Adopt Resolution R—2025-O4, A Resolution Ratifying the City Manager’s Change Order and Authorizing the Execution of Change Order #7 to Agreement No. 458 with Triggi Construction, Inc. for Roosevelt Road Sidewalk Improvements for a Total Amount Not to Exceed $47,103.40 and a Total Award of $658,458.09. WHEATON CITY COUNCIL PROCEEDINGS Tuesday, January 21, 2025 3. Adopt Resolution R—2025—05, A Resoiution Authorizing the Execution of Agreement No. 522 with V3 Companies, LLC for Professional Engineering Services for the Windsor Channei Pedestrian Bridge Repairs for a Totai Amount Not to Exceed $52,594 and a 10% Contingency 4. Adopt Resoiution R—2025—O6, A Resolution Authorizing the Purchase of One (1) 2025 Skid Steer Loader from Atias Bobcat through the Sourceweli Purchasing Cooperative for a Totai Amount Not to Exceed $63,208.57. Reappointments to City Board and Commissions Mayor Suess moved and Councilman Brown seconded that Susan Brinkman be reappointed to the Band Commission, Sarah Antas be reappointed to the Fine and Cultural Arts Commission, and James Vroman be reappointed to the Board of Fire and Police Commissioners all for three-year terms through January 21, 2028. Mayor Suess thanked James Vroman for his attendance. Geneva Road) An Ordinance Amending the Wheaton Zoning Map and Granting a Special Use Permit for a Church — First Assembly of God (Southwest Corner of Geneva Road and President Street) Councilman Weller moved and Councilwoman Robbins seconded that 0—2025-01, An Ordinance Amending Ordinance E-3603 (900 E. Geneva Road) An Ordinance Amending the Wheaton Zoning Map and WHEATON CITY COUNCIL PROCEEDINGS Tuesday, January 2i, 2025 Granting a Special Use Permit for a Church — First Assembly of God (Southwest Corner of Geneva Road and President Street), be passed. City Manager Dzugan reflected upon the January 6, 2025, City Council meeting at which the Councii directed the City Attorney to prepare an ordinance of approval for a speciai use amendment to ailow for the construction of an additional row of 15 parking spaces, a right in and right out drive connection to Geneva Road, and a driveway interconnect with the property to the west. He detailed the applicant revised the landscape plan to meet or exceed the requirements ofthe zoning ordinance, which was shared with the neighbors. Jane Beatty, 840 Pinegrove Court, President of the Wheaton Pine Grove Homeowners Association, thanked the Mayor and City Council for listening to their concerns and going above and beyond on their behalf. Mayor Suess thanked the applicant and neighbors for working with the City to ensure good results. Adopt Resolution R-2025-07, A Resolution Authorizing the Execution of Agreement No. 521 with American Road Maintenance Inc. for GSB-88 Asphalt Surface Treatment for a Total Amount Not to Exceed $100,000 and a 10% Contingency Councilwoman Robbins moved and Councilman Barbier seconded that R—2025—O7, A Resolution Authorizingthe Execution of Agreement No. 521 with American Road Maintenance Inc. for GSB-88 Asphalt Surface Treatment for a Total Amount Not to Exceed $100,000 and a 10% Contingency, be adopted. City Manager Dzugan stated the sole source product called GSB—88 is used by Public Works as preventative maintenance to extend the life of pavement. City Manager Dzugan stated as a short—term solution for vehicle purchasing difficulties, staff recommended approval of a bid waiver to permit the purchase of 4 vehicles as they become available. First Reading of An Ordinance Amending the Code of Ordinances of the City of Wheaton — Chapter 22 — Buildings and Building Regulations and Appendix B — Fee Schedule City Manager Dzugan reflected upon the December 9, 2024, Planning Session when staff introduced an amendment to the City’s building codes. He reported that over the past 45 days very few comments regarding the amendments had been received and are outlined in the memo. 9. Motion to Direct City Staff to Object to DuPage County Zoning Petition — T-1-25 Text Amendments — Video Gaming Councilman Brown moved and Councilman Barbier seconded a Motion to Direct City Staff to Object to DuPage County Zoning Petition — T-1-25 Text Amendments — Video Gaming. City Manager Dzugan reviewed DuPage County’s notice to amend their zoning ordinance related to video gaming to which they plan to reduce the distance of certain uses from 1,000 feet to 100 feet. He stated staff suggested the council consider filing an objection to the amendments and encourage the county to add an additional restriction of 1,000 feet from a municipal boundary if such municipality prohibits such gaming terminals. Mayor Suess reported the incorporation of language which introduced the concept of a café as opposed to a restaurant, and parking requirements associated with each, resulted in the approval of a previously denied zoning permit for Lacy’s Place on North Gary Ave. Mayor Suess asked staff to also forward the objection correspondence to DuPage County Board Representatives in District 4 and District 6. First Reading of An Ordinance Amending the Wheaton Zoning Ordinance — DPCGC — DuPage County Governmental Center Zoning District City Manager Dzugan stated the ordinance amends the zoning ordinance to create a DuPage County Center Zoning District following the January 13, 2025, City Council Public Hearing. He reported the amendment is inline with the intergovernmental Agreement between the City and DuPage County, entered in October of 2024. 