Call to Order and Roll Call The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Citizens to be Heard None. 3. Consent Agenda Councilwoman Bray-Parker moved and Councilman Brown seconded that the following action be taken on the Consent Agenda items: 1. Approve the Minutes of the Wheaton City Council Regular Meeting — September 15, 2025, as submitted. 2. Adopt Resolution R-2025-75, A Resolution Authorizing the Disposal of Certain Surplus Property (PW). 3. Approve Application for a Class A Liquor License —The Guild, LLC d/b/a The Guild — 121 W. Front Street. 4. Approve Application for a Class M Plus Liquor License — F & V Management Co. lnc. d/b/a Tasting deVine — 127 W. Front Street. Approve Appointment and Reappointments to City Commissions Mayor Suess moved and Councilman Weller seconded that Richard Tampier be appointed to the Bicyclist and Pedestrian Commission and Anthony Pope and Ted Witte be reappointed to the Environmental improvement Commission for three year terms through October 6, 2028. First reading of an Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 2 Administration, Article VIII Disclosure Requirements Assistant City Manager Kolschowsky stated this ordinance was discussed at the August 25th Planning Session and explained the reasoning for amending the City Code is staff found redundancies between the City’s Disclosure requirement and the State of Illinois’ Statement of Economic Interest. This would save City Officials and Staff from filling out both forms without materially affecting transparency. 6. First reading of an Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 70 Traffic and Vehicles, Article ll Administration and Enforcement, Division 3 Parking Violations and Article VIII Abandoned and Inoperable Vehicles; and Chapter 2 Administration, Article X System of Administrative Adjudications Assistant City Manager Kolschowsky explained the ordinance would amend three sections ofthe City Code related to parking, towing, and administrative adjudications. He stated we are continually monitoring the downtown parking and the ordinance would change how the City handles chronic parking violators. He stated while unpaid tickets get sent to collections, only 7% are recovered. Assistant City Manager Kolschowsky noted the ordinance would provide the City with the option to tow chronic parking violators and highlighted that there will be a pre- 2 WHEATON CITY COUNCIL PROCEEDINGS Monday, October 6, 2025 tow notice and an opportunity for a pre-tow hearing before a vehicle is towed. Assistant City Manager Koischowsky noted the purpose is to deter repeat vioiators and reduce the number of unpaid parking tickets. In response to Counciiwoman Bray-Parker asking if the number of tickets is based on the vehicle owner, Chief Youker expiained officers issue citations through license plate recognition making it difficult to verify the registered owner of the vehicle while in the field. In response to Councilwoman Bray-Parker, City Attorney Didier stated there are two different softwares that issue citations: DACRA and Passport. City Attorney Didier elaborated that the tickets issued through Passport get a second notice and if unpaid, get sent to collections. She explained the tickets under DACRA receive a second notice mailed to the vehicle registration owner’s address with an Administrative Adjudication Hearing date. She explained if the ticket remains unpaid and they are not present at the hearing, a default judgment is issued and another notice is mailed with the default judgment. in response to Councilwoman Brice, City Attorney Didier clarified it is the cumulative number of unpaid parking tickets. Councilmembers discussed the appropriate number of tickets before Mayor Suess proposed decreasing the number to five tickets. in response to Mayor Suess, City Attorney Didier stated tickets issued through Passport can be contested by going to the Police Department. In response to Mayor Suess, Chief Youker stated the City does not have a tiered fine structure that would double the fine after 30 days for tickets issued through the Passport system. City Attorney Didier stated it can be added to the ordinance. Councilwoman Bray-Parker stated she would like to see the data in a year to see ifadding a late fee to the Passport tickets incentivizes people to pay their tickets. In response to Councilwoman Brice, City Attorney Didier stated if a ticket is paid, the paid ticket is not counted toward the number for towing purposes. She elaborated that it would be five unpaid parking tickets before towing and when the vehicle incurs a sixth ticket, a notice is both posted on the car and placed in the mail stating they have 7 days to pay or request a hearing, otherwise the vehicle will be towed when parked on city property again. In response to Mayor Suess, City Attorney Didier stated a post—tow notice is sent after the vehicle is towed. She explained they can either pay the unpaid parking tickets and the towing and storage fees or they can request a post—tow hearing within 48 hours. In response to Mayor Suess, Chief Youker elaborated that, typically, people will contact the police department once they notice their car is missing. He explained the Police Department will explain why the vehicle was towed. He stated the towing companies being used by the City are open 24 hours, 7 days a week. The City Attorney was directed to make revisions to the ordinance as discussed. 