Call to Order and Roll Call The regular Wheaton City Council Meeting called to order at 7:00 p.m. by Mayor Philip J. Suess. Presentations Mayor Suess presided over the swearing—in ceremony for Firefighter Matthew James Cochran, preceded by remarks from Chief Brill. Mayor Suess presided over the swearing-in ceremony for Police Officer Stephen W. Herrmann, Police Officer Eleftheria Lolis, and Police Officer Grace A. Turney, preceded by remarks from Chief Youker. 3. Citizens to be Heard Steven Johnson, 720 S. Hale St., expressed concerns regarding the proposed sidewalk installation in front of his home. Director of Engineering Tebrugge confirmed a redesign is underway to allow for a vehicle to park in the driveway without parking over the sidewalk. Jeannie lves, expressed concerns regarding the proposed sidewalk installation at 720 S. Hale St. Stephen Goss, 1920 Childs St., requested City Council to consider the inclusion of language in Chapter 22 of the Wheaton City Code of Ordinances to permit fence variances. WHEATON CITY COUNCIL PROCEEDINGS Tuesday, September 3, 2024 City of Wheaton Bicyclist and Pedestrian Commission members Connor Grant, Lou Dieter and Robert Van Valzah presented a revised recommendation for consideration of the City Council to improve the safety of bicyciist and pedestrians. Commission member Grant outiined the revised recommendation to install a “Turning perforated steel traffic signpost and sign reading Vehicles Yield to Bicycles and Pedestrians” on the northwest side of the intersection of Carlton Ave. and Roosevelt Rd. 4. Consent Agenda Councilman Barbier moved and Councilwoman Bray—Parker seconded that the following action be taken on the Consent Agenda items: 1. Approve the minutes of Wheaton City Council Regular Meeting - August 19, 2024, as submitted. 2. Adopt Resolution R-2024-75, A Resolution Approving a Plat of Abrogation and Accepting a Plat of Easement for Public Utilities and Drainage (1711 E. Forest Avenue). 3. Approve Application, Class i Liquor License —Bari Restaurant Group, inc. d/b/a Positano Ristorante Wheaton — 120 E. Liberty Drive. 4. Adopt Resolution R-2024-76, A Resolution Authorizing the Execution of a Permanent Easement Agreement for a Public Sidewalk and Pedestrian Bridge Between the City of Wheaton and Marian Park, Inc. 5. Adopt Resolution R-2024—77, A Resolution Authorizing the Execution of a Temporary Construction Easements Agreement for the Construction of a Public Sidewalk and Pedestrian Bridge Between the City of Wheaton and Marian Park, Inc. Adopt Resolution R-2024-70, A Resolution Authorizing the Execution of a Funding Agreement for the Installation of a Traffic Signal and Lighting Between the City of Wheaton and St. Francis High School Councilman Weller moved and Councilman Brown seconded that R—2024-70, A Resolution Authorizing the Execution of a Funding Agreement for the installation of a Traffic Signal and Lighting Between the City of Wheaton and St. Francis High School, be adopted. City Manager Dzugan stated the agreement formalizes the commitment of St. Francis High School to fund the project for the installation of a traffic signal at St. Francis and Target off Roosevelt Rd. He detailed considerations raised by staff as part ofthe project review include a permanent and temporary easement allowing vehicles from Marian Park to access the new traffic signal, completing a special use process for 2 WHEATON CITY COUNCIL PROCEEDINGS Tuesday, September 3, 2024 off—site parking and other commitments related to snow removal, sidewalk replacement, and traffic striping improvements. He reported his intent to draft a letter of understanding with St. Francis prior to the completion of Phase ii and reported the Council may decide to include other considerations before signing the intergovernmental Agreement with the state. Pass Ordinance 0-2024-24, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 6 (Alcoholic Beverages), Chapter 26 (Businesses) and Appendix B (Fee Schedule) Relating to Fingerprinting of License Applicants Councilman Brown moved and Councilman Barbier seconded that O-2024-24, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 6 (Alcoholic Beverages), Chapter 26 (Businesses) and Appendix B (Fee Schedule) Relating to Fingerprinting of License Applicants, be passed. City Manager Dzugan stated the amendment contracts fingerprinting of applicants and managers of massage businesses and liquor establishments to shift the service from the police department to a contracted provider. He detailed the fee would be the contracted rate for the fingerprinting service. Pass Ordinance 0-2024-25, An Ordinance Amending the Code of Ordinances of the City of Wheaton, Appendix B (Fee Schedule), Section B-8, Public Works/Water Fees Councilman Barbier moved and Councilwoman Bray-Parker seconded that O—2024-25, An Ordinance Amending the Code of Ordinances ofthe City of Wheaton, Appendix B (Fee Schedule), Section B-8, Public Works/Water Fees, be passed. City Manager Dzugan reported the ordinance follows presentations at Planning Sessions in May and July to propose the increase of the City’s water consumption rate and fixed fee in January 2025, 2026, and 3 WHEATON CITY COUNCIL PROCEEDINGS Tuesday, September 3, 2024 2027. He stated the ordinance all0ws for automatic pass-through of DuPage Water Commission usage rate increases foliowing notice to the City. Adopt Resolution R-2024-78, A Resolution Authorizing the Purchase of One (1) Replacement Wheel Loader from West Side Tractor Sales Through the Sourcewell Purchasing Cooperative for a Total Amount Not to Exceed $226,084.34 Councilwoman Bray-Parker moved and Councilman Brown seconded that R-2024-78, A Resolution Authorizing the Purchase of One (1) Replacement Wheel Loader from West Side Tractor Sales Through the Sourcewell Purchasing Cooperative for a Total Amount Not to Exceed $226,084.34, be adopted. City Manager Dzugan stated the 2009—wheel loader’s life was extended to 15 years. Councilman Weller acknowledged the replacement being $60,000 under budget and Counciiman Clousing expressed approval ofthe $51,000 trade-in. First Reading of Ordinance, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 6, (Aicoholic Beverages) & Appendix B (Fee Schedule) Relating to the Creation of a Class U Liquor License — Craft Cocktail Lounge City Manager Dzugan stated the Liquor Control Commission recommended the approval of a new Ciass U license to allow a craft cocktaii lounge where guests may order and consume a curated selection of specialty liquor. ln response to Councilman Brown, Director of Planning & Zoning Kozik reported the license classification proposal follows a request from a local business owner. ln response to Mayor Suess, Director Kozik clarified the license is modeled after the Subourbon, Class Y license for a private craft cocktail lounge. He detailed the Class Y is private whereas the Class U is open to the public. In response to Councilwoman Bray-Parker, Director Kozik confirmed the hours are the same as restaurant licenses. Councilman Weller expressed approval of the Liquor Commission’s tailoring of the ordinance to maintain appropriate use while accommodating the unique concept of the business model. 11. Council Comment Councilman Barbier congratulated Mayor Suess on gaining a new son-in-law. 12. Approval of Warrant Councilman Barbier moved and Councilwoman Bray-Parker seconded that Warrant No. 879 in the amount of $1,977,651.31, be approved.
