Special Use is expressly authorized as a special use in this zoning district;
2. That the Special Use on the Property are necessary or desirable to provide a service
or a facility that is in the interest of public convenience and will contribute to the
general welfare of the neighborhood or community;
3. That the Special Use will not, in the particular case, be detrimental to the health,

safety, or general welfare of persons residing or working in the vicinity or be
injurious to property values or improvements in the vicinity;
4. That approval of the Special Use will not impede the normal and orderly

drainage and other important and necessary facilities, infrastructure and community
services; and
6. That the Special Use complies with all applicable regulations of this zoning
ordinance except as expressly approved in accordance with the procedures of this
zoning ordinance.
Section 4. The Special Use is hereby granted, subject to the following conditions:
1. The Special Use shall be limited to the Petitioner and shall not be transferable without
approval in accordance with the Zoning Ordinance;
2. The Property shall be developed and operated in accordance with the plans and
documents submitted, as referenced herein and made a part hereof;
3. All animal shelter operations shall be conducted entirely within the existing building,
except for the transport of animals to and from the facility;
4. The Petitioner shall maintain all required licenses, permits, and registrations required
by applicable local, county, state, and federal laws governing animal shelters and
animal welfare operations;
5. The Special Use will not impede the normal and orderly development and
improvement of surrounding property for use permitted in the district;
6. No exterior changes, signage, or site modifications shall occur without separate
approval as required by Village codes;
7. The Petitioner shall comply with all applicable Village, County, State, and Federal
laws and regulations, including obtaining all other necessary permits, approvals, and
certificates of occupancy;
8. Any expansion or intensification of the use beyond that presented in the application
shall require additional review and approval;

Cat Guardians has been operating as a cat shelter for 38 years at 932 E St Charles Rd in Lombard. We
would like to move our cat shelter to 31 W St. Charles Road, Villa Park. The location the shelter is now
operating in has approximately 600 square feet to care for and rescue cats. The new property has
approximately 2,000 sf to rescue cats, along with allowing us the space to host community outreach,
fundraising and animal welfare educational events.

The goal of moving Cat Guardians to a new location would be to help rescue and adopt out more
cats. The new facility would allow us to optimally utilize different spaces in order to separate the cats
if needed, for example, if a cat had a contagious disease and needed to be separated from the other
cats. . We would also use the space to host fundraising events, community outreach events and
youth group activities to bring awareness of our mission to save homeless and abandoned cats.
Building use would be primarily to house the cats in our care, but we will also have spaces for
organization administration, a public space to welcome people coming in to look at adoptable cats,
and utilitarian spaces for storage, laundry facilities and an examination room for visiting vets. The goal
is to make the public spaces flexible so that they can be converted to spaces in which we can hold
events and raise money for the organization. The expanded facility would allow more space for the
cats, allowing us to continue to provide the best possible care for the cats at our rescue center.

Cat Guardians is run entirely by volunteers. We have about 70 active volunteers, plus additional
people who help at events or for a limited time. There are two volunteer cat care shifts a day, which
consists of approximately 2-4 volunteers on each shift, who feed the cats, clean litter boxes, sweep,
etc. In addition to volunteers providing cat care, volunteers foster cats, attend to the medical needs of
the cats, fundraise, assist at events, meet with potential adopters, as well as performing all the
needed functions of a non-profit organization.

The proposed new location is centrally located, easy to access and in a commercial corridor. Many
volunteers from the area will come to the facility every day, and may choose to stop at the
Lighthouse to pick up a drink, or get a meal from a local restaurant. We believe this location will be
a benefit to the cats, our organization and the local community.

welfare of persons residing or working in the vicinity or be injurious to property values or

We have operated at 932 E St. Charles Road in Lombard for 38 years, and we have never had an
issue with anyone being injured or seriously hurt on the property. We have good relationships with
neighboring businesses, who enjoyed having us close so they could come and visit the kittens
when they needed a pick me up. Given that the facility is in a commercial corridor and operated as
a veterinary practice for many years, we believe a cat shelter will not impact property values in the
area.

