WHEATON CITY COUNCIL PROCEEDINGS MONDAY, NOVEMBER 20, 2017 WHEATON CITY HALL, COUNCIL CHAMBERS, 303 W. WESLEY ST., WHEATON, IL 1. CALL TO ORDER AND ROLL CALL The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Michael J. Gresk. Upon roll call, the following were: Physically Present: Mayor Michael J. Gresk Councilman Michael Barbier Councilwoman Suzanne Fitch Councilman John Prendiville Councilman John Rutledge Councilman Todd Scalzo Councilman Phil Suess Absent: None City Staff Present: Michael G. Schulz, Director of Human Resources Chad W. Michaelis, Director of Information Technology Sharon Barrett-Hagen, City Clerk 2. PRESENTATIONS Mayor Gresk read and presented a proclamation to Ms. Leanne Stavenger-Vos, Donka, Inc. in honor of their 30th anniversary. Ms. Stavenger-Vos thanked the Mayor and City Council for the proclamation and for their support over the past 30 years. She said additional information can be found about the services Donka offers on their website at www.donkainc.org. 3. CITIZENS TO BE HEARD None. 4. CONSENT AGENDA Councilman Suess moved and Councilman Scalzo seconded that the following action be taken on the Consent Agenda items: 1. Approve the Minutes of the November 6, 2017 regular Wheaton City Council Meeting, as submitted. 2. Adopt Resolution R-117-17, A Resolution Authorizing the Disposal of Certain Surplus Property (PD). 3. Receive the Planning & Zoning Board Request Re: ZA #17-24/Special Use Permit/507 S. Naperville Road/Cord and Pass Ordinance No. F-2043, An Ordinance Granting a Special Use Permit on a Certain Piece of Property Commonly Known as 507 S. Naperville Road – Cord. PASS ORDINANCE NO. F-2044, AN ORDINANCE AMENDING CERTAIN PORTIONS OF CITY OF WHEATON ZONING ORDINANCE – ARTICLE V – ADMINISTRATION AND ENFORCEMENT; ARTICLES VII THRU XIV AND ARTICLE XXIV – ACCESSORY USES AND HOME OCCUPATIONS, FRONT YARD SETBACKS, VOTING REQUIREMENTS, HOME OCCUPATIONS AND PLANNED UNIT DEVELOPMENTS Councilman Prendiville moved and Councilman Rutledge seconded that Ordinance No. F-2044, An Ordinance Amending Certain Portions of City of Wheaton Zoning Ordinance – Article V – Administration and Enforcement; Articles VII Thru XIV and Article XXIV – Accessory Uses and Home Occupations, Front Yard Setbacks, Voting Requirements, Home Occupations and Planned Unit Developments, be passed. City Manager Dzugan stated that at the October 16, 2017 meeting, the Council continued their discussion regarding certain text amendments to the City’s Zoning Ordinance. He believes the ordinance before the Council captures the Council’s intent with regard to planned unit development provisions by including a non-exhaustive list of factors for the Council to consider as part of their PUD approval analysis. Councilman Rutledge asked that a couple of minor corrections be made to the text of the ordinance. PASS ORDINANCE NO. F-2045, AN ORDINANCE AMENDING CHAPTER 22, ARTICLE X OF THE CODE OF ORDINANCES OF THE CITY OF WHEATON: FENCES AND FLAG POLES Councilman Rutledge moved and Councilman Barbier seconded that Ordinance No. F-2045, An Ordinance Amending Chapter 22, Article X of the Code of Ordinances of the City of Wheaton: Fences and Flag Poles, be passed. City Manager Dzugan stated this item appeared on the November 6, 2017 agenda as a first reading. He advised that since that time, staff has modified the language regarding non-conforming fences by removing Council Proceedings November 20, 2017/ Page 3 a specific date for compliance, as well as making modifications to the list of “high volume” streets based upon data the City has received from the KLOA traffic study. In response to Councilman Suess, City Manager Dzugan confirmed that homeowners may install a higher fence along their side yard if it abuts a high-volume street, provided the fence does not extend past the front line of the home. APPROVE APPOINTMENT TO CITY BOARDS/COMMISSIONS Mayor Gresk moved and Councilman Prendiville seconded that Shayne Moore be appointed to the Community Relations Commissions for a three-year term. FIRST READING OF AN ORDINANCE AMENDING CHAPTER 2, “ADMINISATRATION,” ARTICLE VI, “PERSONNEL” OF THE WHEATON CITY CODE, TO ESTABLISH AN ADMINISTRATIVE PROCEDURE FOR ASSESSING AND DETERMINING CLAIMS UNDER THE PUBLIC SAFETY EMPLOYEE BENEFITS ACT City Manager Dzugan advised the proposed ordinance would create a procedure for assessing and determining claims under the Public Safety Employee Benefits Act (PSEBA) which allows full-time law enforcement and/or firefighters and their families to receive health care should they suffer a catastrophic injury. He stated the item appears on the agenda for a first reading and will return for formal action at the December 4, 2017 City Council meeting. Councilman Suess questioned the current process for determining disability pension benefits. City Attorney Knippen explained that the Fire and Police Pension Boards consult with experts, medical and legal, to assist in their determination of whether an injury is disabling following standards established by law. Council Proceedings November 20, 2017/ Page 4 9. ADOPT RESOLUTION R-118-17, A RESOLUTION AUTHORIZING THE EXECUTION OF A LEASE AGREEMENT WITH CANON SOLUTIONS AMERICA, INC. FOR COPIERS AND MULTIFUNCTION DEVICES Councilman Rutledge moved and Councilman Prendiville seconded that Resolution R-118-17, A Resolution Authorizing the Execution of a Lease Agreement with Canon Solutions America, Inc. for Copiers and Multifunction Devices, be adopted. City Manager Dzugan stated the Procurement Officer and Director of Information Technology have recommended the City enter into a lease agreement with Canon for copiers and multifunction devices. It is anticipated the City will see an approximate $50,000 reduction in costs annually with this lease agreement. City Manager Dzugan thanked staff for their efforts on securing this lease. In response to Councilman Suess, Director of I.T. Michaelis stated that while it is beneficial to purchase desktop printers, due to high volume, larger printers/copiers require maintenance on a fairly regular basis and the lease agreement lowers the risk for the City with a maintenance program. Councilman Prendiville questioned how the City will reduce usage. Director of I.T. Michaelis responded that the committee recommended utilizing a paperless agenda for Council meetings, as well as electronic updates to the City’s conference rooms to reduce printing volume. He also stated the cost per page will also be reduced due to more efficient toners. COUNCIL COMMENT Councilman Rutledge stated the downtown area looks good. Mayor Gresk stated all is ready for the holiday kick-off parade on Friday, November 24. He indicated the tree lighting will be at approximately 5:45 followed by the parade at 6 p.m. 11. APPROVAL OF WARRANT Councilman Suess moved and Councilman Scalzo seconded that Warrant No. 716 in the amount of $1,796,769.75 be approved. CLOSED SESSION Councilwoman Fitch moved and Councilman Rutledge seconded that the Wheaton City Council adjourn to closed session at 7:24 p.m. for the purpose of discussion Pending Litigation 5 ILCS 120/2(c)(11) and Review of Closed Session Minutes 5 ILCS 120/2(c)(21). Mayor Gresk indicated that no action would be taken after the Closed Session and announced that this would conclude the broadcast portion of the meeting.
