WHEATON CITY COUNCIL PROCEEDINGS MONDAY, DECEMBER 18, 2017 WHEATON CITY HALL, COUNCIL CHAMBERS, 303 W. WESLEY ST., WHEATON, IL 1. CALL TO ORDER AND ROLL CALL The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Michael J. Gresk. Upon roll call, the following were: Physically Present: Mayor Michael J. CITIZENS TO BE HEARD Mr. Jeff Gahris, 1826 E. Willow, spoke of his great experience with staff during installation of solar panels on his home. He referenced the Future Energy Jobs Act passed by Governor Rauner and believes installation of solar panels not only would be an economic benefit to homeowners, it would create many jobs in the State. He encouraged City staff and officials to attend a seminar on January 29, 2018 in Warrenville to learn more about solar energy and how communities can benefit from it. 3. CONSENT AGENDA Councilman Suess moved and Councilman Rutledge seconded that the following action be taken on the Consent Agenda items: 1. Approve the Minutes of the December 4, 2017 regular Wheaton City Council Meeting, as submitted. 2. Adopt Resolution R-123-17, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (1541 Promenade Lane) 3. Adopt Resolution R-124-17, A Resolution Approving the Plat of Abrogation and Easement Grant (625 West Roosevelt Road). 4. Receive Recommendation from Procurement Officer and Approve Purchase of a 2018 Dodge Grand Caravan to Replace Unit 105 from Wright Automotive in the Amount of $21,308.00. PASS ORDINANCE NO. F-2048, AN ORDINANCE LEVYING TAXES FOR GENERAL AND SPECIAL CORPORATE PURPOSES FOR THE CURRENT FISCAL YEAR COMMENDING ON THE FIRST DAY OF MAY 2017 AND ENDING ON THE THIRTIETH DAY OF APRIL 2018 FOR THE CITY OF WHEATON, ILLINOIS Councilman Prendiville moved and Councilman Suess seconded that Ordinance No. F-2048, An Ordinance Levying Taxes for General and Special Corporate Purposes for the Current Fiscal Year Commending on the First Day of May 2017 and Ending on the Thirtieth Day of April 2018 for the City of Wheaton, Illinois, be passed. Mr. Joseph Mahaty, 927 N. Washington Street, reiterated his comments from two weeks ago in which he believes that the City needs to have a revenue neutral situation. He stated the City’s financial records show an increase of $1.9MM in revenue received from property taxes and believes the City can be more efficient, such as savings from new copiers, and should explore other revenue options. Mr. Mahaty believes that people move out of the City after 3-4 years due to high property taxes. Council Proceedings December 18, 2017/ Page 3 City Manager Dzugan advised that the $1.9MM referenced was additional property tax revenue from 2014 to 2015 levy year and $1.2MM of the difference came from TIF 2. He also stated that the City was under a lease for the copiers and as soon as the lease expired, the City sought for better pricing. Councilman Prendiville had supported Alternative #4 but stated he changed his mind because the Federal tax plan will affect tax deductions and may have an impact on home prices in Wheaton. He has a real concern about sufficiently funding capital improvements as deteriorating infrastructure will have a negative effect on property values. Councilman Prendiville stated each reduction in staff equals approximately $100,000 but a large number of staff layoffs would result in reduced services. He believes that difficult decisions will need to be made in the future with regard to revenue and expenditures. Councilman Suess stated there is a limit as to what the City can do with taxes and feels we need to live with the revenue we have. While some costs are not within the City’s control and are dictated by the State, he stated there has not been one thing the City has been unable to do. He feels the City has time to plan for possible future shortfalls. Councilman Rutledge advised that $117,672, Alternative 1, would be captured from new construction and not from existing homeowners. Councilman Barbier stated an item that jumps out at him is pension costs. He stated the City currently has a $5MM pension obligation and it would be his position to reflect all pension payments directly onto the levy rather than sacrifice paying for infrastructure. Councilwoman Fitch expressed her support for Alternative #1. She feels property taxes are too high in Wheaton and not enough new buyers can afford to pay the taxes. She says the City has an extraordinary amount of tax exempt properties and feels the City needs to expand its tax base. Councilwoman Fitch would like to refocus efforts on economic development to bring in more taxable properties. Councilman Scalzo will support Alternative #1 although he preferred Alternative #4 as it kept pace with pension obligations. He feels that while people want to reduce taxes, they also do not want to reduce services. He believes it is the Council’s job to balance services without imposing too high a burden on taxpayers. Mayor Gresk stated it is a classic argument as to what services to cut and what are people willing to pay for. The City has little to no industrial base and residential real estate plays a substantial role in the City’s tax base. He agrees with approving Alternative #1 and capturing new growth. Councilman Rutledge reminded everyone that the City’s portion of the tax bill is only 12-13% of the entire taxes paid by residents. City Manager Dzugan stated this ordinance will amend the just approved levy by reducing the bond and interest levy related to TIF debt. City Manager Dzugan stated Special Service Area Number Two covers central business district parking enforcement with a proposed levy of $39,000. City Manager Dzugan stated Special Service Area Number Seven covers central business district promotional and management services and the levy is proposed to be $109,256.71. City Manager Dzugan stated the City Council held a public hearing on December 11, 2017 regarding the annexation of the property located at 2S527 Wiesbrook Road. He stated the next two ordinances also pertain to the annexation of this property. FIRST READING OF AN ORDINANCE AMENDING THE OFFICIAL MOTOR VEHICLE AND TRAFFIC SCHEDULES (CHAPTER 70) FOR THE CITY OF WHEATON – PARKING RESTRICTIONS City Manager Dzugan reported that staff received a request from residents along the 400 block of Stoddard to restrict parking in an effort to alleviate traffic congestion. He indicated the item is on the agenda for a first reading and will return in two weeks for formal action. 