WHEATON CITY COUNCIL PROCEEDINGS MONDAY, APRIL 18, 2016 WHEATON CITY HALL, COUNCIL CHAMBERS, 303 W. WESLEY ST., WHEATON, IL 1. CALL TO ORDER AND ROLL CALL The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Michael J. Gresk. Upon roll call, the following were: Physically Present: Mayor Michael J. CITY MANAGER REPORT City Manager Rose announced that Communications Manager Gary White planned to retire on April 30. He presented Communications Manager White with a retirement gift and thanked him for his 20 years of service to the City. 3. PRESENTATIONS Mayor Gresk read and presented a proclamation to City Manager Donald Rose in honor of his upcoming retirement from the City of Wheaton on April 30, 2016. Councilman Rutledge stated that City Manager Rose makes prudent recommendations and the efficiently carries out the decisions made by the City Council. Councilman Rutledge stated that the events surrounding Don Rose’s retirement are meant to give others an opportunity to recognize City Manager Rose’s contributions to the City and its residents Councilman Prendiville thanked City Manager Rose and stated that his intelligence, experience, wisdom and integrity have done much to make Wheaton what it is today. Councilman Prendiville stated that City Manager Rose’s legacy will last a long time and he will be remembered as someone who created an idyllic place in the western suburbs. Council Proceedings April 18, 2016 / Page 2 Councilwoman Fitch stated that City Manager Rose provided her with extensive training when she was elected to the Council and she appreciated the support she has received from City Manager Rose and the fact that he was just a phone call away. Councilman Saline thanked City Manager Rose for his character and integrity. He expressed his respect for Don’s temperance and wished him the best. Councilman Scalzo stated City Manager Rose has always been willing to share his time and advice over the ten years he has been on the Council. Councilman Scalzo listed some of the many challenges the City has faced during City Manager Rose’s tenure and feels he led the City through some tumultuous times with a strong and steady hand. Councilman Suess acknowledged City Manager Rose’s leadership over the past 42 years and his involvement with the City. He feels that local government, specifically Wheaton, has done a great job and much of that credit goes to City Manager Rose. Councilman Suess feels the continuity of leadership over time is the key to the success of this community. He wished him well and thanked City Manager Rose for his 42 years of service. Mayor Gresk stated City Manager Rose has led with a steady hand and his quiet drive and focus has made the City of Wheaton what it is today. Director of Human Resources Duguay presented City Manager Rose with a painting of City Hall painted by Marilyn Dwyer. Director of Human Resources Duguay thanked City Manager Rose for his years of service with the City. Fire Chief Schultz thanked City Manager Rose for his leadership and support for the construction of the City’s three fire stations during his tenure with the City, as well as his support for various Fire Department programs. On behalf of the Wheaton Fire Department, Chief Schultz named City Manager Rose as an honorary member of the Fire Department and presented him with a certificate and jacket. Police Chief Volpe thanked City Manager Rose for his personal support in making it possible for him to attend law school. Assistant City Manager Dzugan stated that at the most basic level, City Manager Don Rose is a City of Wheaton employee. He feels that City Manager Rose’s legacy will be that of a City of Wheaton employee who provided an example of how to be a successful City employee and consistently serve the City’s residents in a professional and respectful manner. He thanked Manager Rose for providing that example and wished him the best. City Manager Rose thanked everyone for their kind comments. He introduced his family, wife Patti and sons Michael and David, and thanked them for being so supportive over the years. City Manager Rose feels fortunate to have been able to raise his family in Wheaton and thanked City staff and City residents for the opportunity to serve the City for 42 years. City Manager Rose also thanked Assistant City Manager Dzugan for his comments and stated the City will be in good hands as he assumes the role of City Manager. 4. CITIZENS TO BE HEARD Mr. John Robertson, 247 Neltor Boulevard, West Chicago, invited everyone to attend the World Tai Chi and Qigong Day on April 30 hosted by the Theosophical Society. Mr. Ron DaRosa expressed his thanks to City Manager Rose for his years of service to the City. Council Proceedings April 18, 2016 / Page 3 5. CONSENT AGENDA Councilman Rutledge moved and Councilman Suess seconded that the following action be taken on the Consent Agenda items: 1. Approve the Minutes of the April 4, 2016 regular Wheaton City Council Meeting and the Minutes of the April 11, 2016 Public Hearing, as submitted. 2. Approve Request for Bond Waivers and Authorize Issuance of Raffle Licenses to the DuPage 4-H Foundation and the Kiwanis Club of Wheaton. 3. Adopt Resolution R-13-16, A Resolution Authorizing the Disposal of Certain Surplus Property. 