Request Summary

shelter.
Background
The Petitioner is looking to relocate from their previous location in Lombard for a larger location. This Special
Use permit would allow the space to function as an animal shelter. This property has 2,000 sq ft and would
allow for space to house rescued cats, host outreach events, and educational events. The building would be
primarily used to house the cats in care, but would also have spaces for organization administration, a public
space to welcome people coming in to look at adoptable cats, and utilitarian spaces for storage, laundry
facilities and an examination room for visiting vets. The goal is to make the public spaces flexible so that they
can be converted to spaces that can hold events and raise money for the organization. The expanded facility
would allow more space for the cats, allowing them to continue to provide the best possible care for the cats at
the rescue center. The business currently operates by appointment only and would retain that initially. They will
also have regular events, once every month or two, which will allow drop-in access if people want to see the
cats without an appointment. Cat Guardians is run entirely by volunteers. They have about 70 active volunteers,
plus additional people who help at events or for a limited time. There are two volunteer cat care shifts a day,
which consist of approximately 2-4 volunteers on each shift, who feed the cats, clean litter boxes, sweep, etc. In
addition to volunteers providing cat care, volunteers foster cats, attend to the medical needs of the cats,
fundraise, assist at events, meet with potential adopters, as well as performing all the needed functions of a
non-profit organization.

developments are intended to serve the local population and those moving throughout the Village. These areas
typically include retail and services that support nearby residential areas and big-box retailers. The Village should
look to concentrate this use along Roosevelt Road and North Avenue.

Special Use
The Zoning Ordinance specifically allows for the right to request a Special Use. The Commission should
consider whether the proposed use is appropriate and whether any conditions of operation may be necessary to
mitigate any otherwise potential negative impacts. Section 11.4.11. of the Zoning Ordinance requires that any
expansion of uses or facilities that qualifies as a major amendment must be reviewed through the Special Use
process.
The Petitioner is seeking a Special Use, per Section 6.1- Table of Allowed Uses, Table 6-1: Use Table, to permit the

shelter. This building was previously used as a veterinary clinic, which did not require a Special Use permit per
Table 6-1: Use Table.
Site Plan Review

location in regard to the proposed development plans:

a. Appointments will be necessary for anyone looking to adopt a cat.
b. Parking will be provided in the lot for clients and volunteers.

development plans:
a. The site currently has 9 parking stalls.
b. Per section 7.2 Minimum Parking Ratios, a boarding or shelter use requires 1 parking stall per
1,000 sq ft. 2 parking stalls would be required on this site.
7. Landscaping - The following comments relate to the issue of landscaping in regard to the proposed
development plans:

a. No landscaping is proposed as part of the Special Use application.
8. Signage - The following comments relate to the issue of signage in regard to the proposed development
plans:
a. No new signage is currently proposed.
b. The existing ground sign could be updated to reflect the new tenant.
c. If a wall sign were to be proposed in the future, it would be reviewed as part of the permit
process.
9. Site Illumination - The following comments relate to the issue of site illumination in regard to the
proposed development plans:
a. No changes to the site lighting are proposed.
10. Completeness - If the Zoning Board of Appeals requires additional information to determine whether the
applicant’s development requests comply with the applicable standards of the Code, they may direct
the applicant to furnish additional information and evidence that may provide clarity regarding their
concerns.
Findings
Per Section 11.4.8. – Review and Approval Criteria: No Special Use may be recommended for approval or
approved unless the respective review or decision-making body determines that the proposed Special Use is
consistent with and in substantial compliance with all village board policies and plans and that the applicant
has presented evidence to support each of the following conclusions for both Special Uses that they are
requesting:
A. That the proposed use or activity is expressly authorized as a Special Use;
Petitioner’s Response: Yes, per Villa Park’s Code of Ordinances, Appendix C Article 6 Section 6.1, an
animal shelter is designated as a special use within the MX-3 zoning classification.
B. That the proposed use at the proposed location is necessary or desirable to provide a service or a facility
that is in the interest of public convenience and will contribute to the general welfare of the
neighborhood or community;
Petitioner’s Response: Cat Guardians cat shelter is an absolute benefit to the community, as it is a
place where volunteers can gather to help animals, people can come meet cats for potential adoption,
the community can come together for outreach activities and youth groups can learn the importance of
animal welfare. The proposed new location is centrally located, easy to access and in a commercial
corridor. Many volunteers from the area will come to the facility every day, and may choose to stop at the
Lighthouse to pick up a drink, or get a meal from a local restaurant. We believe this location will be a
benefit to the cats, our organization and the local community.
C. That the proposed use will not, in the particular case, be detrimental to the health, safety, or general
welfare of persons residing or working in the vicinity or be injurious to property values or improvements
in the vicinity.
Petitioner’s Response: We have operated at 932 E St. Charles Road in Lombard for 38 years, and we
have never had an issue with anyone being injured or seriously hurt on the property. We have good
relationships with neighboring businesses, who enjoyed having us close so they could come and visit the
kittens when they needed a pick me up. Given that the facility is in a commercial corridor and operated
as a veterinary practice for many years, we believe a cat shelter will not impact property values in the
area.
D. That approval of the Special Use will not impede the normal and orderly development and improvement
of surrounding property for uses permitted in the district;

Petitioner’s Response: A cat shelter business is conducted indoors, and the cats do not leave the
building without being safely transported in carriers. There would be absolutely no activity that would be
conducted that would disrupt the surrounding properties.
E. That the proposed Special Use will be served by adequate utilities, access roads, parking, drainage and
other important and necessary facilities, infrastructure, and community services; and
Petitioner’s Response: The building has been a veterinary hospital for approximately 40 years, and the
amount of traffic Cat Guardians would have will be less than the amount of traffic the animal hospital
brought to the property.
F. That the proposed Special Use complies with all applicable regulations of this zoning ordinance except
as expressly approved in accordance with the procedures of this zoning ordinance.
Petitioner’s Response: To the best of our knowledge that is correct, the application for an animal
shelter is the only issue that we currently face in moving the shelter forward to the proposed new
location.
Notification
Legal Notice was published in the Daily Herald on April 24th, 2026, a sign placed on the subject property, and
notifications sent to property owners within a 250.0 foot radius of the subject property in advance of the Public
Hearing.
Recommended Action
To recommend approval of ZBA-26-09 for a Special Use to permit a boarding or animal shelter use within the
existing building.

SUBJECT: An Ordinance Amending Section 2-313(A) of the Municipal Code of the Village
of Villa Park, DuPage County, Illinois, increasing the number of Class EEEE
Liquor Licenses.
RECOMMENDED ACTION:
This Ordinance is based on a recommendation from the Local Liquor Control Commission to
increase the number of Class EEEE liquor licenses, which are designed for a restaurant without
video gaming. This is a first reading.
BACKGROUND:
At its June 2, 2026 meeting, the Local Liquor Control Commission considered the application of 302
Villa Park, which would be located at 324 E. Central Blvd. The restaurant is requesting a Class EEEE
liquor license, which would allow the restaurant to serve alcohol at tables, but it would prohibit video
gaming. The Village Board created this class of liquor licenses last year. This would be the 7th Class
EEEE liquor license.
DISCUSSION:
If the Village Board approves this Ordinance, the Local Liquor Control Commissioner would decide
whether to give the Class EEEE license to 302 Villa Park, which the Local Liquor Control
Commission also recommends.

