MEMORANDUM To: Chair Taylor and members of Local Liquor Control Commission From: James P. Kozik, AICP, Director of Planning & Economic Development Date: November 30, 2015 Subject: License Renewal – Class E and Class E-Café Liquor Licenses – Mariano’s # 8513 – 625 S. Main Street Section 6-90 of the Wheaton City Code requires that licensees found guilty of a violation in the previous year, must attend a liquor license renewal meeting before the Local Liquor Commission prior to a license renewal. On February 12, 2015, the Liquor Control Commission conducted a hearing in aggravation and mitigation with respect to the charges against Roundy’s Illinois Co. d/b/a/ Mariano’s #8513 that liquor was sold to a person under the age of 21. At that time, Roundy’s entered a plea of liable and offered evidence on its behalf as to the circumstances surrounding the incident and as to the establishment’s actions to prevent such future violations. The Mayor, as Liquor Commissioner, considered all the facts and circumstances entered into the record in this case as well as the recommendation of the Local Liquor Control Commission as to the penalty that should be imposed in this matter and found that Roundy’s was responsible for the above mentioned violation of that Ordinance as charged by the Wheaton Police Department. As a consequence of that violation, and in accordance with the Liquor Control Ordinance, Roundy’s was required to pay a $300 fine plus administrative costs. At the renewal meeting, the Commission should inquire as to what steps have been taken by the licensee since their violation to ensure that future violations do not occur. C: Jessica Ditsheit