16. APPROVE REQUEST FOR BID WAIVER AND AUTHORIZE PURCHASE OF PLAYBACK AND PRODUCTION SERVERS FROM AVI SYSTEMS IN THE AMOUNT OF $45,785.84 Councilman Scalzo moved and Councilman Rutledge seconded to approve the Request for Bid Waiver and Authorize Purchase of Playback and Production Servers from AVI Systems in the Amount of $45,785.84. City Manager Dzugan the servers are necessary to continue operations relating to the City’s two cable channels. He indicated the purchase amount was included in the 2017/18 budget and is funded through the Capital Equipment Replacement Fund. ADOPT RESOLUTION R-126-17, A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH BURKE, LLC FOR DESIGN/BUILD SERVICES FOR LORRAINE-EATON SEWAGE LIFT STATION IMPROVEMENTS Councilwoman Fitch moved and Councilman Prendiville seconded that Resolution R-126-17, A Resolution Authorizing the Execution of an Agreement with Burke, LLC for Design/Build Services for Lorraine-Eaton Sewage Lift Station Improvements, be adopted. City Manager Dzugan stated the item before the Council is for an agreement with Burke, LLC for the design and construction for rehabilitation of the Lorraine and Eaton sanitary sewer lift station for a guaranteed maximum cost of $500,000. He indicated this amount has been included in the 2017/18 budget as part of the Sanitary Sewer Capital Projects Fund. F-2059, AN ORDINANCE AMENDING CITY OF WHEATON ORDINANCE NUMBER F-0542, F-0882 AND F-1999, “AN ORDINANCE AMENDING THE WHEATON ZONING ORDINANCE MAP ON A CERTAIN PIECE OF PROPERTY COMMONLY LOCATED AT 518 WEST ROOSEVELT ROAD – WALKER & MAY, INC.” Councilman Suess moved and Councilwoman Fitch seconded that Ordinance No. F-2059, An Ordinance Amending City of Wheaton Ordinance Number F-0542, F-0882 and F-1999, “An Ordinance Amending the Wheaton Zoning Ordinance Map on a Certain Piece of Property Commonly Located at 518 West Roosevelt Road – Walker & May, Inc.,” be passed. City Manager Dzugan indicated that the ordinance before the Council would modify the site plan by eliminating the secondary alley access to Warrenville Road. He stated the access is not feasible due to engineering challenges. ADOPT RESOLUTION R-127-17, A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH VISU-SEWER OF ILLINOIS, LLC FOR SEWER MAIN REHABILITATION PROJECT Councilman Rutledge moved and Councilman Suess seconded that Resolution R-127-17, A Resolution Authorizing the Execution of an Agreement with Visu-Sewer of Illinois, LLC for Sewer Main Rehabilitation Project, be adopted. City Manager stated the proposed agreement with Visu-Sewer of Illinois would be for the rehabilitation of certain sanitary sewer segments for a cost of $101,121. He stated this work has been included in the 2017/18 budget as part of the Sanitary Sewer Capital Projects Fund. ADOPT RESOLUTION R-128-17, A RESOLUTION CONSENTING TO A CHANGE OF OWNERSHIP IN KURTZ PARAMEDIC SERVICES, INC. CONSISTENT WITH ARTICLES XVII AND XVIII OF THE PARAMEDIC SERVICES AND AMBULANCE BILLING SERVICES AGREEMENT BETWEEN KURTZ PARAMEDIC SERVICES, INC. AND THE CITY OF WHEATON, DATED APRIL 14, 2015 Councilman Scalzo moved and Councilman Prendiville seconded that Resolution R-128-17, A Resolution Consenting to a Change of Ownership in Kurtz Paramedic Services, Inc. Consistent with Articles XVII and XVIII of the Paramedic Services and Ambulance Billing Services Agreement Between Kurtz Paramedic Services, Inc. and the City of Wheaton, Dated April 14, 2015, be adopted. City Manager advised that the City’s current contractor for EMS paramedic services and EMS billing services has been acquired by American Medical Response, Inc. (AMR). In accordance with the City’s agreement with Kurtz, the City must consent to any change of ownership. He further advised that the City has conducted its due diligence over the past month and has concluded that AMR will be able to perform the work for the City. In response to Councilman Suess, City Manager Dzugan stated the contract is up for renewal in April of 2018 with a 2-year extension. He stated prices for 2018 and 2019 are included in the existing contract and the City will confirm with AMR if they will honor those prices or if the City will need to go out to bid. Fire Chief Schultz stated closing for the transaction will take place this week. He said AMR retained personnel from Kurtz and feels the transition will be a smooth one. In response to Councilman Suess, Fire Chief Schultz stated AMR has contracts with over 230 cities and counties,throughout the United States, primarily in the west and southwest. Councilman Suess asked if AMR is a publicly traded company. City Attorney Knippen stated he did not have the answer to that question but feels the City is in a good position because AMR is establishing a presence in the mid-west with this contract. COUNCIL COMMENT Mayor Gresk welcomed boy scouts from Troop 34 and thanked them for attending the meeting. Councilman Prendiville extended holiday wishes to everyone. APPROVAL OF WARRANT Councilman Suess moved and Councilman Prendiville seconded that Warrant No. 718 in the amount of $1,413,955.55 be approved.