11. First Reading of An Ordinance Amending the Wheaton Zoning Map DuPage County Governmental Center Zoning District City Manager Dzugan stated the ordinance amends the zoning map to create the DuPage County Governmental Center Zoning District as a result ofthe prior ordinance. 12. Pass Ordinance 0—2025-02, An Ordinance Amending the Wheaton Liquor Control Ordinance, Chapter 6 — Alcoholic Beverages Section 6-129 — Hours of Business — Generally Class L License Councilman Barbier moved and Councilwoman Bray-Parker seconded that 0-2025—02, An Ordinance Amending the Wheaton Liquor Control Ordinance, Chapter 6 — Alcoholic Beverages Section 6-129 — Hours of Business — Generally Class L License, be passed. City Manager Dzugan stated the Liquor Control Commission recommended approval of an amendment requested by Studio Movie Grill, which seeks to modify the permitted hours for liquor sales under the Class L License to align with the hours allowed for restaurant license categories Class A, B, and i. Corey Braseiton, General Manager of Studio Movie Grill, stated he was available for any questions. Approval of an Application for a Class A Liquor License — Dough LLC d/b/a Dough and The Backyard — 111 E. Front Street Councilman Brown moved and Counciiman Weller seconded that an Application for a Class A Liquor License — Dough LLC d/b/a Dough and The Backyard — 111 E. Front Street, be approved. City Manager Dzugan stated the Liquor Controi Commission unanimously recommended the approval of a Class A license application from Dough LLC for a proposed restaurant located at 111 East Front Street. Pass Ordinance 0-2025-03, An Ordinance Vacating a Portion of Wilmette Right-of-Way Councilwoman Robbins moved and Councilman Clousing seconded that O—2025-03 An Ordinance Vacating a Portion of Wilmette Right—of—Way, be passed. City Manager Dzugan stated the City Council held a public hearing on January 13, 2025, on the vacation of 33 feet of the unimproved Wilmette right—of-way to 1520 Wakeman and 1602 Wakeman in accordance with the conditions set forth in the ordinance. First Reading of An Ordinance Amending the Wheaton Zoning Ordinance - Roosevelt Road Corridor District City Manager Dzugan stated the ordinance amends the Zoning Ordinance to create the Roosevelt Road Corridor. He detailed the City Council received the Planning and Zoning Board’s report on September 16, 2024, which recommended the amendment. First Reading of An Ordinance Amending the Wheaton Zoning Map — Roosevelt Road Corridor District City Manager Dzugan stated the ordinance amends the zoning map creating the Rooseveit Corridor District as a resuit of the prior ordinance. 17. Adopt Resolution R-2025-09, A Resolution Authorizing the Execution of Agreement No. 525 with WBK Engineering, LLC for Professional Engineering Services for the 2025 Fall New Sidewalk Program for a Total Amount Not to Exceed $99,601.50 and a 10% Contingency Councilwoman Robbins moved and Councilman Weller seconded that R—2025—O9, A Resolution Authorizing the Execution of Agreement No. 525 with WBK Engineering, LLC for Professional Engineering Services for the 2025 Fall New Sidewalk Program for a Total Amount Not to Exceed $99,601.50 and a 10% Contingency, be adopted. City Manager Dzugan stated the resolution approves engineering services for the design of the 2025 Fall New Sidewalk Program to install 2.53 miles of sidewalks. He noted staff recommended not to proceed with the lowest bidder, Primera, due to conditions contained in their proposal and past experience. In response to Mayor Suess, Director Tebrugge confirmed Webster, McGrath and Ahlberg was used in 2024. Council Comment Councilwoman Bray-Parker reflected upon Mad Fore Plaid, an event hosted by the Wheaton Library and DuPage County Historical Museum. She highlighted the contributions from library staff to coordinate a successful event. Councilman Weller acknowledged the extensive agenda and expressed gratitude to everyone involved for their efforts and contributions. He specifically recognized the research, preparation, and completion of long-standing projects related to Roosevelt Road and the DuPage County Zoning District. 19.