4. Receive the Procurement Officer’s Recommendation and Award Bid for Engineering Services: Water Main Replacements for Collector Street Watermains to Thomas Engineering Group in the amount of $87,117. 6. Receive the Procurement Officer’s Recommendation and Award Bid for Contracted Services for Crack Sealing and Seal Coating to Denler, Inc. for three years in the amount of $186,552. 7. Receive the Procurement Officer’s Recommendation and Award Bid for 2016 Sidewalk Replacement to Globe Construction in an amount not to exceed $300,000. 8. Receive the Procurement Officer’s Recommendation and Award Bid for Line Striping - Thermoplastic to Superior Road Striping in an amount not to exceed $65,000. 9. Receive the Procurement Officer’s Recommendation and Award Bid for Fire Hydrant Sandblasting and Painting Program to Continental Construction, Co. in an amount not to exceed $15,600. F-1931, AN ORDINANCE AMENDING PORTIONS OF CITY OF WHEATON PERSONNEL RULES AND REGULATIONS Councilman Prendiville moved and Councilman Saline seconded that Ordinance No. F-1931, An Ordinance Amending Portions of City of Wheaton Personnel Rules and Regulations, be passed. Council Proceedings April 18, 2016 / Page 4 City Manager Rose stated this item appeared on the April 4 Council Agenda for a first reading. He stated the ordinance amends language in the City’s Employee Manual and recommended approval of the ordinance as submitted. City Manager Rose stated this item also appeared on the April 4 Council Agenda for a first reading. He recommended approval of the ordinance as submitted. PASS ORDINANCE NO. F-1933, AN ORDINANCE GRANTING A PLANNED UNIT DEVELOPMENT (PUD) ALLOWING THE CONSTRUCTION AND OPERATION OF A CONVENIENCE FILLING STATION AND CARWASH ON THE PROPERTY LOCATED AT 100 AND 110 WEST GENEVA ROAD FOLLOWING ITS CONSOLIDATION INTO ONE LOT – CIRCLE K HEARTLAND Councilman Rutledge moved and Councilman Suess seconded Ordinance No. F-1933, An Ordinance Granting a Planned Unit Development (PUD) Allowing the Construction and Operation of a Convenience Filling Station and Carwash on the Property Located at 100 and 110 West Geneva Road Following its Consolidation Into One Lot – Circle K Heartland, be passed. City Manager Rose indicated that at the April 4, 2016 meeting, the City Council directed that this matter be referred to the City Attorney for an ordinance approving the PUD. He recommended the ordinance, as submitted, be approved. Council Proceedings April 18, 2016 / Page 5 Mr. Mark Stinson, Circle K Area Real Estate Manager stated the ordinance calls for the replacement of the existing pole sign with a monument style sign. He stated they feel it is important for their customers to be able to see the price of gasoline. He requested that they be allowed to install a 23 foot pole sign and indicated they would be reluctant to go with anything less than 17 feet. Director of Planning & Economic Development stated the monument sign is consistent with signage at other gas stations in Wheaton. He feels the large canopy is more representative of the station and believes the price can be easily seen on the monument sign. Councilwoman Fitch expressed her support for staff’s position for the monument sign which would be in compliance with City Code. Councilman Rutledge stated he would support a monument sign similar in height to the sign located in front of the Milton Township Offices. Councilman Rutledge moved that the ordinance be amended to allow the installation of a monument sign with a maximum height corresponding to the Milton Township sign. The motion failed due to the lack of a second. Councilman Scalzo questioned if the gasoline price could be moved to the top of the monument sign rather than at the bottom. In response to Councilman Suess, Director of Planning & Economic Development stated the existing sign predates current code regulations. He stated the Danada Shell station has a monument sign. Mr. Stinson asked if the Council would approve two monument signs on the site, one at each entrance rather than on the corner. Mayor Gresk stated the Council does not conduct negotiations on the Council floor and Councilman Suess proposed delaying the item until the next meeting to allow staff and the applicant to further discuss the signage issue. Mr. Stinson stated they would lose the deal with Bakers Square if the item were delayed for two weeks. A vote was called on the current motion on the floor. APPROVE APPOINTMENTS/REAPPOINTMENTS TO CITY BOARDS/COMMISSIONS Mayor Gresk moved and Councilman Prendiville seconded that Brett Mathieson be reappointed to the Board of Trustees – Police Pension Fund for a two year term, that Kevin Maguire be reappointed to the Downtown Wheaton Design Review Board for a three year term, and that Nicole Aranas and Dan Wanzung be appointed to the Planning & Zoning Board, each for a five year term. F-1599, “AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR A SHOPPING CENTER AND OTHER USES – ON LOT 4 IN DANADA FARMS EAST UNIT 1 CARPENTER & COMPANY” – WHEATON TOWN SQUARE Councilman Suess moved and Councilwoman Fitch seconded that Ordinance No. F-1934, An Ordinance Amending City of Wheaton Ordinance No. E-3508, F-0196, F-0467 and Ordinance No. F-1599, “An Ordinance Granting a Special Use Permit for a Shopping Center and Other Uses – On Lot 4 In Danada Farms East Unit 1 