7. Pass Ordinance 0-2025-46, An Ordinance Granting a Special Use Permit on Property Commonly Known as 2015 Manchester Road — DuPage County Division of Transportation Maintenance Facility WHEATON CITY COUNCIL PROCEEDINGS Monday, October 6, 2025 Councilman Brown moved and Councilman Clousing seconded that 0-2025-46, An Ordinance Granting a Special Use Permit on Property Commonly Known as 2015 Manchester Road — DuPage County Division of Transportation Maintenance Facility, be passed. Assistant City Manager Koischowsky stated the ordinance was discussed at the September lS‘h meeting and prepared with the 6 proposed conditions. Adopt Resolution R-2025-76, A Resolution Approving a Shared Parking Agreement Between Salt 4 lnc d/b/a The Hen House of Wheaton and Molos Greek Taverna and 1060 College Wheaton LLC Councilwoman Bray—Parker moved and Councilwoman Brice seconded that R—2025-76, A Resolution Approving a Shared Parking Agreement Between Salt 4 inc d/b/a The Hen House of Wheaton and Molos Greek Taverna and 1060 College Wheaton LLC, be adopted. Assistant City Manager Kolschowsky explained the zoning ordinance allows for shared parking agreements where parking demands are different from each other with Council approval. Assistant City Manager Kolschowsky stated Molos Greek Taverna would be able to expand into additional space with the agreement. Adopt Resolution R-2025-77, A Resolution Authorizing the Execution of Agreement No. 572 with Triggi Construction, inc. for the 2025 Fall Sidewalk Program for a Total Amount Not to Exceed $916,377.50 and a 10% Contingency Councilman Weller moved and Councilman Clousing seconded that R-2025-77, A Resolution Authorizing the Execution of Agreement No. 572 with Triggi Construction, inc. for the 2025 Fall Sidewalk Program for a Total Amount Not to Exceed $916,377.50 and a 10% Contingency, be adopted. WHEATON CITY COUNCIL PROCEEDINGS Monday, October 6, 2025 Assistant City Manager Kolschowsky reported the City received six bids. He noted in total the City Sidewalk Program will install 2.06 miles of new sidewalks this year and 1.44 miles is part of this bid. Assistant City Manager Kolschowsky stated funds for this work are through the Capital Project fund and the bid is 31% under the original budget. Adopt Resolution R-2025-78, A Resolution Authorizing the Execution of Agreement No. 571 with Nardulli Construction Company Inc. for the 2025 Concrete Panel Replacement Program for a Total Amount Not to Exceed $145,763 and a 10% Contingency Councilman Clousing moved and Councilman Brown seconded that R-2025-78, A Resolution Authorizing the Execution of Agreement No. 571 with Nardulli Construction Company Inc. for the 2025 Concrete Panel Replacement Program for a Total Amount Not to Exceed $145,763 and a 10% Contingency, be adopted. Assistant City Manager Kolschowsky reported the City received 10 bids to remove and replace deteriorated panels at 6 different street segments in the City. WHEATON CITY COUNCIL PROCEEDINGS Monday, October 6, 2025 Assistant City Manager Kolschowsky reported the City is to begin work on this segment of President Street in 2027 with engineering design to start in 2026. He reported to stay ahead of project deadlines, as the project is 40% grant funded, the City is looking to engage with professionai engineering services now. Adopt Resolution R-2025-80, A Resolution Authorizing the Purchase of One (1) Maintenance Distributor Through the Sourcewell Purchasing Cooperative for a Total Amount Not to Exceed $121,507 Councilman Brown moved and Councilman Clousing seconded that R—2025-80, A Resolution Authorizing the Purchase of One (1) Maintenance DistributorThrough the Sourcewell Purchasing Cooperative for a Total Amount Not to Exceed $121,507, be adopted. Assistant City Manager Kolschowsky stated the resolution authorizes the purchase of a replacement tack coat oil distributor as the City’s current distributor has met the end of its useful life and is an important piece of equipment for paving operations. Council Comment Councilwoman Bray—Parker expressed gratitude as she had attended the Cosley Zoo Hale Family Education Pavilion dedication ceremony and noted how beautiful it was. She recognized the Fire Department’s Open House as a great time for families and thanked the Fire Department for their extra effort in putting on the Open House for the Community. Councilman Weller reflected on being a judge for the Downtown Wheaton Chili Cookoff the past weekend. He noted it was a great event to close out the summer season and is looking forward to the events lined up for the fall and holiday season. WHEATON CITY COUNCIL PROCEEDINGS Monday, October 6, 2025 Mayor Suess acknowledged the Fire Department’s Open House and being the first open house in 15 years. Mayor Suess noted the perfect weather and turnout of young famiiies. Mayor Suess congratuiated the Peopie’s Resource Center on their 50‘“ Anniversary. He stated the program started as a rental house in Wheaton in 1975 and over the 50 years has expanded their facility in Wheaton and in Westmont. 14. Approval of Warrant Councilwoman Bray—Parker moved and Councilwoman Brice seconded that Warrant No. 905 in the amount of$ 2,181,762.63, be approved.
