December 3, 2018 1. Call to Order and Roll Call The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Michael J. Gresk. Upon roll call, the following were: Physically Present: Mayor Gresk Councilman Barbier Councilwoman Fitch Councilman Prendiville Councilman Rutledge Councilman Scalzo Councilman Suess Absent: None City Staff Present: Michael G. Dzugan, City Manager John M. Duguay, Assistant City Manager James Knippen, City Attorney James Kozik, Director of Planning and Economic Development Paul G. Redman, Director of Engineering Robert R. Lehnhart, Finance Director Sharon Barrett-Hagen, City Clerk 2. Report of the City Manager City Manager Dzugan thanked staff for their efforts on Sunday and Monday following a pretty significant storm event. He feels they did an excellent job and appreciated their efforts. 3. Presentations None 4. Citizens to Be Heard None 5. Consent Agenda Councilman Rutledge moved and Councilman Suess seconded that the following action be taken on the Consent Agenda items: 1. Approve the November 19, 2018 minutes of the regular Wheaton City Council meeting, as submitted. 2. Approve Request and Authorize Issuance of Special Event Permits to Downtown Wheaton Association – Let’s Wine About Winter Wine Walk. WHEATON CITY COUNCIL PROCEEDINGS December 3, 2018 3. Adopt Resolution R-2018-109, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (310 North Gary Avenue). 4. Approve Bond Waiver and Authorize Issuance of a Raffle License to Giving DuPage. First Reading of An Ordinance Repealing Chapter 82 “Vehicles for Hire” of the Wheaton City Code City Manager Dzugan stated the Assistant City Manager is recommending elimination of Chapter 82 of the City Code that governs taxi cabs. He advised with the disruption that Uber and Lyft have caused in the industry, many municipalities have rolled back their regulations for taxi cabs, and our data shows a decline in the issuance of license and stickers. City Manager Dzugan stated this item appears for a first reading with formal action to be taken at the December 17, 2018 meeting. 7. Approve Reappointments to City Boards/Commissions Mayor Gresk moved and Councilman Scalzo seconded that Christine Richardson be reappointed to the Environmental Improvement Commission for a three-year term. First Reading of an Ordinance Levying Taxes for General and Special Corporate Purposes for the Fiscal Year Beginning January 1, 2019 and Ending December 31, 2019 for the City of Wheaton City Manager Dzugan stated the next eight items relate to the City’s General Purpose and Debt Service property tax levy and levies for the City’s three special service areas. He reported at the November 12 Budget Workshop the Council discussed a 2018 General Purpose and Debt Service levy that would capture new construction, which would equal a levy increase of $151,175 or .7%. The proposed 2 WHEATON CITY COUNCIL PROCEEDINGS December 3, 2018 ordinance would capture $16.4MM of new construction and the levy increase of $151,175 is projected to decrease the tax rate from $.9631 to $.9241, a reduction of 4.1%. He indicated the rate decrease is tied to a 5% increase in total assessed value. City Manager Dzugan stated all ordinances appear as a first reading with formal consideration to be taken at a special meeting of the City Council on December 10. 9. First Reading of An Ordinance Amending the 2018 Tax Levy Contained in Ordinance No. O-2018- XX City Manager Dzugan stated the proposed ordinance would abate $1,568,365 of the TIF 3 related bond and interest portion of the levy. 10. First Reading of An Ordinance for the Levy and Assessment of Taxes for the Fiscal Year Beginning January 1, 2019 and Ending December 31, 2019 in and for the City of Wheaton Special Service Area Number Two City Manager Dzugan stated the levy amount of $39,400 is for parking service expenses in the central business area. 11. First Reading of An Ordinance Making Appropriations for the City of Wheaton Special Service Area Number Two for the Fiscal Year Beginning January 1, 2019 and Ending December 31, 2019 City Manager Dzugan indicated this ordinance would appropriate the taxes for Special Service Area Number Two. 12. First Reading of An Ordinance for the Levy and Assessment of Taxes for the Fiscal Year Beginning January 1, 2019 and Ending December 31, 2019 in and for the City of Wheaton Special Service Area Number Three City Manager Dzugan stated the levy amount of $12,000 is for maintenance of open spaces within the Streams Subdivision. 13. First Reading of An Ordinance Making Appropriations for the City of Wheaton Special Service Area Number Three for the Fiscal Year Beginning January 1, 2019 and Ending December 31, 2019 City Manager Dzugan indicated this ordinance would appropriate the taxes for Special Service Area Number Three. 14. First Reading of An Ordinance for the Levy and Assessment of Taxes for the Fiscal Year Beginning January 1, 2019 and Ending December 31, 2019 in and for the City of Wheaton Special Service Area Number Eight City Manager Dzugan stated the levy amount for Special Service Area Number Eight of $126,600 will generate a total of $250,000, includes $123,400 from the TIF 2 increment, and funds the services provided by the Downtown Wheaton Association in an amount requested in their 2019 budget. 15. First Reading of An Ordinance Making Appropriations for the City of Wheaton Special Service Area Number Eight for the Fiscal Year Beginning January 1, 2019 and Ending December 31, 2019 City Manager Dzugan indicated this ordinance would appropriate the taxes for Special Service Area Number Eight. 16. Adopt Resolution R-2018-110, A Resolution Approving the Final Plat of Cline’s Hawthorne Estates Subdivision Councilman Suess moved and Councilman Prendiville seconded that Resolution R-2018-110, A Resolution Approving the Final Plat of Cline’s Hawthorne Estates Subdivision, be adopted. 3 WHEATON CITY COUNCIL PROCEEDINGS December 3, 2018 City Manager Dzugan stated the proposed resolution approves a final plat for property recently annexed and subdivided into two lots on Hawthorne Lane, south of Merrill Drive. Council Comment None 18. Approval of Warrant Councilman Suess moved and Councilman Scalzo seconded that Warrant No. 741 in the amount of $774,401.78, be approved.