Carpenter & Company” – Wheaton Town Square, be passed. City Manager Rose stated staff received a request from the owner of the Town Square Wheaton shopping center for a PUD amendment to replace two of the existing monument signs and add additional sign. He indicated the new signs would include tenant identification panels. City Manager Rose stated staff has reviewed the request and he recommended approval of the ordinance as presented. F-1935, AN ORDINANCE AMENDING ORDINANCES E-3191, E- 3328, F-1260, F-1578, AND F-1676 “AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR PLANNED UNIT DEVELOPMENT ON A CERTAIN PIECE OF PROPERTY COMMONLY LOCATED AT THE NORTHEAST CORNER OF NAPERVILLE AND BUTTERFIELD ROADS – S & W ASSOCIATES/DANADA FARMS EAST C-3 GENERAL BUSINESS DISTRICT” Councilman Rutledge moved and Councilman Suess seconded that Ordinance No. F-1935, An Ordinance Amending Ordinances E-3191, E-3328, F-1260, F-1578, and F-1676 “An Ordinance Granting a Special Use Permit for Planned Unit Development on a Certain Piece of Property Commonly Located at the Northeast Corner of Naperville and Butterfield Roads – S & W Associates/Danada Farms East C-3 General Business District,” be passed. Council Proceedings April 18, 2016 / Page 7 City Manager Rose stated the property owners have requested a PUD amendment to allow a change in the façade of the former Dominick’s store to accommodate Whole Foods and Sierra Trading Post. City Manager Rose stated staff has reviewed the request and he recommended approval of the ordinance as presented. ADOPT RESOLUTION R-14-16, A RESOLUTION AUTHORIZING THE EXECUTION OF AN AMENDMENT TO A CERTAIN TEMPORARY LICENSE AGREEMENT – COMMONWEALTH EDISON Councilman Prendiville moved and Councilman Saline seconded that Resolution R-14-16, A Resolution Authorizing the Execution of an Amendment to a Certain Temporary License Agreement – Commonwealth Edison, be adopted. City Manager Rose stated the proposed resolution would authorize the signing of an extension to a temporary license agreement between the City and Commonwealth Edison. Approval of the resolution would allow the City to continue utilizing a portion of Parking Lot 4, owned by ComEd, for parking purposes. He recommended approval of the resolution as submitted. RECEIVE THE PROCUREMENT OFFICER’S RECOMMENDATION AND APPROVE BID AWARD FOR CONSTRUCTION SERVICES FOR PARKING LOT RENOVATION AT CITY HALL, POLICE STATION, LIBRARY AND METRA LOT 10 TO ABBEY PAVING & SEALCOATING IN THE AMOUNT OF $594,547 Councilman Suess moved and Councilman Scalzo seconded that the Procurement Officer’s Recommendation be Received and the Bid Award for Construction Services for Parking Lot Renovation at City Hall, Police Station, Library and Metra Lot 10 to Abbey Paving & Sealcoating in the Amount of $594,547 be approved. Council Proceedings April 18, 2016 / Page 8 City Manager Rose stated the Procurement Officer has recommended that the bid award for City Hall, Police Station, Library and Metra Lot 10 parking lot renovations to Abbey Paving & Sealcoating for a total amount of $765,500. He recommended approval of the bid award as presented. City Manager Rose stated the budget was discussed over the course of three budget workshops and includes expenditures in all funds in the amount of $94,750,081. He recommended approval of the ordinance as presented. F-1859 Councilman Suess moved and Councilman Prendiville seconded that Ordinance No. F-1937, An Ordinance Amending the 2015-2016 Budget Contained in Ordinance No. F-1859, be passed. City Manager Rose stated that a transfer of funds between several funds that have excess fund balances and the creation of a capital improvement account was discussed during the budget discussions. He stated the proposed ordinance would amend the current fiscal year budget to enact those changes and he recommended its approval. FRONT STREET Councilman Rutledge moved and Councilman Saline seconded that Ordinance No. F-1938, An Ordinance Amending Chapter 6 (Alcoholic Beverages), Article III (Retail Licenses) of the Wheaton City Code – Increase in Class A Liquor License/Choun’s Inc. d/b/a Choun’s Restaurant/226 W. Front Street, be passed. City Manager Rose reported that the Liquor Control Commission recommended approval of a Class A liquor license to Choun’s Inc. for a new restaurant at 226 W. Front Street. City Manager Rose recommended approval of the ordinance as presented. MAIN STREET Councilman Scalzo moved and Councilwoman Fitch seconded that Ordinance No. F-1939, An Ordinance Amending Chapter 6 (Alcoholic Beverages), Article III (Retail Licenses) of the Wheaton City Code – Increase in Class V Liquor License/River City Roaster Co. /114 N. Main Street, be passed. City Manager Rose reported that the Liquor Control Commission recommended approval of a Class V liquor license for a coffee shop to River City Roaster Co. City Manager Rose recommended approval of the ordinance as presented. COUNCIL COMMENT Mayor Gresk stated that with City Manager Rose’s retirement, this is the end of an era. City Manager Rose confirmed this is indeed his last Council meeting as there will not be a Planning Session next Monday night. 19. APPROVAL OF WARRANT Councilman Suess moved and Councilman Scalzo seconded that Warrant No. 678 in the amount of $1,223,762.78 be approved.