The business at 324 E. Central Blvd. is requesting a Class EEEE to prohibit video gaming but
shall authorize the sale at retail in restaurants of alcoholic liquors to patrons at tables on premises
described in said license. Patrons are to be served only if they are seated at a table. The alcoholic
beverages are to be consumed only in the portion of the premises described in the license in
which food is ordered and served to patrons, and then only as part of the food ordered by and
served to said patrons provided that the sale of liquor produces less than fifty (50) percent of the
total gross receipts for such restaurant. There are currently no available Class EEEE liquor
licenses, so the Village will need to adopt the attached ordinance to allow for this liquor license.
Recommended Action
The Liquor Commission recommends that the Village Board by ordinance increase the number
of Class EEEE licenses from 6 to 7. The Liquor Commission also recommends that the Local
Liquor Control Commissioner grant the newly-created EEEE liquor license to 302 Villa Park,
LLC.

AN ORDINANCE AMENDING SECTION 3-313(A) OF THE MUNICIPAL CODE OF
THE VILLAGE OF VILLA PARK, DUPAGE COUNTY, ILLINOIS INCREASING THE
NUMBER OF CLASS EEEE LIQUOR LICENSES
WHEREAS, the Village of Villa Park (the “Village”) is a duly organized and validly
existing non-home rule municipality created in accordance with the Constitution of the State of
Illinois of 1970 and the laws of the State; and
WHEREAS, pursuant to Section 5/4-1 of the Liquor Control Act of 1934, as amended,
(235 ILCS 5/4-1 et seq.) the Village President and Board of Trustees of the Village (the “Corporate
Authorities”) have the power, and are charged with the responsibility, to determine the number,
kind and classification of liquor licenses that are available for the sale and distribution of alcoholic
beverages within the Village; and
WHEREAS, Chapter 3 of the Municipal Code of the Village of Villa Park, as amended
(the “Municipal Code”), provides that a Class EEEE-Restaurant, unrestricted liquor license
authorizes the sale at retail in restaurants of alcoholic liquors to patrons seated at tables on the
premises described in said license, but prohibits video gaming. The alcoholic beverages are to be
consumed only in the portion of the premises described in the license in which food is ordered and
served to patrons, and then only as part of the food ordered by and served to said patrons provided
that the sale of liquor produces less than fifty (50) percent of the total gross receipts for such
restaurant; and
WHEREAS, the Local Liquor Control Commission recommends that the Corporate
Authorities increase the number of Class EEEE Liquor Licenses by one; and

WHEREAS, the Corporate Authorities find that it is in the best interest of the residents of
the Village to accept the Local Liquor Control Commission’s recommendation and amend the
Municipal Code accordingly; and
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Villa Park, DuPage County, Illinois, as follows:
Section 1: The above recitals and legislative findings are found to be true and correct and
are hereby incorporated herein and made a part hereof, as if fully set forth in their entirety.
Section 2. Section 3-313 (“Number of Licenses”) of Chapter 3 (“Alcoholic Liquor”) of
the Municipal Code of Villa Park, Illinois, is hereby amended by deleting the stricken language and
adding the underlined language to read, as follows:
3-313. – Number of licenses.
(a) There shall be in effect at any one time no more than the number of licenses indicated

held invalid, the invalidity thereof shall not affect any other provision of this Ordinance.

SUBJECT: An Ordinance of the Village of Villa Park, DuPage County, Illinois, Amending
Section 3-409 of the Villa Park Municipal Code Regarding Video Gaming
Licenses.
RECOMMENDED ACTION:
This Ordinance would prohibit the expansion of video gaming anywhere within the Village. It would
not affecting existing businesses. This is a second reading; the first reading occurred on May 18,
2026.
BACKGROUND:
In April, the Village Board adopted Ordinance No. 4554 to prohibit additional video gaming terminals
along St. Charles Road. At its May 11 meeting, the Village Board voted to bring the ordinance back
to the agenda to expand that prohibition throughout Villa Park. Members of the Board have
expressed concerns over negative societal impacts resulting from video gaming, including gambling
addiction. There are also concerns that business development is too reliant on restaurants and bars
that offer video gaming. A prohibition on new video gaming across the Village could positively impact
both those concerns.
DISCUSSION:
The code changes in this ordinance are identical to the changes in Ordinance No. 4554, except
instead of St. Charles Road, the prohibition would apply to the entire Village. Existing businesses
would be allowed to continue with video gaming, but they could not increase the number of terminals
or relocate to another location within Villa Park. The text of this Ordinance was modified slightly from
the previous meeting so that it would contain the additional video gaming language that was
approved at the last meeting (regarding age restrictions, advertising restrictions, and a sweepstakes
bans.

AN ORDINANCE OF THE VILLAGE OF VILLA PARK, DUPAGE COUNTY, ILLINOIS,
AMENDING ARTICLE IV OF CHAPTER 3 OF THE VILLA PARK MUNICIPAL CODE
REGARDING VIDEO GAMING LICENSES
WHEREAS, the Village of Villa Park (“Village”) is a duly organized and validly existing
non-home rule Illinois municipality created in accordance with the Constitution of the State of
Illinois of 1970, as amended, and the laws of the State; and
WHEREAS, the Illinois Municipal Code, 65 ILCS 5/1-2-1, provides that the corporate
authorities of each municipality may pass all ordinances and make all rules and regulations proper
or necessary, to carry into effect the powers granted to municipalities, with such fines or penalties
as may be deemed proper; and
WHEREAS, the Illinois Municipal Code (65 ILCS 5/11-80-2) grants to the corporate
authorities of each municipality the power to regulate the use of streets or other municipal property;
and
WHEREAS, the Illinois Video Gaming Act, 230 ILCS 40/1 et seq., authorizes the
operation of video gaming terminals within licensed establishments, subject to regulation by the
Illinois Gaming Board and local controls adopted by municipalities; and
WHEREAS, the Village President and Board of Trustees of the Village (the “Corporate
Authorities”) have determined that there is an over-abundance of restaurants, bars, and other
establishments that operate video gaming terminals within the Village; and
WHEREAS, the Corporate Authorities recognize that video gaming terminals uniquely
contribute to increased gambling within the Village, due to the ease and which in turn leads to
increased levels of gambling addiction and other societal problems for Village residents; and
WHEREAS, the Corporate Authorities find that preventing the addition of video gaming
terminals within the Village will help to stave off the negative effects of gambling on the
community; and
WHEREAS, the Corporate Authorities also desire to further diversify the types of
businesses located within the Village, including restaurants and bars that operate without video

gaming, to avoid saturation, improve business opportunities, and provide more options for Villa
Park families; and
WHEREAS, for the foregoing reasons, the Corporate Authorities have determined that it
is in the best interests of the Village to regulate the location of new video gaming establishments
within the Village;
NOW, THEREFORE, BE IT ORDAINED, by the Village President and Board of
Trustees of the Village of Villa Park, DuPage County, State of Illinois, as follows:
Section 1: The foregoing recitals shall be and are hereby incorporated herein as the
findings of the Corporate Authorities.
Section 2: Section 3-409 (“Gambling, entertainment and dancing”) of Article IV
(“Operational Rules and Regulations”) of Chapter 3 (“Alcoholic Liquor”) of the Villa Park
Municipal Code is hereby amended by adding the following underlined language:
Sec. 3-409. – Gambling, entertainment and dancing.

(d) Video gaming.
(1) Any establishment within the village which holds a liquor license and has
obtained a license to operate a video gaming terminal from the
Illinois Gaming Board at such premises shall be required to apply for and obtain
a license and video gaming sticker from the village.
(2) No establishment shall operate a video gaming terminal without having
obtained a license and video gaming sticker from the village pursuant to the
application procedures of this Code.
(3) The fee to operate a video gaming terminal in the village shall be two hundred
and fifty dollars ($250.00) per terminal. The cost of this fee shall be shared
equally between the terminal operator and the applicable licensed
establishment, licensed fraternal establishment, or licensed veterans
establishment.
(4) Video gaming terminals may not be operated on any premises that is: (i) located
within one thousand (1,000) feet of a horse racing or riverboat gambling
facility; or (ii) located within one hundred (100) feet of a school or a place or
worship.
(5) There shall not be more than six (6) video gaming terminals on any premises.

(6) Video gaming terminals must be located in an area that is restricted to persons
over 21 years of age, unless the licensed business prohibits entry to those under
21. The entrance to such area must be within the view of at least one employee
who is over 21 years of age. An owner, manager or employee of the licensee
over 21 years of age shall be present during all hours of operation when video
gaming terminals are available for use by the public. Such restricted area shall
be clearly marked by signage stating that no person under the age of 21 is
permitted to enter or remain in the video gaming area. In addition, a physical
barrier to the gaming area is required, which may consist of a short partition,
gate, or rope. However, the barrier shall not visually obscure the entrance to the
gaming area from employees.
(7) No licensee may cause or permit any person under the age of 21 years to use or
play a video gaming terminal. No licensee shall permit any person under the
age of 21 to access, enter, or remain in any area where video gaming terminals
are located, regardless of whether such person participates in gaming activities.
This shall constitute a strict no-access policy.
(8) Each establishment that desires to operate a video gaming terminal must
possess a valid liquor license issued by the Illinois Liquor Control Commission
and the village.
(9) Those establishments that are licensed establishments, licensed fraternal
establishments and licensed veterans establishments, all pursuant to the
Illinois Video Gaming Act, may operate video gaming terminals only during
the hours of operation for the consumption of alcoholic beverages at that
establishment.
(10) Annual fees to be paid shall be for a calendar year without proration should
the video gaming terminal operate for any portion of any calendar year.
(11) Any licensee must also follow any rules and further restrictions imposed by
the Illinois Gaming Board. All video gaming operations conducted within the
Village shall comply with the Illinois Video Gaming Act (230 ILCS 40/1 et
seq.) and all rules and regulations promulgated thereunder, as may be amended
from time to time.
(12) No establishment located within the village on St. Charles Road, or having
frontage on or access from St. Charles Road, shall be permitted to obtain, renew,
or maintain a license or video gaming sticker from the Village unless that
establishment has been lawfully and continuously operating video gaming
terminals within the Village on that St. Charles Road property since before June
8May 1, 2026.
(13) No establishment located within the village on St. Charles Road, or having

frontage on or access from St. Charles Road, shall be permitted to expand the
number of video gaming terminals beyond the number or location of video
gaming terminals lawfully and continuously operating on that St. Charles Road
its property as of June 8May 1, 2026.
(14) No license or sticker issued for video gaming under this Section shall be
transferable or assignable to any other person or entity or for any other
premises other than as set forth on the license.
(15) Signs informing patrons how to obtain assistance with problem gambling shall
be posted and maintained at each licensed video gaming location. The signs
must be conspicuously posted and visible at the entrance to any gaming area
and from any ATM in the licensed location. The signs shall be provided to
the licensee by the terminal operator.
Section 4: All ordinances, resolutions and policies or parts thereof, in conflict with the
provisions of this Ordinance are, to the extent of the conflict, expressly repealed on the effective
date of this Ordinance.
Section 5: If any provision of this Ordinance or application thereof to any person or
circumstances is ruled unconstitutional or otherwise invalid, such invalidity shall not affect other
provisions or applications of this Ordinance that can be given effect without the invalid application
or provision, and each invalid provision or invalid application of this Ordinance is severable.
Section 6: The headings/captions identifying the various sections and subsections of
this Ordinance are for reference only and do not define, modify, expand or limit any of the terms
or provisions of the Ordinance.
Section 7: This Ordinance shall be in full force and effect from and after its passage
and approval as provided by law.
